May 12, 1981 185 WORK SESS ION 9:00 A.M. - The Board's appointment with Barbara.To~nsen~ of the Office of Mental Retardat'ion and'Deve~o~ental Disabilities, NYS, was cancelled and tentatively resche'duled for 1-30 P M , M~y 26th. Ms. Townsend was involved in an automobile accident on the Long Island Expressway enroute to this meeting. 9:15 A.M. - The Board began reviewi~g~he agenda. 10:15 A.M. - Robert D. Traugott, President and Mike Krug, vice- President of Energy Development Corp N~rwich, Connecticut, made a presentation to the.'Town Board Concerning their proposal for the disposal of municipal~solid Waste for the. Town of Southold. (also p~esent: Dave New~on, Cooperative Extension, and Martin Garrell). SUMMARY~ Municipal Solid Waste-Southold, NY, Ltd. (MSW-SNY, Ltd.) would enter into a 20 year contract with the Town- ship of Southold, New York to dispose of all of the burnable municipal solid waste generated within the borders of the Township in return for a tipping fee of $10.00 per ton firm until the capital plant must ~e expanded. The expansion is expected in 1991 and the adjustment to the tipping fee would be to offset the deterioration o£ the value of the dollar caused by inflation during the intervening years. MSW-SNY, Ltd.' would take certain liquid wastes depending on their composition and the quantity at any one time. For example, rotten soggy potatoes could be disposed of easily if the rate was low compared to the MSW. The tipping fee would have to be established as the situation presents itself. As a guide, the tipping fee would not exceed $80.00 per ton and could often be much less.----A transcript of Mr. Traugott's presentation is on file in the Town Clerk's Office.----The Board plans a trip to Mt. Laurel, New Jersey on June 2, 1981 to witness a demonstration of a plant,similar to the type proposed for Southold Town, which is presently in operation. ~ 12:15 P.M. The Board recessed for lunch. 1:30 P.M. - Mr. Charles Randolph from the Eastern Long Island Branch of the National Association for the Advancement of Colored People spoke t'~ the Board relative to the adoption, b~ the Town of Southold, of an ~ffirmative Action Pla~ (for employment, Con- tracting and access to services)U (Mrs.-Bessie Swann, Director of CAST was also in attendance.) Mr. Randolph stressed that the Affirmative Action Plan is a mechanism necessary to increase the minority representation in the Town's work force. The Plan sets goals, objectives and a timetable. The Town is legally obligated to have such a plan to include minorities, which includes women. The NAACP would evaluate and monitor the Town to determine whether they are in compliance under the Plan. The employment should reflect the percentage of minorities living in a given township. Supervisor Pell advised Mr. Randolph the proposed Affirmative Action Plan will be put back on the Board's agenda for June. In the meantime Mr. Randolph will review and assess the Town's work~ force, and EEO-1 form. 2:05 P.M. - Mr. Jay Fitzgerald, Senior Real Property Information i System Specialist, New York_State Division of .~qualizati0n and ~ Assessment, accompanied.by Assessors Moisa,~ Watts and Gordon met ~ith the'Town Board to discuss the Assessment Roll and Levy Module .(ARLM System). At the present time 75% to 80% of the municipalities in the State of New York are ARLM users. The principle of the system is to facilitate various assessment functions and to produce the final and tentative assessment roll, the tax ~oll and the tax bills through a computer-based system. The ARLM system crea~es, updates and maintains a master file of real property assessment and levy data, which includes tax map numbers, sales information, land and 186 MAY 12.. 1981 total assessments, exemptions, special district, school'districts, delinquent tax status indicator, taxpayer name and address, and property locations. It;has ihs capability to produce the Assessor's Annual Report, notices or increased assessments, full disclosure notice, exemption reports, cross-reference reports, and property class summary reports. I't does not. generate real property values. In the opinion of the Chairman Moisa, the physical labor can be done in-house. The NYS-SDEA will do all the training, programing and processing. The ARLM processing, including conversion, wilt be provided at no charge through January l, 1982, except for required paper chargebacks-which is estimated to be about $300.00. The total cost to the Town.would be $tt,800.00~for 1982 and $10,900.00 for 1983. IS the Town adopts the ARLM system, the services of Sandsport Data Processing would not be needed after December 31, 1981, or any other computer firm, which would be a considerable savings for the Town. If the Town adopts the system there will be a 232,000.00 reimbUrsement,-based on 16,000 parcels, for the years 1981-1983. . The Town of Riverhead is already in the system and there is a possibility, according to Tom Ryan of Real Property in the County, that a-'computer could be located in Hauppauge in the future. Presently the computer is located in Albany. The :entire Board of Assessors recommends that the ARLM system be 'instituted in Southold Town. Supervisor Pell, Councilmen Murdock, Drum and Murphy are in agreement. Councilman Nickles said he is apprehensive of anything involved with the State of New York. He said that the State Division of Dqualization and Assessment has created the need for the system and now the Towns are being forced to conform with it in order to produce the reports that are required by SDEA. Supervisor Pell asked Councilman Nickles to contact Assemblyman Behan, a former East;Hampton Assessor, and determine what is viewpoint is of the ARLM system. He asked Chairman Moisa to contact Town Attorney Tasker to get his opinion on the letter of commitment that the Town would be required to sign to carry out the project with the State. He advised it is the intent of the Town Board to place the adoption on the ARLM. system on the May 26th agenda. 2:45 P.M. - The following off-agenda items Were discussed: 1. Letter from ~uffolk County Department of Public Work~ advising of the availability of approximately $3,000;000.00 under the~deral Aid Rural Secondary System Progr~,-for highway improve- ..me~ts~for Suffolk County - eastern Brookhaven and the five e~stern -' towns. Preliminary proposals f~r projects must be-submitted to the DPW within 30 days. Highway Superintendent Dean was asked to study the proposal'and submit proposed projects for the Board's evaluation. 2.~ Justice Doyen has advised Supervisor Pell that he Will contact the owner of the ~aseball diamon~ that was offered to the Town on ~ishers Island and report to the Board at their next meeting. 3. Town Attorney Tasker-~is working' on a Solution'for the proposal of the Town Trustees' that ~he Code of the Town of Southold be amended empowering the bay c'onst~ble to enforce the Code as it pertains to the Town Trustees~ jurisdiction. 4. 8:00 P.M. this evening there will be a public informa- tion meeting by the ~uffolk County Department of Public Works con- cerning the reconstruction of the bridges on New Suffolk Avenue. 5. The'balance in the Federal Revenue Sharing'ac'count is $12,700.00. The Town will not receive their n~xt payment of $31,000.00 until July 1st. Spending in this area must be curtailed. 6. Highway ~uperintendent Dean is preparing a punch list relativ~ to work done by his department on the Town Hall Addition. There is $500.00 left in the account 'due to ~inne~ota Construction Corp_., the general contractor. 7. Councilman Murdock asked if the Beach Committee would look into the construction of a boat launching ramp on the Sound at Goldsmith's Inlet. He was advised there is presently a dirt ramp- there, similar to the one at the Town B~ach~ at Arshamomaque. SUPERVISOR FELL:.- I:'wou~d like;to announce on'the meeting also tonight at 8:00 P.~. there will be a meeting here put on by the ~Public Works Department in regards to the ~ew Suffolk Avenue bridges~. Next Town Board meeting at 7:30 at night the Town'Board is going to come back after dinner and meet with the Robins Island Advisory Committee to go over their report. At this time I would like to go away from the prepared agenda and go to what we call Resolutions No. 13. If you have an agenda you can follow with us. It seems that I've been on the Town Board for three years, a little bit over three years and this past year we had two heroic deedsdone by citizen.s in our Town. The first one was the rescue of a seven year old boy out of the water and'right after that we had an accident occur and a young man was saved from burning to death by some passers by. At this time we'would like to honor the people who thought secondly of their own life and went ahead and put out the fire and grabbed this young man to safety. He is received 40% burns and his parents are here with us today. I ~nder- stand he is coming along. 'MRS. CURTIS NORKLUN (mother of Michael Miller): Very very beautifully. SUPERVISOR FELL: On behalf _of this we would like to present to the gentlemen who went ahead and put the fire out and pulled this young man~from the accident with his pickup truck. Councilman ~urdock will read it and then I will ask the gentlemen to come up. Moved by Councilman MurdoCk, seconded by Supervisor Fell, WHEREAS, the sanctity and value of human life is treasured and honored as a basic tenet~f American life, and WHEREAS, .it is in the hi~ghest pursuit and 'maintenance of that belief that a person should expend all of his knowledge, ability and efforts toward that goal, even at the risk to his own life and welfare, and ~ WHEREAS, qn April 14, 1981, Michael Miller was involved in a mo~o~ ~ehicle accident i~ East Mariog, New York and suffered critical injuries, and ~. WHEREAS, upon arrivihg at the scene of the accident .Frank Brush~ and Winston Davids of~Cutchogu~, without hesitation,'Pulled ~ic~el ~iler from the burning vehicle, at great risk to.themselves, and WHEREAS, Leon Gordon of Greenport, Arthur Ruroede of Orient and Kenneth Ketcham of East Marion. extinguished the flames in the burn- ing vehicle with their bare hands, without regard for their personal safety, and WHEREAS, the life of Michael Miller was saved by the heroic acts of these five residents of the Town of Southold, now, there'fore, be it 188 MAY 12, 1981 RESOLVED that the Town Board Of the Town of Southotd does hereby commend Frank Brush, Winston Davids, Leon Gordon, Arthur Ruroede and Kenneth Ketcham, and does by this-resolution desire that the knowledge of their acts be brought to.the attention of the community so that the citizens thereof may be aware of the courage of these fine men. SUPERVISOR DELL: I was thinking today, as you come up here, things like this is what makes our Town so great and the Town Board so proud of our Township. (Mrs. Norklun expressed her thanks to the Town Board and the gentlemen who received the commendations.) I. REPORTS - SUPERVISOR PELL: 1. Justice Rich monthly report (April 1981). 2. COUNCILMAN NICKLES: The Supervisor asked the Beach' Committee to check into.the possibility of having pay phones installed at some ~ of our beache~. 1 spoke to the telephone company and they would have to do a survey to see if we could have a straight coi~ operated phone and a salesman will be in touch with me on the I4th of this month. There is another alternative if we do not qualify for a coin operated phone. Of coarse it would be 'at no charge to the Town. That would be a phone that we could install on Town property at an installation fee of $145.00 and the monthly rental will be $17.02, which is the outside~ and we would have to build a protective device to house this instrument. There are a few other'liabilities which I find out would be: we would be responsible for vandalism, for slugs, for collect telephone calls, anything that happens to that equipment, I guess we'd be responsible. They are sending me out the SpeCifications for the protective device. The salesman will be in touch With me on the 14th -and we can review the possibilities. Hopefully we can get the free service as opposed to thfs service. I might add, on the equipment that we would have to hav~ installed at the fee of $145.00, there is only a one month minimum service, so we could possibly have it in for three months, five months or whatever we felt necessary, or in fact~ all year long. I wilI be getting back to you sometime after the 14th. SUPERVISOR DELL: Any other Councilman wish to make a report? The only thing I have to report is I had a very nice trip to the fishing communities of New England. Supervisor Lang, Super- visor Fallon, Legislator Wehrenberg, Legislator Rosso and Greg Blass an~ his aid. The county exec sent three or four of his staff. We did tour New England fishing ports and many of the people were very impressed with the value of putting up the dock in Greenport which is a million dollar project, to follow through on that one, and looking~at the one in Hampton Bays which the County has committed five hundred thousand dollars to and they are waiting for EDA to come up with the other matching funds to put up a dock there. They were very impressed with the amount of money that comes into a community from outside and it was a good triD. I had a good time. ii. From Mr. Mullen who advises my office on insurance problems.. He has given us some advise that we evaluated (re:' public official liability coverage). 4. A letter from the county attorney to the county exec ~egarding the State Comptroller Regan's viewpoint on the charges of the ~eventh Squad. To be short, the county attorney did not reinterpret the l'aw the way that~ Mr. Caputo does or Mr. Regan does and there's a slight difference of opinion and we are sitting tight on that one. IV. SUPERVISOR PELL: This program is run by Robert Muir who coordinates them and checks their qualifications out. I don't go checking qualifications out. Number 13 we did, we move on to Number 14. This is something we have been working.on through this program we just talked about in purchase of a car for. 17. Moved by Councilman Murphy, seconded by Councilman Nickles, WHEREAS, the Youth Services Coordinator for the Town of Southold Delinquency Diversion and Prevention Program has proposed that the To~ut' Board authorize a Community Service Sentencing Program under the terms' of which individuals who have been Sentenced to probation by the Town Justice Court may, as a condition of such sentence, be assigned to perform community service work for the Town, and WHEREAS, the Town Board believes that it is in the public interest to authorize such a program provided that the same is permitted by existing law; properly supervised; adequate insurance protection is provided; and funds are available therefor. NOW, THEREFORE, IT IS RESOLVED that the Town Board does hereby authorize a Community Services Sentencing Program pursuant to which individuals' who h~ve been sentenced to probation by the Southold Town Ju&tice Court may, as a condition to such sentence, be assigned to perform community service work for the Town, subject, however, to the following terms and conditions, ~o wit: 1. That such assignments will be under the direct supervision of the Supervisor. 2. That no such assignments shall be accepted by the Super- visor unless and until adequate Workmen's CompenSation Insurance and Public Liability Insurance is provided. ~. Moved by Councilman Nickles,.seconded by'Councilman Murphy, WHERE~S, local organizations and groups sponsoring high blood pressure control programs are making a difference nationally in public knowledge about hypertension and in lowered death rates for hypertension-related diseases, and WHEREAS, a 1979 national survey of public knowledge abont high blood pressure showed that almost three-quarters of Americans now believe high blood pre-sure is a very serious disease, with significantly more recognizing that treatment must continue through life, and __WHEREAS, high blood pressure is still a leading cause of death and disability, contributing to more than 853,000 deaths from cardio- vascular and related diseases annually, and ~ WHEREAS, about. 60 million Americans have high blood pressure of some degree, many of them unaware of the disease's presence because it is symptomless; and millions more. are aware of having the disease but are not under treatment, or do not have adequate blood pressure control, and ~ WHEREAS, untreated or i~ad~quately treamed high blood pressure increases the risk of premature illness or death from coronary heart disease, stroke, and heart or kidney failure, while hyper- tens%yes effectively under blood pressure control can lead normal, healthy lives, and WHERAS, hundreds of American's major private, professional, voluntary, stat~ and Federal organizat.ions work together in an effort called the National High Blood Pressure Education Program to encourage extension of existing high blood pressure programs, and to establish new long-term programs throughout this country, in order to make a lasting difference in the number of local hypertensives under recommended blood control, 19. 21. 23. If blood pressure is high, they should seek and follow their physician's advice. I understand bhat we are the first town in New York State to do so and I checked the machine yesterday and after three months and some odd days, we have done 2350 blood pressure readings. Lundberg as the Town Board Representative on the Arbitration Panel for the P.B.A. contract, at a fee of $90.00 per hour, including travel time and mileage and other expenses on any occasion he would be required to go elsewhere than the Southold Town Hall. Thsre was a news release from the Commissioner of Health Services and that many children in Su~foik County will not be able to e~ter or re-enter school in the fail because they are not adequately immunized. The state law requires that all children be immunized against diphtheria, measles, mumps, rubella and polio before they may attend school. And they are providing, the County is providing, clinics and there is nothing out on the east end and I think maybe we would write to them and ask them to have a clinic out here. SUPERVISOR PELL: If the Board so directs I'wilt do it. COUNCILN~N MURPHY: I think it would be a good idea. SUPERVISOR PELL: Any objections to it? (none). TOWN CLERK TERRY: Don't they have the one at the Methodist ChurCh any more? The Well-Baby Clinic? SUPERVISOR PELL: Not that I know of; I think that died. We have not taken any stand whatsoever. MAY 12, 1981 195 COUNCILMAN NICKLES: I think our position is still the same as it was in late summer or early fall of 1979, and we're waiting for the legislature to get their act tbgether, and as you know, with all their budget problems I don't~know how thoroughly they are going to address it this spring. Our meeting today was relative to what they call the ARLM System which has to do with the assessment roll, has to do with developing ~ates for equalization, retrieval of information ~or reports that the assessors must provide.
