Id To~.m Re: CR 48 Changes of Zone Dear Mrs. Neville, The recommendations proposed by the Cramer Consulting Group in the above-noted Study, have been reviewed and discussed by the Planning Board Collectively we offer the following observations. The underlying premise of fhis Study is to preserve the bypass capability of the CR 48 divided highway Doing so will prevent the commercial retail sprawl that characterizes every Long Island town to our west. More specifically, the overall purpose is to avoid repeating the mistakes made elsewhere on western Long Island, where unchecked commercial retail development not only resulted in serious traffic congestion problems, but played a role in the demise of the economic vitality of downtown districts located on State Route 25. This community's Vision, as stated in many documents amt public meetings some going back to the mid-1980s (prior to the adoption of the 1989 Zoning Map), is to preserve the small-town qualkies that distinguish Southold. In order to achieve this goal, it is critically important to consolidate future retail business growth around the existing business centers within each hamlet. Furthermore, reducing the potential for retail and other traffic-generating uses to be introduced (or expanded) will have other long-term benefits to the communky. First, it will ensure a bypass road for through traffic, thereby relieving some congestion on SR 25. Second, k will boost the economic development potential of the existing and potential business properties bordering SR 25, where most of the Town's traditional hamlets are centered. Ihird, it will preserve a scenic corridor that is a source of pleasure to residents and tourists. Therefore, we support the overall study recommendations as proposed. In recommendiflg their adoption, we recognize there may be reservations about specific October proposed rezonings and that alternate rezoning proposals may be under consideration. BE IT ENACTED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD AS FOLLOWS: Section l. Legislative latent Consistent with our comprehensive land use plan and our established objectives and goals as reflected by the existing zoning patterns within the Town, and based upon our current County. Route 48 Land use study as well as numerous land use studies and plans developed heretofore, we hereby determine that it is necessao- and desirable to revise and amend the zoning designation applicable to the parcel identified herein as wall as other lands; thus, we hereby ideuti~- and adopt the following overall themes of (1) Preservation of Farmland and Agriculture; (2) Preservation of Open and Recreational Space; (3) Preservation of the Rural, Cultural, Commercial and Historical Character of the Hamlets and Surrounding Areas; (4) Preservatian of the Natural.Environment; which derive from the shared vision held by residents and local public officials of the Toma and which are intended to foster a strong economy and which encourage and preserve the existing high quality of life, as more specifically set forth herein below: 1. Preservation of Farmland and Agriculture Farmland is a valuable and dynamic iadusti3r in the Toam of Southold_ The open farmlands are not only highly cherished for their economic value, but for the scenic xristas they provide. The open space and scenery created by farmland addinoually cenlxibutes to the quality of life of the residents, wldle promoting tourism and recreation. 2. Preservation of Open and Recreational Space The To~a of Southold relies heavily upon its scenic beau _ty and open landscapes for recreatiom clean air and water, as well as for its attraction to tourists and recreation-seekers. The Tox~ has am-acted many second homeowners because of its "natural resources, abundance of open space, farms, picturesque x4llages, and the ever-prasent wateffrouf' (Master Plan Update. 1985). Due to th~s open space, the To~ has a ~'emendous development potentml. Bleak pictures have been painted in a fexx documents, warning of strip-type development, suburban sprawl and water supply issues. The preservation of open and recreational space is not only aesthetic, but also a necessity ~oi- the present and futura needs of the Toaax. ' 3. Preservation of the Rural, Cultural, Commercial and Historical Character of the glarnlots and Surrounding Areas The Town of Southold is reno,amed for its rural cultural cormmercial and historic character. Tlds unique character is recognized in all of the documents reviewed. Based on the input of Town residents, the Final IReport and Recommendations states [hat the m'o most prevalent and key issues are keeping growth m the exisling hamlet centers and preserving the enlmncing the surrounding rural am. as. Additionally, the Master Plan Update recomroends the provisian for "a community of residential hamlets that are comprised of a variety of housing opportumties, conmtercial, service and cultural acfixSfies, set in an open or rural atmosphere and supported by a divarsified economic base (including agriculture, marine conm~ercial and seasonal recre~qtion activities)." Preservation of the Natural Environment Accommodating ~grex~edi and change x~'ithin the Town without destro35ng its traditional econmni~ base, the natural envimmnent of xvhich that base rests, and the unique character and the way of life that defines the Town" is of utmost importance" (Ground Watershed Protection and Water Supply Management S~-ateg3). The Master Plan Update recoramends presem'afion of the Tox~m's natural environmant from wetlands to woodlands and to "achieve a land use pattern that is sensiti~e to the limited indigenous water supply and a411 not degrade the subsurface water quality. The outstanding needs enumerated below are the culmination o~' careful comparison of the intent and · objective~ ~f the toxnm~(as stated,in past land use plans and studies) and the currently existing conditions along the Couuty Route 48 corridor. These needs reflect the past and present vision of the Town and the work th,at still needs to be done due to the proximity of County Route 48 to the hamlet commerfftal centers and to avoid potentially co ,i?icting development strategies for such areas. SUBJJ~CT to any state of facts an accurate survey might show, providing same does not render title unmarketable, and to covenants, restrictions, easements, agreemen reservations~ and zoning regulations of record, of any, providing same do not prohik present structure(s) Together with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; Together with the appurtenances and all the estate and rig hts of the parry of the first part in and to said premises; To Have And To Hold the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of thesecond part forever. And the party of the first part covenants that the party of the first part has not done or suffered anything wherebythe said premises have been encumbered in any way whatever, except as aforesaid. And the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvem ant before using any part of the total of the same for any other purpose.
