Dear Mrs. Neville,
lhe recommendations proposed by the Cramer Consulting Group in the above-noted
Study, have been reviewed and discussed by the Planning Board. Collectively we
offer the following observations.
The underlying premise oftqais Study is to preserve the bypass capability of the CR
48 divided highway. Doing so will prevent the commercial retail sprawl that
Characterizes every Long Island town to our west. More specifically, the overall
purpose is to avoid repeating the mistakes made elsewhere on western Long island,
where unchecked commercial retail development not only resulted in serious traffic
congestion problems, but played a role in the demise of the economic vitality of
downtown districts located on State Route 25.
This community's Vision, as stated in many documents and public meetings some
going back to the mid-1980s (prior to the adoption of the 1989 Zoning Map), is to
preserve the small-town qualities that distinguish Southold. In order to achieve this
goal, it is critically important to consolidate future retail business growth around the
existing business centers within each hamlet.
Furthermore, reducing the potential for retail and other traffic-generating uses to be
introduced (or expam:led) will have other long-term benefits to the community. First,
it will ensure a bypass road for through traffic, thereby relieving some congestion on
SR 25. Second, it will boost the economic development potential of the existing and
potential business properties bordering SR 25, where most of the Town's traditional
hamlets are centered. Third, it will preserve a scenic corridor that is a source of
!pleasure to residents and tourists.
Therefore, we support the overall study recommendations as proposed. In
recommending their adoption, we recognize there may be reservations about specific

proposed rezonings and that alternate rezoning proposals may be under consideration.

from Mr. Daniel Smith, who had se[d his store on the ~ road in Southold separately .The o~y store I conld firtd
to re_at_ at. the ~_me w0s [0~d_ on_ Koum 48 in pec. oni~, h O~ober of !976 we_ bought a store fie,hr ~at hag ¢0vo
separate business located in Peconic between EeCo Electrical Corp. and North Shore Canvas. Over the years the
store front has had several different businesses adjacent to the floor covering shop. The proper~ has alwaTs been
and still remains to this da3, two separate business located in one store front. Although when no one is renting the
other store k is used by the floor coveting shop. '~en I bought this Propel=fy k was tuned Heavy Industrial since it
had been a saw mitll at one point.
Several years ago the Town saw fit to rezone it down to light business and now it is my understanding that it
will he re~oned again to Residential Business District ( R.O. ). I have also found out that the property ~-est of mine
owned by the late l-Ielmut Hass and the property East of mine ax~-ed by Clifford Comell ~11 change as well fi-em
L~g~ Bu~des to KO as well as numerous business along route 4~. Why may t ask w/Il my pmpea'6' as well as [h~se
other properties be changed. It makes no sense at all.? I have a 5000 SQ. foot werehouse located in the back of my
property which I have been pa~/in~ $ 5000 00 a year extra taxes on since 1985. How can my property be rezonnd to
R_O.. what will a do,tots office need with a 5000 SQ foot warehouse. Please explain the logic in th/s zone change to

The Town Board of the Town of Southold, on its ox~ motion, has proposed a
change of zone for a certain parcel in the Town of Southold at Sonthold, which parcel is
shown on the Snffolk County Tax Map as 1000-069-4-2.2 so that the zoning of said
parcel shall change from LB ("Lknited Business Dist~Sct') to RO ("Residential Office
District"). This parcel is part of a proposed change of zone designated by the Tox~m Board
as "Southold 1."
Notice of the proposed change of zone ~vas issued by the Toxvn Clerk on
September 14, 1999.
The undersigned owner(s) of property within that prat of the Town of Southold
which would be affected by such proposed change of zone, do(es) hereby and herewith
protest to the Town Board of the Town of Southold against said change of zone.
This instrtunent is a protest against such change of zone made pursuant to Section
265 of the Tow~ Law o£the State of New York.

ZONING DISTRICT DESIGNATION TO THE
ZONING DISTRICT DESIGNATION.
BE IT ENACTED BY THE TOWN BOARD OF THE TOWN OF SOLrl?HOLD AS FOLLOWS:
Section 1. Legislalive Intent
Consistent with our comprehensive land use plan and our established objectives and goals as
reflected by the existing zoning patterns within the Town, and based upon our current County Route
48 Land use study as well as numerous land use studies and plans developed heretofore, we hereby
determine that it is necessary and desirable to revise and amend the zoning designation applicable to
the parcel identified herein as well as other lands: thus, we hereby idcutify and adopt the following
overall themes of (1) Preservation of Farmland and Agriculture; (2) Preservation of Open and
Recreational Space; (3) Preservation of the Rural, Cultural, Commercial and Historical Character of
the Hamlets and Surrounding Areas; (4) Preservation of the Natural Environment; which derive
from the shared ~Ssian held by residents and local public officials of the Town and which are
intended to foster a strong economy and which encourage and preserve the existing high quality of
life, as more SlmCifically set forth herein below:
1. Preservation of Farmland and Agriculture
Farmland is a valnable and dynamic indus~ in the Tom of Southold. The open
farmlands are not only highly cherished for their economic value, but for the scenic vistas they prmSde.
The open space and sceneW created by farmland addiuonaliy con~ibutes to the qualit3, of life of the
msidems, x~hile promoting tourism and recreation.
2. Preservation of Open and Recreational Space
The Tm~m of Southold relies heavily upon its scenic beaut5_' and open landscapes for
recreation, clean ah- mid water, as well as for its attraction to tourists and recreation-seekers. Th~
Town has attracted rmmy second homeo'a~ers because of its "natural resources, abundance of
open space, fanms, picturesque ¥illages, and rite ever-present waterfront" (Master Plan Update.
1985). Due to this open space, the Town has a tremendous development potential. Bleak pictures
have been painted in a few documents. ,aaraing of strip-typo developmeni, suburban sprawl and
water supply ~sanes. The pmsep,'afion of open and recreational space is not only aesthetic, but also
a necessii3' for the present md future needs of the Tbwn.
3. Preservation of the Rural, Cultural, Commercial and Historical Character of the
Hamlets and Surrounding Areas
The Town of Soufuold is renowned for its rural, cultural, commereinl and historic
character. Tlfis unique character is recognized in all of the documents re,4ewed. Based on the input of
To~a~ residents, the Final Report and Recommendations slates that the two most pi~evalant and key issues
are keeping gro~gh in rte extsting hamlet centers and presort lng the enhancing the surrounding rural areas.
Additionally, the Master Plan Update recommends the pro~-isian for "a commun/t3.- of residentizd hamlets
that are comprised of a variets, of housing opportunities, commercial, sen,ice and cultural acfix4fies, set in
un open or rmal atmosphere and supported by adb, ersified economic base (including agriculture, marine
commercial and seasoned recreation activities)."
Presurvation of the Natural En,~ronment
Accommodating "growth and change within the Town w~thout destroying its Lraditionul
economic base, the natural eus~ronment of which that base rests, and rite tmique character
und the w~' of life that defines the To,~n' is of utmost nnportunce' (Ground Watershed
Protection and Water Supply Management SWateg3_ ). The Master Plan Update
recommends preservafien of the Town's natural eus-iro~tment from wetlands to
woodlands and to ~achieve a land use palXem that is sensitive to the limited indigenous
water supply and ~s~ll not degrade thc subsurface water qnality.
The outstanding needs enumerated below a~e the culmination of caxeful comparison of the inlet and
objectives of the towa (as stated in past land.use plans and studies) and the currently existing conditions
along the County Route 48 corridor. These needs reflect the past und present vision of the Town and the
work that still needs to be done due to the proxdmity of Count}_, Route 48 to rile hamlet commercial centers
and to avoid potentially conflicting development slxateg~es for such areas. These outstnadlng needs we find
exist throughout the Toxxa and are specifically identified as follox~5:
1 ) to provide for x4able land use development al levels of intensifies wlfich are sensitive to subsurface
water qnalits' and quanlJ, ts'
2) To maintain and strengthen hamlet centers as the focus of commercial residential, and culbxml
acfivi _ty;
3 ) To preserve the open. agricultural and n~ral character of areas outside o£ the hamlet centers;
4) to provide for a varie~' of housing opportunities for citizens of different incomes and age levels:
5) to enhance rite opportunities for pedestrian-friendly shopping;
6) to: continue to rite support of the Train's agricultural econom3;
7) to ma~dmize the Town's nattwal assets, including its coastal location and agricultural base, by
balancing commercial residential and recreational uses
8) to ~lxengflten the Town s n~arme-recreattonal and manne-commerc~al acttxqtxes;
9) to encourage the presei~:atiun of parkland and public access to the waterfront:
10) to support tourism by maintaining and sirength~ning the Town's assets that foster a tourist lxede
nmme!y lmmlet center businesses, historic lientage, architecture, a sense of place, of rural and open
character, agriculture, and marine acti~fies;
ll) o greserve prime farraland: anal encourage the diversification of agriculture;
12) to' preserve' th~ historic, .... colmr~ architectural and arcbaeologncal resources o£the Town;
13 ) to ensure visual qualily of hamlet centers;
14) to enC°urage appropriate land uses both inside and out of hamlet centers:
15) to promote bhlanCed economy and tax base:
16) to preserv~ thelintegrity of the Town's vegetative habilats, inchiding freshwater wetlands and
woodlands.
Section 2 Enactment
Therefore, based upon the aforementioned goals and identified needs of the Toma and upon our
consideration of the recommendations and comments of our Planning Board the Suffolk Count3' planning
Commission. our planning consultant (CCG) and the public comment taken at the public hearing and
otherwise we hereb3 change the zoning district designation for the parcel lcam~m as

thereon erected, situate, lying and being in the hamlet of Peconic, Town of Southold,
County of Suffolk and State of New York, bounded and described as follows:
BEGINNING at a point on the southerly line of Middle Road at the northwesterly comer
of land of Cornell, being the northeasterly comer of the premises herein described; rmming
thence along said land of Comell, south 23 degrees 51 minutes 20 seconds east, 198.30
feet to the land of Suffolk County; thence along said land of Suffolk County, south 58
degrees 07 minutes 20 seconds west, 200 feet to land now or formerly of Hass; thence
along said land north 23 degrees 53 minutes 30 seconds west, 199.30 feet to the southerly
line of Middle Road; thence easterly along said southerly line on a curve to the left having
a radius of 5789.58 feet a distance along said curve of 200 feet to the point of
BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first
part, et al by deed made by Helmut Hass, said deed being dated 1 lth day of February,
1977, and recorded in the office of the Clerk of the County of Suffolk on the 18th day of
Febma~, 1977 in liber 8194 on page'67; subject to restrictions therein contained.

The zoning map as adopted by section 100-21 of the Town Code of the Town of Southold is
hereby mnende~ to reflect the within change of zoning dislnct designation for said parcel.
