Collectively we offer the following observations. The underlying premise of tlais Study is to preserve the bypass capability of the CR 48 divided highway. Doing so will prevent the commercial retail sprawl that characterizes every Long Island town to our west More specifically, the overall purpose is to avoid repeating the mistakes made elsewhere on western Long Island, where unchecked commercial retail development not only resulted in serious traffic congestion problems, but played a role in the demise of the economic vitality of downtown districts located on State Route 25 This community's Vision, as stated in many documents and public meetings some going back to the mid-1980s (prior to the adoption of the 1989 Zoning Map), is to preserve the small-town qualities that distinguish Southold. In order to achieve this goal, it is critically important to consolidate future retail business growth around the existing business centers within each hamlet. Furthermore, reducing the potential for retail and other traffic-generating uses to be introduced (or expanded) will have other long-term benefits to the community. First, it will ensure a bypass road for through traffic, thereby relieving some congestion on SK 25. Second, it will boost the economic development potential of the existing and potential business properties bordering SR 25, where most of the Town's traditional hamlets are centered. Third, it will preserve a scenic corridor that is a source of pleasure to residents and tourists. Therefore, we support the overall study recommendations as proposed. In recommending their adoption, we recognize there may be reservations about specific October proposed rezonings and that alterr/ate rezoning proposals may be under consideration. We, urge ex-treme caution m mod fym~ the consultant s recommendations lest the integrity of the whole be undermined in the interest of satisfying a few. ely, Chairman NOTICE OF CONTIUNATION OF PUBLIC HEARING ON all Local Laws to Change the Zoning District Designation of the parcels and part of the parcels listed below and identified by Suffolk County Tax Map Number and record owner PUBLIC NOTICE IS HEREBY GIVEN THAT THE TOWN BOARD OF THE TOWN OF SOUTHOLD HAS KEPT OPEN ALI, THE PUBLIC HEARINGS ON THE ABOVE REFERENCED LOCAL LAWS. NEVILLE SOUTHOLD TOWN CLERK October 4, 1999 Jean Cochran, Snpervisor Southold Tox~m Board Members Southold Town Hall Main Road Southold, NY 11971 EEC_EtVED 1999 RE: Suffolk Comity Tax Map: 069-2-3 Dear Supervisor and Town Board IvIembers, In 1936 1 rented this parcel of land Mt/ch extended fi:om what was knox~m as the North Road, at that thne, to Soundxsew Ave to the North. Then in 1953 I purchased this land fi:om my mother and father-in-law, Mr. & M2-s. Frank Zaveski. My wife Frances, now deceased, and I farmed this land and started a small roadside farmstand where we sold our farm produce? plants and roses we grew on our farm. In 1967 Suffolk Cotmty took 3 acres of my property and dMded my farm leaving me x~qth a serious drainage problem, north and south of the highway, making Rte 48 eight feet l~/gher than my property. Since my farm property was decreased m size and traffic flow was re-routed offthe North Road to Rte 48, in 1968 1 built what is now knox~m as Doroski's Garden Center and Nursew? Inc.. At that time my Garden Center was zoned Linffted Business and has operated as such all these years and I have paid Limited Bus/ness taxes on this proper%~. My Garden Center faces east on Ackerly Pond land and has no entrances or exits onto Rte 48. I have buffered Rte 48 and my property with trees and landscaping so as to obscure any unpleasantries. Also on the west side of this property we have planted our nursery stock, which I feel adds to the rural look of Rte 48. My family and I t~3~ to keep our Garden Center attractive to the passerby and a pleasant place to xdsit. Today the Southold Town Board wants to change my property to a Res/dent/al office. I am opposed to tiffs change as I do not see how an otlSce building looking hke a home can be made out of a greenhouse. Will my taxes decrease xxSth this change, or w/ll I continue to pay the same tax rate or more? Also at this time I do not know what the permitted usage will be with the new proposed zone land usage changes. I trust that the elected officials of Southold Tox~rn will take the initiative to consider leaving my family's and my Gm-den Center as well as my other propert/es as the3, are presently with theft' present usages. Bm to have someone come and pull the mg from under'us is not fair orjnst. We work hard for our lh'ing as do other bnisness people on 48. therefore I feel you should leave exisling bu/smesses alone. I would worry abmtt the accidauts on Rt 48 i~stead of zoning.- A fen' years ago a bo) riding a bicycle ~x as killed on RI 48 ~xhile trying to cross the highway. There are many accidents all rite time. People don't look at the v~sta, thex~-e going to fast. The oul~ time they slmv dm~m is when there is an accident then the5' slow down to gan k. I have a question, hmv often does anyone on the town board drive dm~n RT 48 and sax oh how beautiful. how saraue, look at the qua/ut binsnesses. You didn't do that a few weeks ago. you go{ Olt a bus and tkov~ around sa}Sug we think we should change tkis to this, stop this. mox e ilds persan out or mm e them over here . - , . . . etc You sa5 5 an are for the bctterment of the to~n attd tts bmsnesses l think not. Do you think changing established buiauesses is good for everyone? I do not want to see Hoare Depot an Rt 48. but let us be realistic do you think Home Depot would evau consider coming to Rt 48? Southold Tun'n is not like up west and will never be because x'an have already made it difficult to do am~fing here already. So ~hv li~au to a proposal from someone up west who doesnt know a thing abmtt the East End. We don t have their problems so why are ran imidng trouble here? Why can't yan leare well enough alone. James Mad/son once said."The- essence of gm-enmtent is power and prover lodged as it must be in lauman hands, will ever be liab}e to abuse" You have upset tile whole farrdlr over ttds both pbx sicallv and memally. I do not know alot about Politics, Zoning laws or Government. but I do Imow the di~erauce bem,een right and u~rang and what van are doing is ur'ong. Scincer~', j ~ S. Jenkins ELIZABETH A. BE iT ENACTED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD AS FOLLOWS: Section 1. Legislative Intent Consistent with our comprehensive land use plan and our established objectives and goals as reflected by the existing zoning patterns within the Town, and based upon onr current County Route 48 Land use study as well as numerous land use studies ,'md plans developed heretofore, we hereby determine that it is necessar3 and desirable to revise and amend the zoning designation applicable to the parcel identified herein as well as other lands; thus, we hereby identify and adopt the following overall themes of (1) Preservation of Farmland and Agriculture; (2) Preservation of Open and Recreational Space; (3) Preservation of the Rural, Cultural, Commercial and Historical Character of the Hamlets and Surrounding Areas; (4) Preservation of the Natural Environment; which derive from the shared vision held by residents and local public ofl"lcials of the Town and which are intended to foster a strong economy and which encourage and preserve the existing high quality of life, as more specifically set forth herein below: 1. Preservation of Farmland and Agriculture Farmland is a valuable and ~mamic indusU3, in the Toam of Southold_ The open farmlands are not only highly cherished for theh' economic value, but for the scenic vistas they prm'ide. The open space and scenery created by farmland additionally contributes to the qUnlits, of life of the residents, while promoting tourism and rocreation_ 2. Preservation of Open and Recreational Space The Tm~ of Southold relies heavily upon its scenic beauty and open landscapes for recreation, clean air and water, as well as for its am'action to tourists and recreation-seekers. Th~ Town has allracted man)' second homemvners because of its "natural resources, abundance of open space, farms, picturesque villages, and the ever-present waterfronf' (Master Plan Update. 1985). Dne to this open space, the Town has a tremendous devehipment potential. Bleak pictures have been painted in a few documents, ~mmmg of strip-t3~e developarent, suburban sprawl and water supply ts, sues. The preservanon of open and recreafionnl space is not only aesthetic, but also a necessity for rite present and future needs of the Tram 3. Preservation of the Rural, Cultural, Commercial and l:[istorical Character of the llamlets and Surrounding Areas The Tmxm of Southold is reno~xmed for it~ rural, cultural, commercial and historic character. This unique character is recogni?ed in a~l of the documents rcxSewed. Based on the input of To~m residents, the Final Report and Reeommefidanons states that the two most prevalent and key issues are keeping grox~th in the existing hamlet centers and preserving the ealmncing the surrounding rural areas. Additionally, the Master Plan Update recommends the provision for "a community of residential hamlets that are comprised of a x-arie _ty of housing opportunities, commercial, service and cultural activities, set in an open or rural atmosphere and supported b3 a diversified economic base (including agriculture, marine commercial and seasonal recreatiun activities)." Preservation of the Natural Em4ronment Aceommodating "gro;x~h and change ,~ithin the Town witltout destro34ng its ~aditional econormc base, the natural emSronment of which that base rests, and the unique character and the way of life that defines rite Town" is of utmost impormce" (Ground Watershed Protection and Water Supply Management Strategy). The Master Plan Update recommends preservation o£the T6x~t's nai~ral environment from wetlands to woodlands and to "acldeve a land use pattern that is sensitive to the limited indigenous water supply and xvill not degrade the subsurface water qnality. The outstanding needs enmnerated below are the culmination of careful comparison of the intent and objectives of the toga (as stated in past land use plans and studies) and the. currently exis~ag conditions along the Coum3 Route 48 corridor. These needs reflect the past and present x~ision of the Town and the work that sfill needs to be done due to the pro.,dmity of Count3' Route 48 to the hamlet commercial cemers and to avoid potentially conllicling de~elopmeut s~ategies for such ate. as. These outstanding needs we find exist throughout the Town and are spocifieally identified as follows: 1) to provide for ~aable land use development at levels of intensifies which are'sensitive to subsurface ~ ater quality and quantity 2) To maintain and strengthen hamlet centers as the focus of commereial, residential, and calmral actixity; 3) To preserve rite open, agricultural and rural character of areas outside of the hamlet centers; 4) to provide for a variety of housing oppommities for c/tizens of different incomes and age levels: 5) to enhance rite opportunities for pedestrian-friendly shopping; 6) to conlmue m the support of theToxwt'sagricalturaleconoms; 7} to minimize the Tou~t's natural assets, mcloding its coastal location and agricaltuml base, by balancing commerciaL residential and recreational uses; 8) to strengthantheTown'sn~ane-recreationalandmadne-commereialacti¥ities: 9) to encourage the preservafion of parkland and public access to the waterfront; 10) to support tourism by mainlaining and strengthemng rite Town's assets flint foster a tourist Irede, namely hamlet center businesses, ldstoric heritage, architecture, a sense of place, of rural and open claaracter, agficalture, and me activities; 11) to preserve prime farmland; and encourage the diversification of agriculture; 12) to preserve the lfistoric, cultural, architectural and archaeological resources of the Town; 13) to eust~e msunl quality of hamlet centers: 14) to encourage, appropriate land uses both inside and out of hamlet centers; 15) to promote balanced economy and tax base; 16) to preserve the integrity ot-the Toxma's vegetative habitats, including freshwater wetlands and woodlands. Section 2. Enactment Therefore, based upon the aforementioned goals and identified needs of the Totem and upon our consideration of the recommendations and comments of ou~r Plmming Board, the SulTolk County Planning Conunissiom our planning consultant (CCG) and rite public c6mment l~en at the public hearing and otherwise, we hereb_~ change the zoning district designatio~a for the parcel knox~xt as SCTM# ~(30~- ~oC~-O0- OZ.O0-O0~)-000 (and as more fu[l_~' dc'scm'bed herein below) fi-om the L(~) LI M IT~73 1~$ II~[~-.~ zoning dim-ict designation to the C~_) RE ~.1~ I,,ITI &l_. From all the letters I know you hax'e recieved and the people speakk~g up against the Craarer report you should know by now this was not a good idea. Yan haxe hrred up alot of people emofionail5 .i tmiy beiieve you didm thh~k ymt would. The buisness people on Rt 48 are not gohlg to stand by ici[) and watch you change aitd possibly iii the thmre take all our fights aw~ as land oxvn~rs and buisness people. I tld~ you should have agreed with John Romanelli and .Alice Hussie x~ hen the5' proposed to put aside the whole plan. Someone is using their brain. It is not to late to achrdl youve made a mistake, and put a ~op to all of this.Tiffs might not hm~e any bearing on any of this but ill sa5 ~t an)~va), President Clinton admitted he made a mistake and hes the President of the enUre U.S.A.You could do it to. I lox e li'~'ing and wor ~king in Southold Town, but Im stm'~g to have second thoughts about it. When a Town Board has the oppor~mxi~~ and possible power to ruin 3'our life and bulsness at a drop of a hat that Alot of hidsnesses on Rt48 x~ ere started man) many years ago and have been passed down from generation to generation as our bulsness was and you want to put a ~op to it all? Why do you haxe Hie rights and we clout? Why would yo'.-~ e~-en consider comJ ~g ,.ko with such an idea of t-he Crame~ Repo~. ~e ~ere not o~er issues mole important than this. I xx ould ttdt~k so As far as Im concered that moue5 was wasted and could haxe been put to better use.. So again I sa)' to look to 3-o``tr souls and do the tight thing and not only put the Cramer Report in Hie Basement but pttt it in the fiunace where it should have gone in the first place.
