Notice of the rnoposed change of zone was issued by the Town Clerk on
Scptamber 14, 1999.
The undersigned axe all of the owners of the entire prol~erty identified above
which would b~ al'footed by such proposed change of xen~. 'I~hc undersigned does hereby
ptotc~t to the Town Boa~d of tl~ Town of $outhold against said cha~ge of zone.

Dear Members of the Town Board of Southotd:
I object to the rezohing of Route 48 and question the manner in which the entire Cramer
Study was commenced, paid for and carded out. The study has cost me my tax dollars,
unending hours of stress, possibly my planned retirement and a hold on any available
investment money as a result of having to now budget funds to defend my own land_
The Route 48 study has targeted apprexiraately 126 properties for rezoning out of only
272. Thats an unbelivable 47%. In most every case this ~Sxpzoning," as the board has
politically named it, d~values the property of local families who have taken the initiative to
invest in their town and provide the town's employees with their paychecks through the
real estate taxes they have paid. I've heard comments by new North Fork Residents who
say, ~they want to get involved and maintain the rural character_" I. a~ always, feel the
same way, but I didn'~ tell the farmers that they were now permitted only to grow grass
instead of the oropa they depend upon because I thought grass created a prettier ~Ssta_
WE CAN'T STOP PROGRESS, BUT WE CAN CREATE A DRESS CODE. I recently
read a comment in th~ editorials cfa local paper which state~ ~'Greedy business people
and speculators are tge people interested in overthrowing the rezoning.' If the people of
Southold believe this lis mm, t believe they should, read George.. Orwelt' ~ book, 1,984, to
see how "Big Brother" will watch out for us. After all, I don't believe that it is the
American Dream to have your business and property devalued by, our ]omi government.
We constructed our building and worked our hardest to consider our neighbors and the
rural character of the(area while creating a building that was functional for our business.
We employed local tradesmen, financed the project with a local bank and have employed
local families for 15 years. Many of these families have gained a successful future within
the Electrical InduStry. In addition, these families and I, EECO Electric Corp. and Ruth
Enterprises, Inc. make a majority of their money fi'om Western Suffolk m~ Nassau
County. These incoraes support the town economy with "new" money used to pay the
property and sales ray rates we all pay. I considered calling in many ofthes,families to
support us during the hearh~gs, but realized they, like myself and the towr~ would not have
any way to recoup the loss of income by dedicating additional-time to this study_ We have
contributed to local fi~nd misers including the PBA, Fire Department, 3,thiefic
Associations, chureh~s, school Fund Raisers, etc. For approximately I0 years, I chaired
with committee members, the Kiwanis Scholarship Fund for Sou/hold, Greenport and
Mattituclc Schools_ Most of these meetings were hosted from the. Ruth. t~nterlxises,
Inc./EECO Electric building Finally, we have been able to use the building in conjunction
w~th town electrical inspectors for trmmng conferences and code mterpretataon meetings.
I am currently trying.,,to plan my retirement. The moratorium and/or the possible rezoning
has caused me an im ,measurable amount of stress. It destroys most.of my retirement plans
because the properties effected by the zone changes will loose most oftbeir liquidity and
therefore, most of their value. Even though many advocates of the zone changes may
have owned property in the past, building a business on a piece of property is a much
different investment because there are two assets available for sale_ If the more liquid
asset, being the business, is sold to another company who already has property, the value
of our land will devalue as a result of your zone cl~nges. IfI am unable to sell the
property at the value Ineed bemuse of this zone change, I loose along with alt of the other
land owners who have objected to this extremely taxing proposal.
In dosing, I strongly object to the zone changes on route 48 and the two properties of
which are owned by myself are Ruth Enterprises. I petition the tows to decrease the
anmuat of money they spend on studies which seem to have a very minimai amount of
support f~om those they intend to help and rem/nd each person involved that the law suits
which may evolve as a result of'the decision made on the Route 48 study ~ once again
increase the property tax rates in the town of Southold and once again devalue each piece
of property within the' towr~ therefore devatuing Southold.

Dear Mrs. Neville,
The recommendations proposed by the Cromer Consulting Group in the above-noted
Study, have been reviewed and discussed by the Planning Board. Collectively we
offer the following observations.
The underlying premise of this Study is to preserve the bypass capability of the CR
48 divided highway Doing so will prevent the commercial retail sprawl that
characterizes every Long island town to our west. More specifically, the overall
purpose is to avoid repeating the mistakes made elsewhere on western Long [sland,
where unchecked commercial retail development not only resulted in serious traffic
congestion problems, but played a role in the demise of the economic vitality of
downtown districts located on State Route 25
This community's Vision, as stated in many documents and public meetings some
going back to the mid-1980s (prior to the adoption of the 1989 Zoning Map), is to
preserve the small-town qualities that distinguish Southold. In order to achieve this
goal, it is critically important to consolidate future retail business growth around the
existing business centers within each hamlet.
Furthermore, reducing the potential for retail and other traffic-generating uses to be
introduced (or expanded) will have other long-term benefits to the community. First,
it will ensure a bypass road for through traffic, thereby relieving some congestion on
SR 25. Second, ~t will boost the economic development potential of the existing and
potential business properties bordering SR 25, where most of the Town's traditional
hamlets are centered. Third, it will preserve a scenic corridor that is a source of
pleasure to residents and tourists.
Therefore, We support the overall study recommendations as proposed. In
recommending their adoption, we recognize there may be reservations about specific

proposed rezonings and that alternate rezoning proposals may be under consideration.
We urge extreme caution in modifying the consultant's recommendations lest the
integrity of the whole be undermined in the interest of satisfying a few.

ZONING DISTRICT DESIGNATION.
BE IT ENACTED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD AS FOLLOWS:
Section 1. Legislatve Intent
Consistent with our comprehensive land use plan and our established objectives and goals as
reflected by the existing zoning patterns within the Town, and based upon our current County Route
48 Land use study as well as numerous land use studies and plans developed heretofore, we hereby
determine that it is necessary, and desirable to revise and amend the zoning designation applicable to
the parcel identified herein as well as other lands; thus, we hereby idenrify and adopt the following
overall themes of (1) Preservation of Farmland and Agriculture; (2) Preservation of Open and
Recreational Space; (3) Preservation of the Rural, Cultural, Commercial and Historical Character of
the Hamlets and Surrounding Areas; (4) Preservation of the Natural Environment; which derive
from the shared vision held by residents and local public officials of the Town and which are
intended to foster a strong economy and which encourage and preserve the existing high quality of
life, as more specifically set forth herein belmv:
1. Preservation of Farmland and Agriculture
Farmland is a valnabIe and dlmamic industry in the Tox~n of Southold. The open
farmlands are not only highly cherished for their economic value, but for the scenic vistas they prmsde.
The open space and seeneD' created by farmland addifionall2, conlributes to the quahty oflifa of the
residents, while promoting tourism and recreation.
2. Preservation of Open and Recreational Space
The Town of Southold relies heax,ily upon its scemc beauty and open landscapes for
recreation, clean air and water, as well as for its am-action to tourists and recreation-seekers. The
Town has allracted many second homeowxters because of its "natural resources, abundance of
open space, farms, picturesque villages, and the ever-present waterfront" (Master Plan Update,
1985). Due to this open space, the Tm,,m has a a'emendons development potential. Bleak pictures
have been painted ia a few documents, x~aming of stdp-ts~e development, submban sprmsq and
~vater supply issues. The preservation of open and recreational space is not anly aesthete, but also
a necessity for the present and future needs oftbe Toan.
3. Preservation of the Rural, Cultural, Commercial and Historical Character of the
Hamlets and Surrounding Areas
The Toam of Soufllold is renowned for its rural, cultural, commer~ml and historic
character. Tlds unique character is recognized in all of the documents rex,ica,ed. Based on the input of
To*an residents, the Final Report and Recommendations states that the two most prevalent and key issues
are keeping gro*ath ia the existing hamlet centers and preserving the enl~xncmg the surrounding rural areas.
Additionally, the Master Plan Update recommends the provision for "a coxnmunity of residential hamlets
that are comprised of a variety of housing opportunities, commercial, service and cultural activities, set m
an open or rural atmosphere and supported by a diversified economic base (including agriculture, marine
commercial and seasonal recreaUon activities)."
Preservation of the Natural Environment
Accomm°dating'~gro*a~d~ and chauge xvithia the Tonm ~ithout deslxoying its tmclitional
econo~nic base, the natural enx~romnent of which that base rests, and the umque character
and the ~aay of life that defines the Toxin" is of utmost importaaee" (Ground Watershed
Protection and Water Suppl3 Management Strategy). The Master Plan Update
recommends preservation of the Town's natural en~Sromnent from wetlands to
wondlands and to "achim,e a land use panem that is sensitive to the limited indigenous
water supply and will not degrade the subsurface water quali~.
The outstanding needs enumerated below are the culmination of careful comparison of the intent and
objecth,es of the towaa:(us stated.ia,past land;use plans and studies) and the currenfl_v eMs-mag conditions
along the County_ Route 48 corridor. These needs reflect the past and present vision of the To*aaa and the
work that still needs to be done due to the proximity of County Route 48 to the hamlet commercial cemers
and to avoid potentially conflicting development strategies for such areas. These outstanding needs x~ find
exist throughout the To*am and are spocitically identified as follows:
1) to provide for viable land use development at levels of intensifies which are sensitive to subsurface
water quality and quantity
2) To mainlaia and sta-engthen hamlet centers as the focus of commercial, residential, and cultural
activity;
3 ) To presen, e th~open, agricultural and rural character of areas outside of the lmmlet centers;
4) to provide for a vane~- of housing opportunities for citizens of different incomes and age levels;
5) to enhance the oppommilies for pedestrian-friendly shopping;
6) to continue to the support of the Town's agricultural economy'
7) to ma.,dmize the.,Town's natural assets, including its coastal location and agricultural base, by
balancing cemmemial, residential and recreatious/uses;
8) to slmngthen ~e Tm~m's me-recreational and me-commercial activities;
9) to encourage the presen:ation of parkland and public access to the waterfront;
10) to support touns,m by mamlalnmg and strengthening the Town's assets that foster a tourist lrade,
namely hamlet enter businesses, historic heritage, architcetare, a sense of place, of rural and open
character, agriculture, and marine activities;
1 l) to preserve priafe farmland: and encourage the diversiticafion of agriculture;
12) to preserve the historic, cultural, architectural and archaeological resources of the Town;
13) to ensure visual~qualityofharulet centers;
14) to encourage appropriate land uses both inside and out of hamlet centers;
15) to promote balgnced ecoanmy and kqx, base;
16) to preserve the !ntegnty of the Toma s vegetative habitats, including f~eshwater wetlands and
woodlands.
Section 2. Enactment
Therefore, based upon the aforementioned goals and identified needs of the To~n and upon our
consideration of file recommendations and comments of our Planning Board, the Suffolk Count3. PIanning
Comnfission_ our planning consultant (CCG) and the public comment token at the public hearing and
othen~se, we hereby change the zoning district designation for the parcel known as
SCTM# ~(5~-0~oq-0D-Oq' 00-005. O(~ (and as more fully described
herein below) from the

ALL that certain plot, piece or parcel of land, with the buildings and improvements
thereon erected, situate, lying and being at Peconic, Town of Southold, County of Suffolk
and State of New York, bounded and described as follows:
BEGINNING at the Northwesterly comer of the premises hereinafter described at a
monument on the Southerly side of Middle Road where the Westerly line of the premises
hereinafter described and the Easterly line of land ofJ. Hass intersects the Southerly side
of Middle Road,
RLrNNING THENCE along the Southerly side of Middle Road on a curve to the left with
a radius of 5789.58 feet an arc distance of 108.73 feet to a monument;
THENCE along land 0fthe County of Suffolk the following two (2)courses and distances: (1) South 25 degrees 22 minutes 40 seconds East 200 feet to a monument;
(2) South 58 degrees 07 minutes 20 seconds West 113.73 feet to a monument;
