THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD HELD ON
SEPTEMBER 12, 2000:
WHEREAS the Town Board of the Town of Southold is considering a change in the zoning
designation from LB Limited Business Zoning District Designation to the
AC Agricultural Conservation Zoning District Designation of a certain parcel of land lying in
the Town of Southold identified by SCTM # 1000-059.00-07.00-032.000; and
WHEREAS, GEIS which said "no further SEQRA review required" when "Changing the
Zoning Category of a parcel from any one of the industrial or commercial zones in the Town of
Southold to a single-family residential or Agricultural Conservation zone shall not require further
SEQRA review." And this proposed action meets this criteria; and
WHEREAS, the Town Board nevertheless conducted a LEAF pursuant to SEQRA in addition to
the GEIS findings statement; and be it
RESOLVED the Town Board found that for the above action there is no other involved agency,
that for the above action the Town Board is Lead Agency; that this action is an Unlisted Action;
all pursuant to SEQRA Rules and Regulations 6 NYCRR 617.1 et. Seq. and Chapter 44 of the
Southold Town Code; and be it further
RESOLVED by the Town Board that this proposed project will not have any significant adverse
environmental impacts and therefore the Town Board issues a NEGATiVE DECLARATION
pursuant to the SEQRA roles and regulations.

The Planning Board has again reviewed the recommendations of the Cramer Consulting
Group in the above study. Our conclusions are the same as contained in the Board's letter
to you of October 8, 2000, (attached).
Several changes were given careful review as to reasons and fairness for the
recommended change. However, recognizing that the underlining premise of this study is
to preserve the bypass capability of the CR 48 divided highway and to prevent retail
sprawl, the Board has no option but to support the overall recommendations which we
feel will accomplish this objective.

Dear Mrs. Neville,
The recommendations proposed by the Cramer Consulting Group in the above-noted
Study, have been reviewed and discussed by the Planning Board. Collectively we
offer the following observations.
The underlying premise of this Study is to preserve the bypass capability of the CR
48 divided highway. Doing so wilI prevent the commercial retail sprawl that
characterizes every Long Island town to our west. More specifically, the overall
purpose is to avoid repeating the mistakes made elsewhere on western Long Island,
where unchecked commercial retail development not only resulted in serious traffic
congestion problems, but played a role in the demise of the economic vitality of
downtown districts located on State Route 25.
This community's Vision, as stated in many documents and public meetings some
going back to the mid-1980s (prior to the adoption of the 1989 Zoning Map), is to
preserve the small-town qualities that distinguish Southold. In order to achieve this
goal, it is critically important to consolidate future retail business growth around the
existing business centers within each hamlet.
Furthermore, reducing the potential for retail and other traffic-generating uses to be
introduced (or expanded) will have other long-term benefits to the community. First,
it will ensure a bypass road for through traffic, thereby relieving some congestion on
SR 25. Second, it will boost the economic development potential of the existing and
potential business properties bordering SR 25, where most of the Town's traditional
hamlets are centered. Third, it will preserve a scenic corridor that is a source of
pleasure to residents and tourists.
Therefore, we support the overall study recommendations as proposed. In
recommending their adoption, we recognize there may be reservations about specific

BE IT ENACI'ED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD AS FOLLOWS:
Section 1. Legislative Intent
Consistent with our comprehensive land use plan and our established objectives and goals as
reflected by the existing zoning patterns within the Town, and based upon our current County Route
48 Land use study as well as numerous land use studies and plans developed heretofore, we hereby
determine that it is necessary and desirable to revise and amend the zoning designation applicable to
the parcel identified herein as well as other lands; thus, we hereby identify and adopt the following
overall themes of (1) Preservation of Farmland and Agriculture; (2) Preservation of Open and
Recreational Space; (3) Preservation of the Rural, Cultural, Commercial and Historical Character of
the Hamlets and Surrounding Areas; (4) Preservation of the Natural Environment; which derive
from the shared vision held by residents and local public officials of the Town and which are
intended to foster a strong economy and which encourage and preserve the existing high quality of
life, as more specifically set forth herein below:
1. Preservation of Farmland and Agriculture
Farmland is a valuable and dynamic industry in the Town of Southold. The open
farmlands are not only highly cherished for their economic value, but for the scenic vishas they provide.
The open space and scenery created by famfland additionally contributes to the quality of life of the
residents, while promoting tourism and recreation.
2. Preservation of Open and Recreational Space
The Town of Southold relies heavily upon its scenic beauty and open landscapes for
recreation, clean air and water, as well as for its allmction to tourists and recreation-soekea, s. The
Town has attracted many second homeowners because of its "natural resources, abundanr~ of
open space, farms, picturesque villages, and thc ever-present waterfront" (Master Plan Update,
1985). Due to fids open space, the Town has a t~emendous development potential. Bleak pictures
have been painted in a few documents, warning of stripqype development, suburban sprawl and
water supply issues. The preservation of open and recreational space is not only aesthcti~ but also
a nece~ity for the present and future needs of the Town.
3. Preservation of the Rural, Cultural, Commercial and Historical Character ~f the
Hamlets and Surrounding Areas
The Town of Southold is renowned for its mini, cultural, commercial and historic
character. This unique character is recognized in all of the documents reviewed. Based on lhe ~ of
Town residents, the Final Report and Recommendations ~ates that the two mo~t prevalent and key issues
are keeping growth in the existing hamlet centers and preserving the enhancing the surrounding rural areas.
Additionally. the Master Plan Update recommends the provision for "a community of residential hamlets
that are comprised of a variety of housing opportunities, commercial, service and cultural activities, set in
an open or rural atmosphere and supported by a diversified economic base (including agriculture, marine
commercial and seasonal recreation activities)."

Preservation of the Natural Environment
Accommodating "groxvth and change within the Town without destro.~fng ils traditional
economic base, the natural environment of xvhich that base rests, and the unique character
and the way of life that defines the Town" is of utmust importance" (Ground Watershed
Protection and Water Supply Management Strategy). The Master Plan Updale
reconunends preservation of the Town's natural environment from wetlands to
woodlands and to "achieve a land use pattern that is sensitive to the limited indigenous
water supply and will not degrade the subsurface water quality.
The outstanding needs enumerated below are the culmination of eare/ul comparison or,he inlent and
objectives of the town (as stated in past land use plans and studies) and the currently existing conditious
along the County Route 48 con'idor. These needs reflect the past and present vision oftbe Town and the
work that still needs to be done due to the proximity of County Route 48 to the hamlet commercial centers
and to avoid potentially conflicting development strategies for such areas. These outstanding needs we find
exist throughout the Town and are specifically identified as follows:
1 ) to provide for viable land use development at levels of intensities which are sensitive to subsurface
water quality and quantity
2) To maintain and strengthen hamlet centers as the focus of commercial, residential, and coltmal
activity;
3) To preserve the open, agricultural and rural character of areas outside of the hamlet centers;
4) to provide for a variety of housing opportunities for citizens of different incomes and age levels;
5) to enhance the opportunities for pedestrian-friendiy shopping;
6) to continue to the support of the Town's agricultural economy;
7) to maximize the Town's natural assets, inchiding its coastal location and agricultural base, by
balancing commercial, residential and recreational uses;
8) to strengthen the Town's me-recreational and me-commercial activities;
9) to encourage the preservation of parkland and public access to the waterfront;
10) to support tourism by maintaining and strengthening the Town's assets that foster a tourist trade,
namely hamlet center bUSinesses, historic heritage, architecture, a sense of place, of rural and open
character, agriculture, and marine activities;
11) to preserve prime farmland; and encourage the diversification of agriculture;
12) to preserve the historic, cultural, architectural and archaeological resources of the Town;
13 ) to ensure visual q~mli~y of hamlet centers;
14) to encourage appropriate land uses both inside and out of hamlet centers;
15) to promote balanced economy and tax base;
16) to preserve hhe integrity of the Town's vegetative habitats, including freshwater wetlands and
woodlands.
Section 2. Enactment
Therefore. based upon the aforementioned goals and identified needs of the Town and upon our
consideration of the recommendations and commems of our Planning Board. the Suffolk County planmng
Commission, our planning consultant (CCG) and the public comment haken at the public hearing and
otherwise, we hereby change the zoning district designation for the parcel known as

Dear Mrs. Neville,
The recommendations proposed by the Cramer Consulting Group in the above-noted
Study, have been reviewed and discussed by the Planning Board. Collectively we
offer the following observations.
The underlying premise of this Study is to preserve the bypass capability of the CR
48 divided highway. Doing so will prevent the commercial retail sprawl that
characterizes every Long Island town to our west. More specifically, the overall
purpose is to avoid repeating the mistakes made elsewhere on western Long Island,
where unchecked commercial retail development not only resulted in serious traffic
congestion problems, but played a role in the demise of the economic vitality of
downtown districts located on State Route 25.
This community's Vision, as stated in many documents and public meetings some
going back to the mid-1980s (prior to the adoption of the 1989 Zoning Map), is to
preserve the small-town qualities that distinguish Southold. In order to achieve this
goal, it is critically important to consolidate future retail business growth around the
existing business centers within each hamlet.
Furthermore, reducing the potential for retail and other traffic-generating uses to be
introduced {or expanded) will have other long-term benefits to the community. First,
it will ensure a bypass road for through traffic, thereby relieving some congestion on
SR 25. Second, it will boost the economic development potential of the existing and
potential business properties bordering SR 25, where most of the Town's traditional
hamlets are centered. Third, it will preserve a scenic corridor that is a source of
pleasure to residents and tourists.
Therefore, we support the overall study recommendations as proposed. In
recommending their adoption, we recognize there may be reservations about specific

proposed rezonings and that alternate rezoning proposals may be under consideration.
We urge extreme caution in modifying the consultant's recommendations lest the
integrity of the whole be undermined in the interest of satisfying a few.

Southold, New York
The Town Board of the Town of Southold, on its own motion, has proposed a
change of zone for a certain parcel in the Town of Southold at Southold, which parcel is
shown on the Suffolk County Tax Map as 1000-059-7-32 so that the zoning of said parcel
shall change from LB ("Limited Business Districf') to A-C ("Agricultural-Conservation
Dislrict [two-acre minimum]"). This parcel is part of a proposed change of zone
designated by the Town Board as "Southold 3."
Notice of the proposed change of zone was issued by the Town Clerk on
September 14, 1999.
The undersigned owner(s) of property within that part of the Town of Southold
which would be affected by such proposed change of zone, do(es) hereby and herewith
protest to the Town Board of the Town of Southold against said change of zone.
This instrument is a protest against such change of zone made pursuant to Section
265 of the Town Law of the State of New York.

review. The Findings Statement has been pt~ared pursuant to the requirements of Part 617.11
of thc State Environmental Quality P~view Act (SEQRA) regulations which state that no
agency shall make a decision on an action which has been the subject ora Final GElS until a
written findings statement has been prepared in regard to the facts and conclusions in the DraR
and Final GElS relied upon to support its decision
It is hnportant to note that the Findings Stat=ment is in a draft form and, thereforg, the
entire document should be rtwicwed in detail and amended as the Town Board deems
appropriate. Two sections of the Findings Statement are wot, by of particular review. These
sogtions aro th~ rostatongnt of Recommendations and Opportunities (pages 4 through 9) and the
Review and Implementation of Future Specific and Sfte-,.Vpecific Actions Related to the Land
Use Study (pages 14 through 16).
Recommendations and Opportunities
The recomngndations ~om the County Route 48 Corridor Iamd Ug Study are r~tated
and clarified in this section. Reco.~eytaatiom that w~re the subject of public
comments include further explanation as per the Final GElS and/or Final Supplemental
GELS. It is suggested that th~ Town Board ~view this section in detail and provide
sdaitional discussion or clarification as it deems necessary.
Review and Implementation of Future Specific and Site-Specific Actions Related to the
Land Use Xtndy
SEQRA rt'gulations 617.10C0) and (c) state that GEISs and their findings should set
forth specific conditions or criteria under which future actions will be undertaken or
approved, including requirements for any subs~uent SEQR complianc~. Iropacts of
individual actions proposed to be carried om in conlbrman~ with the Land Usc Study
and cri/eria identified in flu: Findings Statement may r~luire no or limited SEQR renew.
This section of the Findings Stateroom co~alrts the criteria that dacrmincs which future
actions will require further SEQR review. It is suggested that the Town Board review
this criteria in detail and consider all possible future a~ions related to the Land
Study (Code changes, re-zonings, etc.). Comprehensive and thought-given criteria will
permit the streamlining of the approval and implementation process for actions with no
environmental impact, while providing for further SEQR review for those actions which
may result in adverse impa~s.

recommendations to the Town Board regarding appropriate land use and zoning
within thc County Route 4g corridor. The recommendations provided in the
Study include potential future zoning code clmngcs, changes in permitted land
uses within specific zoning districts, potential zone changes, and the adoption of

INTRODUCTION
On September g, 1998, the Town Board of the Town of Southold filed a moratorium on
thc issuance of approvals and permits for business-zoned properties within the County Route ag
corridor. The moratorium was intended to allow for the study of the corridor and to make
amendments with regard to the "level and nature of business uses that are appropriate along
Route 48, such that these uses compliment existing hamlet economic centor~ and that business
uses appropria~ outside hamlet centers are provided ample location in which to be situated".
The County Route 48 Corridor Land Use Study was subsequently conducted and submitted to the
Town Board on April 13, 1999.
The study corridor is situated entirely within the Town of $outhold and includes portions
of Sound Avenue, County Route 48 and State Route 25. The corridor begins on Sound Avenue
at the we.~rn Southold Town line and continues along Sound Avenue to its junction with
County Route 48 in Mattituck hamieL The study corridor then follows County Route 48 until its
junction with State Route 25 in thc hamlet of C, recnpon. Thc corridor then torminatos at the
in~tion of Manhasset Avenue and County Route 4g/State Route 25. All parcels located
within 1,000 feet of the above portions of these roadways are included in the study, with the
cxceptiun of those parcels that are within the jurisdiction of the Village of G-reenport.
A Positive Declaration, Notice of Public Hearing and Draft Generic Environmenud
Impact Statement on thc Land Use Study were adopted by the Town Board of the Town of
Southold on April 20, 1999. A Public Hearing on the Draft Generic Environmental Impact
Stat~nent was held on May 6, 1999 and public comments were accepted until May 20, 1999. A
Final Generic Enviromnenral Impact Statement (FGEIS) was adopted by the Town Board on July
20, 1999. A Supplemental Final Generic Enviroum~ntal Impact Statement (FGEIS) was adopted
by the Town Board on August 3, 1999.

the Sta~ Environmental Quality Revie~v Act regulalions (SEQRA) which state that no agency
shall make a decision on an action which has been the subject of a Final GElS until a written
Fi~cllng-~ statement has beeB prepared in regard to the feets o/id conclusions in the Draft and Final
GElS relied upon to support its decision. To conform to the SEQRA provisions, the Town Board
of thc Town of Southold has prepared this Findings Statement.
In its SEQRA review of the County Route 48 Corridor Land Usc Study, the Town of
Southold has not identified any si~rmificant adverse environmental impacts. Nevertheless, the
Town of Southold chose to use thc format of a Genetic Environmen~ Impact Sta~ment (GELS)
in its sub2eqnent SEQR.A review of and public comment on this Study it provided for the most
comprehensive environmental rcvicw of thc Study and allowed for the greatest degree of public
awareness and input. Furthermore, even though no significant adver, e environmental impacts
w~re identified az a result of the Study, Section 617.10 of the SEQRA regulations stnt~s that
GEI~$ mny be Hied "to assess the eavironmental impacts of: an entire program or plan having
wide upplication...in¢luding new or signiti~ant c, hang~s to existing land use plans.,." regardless of
whether or not the action is expect~i to possibly result in adverse environmental impacts.
COUNTY ROUTE 48 CORRIDOR LAND USE STUDY
The County Route 48 Corridor Land Use Study pmvidas recommendations to the Town
Board regardin~g appropriate land use and zoning within thc corridor. These recommendations
arc the final step in a four-step planning and study proccss that was intendexi to provide a
methodical and comprehensive look at land use and zoning in the corridor. The first step in the
Study was to identify the characteristics of the corridor and surrounding areas that the Town and
its citizens believe are important and valuable. These characteristics were garnered from past
Town land use plans and studies as well as from the intent of Town actions, particularly previous
land use decisions, re-zonings and code changes. Subsequent to the identification of desirable
oharacteristics of the corridor, an analysis of existing conditions along the corridor was
conducted and included existing zoning, land use, non-conforming lots, soils and habitats,
economy, historical areas and Ir·fflc conditions. The third step in the process outlined the
outstanding needs of the corridor based on a comparison of the desirable characteristics of the
Town to thc existing conditions of the corridor, ha other words, the outstanding needs are an
enumeration of the work that still needs to be done to make the desim:l characteristics of thc
Town a reality. The final step in the process provided recommendations relative to satisfying the
outstanding needs. The recommendations provided in the Study include potential future zoning
code changes, changes in permitted land uses within specific zoning districts, potential zoning
changes, and the adoption of visual resource best management practices. Once the Land Usc
Study is adopted, Town would, at its discretion, implement all or part of iLs recommendations.
The Town of Southold finds the following with regard to the County Route 48 Corridor
Land Use Study:
Previous Land Use Pious and Town Aefions
It was not the intent of the County Route 48 Land Use Study to develop new goals and
at~ategi~s for the Town of Southold to follow, but rather to synopsize what the Town has
already determined to be ils goals and desires. This determination of goals has been
clearly ~ in numerous land use phn.~ and stodi~, and can be inferred from the intent
of past Town rc-zonings and code chan~. Thc Land Usc Study took thesc goals and
categorized them into four major themes. All four of the themes, derived from a shared
vision of residents and officials, arc ge·reel toward providing the Town wi~h a strong
economic base sad ~ high qualiPJ of life. Each thcme is briefly discussed below. More
specific comments regarding each theme arc included in Section IH of thc Land Use
Study.
1. Pr~erv~tiOl~ of Fmrmland mid Agrlcliture
Farmland is · valuable and dynamic industry in the Town of Southoid. The open
farmlands are not only highly cherished for their economic value, but for the scenic
vistas they provide. The open space and sc·nco, created by farmland additionally
conuibu~es to ~h¢ quality of life of the residents, while promoting tourism and
recreation.

The Town of Southold r~liew heavily upon its ~cenic beauty and open landscapes for

seekers. The Town has attracted many second homeowners because of its "natural
resources, abundance of open space, farms, picturesque villages, and the ever-prescnt
waterfront" (Master Plan Update, 1985). Due to this open space, the Town has a
tremendous development potential. Bleak pictures have been painted in a few
documents, warning of strip-type development, suburban sprawl and water supply
issues. The preservation of open and recreational space is not only aesthetic, but
also a necessity for thc present and future needs of the Town.
Preservation of the Rural, Cultural, Commercial and Hhtorieal Character of
the Hxmlcte and Surrounding Arena
The Town of Southold is renowned for its rural, cultural, commcrcial and historic
character. This unique character is recognized in all of the documcnts revicwcd.
Based on the input of Town residents, the Firml Report and ge. commendations states
that the two most prevalent and key issues are keeping ~rowth in thc existing hamlet
centers and preserving and cnhnncing the surrounding rural arcas. Additionally, the
Master Plan Update recommends the provision for "a community of residcntial
hamlets that are comprised of a variety of housing opportunities, commercial, service
end cultural activltie~, set in an open or rural atmosphere end supported by a
diversified economic bnsc (including agriculture, marine commercial and seasonal
recreation activities).'
preservation of the Natural Environment
Accommodating =growth and change within the Town without destroying its
traditional economic base, the natural environment on which that base rests, and the
unique character and thc way of lifc that defines thc Town" is of utmost importance"
(Ground Watershed Protection and Water Supply Management Strategy). The
Master Plan Update recommends preservation of the Town's natural environment
from wetlands to woodlands and to ,'achieve a land usc pattern that is sensitive to the
limited indigenous water supply and will not degrade t~c subsurface water quality.
Outstanding Need~
The outstanding needs enumerated below are thc culmination of razreful compatieon of
the intern and goals of the town (as ~,-d in past land usc plans and studies) nnd ~,e
existing conditions along the County Rome 48 corridor. Therefore, the needs are not
new, but rather reflect the pest and prescut vision of the Town end the work that still
needs to be done. Due to the proximity of Couuty Route 48 to the hamlet centers and to
avoid potentially confli,~ing developm~ni stra~egics for the two areas, the outstanding
needs are intended to be valid throughout the Town. The outstanding needs for the Town
of Southold are found to b~:
· Provide for viable land use development at intensities sensitive to subsurface water
quality and quantity,
· Maintain and stvmfftben hamlet centers as the focus of commercial, residential, and
cultural ~otivity.
· Preserve the open, agricultural and rural charac~r of areas outside of tho hamlet r, ente~.
· Provide for a variety of housing opportunities for citizens of different incomes and age
levels.
· Enhancx the oppo~unltles fur pedestrian-friendly shopping.

· Continue to suppo~ thc Town's agricultural economy.
· Maximize the Town's natural assets, including its coastal location and agricultural base,
by balancing commercial, residential and recreational uses.
· Strengthen the Town's marine-recreetional and marine-Commercial activities.
· Encourage thc preservation of parkland and public access to thc waicrfront.
· Support tourism by maintaining and strengthening the Town's assets that attract tourists,
namely hamlet center businesses, historic heritage, building architecture, a sense of
place, rural and open character, agriculture, and marine activities.
· Preserve prime farmland in thc Town and continue to support the diversification of
agrioulturc.
· Prcscrv¢ the historic, cultural, architectural and archaenlogical rvsources of the Town.
· Ensure the efficient and safe movement of people and goods within the Town.
· preserve visual quality of hamlet centers.

Recommendations and Opportunities
In an cffort to satisfy the outstanding ncccis of the Town of Southold as they apply
to the County Route 48 corridor, land usc rccommcndalions wcrc developed. Thcsc
recommendations arc found to meet the outs~nding needs to the best extent practicable
and arc consistent with thc major themes gamcrcd form prcvions land nsc documenLs and
Town actions, while providing the Town flexibility in their actual implementation.
Howcvcr, it should be noted that thc list of recommendations is not exhaustive and that a
variety of technlques and mcchanisms may be utilized by the Town to achieve desired
rcsults. Furthennorc, it is recognized that some of thc recommendations would need
further anvironmentM and planning analysis as well an opportunity for public input prior
to implcmcnmfion.
Each recommendation below is written in Bold lta//cs and is identified by a

The Town of Southold finds that the following recommendations are appropriatc
for considcration for land usc in thc County Route 48 corridor:

Several opportunities exist to re-zone properties to allow for more
appropriate uses: Such re-zonings may includc changes from commercial to
residential or A-C zoning categories as w~U from tcsick'ntial or A-C to
commercial. In some cases, the tn-zoning of parcels to less intensive uses will
help to limit the int=,~uption of scemic vit~vs and vislas from the roadway, and
will help to maintain the agricultural character of much of the conidor.

Re-zonings are intended to balance the residential, commercial,
~nvironmcntal and r~-eational needs of the Town. Existing enclaves of
commercial use may be cnlum¢~ by additional appropriate commercial parcels.
Similarly, existing agricultural or residential areas may be enhanced by the re-
zoning of nearby vacant commercially-zoned parcels. By concentrating future
commercial uses in areas of existing commercial activity (particularly hamlet
centers) results in a more viable and ordered land usc pattern and hcips to prevent
the dilution of consumer activity in the Town. The hamlet centers currently act as
thc commcrcial centers of thc Town and providc a sense of place. In contra.~
areag outside of the hamlet centers generally portray a more open and agricultural
character, with ~mall arenas of commercial activity. The con~rasting characteristics
of these areas are highly prized by the residents of the '[own. $outhold is one of
the only towns on Long Island where hamlet centers still exist for the most part.
The re-zoning of certain parcels within the corridor to more appropriate uses will
have the effect of anhancing the basic characteristics of the hamlet centers and
mess along the conidor.
The statement on page 50 of the Land Use Study stating that "a reduction in
the potential intensity of land use in this area is anticipated to have a beneficial
impact in terms of water usage and potential groundwater impact' is rescinded. It
is noted that agricnlmral use may, under certain scenarios, result in groundwater
usage and/or contamination above thst associated with commercial uses.
However, as stated on pages 4-8 through 4-10 of the Final GEIS, the trend in
agriculture in the Town of Southoid is mw&rd crops that require drastically lesser
amounts of irrigation, fertilizer and pesticide, such as vineyards.

It is recommcndcd that applicant~ seeking to increase density or change of
use allowed by special exception/special permit in an appropriate zoning diatrict
would be required to provide development wedits from other more sensitive
parcels (clustering). The parcels from which these credi~ were taken would
effectively become sterilized, with the exception of continued agricultural usage.

Orient buildings to limit the interruption of scenic vi~ta~ and views.
This recommendation is to be used at the time of site plan review.
Consideration should be given to the orientation, size and height of the building
with respect to its visual impact from perspectives along Coumy Route 48 and
Sound Avenue. This recommendation is not intended to preclude the construction
of buildings, but rather to examine viable alternative building locations that meet
the needs oftl~ property owner while limiting the interruption of open scenic
views.
Continue enforcement of the Town Code with respect to the type of products
permitted to I~ sold at furm stands.
This recommendation is intended to help maintain the agricultural character
of the comdor by limiting the products sold at farm stands to only those that are
permitted under the Code. Such limitations have the effect of limiting the dilution
of consumer activity in the Town, strengthen commercial establishments in
hamlet areas, maintain the character of the area and maintain the safe and efficient
flow of traffic. It is recognized that the Town has revisited the section of the Code
dealing with farm stands several times. Due to the continually changing tronds in
agriculture and the sale of agriculturally related products, the Town Code must be
periodically updated to provide for viable enterprises while maintaining the
desired character of the Town.
Continue enforcement of the Town Code with respect to the conversion of
agricultural buildings to other commercial uses.
The Town Code contains restrictions on the conversion of agricultural
buildings to other commercial uses. It is m:ommended that the current provisions
of the Code continue to be enforced to preserve thc character of the agricultunfl
and open areas a.s well ~ limit thc potcntial for thc dilution of consumer activity
in the Town.
· Cluster residential development away from the roadway.
To maintain the open chara~r of most of the corridor, it is recommended
that future residential development be clustered away from the roadway. Use of
thc clustering technique allows for retention of naturally vegetaled or agricultural
lands. Maintaining a distance between thc development and the roadway
decreases the apparent mass of the project and maintains at least a portion of~the
opcn vistas. A recommcnda~ion to amend lhe Town Code with rcspect to non-
contiguous clustering (chmtea4n_o of development using development rights
transferred from non-contiguous parcels) would require detailed SEQR review
prior to implementation.

Require vegetated buffers between residential development and tbe roadway.
This recommendation may be utilized in conjunction with thc clustering
recommendation above. It is sugges~l that, where possible, agricultural uses be
maintainccl along the roadways for scenic vistas and views and then a natural
and/or landscape buffer be provided to screen the new homes. Agricultural uses
along the roadway would maintain the open views and vistas. A landscape buffer
is especially important for screening of distant homes when they are built on farm
fields, Tiffs recommendation may be implemented on a site by site basis on
properties where the size and configuration can support such a layout.
· Develop and implement the use ofvivual resource best management practices.
A suggested list of visual resource best management practices is provided in
Appendix B located at the end of the County Route 48 Land Use Study. These
practices were developed subsequent to the identification of four guiding
principles of thc desirable visual character in the Town of Southold. The best
management practices are intcaded to be utilized at the time of site plan review or
as othcrwisc dccmcd appropriate by thc Town. Much of thc intent of the practices
is to maintain or enhance the open character of thc County Route 48 corridor.
Amend the Town Code with resgect to the Residence O~/ice (RO) Dlstrlc~
Thc visual and historical character of thc hamlet centers are based, in part,
on the existing rcsidcntial homcs. Historically, many of thc homcs in thc Town
wcrc consmicted along the major roadways. As development and population in
thc Town has increased, many of these older homes arc no longer as desirablc for
continued residential use duc to traffic and surrounding land uses. Changes of use
from purcly rcsidcntial to commercial ur other use may [ikcly include thc removal
of strnetures that were once a major pan of the character of the hamlet.
Strengthening of the RO disUict through amendmcnts to thc Code would help to
preserve thc architectural character of thc hamlcus. Recommended code
amendments with respect to the RO district include requiring the adaptive re-use
of existing residences whcrc appropriate; increase the number of allowablc uses
permitted in ~le RO district, particularly those that generate little traffic; increase
the number of uses pcrmitted in the district by special exception; and amend site
plan requirements with respect to buffers, parking and building design.
· Amend the Town Code with respect to the £im~ed Business (LB) Distric&
Thc Tovm Code is r~ommended to be smended to allow additional as-of-
right uses in thc LB zoning district. The site plan requirements associated with
LB zoned propcrties should be ameaded to provide for better buffering and
screening of uses. Additional[y, thc architccxure of a proposed s~c in this
district should be in conformance with surrounding area and resemble residential
stmcturos as much as possible.
The Town Code should be amended with respect to non-conforming uses.
In cerJain areas, parcels can be found where the existing use does not
conform with the existing zoning. In cases where the use became non-conforming
due to a zone change, provisions can be made to allow for limited expansion of
that use or permit a change of use to a less intensive non-conforming use.
Applicants requesting expansion or change of use could make site improvements
as mitigation for rite request. These site improvements are anticipated to improve
the visual character of the area as well as improve traffic flow and other
undesirable effects of the non-conforming use. As stated on pages 4-13 and 4-14
of the Final GEIS, this recommendation allows for non-conforming businesses to
change, grow and remain viable by permitting expansion and change beyond that
which is commonly permitted. The recommendation is not limited to parcels
located within the Courtly Koute 48 corridor, but instead is intended to be applied
to parcels throughout the Town.
Re-zone appropriate parcels adjacent to Muttituck Creek to MI and/or MII
zonlag category.
The 1985 Master Plan Update (RPPW), as well as other past Town of
Southold plans and studies, recommends the enhancement of water-related
recreational and commercial activities. Oppon'tmities exist in the vicinity of
MaUituck Creek to enhance marine recreational and marine business usage. Re-
zoning of certain parcels would allow for viable commercial businesses to thrive
while taking advanlage of the Town's proximity to the water. Matfituck Creek is
the only portion of the County Route 48 corridor that may be appropriate for such

developmenL It is im~nortant to note that the recommendation for a chanEe of
zone does not commlt the Town to a coul~e of action that will result in adverse
environmental impacts. Prior to the r~-zo~ing of parcels consistent with the
County Route 48 Corridor Land Usc Study and thc Master Plan Update, the
l, ecomm~ndation to re-zone shoBid undergo SEQR review to determine fin. at
sufficient developable land exists on the site for reasonable development with
appropriate mitigation measures. The ultimate development plan for thc site
should undergo additional SEQR review and must take into account site-specific
characteristics in¢ltlding, but not limited to, site size, configuration, drainage,
surrounding land use, noise, traffic and proximity to wetlands. Specific mitigation
measures including site design constraints and limited permitted uses would be
appropriate at that time.
· Preserve the lnt~rlty of the Town's vegetative habeaS, ~cl~ingfr~hw~er

ecologically important habitats. It may be appropriate to re-zone parcels
containing or adjacent to these habitats to allow for lower impact uses. Proposals
to implement incentive zoning and non-contiguous clustering should uadergo
SEQR review and public comment period to identify potential adverse
enviroamcmal impacts prior to implementation.
Modify the Town Code to allow other use~ in vineyards under special
txemptlon/speclal perml~
Additional uses including restaurants and bcd & b~eakfasts may be allowed
under special exemption/special permit as long as yield is provided from other
parcels. This recommendation is intended to draw consumers into the Town of
Southo[d by promoting the Town as aa agricultural and wincmaking region. Thc
recommendation does,not suggest the sale of non-agricultural products that would
otherwise bc more appwpriately sold in other zoning districts or the sale of take-
out food.
Modify the Town Code to Ibnit curb cuts to one per site unless unusual
circumsttmco$ exi~L
An increasc in thc number of curb cum typically has a negative impact on
traffic flow. By limiting the number of curb cuts, particularly along Coumy Route
48 and Sound Avcnuc, impacts to traffic flow arc anticipated to be limited.
· Require llnl~ between the parking areas of commercial operations to allow for
vehicle movement between adjacent establishments.
This r~commendatien can be applied at the time of site plan review for
approprime sites. The requffemem will have the effect of reducing the number of
velfi¢les entering and exiting County Route 4g and Sound Avenue.

County Route 4g, where appropriate.
As noted earlier, an increuse in the number of curb cuts generally has a
negative impact on the flow of traffic. This recommendation in effect reduccs the
number of curb cuts on County Route 48 and Sound Avenue.

ENVIRONMENTAL SETTING;
POTENTIAL ADVERSE ENVIRONMENTAL IMPACTS
AND MITIGATION MEASURES
Thc Envirom-nental Setting for the Land Use Study/OEIS is represented by the existing
natural resources and human resources found within the County Route 48 corridor. The Land
Use Study reviewed the existing conditions in the corridor including existing zoning, existing
land use, non-conforming lots, soils, habitats, economy, historical areas, and traffic conditions.
Past land use plans, studies and Town actions were reviewed in order to identify common
goals for proper development in the Town. These goals were compared to the existing
conditions in the corridor and a subsequent list of outstanding needs was developed, indicating
those areas where the existing conditions were wholly or partially inconsistent with the goals.
The discrepancies between land use goals and actual land uses are considered to be impacts. The
recommendations provided in the Study are intended as mitigation measures to avoid or
minimize any future discrepancies (impacts) between future land use and the land use goals.
Accordingly, implementation of the recommendations of the Study or similar land use techniques
is expected to result in significant beneficial environmental and social impacts. As the
reconunendations of the Study are directed at a more comprehensive, coordinatcd and sensitive
approach to directing land use, the Study is not anticipated to result in any adverse environmental
impacts.
In addition to the analysis described above, a review of the Study was conducted in
comparison with the Criteria for Determining Significance in Section 617.7 of the SEQRA
regulations. These criteria include impacts to air quality; groundwater quality or quantity;
surface water quality or quantity; traffic; noise levels; ~olid waste production; potential for
erosion; flooding, leaching or drainage problems; impacts to vegetation, wildlife, significant
habitat areas; and threat~nad or endangered spe. cie~; impacts to Critical Environmental Areas;
historical or archaeological resources; architectural or aesthetic resources; existing community or
neighborhood chacacter; energy; and agriculture. This ~view found that adoption of the Plan
did not exceed any of the thre~hold~ listeA. Accordingly, on this analysis alone, the adoption of

resources examined.
Also examined was the potential for adverse growth-inducing actions and any potential
cumulative impacts from two or more related actions, no one of which would have a significant
impact on the environment, but when considered together regult in a substantial adverse impact
on the environment. The analysis of these types of impacts found that they would not be
generated by the adoption of the Study.
Finally, the Study itself does not. in and of itself, result in any direct physical activity or
direct modification of the environment and. therefore, hag no potential for significant adverse
physic, al impacts, regardlcss of thc aforemcntioned analyses. In addition, the Study does not

commit the Town to any one course of action, lrmtead thc Study presents, in the form of
recommendations, mitigation measures or a range of mitigation measures that could be utilized in
future land use decisions to minimize or avoid adverse impacts caused by past development
In conclusion, the Town of Southold has not identified any significant adverse
environmental impacts for this action. As noel above, the proposed action is expected to result
in long-term beneficial impacts on the Town of Southold including those actions which are
environmentally-sensitive, socially-desirable and economically feasible.
ALTERNATIVE
The Alternatives section of the DGEIS describes only one alternative, the No action Alternative,
which is required by thc SEQRA regulations. No a~tion herein is determined to mean that land
use and developroent would continue to uecur under the present Town Code, zoning and
regulations, i.e. the status quo. (A No Action alternate entailing a No-Build and no physical
activity scenario is um-ealistic and unfeaeible). No other alternative was discussed in this section
because no other means of comprehensively addressing the identified land use, transportation,
environmentad, cultural resource, hamlet and demographic issues has been determined.
Under a No Action alternative, a more comprehensive, coordinated approach to directing
land use will not be implemented and the goals of the Town and its citizens will not be addressed
in a cohesive manner. If no action is taken, existing problems and issues identified the existing
problems in the corridor that run contr~ to past land use plans mad studies will not be rectified
or addressed and will continue to represent significant areas of concern for all who live and work
in the Town of Southold.

ECONOMIC
Analysis and consideration of economic factors and impacts are not mandated by SEQRA
as they are not directly involved ~vith the determL, mtion of environmental impact. Neverthcless,
when issuing a Findings Statement for a decision, Part 617. I 1 (d) of the SEQRA regulations
requires that the lead agency weigh and balance relevant environmental impacts with economic,
social and other consideratioas.
The Land Use Study offers comprehensive planning recommendations which promote
land use that is within sound environmental constraints and parameters. There have not been any
significant adverse economic impac~ identified that would result from the approval of this Land
Use Study.
The Land Usc Study provides ample opportunities for existing business to expand and
new businesses to locate in the Town. Furthermore, the Plan promotes development of land uses
which result in making the Town an attractive place not just in which to work, but in which to
live. The Land Use Study accomplishes this by providing ample areas for the growth of
commercial, residential and agricultural uses while maintaining the open space and rttral
character of the Town. Measures intended to maintain the existing open and rural character of
the Town by promoting balanced and coherent land use, are anticipated to maintain or enhance
the draw of tourists and consumers from outside of the Town, thereby bolstering local
businesses. In addition, Land Use Study recommendations will help to limit infrastructure costs
by promoting commercial uses in existing commercial enclaves, limiting curb cuts, and
promoting pedestrian-friendly shopping.
Additional SEQRA review will be performed for future specific actions which implement
the recommendations of the Land Use Study and which may have an economic impact.

REVIEW AND IMPLEMENTATION OF FUTURE SPECIFIC
AND SITE-SPECIFIC ACTIONS RELATED TO THE LAND
USE STUDY
SEQRA regulations 617.10(b) and (e)state that:
"GEISs and their findings should set forth specific conditions or criteria under
which future actions will be undertaken or approved, including requirements for
any subsequent SEQR compliance. This may include thresholds and criteria for
supplemental EISs to reflect specific significant impacts, such as site specific
impacts, that were not adequately addressed or analyzed in the generic EIS.
Impacts of individual actiorm proposed to be carried out in conformance with [the
Land Use Study] and the thresholds or conditions identified in the generic EIS
[and findings statement.] may require no or limited SEQR review".
In conformance with this portion of the SEQR regulations, criteria and thresholds have
been established to indicate when additional SEQR review is required for actions carried out in
conformance with the reconunetldafions of the Land Use Study. These criteria and thresholds do
not preclude the Town from reviewing proposed actions, but rather states when SEQR review is
required. These criteria and thresholds are as follows:
Changing the zoning category ora parcel from any one of the industrial or
commercial zones in the Town of Southold to a single-family residential or
Agricultural Conservation zone shall not require further SEQR review.
Changing the zoning category of a parcel from a higher density residential zone to
a lower density residential zone or Agricultural Conservation zone shall not
require further SEQR review.
Changing the zoning category of a parcel from one industrial zone to another
industrial zone, or from one commercial zone to another commercial zone. or
from an indu~u'ial zone to commercial zone shall not require further SEQR review
if:
a) the proposed new zoning category for the subject parcel is consistent
with the zoning of surrounding parcels, or
b) the propo~! change of zone does not permit higher intensity use of the
subject parcel as compared to the existing zone in terms of lot
ceverage, building height, parking requirements, ~rm"fic, impervious
area, drainage, and setbacks, or
e) the proposed change of zone does not take place in a designated
historical area, a critical environmental area. areas of low depth to
groundwat,r, or c, unmin or ~r, m/jac~nt to freshwater or tidal w~tiand~,
or
d) the proposed change of zone is inconsistent with the County Route 48
Corridor Land U~e Study and past land use p~Rnn of the Town of

Thc Town of Southold shall adhere to the above statement and thresholds for review and
implementation of specific actions related to thc County Route 48 Corridor Land Use Study.
CERTIFICATION OF FINDINGS TO APPROVE:
In accordance with Part 617.11 (d) of the New York State Environmental Quality Review
Act regulations, the Town Board of thc Town of Southold has considered thc Dra~ Generic and
Final Ocnedc Environmental Impact Statements for the action known as the County Route 48
Corridor Land Use Study and has met the requirements of this Part. These Findings contain the
facts and conclusions relied upon to support the Town Board's decision and indicate the social,
economic and other factors and standards which formed the basis of its decision.
Furthermore, the Town Board finds that consistent with social, economic and other
essential considerations in the No Action Alternative, the Land Use Study avoids or minimizes
adverse environmental impacts to the maximum extent practicable. The Study provides an
assessmeat of existing conditions along the corridor and identifies those areas where the existing
conditions are inconsistent with the goals oflmst land use plans. The Study then offers various
recommendations as mitigation measures to bring the conditions of the County Route 48 corridor
into conformance with the goals of the Town. Therefore, adverse environmental impacts will be
avoided or minimized by the implementation of all or part of the recommendations (mitigation
measures) of the Land Use Study, or the implementation &other land use policies that have the
same effect as the Study recommendations.
It is therefore recommended that the County Route 48 Corridor Land Use Study and its
recommendations be adopted.

significant adverse environmental impacts, but wishes to provide a format through
the SEQRA review and public comment of the Study; and
WHEREAS a Final Generic Environmental Impact Statement (FGEIS) has been
prepared and adopted by the Town Board; and
WHEREAS a Supplemental Generic Environmental Impact Statement has been
prepared to address the Study; and
RESOLVED that the Town Board of the Town of Southold, acting as lead agency
hereby adopts the annexed Notice of Completion for the Supplemental Generic
Environmental Impact Statement on the Town of Southold County Route 48
