THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION WAS ADOPTED AT
THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD HELD ON
SEPTEMBER 12, 2000:
WHEREAS the Town Board of the Town of Southold is considering a change in the zoning
designation from LB Limited Business Zoning District Designation to the
AC Agricultural Conservation Zoning District Designation of a certain parcel of land lying in
the Town of Southold identified by SCTM # 1000-059.00-10.00-005.000; and
WHEREAS, GElS which said "no further SEQRA review required" when "Changing the
Zoning Category of a parcel from any one of the industrial or commercial zones in the Town of
Southold to a single-family residential or Agricultural Conservation zone shall not require further
SEQRA review." And this proposed action meets this criteria; and
WHEREAS, the Town Board nevertheless conducted a LEAF pursuant to SEQRA in addition to
the GEIS findings statement; and be it
RESOLVED the Town Board found that for the above action there is no other involved agency,
that for the above action the Town Board is Lead Agency; that this action is an Unlisted Action;
all pursuant to SEQRA Rules and Regulations 6 NYCRR 617.1 et. Seq. and Chapter 44 of the
Southold Town Code; and be it further
RESOLVED by the Town Board that this proposed project will not have any significant adverse
environmental impacts and therefore the Town Board issues a NEGATIVE DECLARATION
pursuant to the SEQRA roles and regulations.

The Planning Board has again reviewed the recommendations of the Cramer Consulting
Group in the above study. Our conclusions are the same as contained in the Board's letter
to you of October 8, 2000, (attached).
Several changes were given careful review as to reasons and fairness for the
recommended change. However, recognizing that the underlining premise of this study is
to preserve the bypass capability of the CR 48 divided highway and to prevent retail
sprawl, the Board has no option but to support the overall recommendations which we
feel will accomplish this objective.

Dear Mrs. Neville,
The recommendations proposed by the Cramer Consulting Group in the above-noted
Study, have been reviewed and discussed by the Planning Board. Collectively we
offer the following observations.
The underlying premise of this Study is to preserve the bypass capability of the CR
48 divided highway. Doing so wilt prevent the commercial retail sprawl that
characterizes every Long Island town to our west. More specifically, the overall
purpose is to avoid repeating the mistakes made elsewhere on western Long Island,
where unchecked commercial retail development not only resulted in serious traffic
congestion problems, but played a role in the demise of the economic vitality of
downtown districts located on State Route 25.
This community's Vision, as stated in many documents and public meetings some
going back to the mid- 1980s (prior to the adoption of the 1989 Zoning Map), is to
preserve the small-town qualities that distinguish Southold In order to achieve this
goal, it is critically important to consolidate future retail business growth around the
existing business centers within each hamlet.
Furthermore, reducing the potential for retail and other traffic-generating uses to be
introduced {or expanded) will have other long-term benefits to the community. First,
it will ensure a bypass road for through traffic, thereby relieving some congestion on
SR 25. Second, it will boost the economic development potential of the existing and
potential business properties bordering SR 25, where most of the Town's traditional
hamlets are centered. Third, it will preserve a scenic corridor that is a source of
pleasure to residents and tourists.
Therefore, we support the overall study recommendations as proposed. In
recommending their adoption, we recognize there may be reservations about specific

proposed rezonmgs and that alternate rezoning proposals may be under consideration

integrity of the whole be undermined in the interest of satisfying a few

BE IT ENACIED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD AS FOLLOWS:
Section 1. Legislative Intent
Consistent with our comprehensive land use plan and our established objectives and goals ns
reflected by the existing zoning patterns within the Town, and based upon our current County Route
48 Land use study as well as numerous land use studies and plans developed heretofore, we hereby
determine that it is necessary and desirable to revise and amend the zoning designation applicable to
the parcel identified herein as well as other lands; thus, we hereby identify and adopt the following
overall themes of (1) Preservation of Farmland and Agriculture; (2) Preservation of Open and
Recreational Space; O) Preservation of the Rural, Cultural, Commercial and Historical Character of
the Hamlets and Surrounding Areas; (4) Preservation of the Natural Environment; which derive
from the shared vision held by residents and local public officials of the Town and which are
intended to foster a strong economy and which enconrage and preserve the existing high quality of
life, ns more specifically set forth herein below:
1. Preservation of Farmland and Agriculture
Farmland is a valuable and dynamic iudustly in the Town of Southold. The open
farmlands are not only highly cherished for their ~onomic value, but for the scenic vistas they provide.
The open space and sconcny created by farmland additionally contributes to the quality of life of the
residents, while promoting tourism and recreation.
2. Preservation of Open and Recreational Space
The Town of Southold relies heavily upon its scenic beauty and open larutq:apes for
recreation, clean air and water, as well as for its attraction to tourists and mt/on-seekers. The
Town has attracted many second homeowners because of its "uatm'al resources, alumnae of
open space, farms, picturesque villages, and the ever-present waterfront" (Master Plan Update,
1985). Due to this open space, the Town has a tremendous development potential BIl~lk pictur~
have been painted in a few documents, warning of strip-type development, subuflmn slwawl and
water supply issues. The preservation of open and recreational space is not only aesthetic, but also
a necessity for the present and future needs of the Town.
3. Preservation of the Rural. Cultural, Commercial and Historical Character of the
Hanslet~ and Surrounding Areas
The Town of Southold is renowned for its rural, cultural, commercial and historic
character. Th/s unique character is reco~m~i~t,xl in all of t&e documents l~vicwed. Based on/he/npu~ of
Town ~esidents, thc Final Report and Recommendations state~ that the two most prevalent and key issues
are keeping g~o~lh in the existing hamlet centers and pre~rving the enhancing the surrounding nu-al areas.
Additionally. the Master Plan Update recommends the provision for "a community of residential hamlets
flint are comprised of a variety of housing opportunities, commercial, service and cultural activities, set in
an open or rural atmosphere and supported by a diversified economic base (inclutling agriculture, marine
commercial and seasonal recreation activities)."
Preservation of the Natural Environment
Accommodating "growth and change xdthin the Town without destroying its traditional
economic base, the natural environment of which that base rests, and the unique character
and the way of life that defines the Town" is of utmost importance~ (Ground Watershed
Protection and Water Supply Management Strategy). The Master Plan Update
recommends preservation of the Town's natural environment from wetlands to
woodlands and to "achieve a land use pattern that is sensitive to the limited indigenous
water supply and will not degrade the subsurface water quality.
The ontstanding needs enumerated below are the culmination of uarcful comparison of the intent and
objectives of the town (as stated in past land use plans and studies) and the c~t~adly ~dsting conditious
along the County Route 48 corridor. These needs reflect the past and present vision of the Town and the
work that still needs to be done due to the proximity of County Route 48 to the hamlet commercial centers
and to avoid potentially conflicting development strategies for such areas. These outslanding needs we find
exist throughout the Town and are specifically identified as follows:
1 ) to provide for viable land use development at levels of intensities which are sensitive to subsurface
water quality and quantity
2) To maintain and strengthen hamlet centers as the focus of commercial residential, and cultural
activity:
3 ) To preserve the open, agricultural and rural character of areas outside of the hamlet centers;
4) to provide for a variety of housing opportunities for citizens of differcn! incomes and age levels;
5) to enhance the opportunities for pedestrian-friendiy shopping;
6) to continue to the support of the Town's agricultural economy;
7) to maMmize the Town's natural assets, including its coastal location and agricultural base, by
baluncing commercial, residential and recreational uses;
8) lo strcagthen the Town's me-recrcational and marine-commercial activities;
9) to encourage the preservation of parkland and public access to the waterfront;
I0) to support tourism by maintaining and stren~g the Town's assets that foster a tourist trade,
namely hamlet cemer businesses, historic heritage, architecture, a sense of place, of rural and open
character, agriculture, and marine activities;
1 !) to preserve prime farmland; and encourage the diversification of agriculture;
12) to preserve the historic, cultural, architectural and archaeological r~ources of the Town;
13) to em visual quality of hamlet centers;
14) to encourage appropriate land uses both inside and out of hamlet centers;
15) to promote balanced economy and tax base;
16) to pr~,erve the integrity of the Town's vegetative habitats, including freshwater wetlands and
woodlands.
Section 2. Enactmenl
Therefore, based upon the aforementioned goals and identified needs of the Town and upon our
consideration of the recommendations and comments of our Planning Board, the Suffolk Count), Planning
Commission, our planning consultant (CCG) and the public comment taken at the public hearing and
otherwise, we hereby change the zoning district designation for the parcel known as

herein below) from the

southerly side of North Road and the northwest comer of land now or formerly of
Booth;

The Town Board of the Town of Southold, on its own motion, has proposed a
change of zone for a certain parcel in the Town of Southold at Southold, which parcel is
shown on the Suffolk County Tax May as 1000-059-10-5 so that the zoning of said parcel
shall change from LB ("Limited Business D~stnct" to A ~' t,,A
· ' ) --- ~ ~gdcultural-Conservation
District). This parcel is part of a proposed change of zone designated by the Town Board
as "Southold 3."
Notice of the proposed change of zone was issued by the Town Clerk on
September 14, 1999.
The undersigned owner(s) of property within that part of the Town of Southold
which would be affected by such proposed change of zone do(es) hereby and herewith
protest to the Town Board of the Town of Southold against said change of zone.
This instrument is a protest against such change of zone made pursuant to Section
265 of the Town Law of the State of New York.

BE IT ENACTED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD AS FOLLOWS:
Section 1. Legislative Intent
Consistent with our comprehensive land use plan and our established objectives and goals as
reflected by the existing zoning patterns within the Town, and based upon our current County Route
48 Land use study as well as numerous land use studies and plans developed heretofore, we hereby
determine that it is necessary and desirable to revise and amend the zoning designation applicable to
thc parcel identified herein as well as other lands; thus, we hereby identify and adopt the following
overall themes of (1) Preservation of Farmland and Agriculture; (2) Preservation of Open and
Recreational Space; (3) Preservation of the Rural, Cultural, Commercial and Historical Character of
the Hamlets and Surrounding Areas; (4) Preservation of the Natural Environment; which derive
from the shared vision held by residents and local public officials of the Town and which are
intended to foster a strong economy and which encourage and preserve thc existing high quality of
life, as more specifically set forth herein below:
1. Preservation of Farmland and Agriculture
Farmland is a valuable and dynamic industry in the Town of Southold. The open
farmlands are not only highly cherished for their economic value, but for the scenic vistas they provide.
The open space and scenery created by farmland additionally contributes to the quality of life of the
residents, while promoting tourism and recreation.
2. Preservation of Open and Recreational Space
The Town of Soutbold relies heavily upon its scenic beauty and open landscapes for
recreation, clean air and water, as well as for its attraction to tourists and recreation-soekem. The
Town has attracted many second homeowners because of its "natural resources, abundance of
open space, farms, picturesque villages, and lhe ever-preseut waterfront" (Master Plan Update,
1985). Due to this open space, the Town has a tremendous development potential. Bleak pictures
have been painted in a few documents, warning of strip-type development, subuzban sprawl and
water supply issues. The preservation of open and recreational space is not only aesthetic, but also
a necessity for the present and future needs of the Town.
3. Preservation of the Rural, Cultural, Commercial and Historical Character of the
Hamlets and Surrounding Areas
The Town of Southold is renowned for its rural, cultural, commercial and historic
character. This unique character is recognized in all of the documents reviewed. Based on the input of
Town residents, the Final Report and Recommendations states that the two most prevalent and key issues
are keeping growlb in the existing hamlet centers and preserving the enhancing tile surrounding rural areas.
Additionally, the Master Plan Update recommends the provision for "a community of residential hamlets
that arc comprised of a variety of housing opportunities, commercial, service and cultural activities, set in
an open or rural atmosphere and supported by a diversified economic base (including agriculture, marine
commercial and seasonal recreation activities)."
Preservation of the Natural Environment
Accommodating "growth and change within the Town without destroying its traditional
economic base, the natural environment of which that base rests, and the unique character
and thc way of life that defines the Town" is of uUnost impertance" (Ground Watershed
Protection and Water Supply Management Strategy). The Master Plan Update
recommends preservation of file Town's natural environment from wetlands to
woodlands and to "achieve a land use pattern that is sensitive to the limited indigenous
walcr supply and will not degrade the subsurface water quality.
The outstanding needs enumerated below are the culmination of eareful comparison of the intent and
objectives of the town (as stated in past land use plans and studies) and the currently existing conditions
along the County Route 48 corridor. These needs reflect the past and present vision of the Town and the
work that still needs to be done due to the proximity of County Route 48 to the hamlet commercial centers
and to avoid potentially conflicting development strategies for such areas. These outstanding needs we find
exist throughout the Town and are specifically identified as follows:
1 ) to provide for viable land use developmenl at levels of intensities which am sensitive to subsurface
water quality and quantity
2) To maintain and strengthen hamlet centers as the focus of commercial, residential, and cultural
activity.:
3) To preserve rite open, agricultural and rural character of areas outside of the hamlet centers;
4) to provide for a variety of housing opportunities for citizens of different incomes and age levels;
5) to enhunce the opportunities for pedestrian-friemlly shopping;
6) to continue to the support of the Town's agricultural economy;
7) to ma:dmize the Town's natural assets, including ils coastal location and agricultural base, by
balancing commercial, residential and recreational uses:
8) to strengthen the Town's manne-recreational and manne-commercial activities;
9) to encourage the preservation of parkland and public access to the waterfront;
10) to support tourism by maintaining and strengthening the Town's assets that foster a tourist trade,
namely hamlet center businesses, historic heritage, architecture, a sense of place, of mml and open
character, agriculture, and manne activities;
11) to preserve prime farmland; and encourage the diversification of agriculture;
12) to preserve the historic, cultural, architectural and archaeological resources of the Town;
13) to ensure visual quality of hamlet centers;
14) to encourage appropriate land uses both inside and out of hamlet centers;
15) to promote balanced economy and tax base;
16) to preserve the integrity of the Town's vegetative habitats, including freshwater wetlands and
woodlands.
Section 2. Enaclmenl
Thcrefore~ based upon thc aforementioned goals and identified needs of the Town and upon our
consideration of thc recommendations and comments of our Planning Board, the Suffolk County Planning
Commission, our planuing consultant (CCG) and the public comment taken at the public heanng and
otherwise, we hereby change the zoning district designation for the parcel known as
SCTM# IOOO- O~q. O0-10 .00-OOS. OOO _(and as more fully described
herein below) from the
zoning district designation to the
zoning district designation.

ALL that certain plot, piece or parcel of land, with the buildings and improvements
thereon erected, situate, lying and being at Southold, Town of Southold, County of
Suffolk and State of New York, more particularly bounded and described as follows:
BEGINNING at a concrete monument which is located on the
southerly side of North Road and the northwest comer of land now or formerly of
Booth;
THENCE RUNN1NG South 28 degrees 07 minutes 10 seconds East along said land
now or formerly of Booth, 272.23 feet;
THENCE South 55 degrees 29 minutes 40 seconds West 54.21 feet;
THENCE North 30 degrees 54 minutes 00 seconds West 245.61 feet
to the southerly side of Middle Road;
THENCE northeasterly along the southerly side of Middle Road on an arc
bearing to the right having a radius of 2050.68, a
distance of 73.61 feet to the point or place of BEGINNING.
Section 3.
The zoning map as adopted by section 101)-21 of thc Town Code of the Town of Southold is

It is important to note that the Findings Statcment is in a draft form and, therefore, the
entire document should be reviewed in detail and amended as the Town Board detnns
appropriate. Two sections of the Findings Statement are worthy of particular review. These
segtions ate the reatatem0nt of Recommendations and Opportunities (pages 4 through 9) and the
Review and Implementation of Future Specific and ~tte..~pecific Actions Related to the Land
Use Study (page~ 14 through 16).
Recommendations and Opportunities
The recommendations ~om the County Route 48 Corridor Land Use Study arc r~ated

Review and Implementation of Future Specific and Site-Specific Actions Related to the
Lar~l Use ~
SEQRA regulations 617.10(b) and (c) suite that GEISs nnd their findings should set
forth specific conditions or ctiu:ria under which future actions will be uudertaken or
approved, including requirements for any subsequent SEQR con~liance. Impacts of
individual actions proposed to be carried om in conlbrmant~ with the Land Use Study
and criteria identified in th~ Findings Statement may require no or limited SEQR t~4ew.
This section of the Findings Statement ~o~_ airls the criteria that d~erminea which future
actions will require further SEQR review. It is suggested that the Town Board review
this critcda in detail and consider all possible future actions related to thc Land Usc
Study (Code changes, re-z~nings, etc.). Comprehensive and thought-given critcria will
permit the streamlining of the approval and implementation process for actions with no
environn~ntal impact, while providing for further SEQR review for those actions which
may result in adverse impacts.

Description of file Action: The Town Board of the Town of Southold proposes to approve and adopt
thc County Route 48 Land Use Study, the purpose of which is to provide
recommendations to thc Town Board regarding appropriate land use and zoning
within the County Route 48 corridor. The recommendations provided in the
Study include potential future zoning code changes, changes in permitted land
uses within specific zoning districts, potential zone changes, and the adoption of
visual r~source best management practices.

iNTRODUCTION
On September 8, 1998, the Town Board of thc Town of Southold filed a moratorium on
thc issuance of approvals and p~nnits for business-zoned properties within the County Route 48
corridor. The moraturium was intended to allow for the study of the corridor and to make
amendments with regard to thc "level and nature of business uses that are appropriate along
Route 48, such that these uses comphment exastmg hamlet e~onomic center~ and that business
uses appropriate outside hamlet centers are provided ample location in which to be situated".
The County Route 4g Corridor Land Use Study was subsequently conducted and submitted to the
Town Board on April 13, 1999.
The study corridor is situated entirely within the Town of $outhold and includes portions
of Sound Avenue, Gounty Route 48 and State Route 25. The corridor begins on Sound Avenue
m the western Southold Town line and continues along Sound Avenue to its junction with
County Route 48 in Mattituck bamiet. The study corridor then follows County Route 48 until its
junction with State Route 25 in the hamlet of Greenport. The conic[or then terminates at the
intersection of Manhass~t Avenue and County Route 48/State Route 25. All parceLs located
within 1,000 f~et of the above portions of these roadways are included in the study, with the
exception of those parcels that are withi~t the jurisdiction of the Village of Grecnporc
A Positive Declaration, Notice of Public Hearing and Draft Generic Environmental
Impact Statement on thc Land Use Study were adopted by the Town Board of the Toval of
Soutbold on April 20, 1999. A Public Hearing on the Draft Generic Environmental Impact
Statement was lmld on May 6, 1999 and public comments were accepted until May 20, 1999. A
Final Generic Environmental Impact Statement (FOEIS) was adopted by the Town Board on July
20, 1999. A Supplen~ntad Final Generic Environmental Impact Statement (FGEIS) was adopted

in its subsequent SEQRA review of and public comment on this Study it provided for the most

COUNTY ROUTE 48 CORRIDOR LAND USE STUDY
The County Route 48 Corridor Land Use Study pmvidas recommendations to the Town
Board regarding appropriate land use and zoning within the confidor. These recommendations
ax~ the fmal step in a four-step planning and study process that was intended to provide a
methcMical and comprehensive look at land use and zoning in the comdor. The first step in the
Study was to identify the characteristics of the corridor and surrounding areas that the Town mad
its citizens believe are important and valuable. These characteristics w~e garnered from past
Town land use plans and studies as well as from the intent of Town actions, particularly previous
land use decisions, re-zonings and cede changes. Subsequent to the identification of desirable
characteristics of the corridor, an analysis of existing conditions along the cotxidor was
conducted and included existing zoning, land usg, non-conforming lots, soils and habitats,
economy, historical areas and ~affic conditions. The third step in the process outlined the
outstanding noels of the corridor based on a comparison of the desirable characteristics of the
Town to th~ existing conditions of the corridor, in other words, the outstanding needs are an
enumeration of the work that still needs to be done to make the desired characteristics of the
Town a reality. The final step in the process provido:l recommendations relative to satisfying the
outstargting needs. The recommendations provided in the Study include potential future zoning
code changes, changes in permitted land uses within specific zoning districts, potential zoning
changes, and the adoption of visual resource best management practices. Once the Land Usc
Study is adopted, Town would, at its discretion, implement all or part of its recommendations.
The Town of Southold finds the following with regard to the County Route 48 Corridor
Land Use Study:
Previous Land Use Plans and Town Agtlons
It was not the intent of the County Route 48 Land Use Study to develop new goals and
strategies for the Town of Southold to follow, but rather to synopsize what the Town has
already determined to be its goals and desires. This determination of goals has been
clearly s~ated in numerous land use pinna and studies, and can be inferred from the intent
of past Town re-zonings and code changes. Thc Land Usc Study took these goals and
categorized them into four major themes. All four of the themes, derived fzom a shared
vision of r~id~nts and officials, are g~u~d toward providing the Town with a strong
economic base and a high qualit~ of life. Each theme is briefly discussed below. More
specific comments regarding cash theme ate included in Section IH of the Land Use
Study.
Preservation of Farmland and Agriculture
Farmland is a valuable and dynamic industry in the Town of Southold. The open
farmlands are not only highly chofish~d for their ~onomi¢ value, but for the scenic
vistas they provide. The open space and scen,:ry created by farmland additionnlly
cotmibutes to the quality of life of the residents, while promoting tourism and
r~.reation.

seekers. The Town has attracted many second homeowners because of its "natural
r~sourcas, abundance of open space, farms, picturesque villages, and the ever-present
waterfront" (Master Plan Update, 1985). Du~ to this open space, the Town has a
tremendous development potential. Bleak pictures have been painted in a few
documentS, warning of strip-type development, suburban sprawl and water supply
issues. The preservation of open and recreational space is not only aesthetic, but
also a n~essity for the present and f~ture needs of the Town.

Accommodating "growth and change within the Town without destroying its
waditional economic base, the natural environment on which that base rests, and the
unique character and the way of life that defines thc Town" is of utmost importance"
(Ground Watershed Prow. ctiun and Water Supply Management Strategy). The
Master Plan update recommends preservation of the Town's natural environment
from wetlands to woodlands and to "achieve a land use pattern that is ~ensitive to the
limited indigenous water supply and will not degrade the subsurface water quality.
OuUtsnding Needs

· Support tourism by maintaining and strengthening the Town's assets that attract tourists,
namely hamlet center businesses, historic heritage, building architecture, a sense of
place, rural and open character, agriculture, and marine activities.
· Preserve prime farmland in the Town and continue to support the diversification of
agriculture.
· Preserve thc historic, cultural, an;hitectural and archaeological r~sour~es of thc Town.
· Ensure the efficient and safe movement of people and goods within thc Town.
· Preserve visual quality of hamlet centers.
· Encourage appropriate land uses both inside and out of hamlet centers.
· Promote balanced economy and tax base.
· Preserve thc integrity of thc Town's vgg~ativc habitats, including freshwater wetlands
and woodlands.
Recommendations and Opportunllies
In an effort to satisfy the outstanding needs of the Town of Southold as they apply
to the County Route 48 corridor, land usc re. commendations were devaloped. These
recommendations arc found to mee~ the outstanding needs to the best extent practicable
and are consistent with the major themes garnered form previous land use dooumcnL~ and
Town actions, while providing the Town flexibility in their actual implementation.
However, it should be noted that the list of recommcndatious is not exhaustive and that a
variety of techniques and mechanisms may be utilized by the Town to achieve desired
results. Fm'thermorc, it is recognized that some of the rccommcndatious would need
further environmental and planning analysis as well an opportunity for public input prior
to implcmcnmion.

The Town of Southold finds that the following recommendations are appropriate
for considcmtion for land usc in the County Route 48 corridor:

will help to maintain the agricultural character of much of the corridor.

Re-zonings are intended to balance thc residential, commercial,
environmental and recreational needs of the Town. Existing enclaves of
commercial use may be enhanced by additional appropriate commercial parcels.
Similarly, existing agricultural or residential areas may he enhanced by the re-
zoning of nearby vacant commercially-zoned parcels. By concentrating future
commercial uses in areas of existing commercial activity (particularly hamlet
centers) rcsnlts in a more viable and ordered land use pattern and helps to prevent
thc dilution of consumer activity in the Town. The hamlet centers currently act as
thc commcrcial centers of thc Town and provide a sense of place. In contrast,
areaa outside of the hamlet centers generally portray a more open and agricultural
character, with small areas of commercial activity. The contrasting characteristics
of these areas are highly prized by thc residents of the Town. Southold is one of
thc only towns on Long Island where hamlet centers still exist for thc most pan.
Thc re-zoning of certain parcels within the corridor to more appropriau: uses will
have the effect of enhancing the basic characteristics of the hamlet centers and
arces along the conidor.
The statement on page 50 of thc Land Usc Study stating t~I "a reduction in
the potential intensity of land use in this area is anticipated to have a bencficial
impa~t in terms of water usage and potential gmundwatar impact" is rescinded. It
is noted that agricultural use may, under certain scenarios, result in groundwater
usage md/or contamination above that associated with commercial uses.
However, as stated on pages 4-8 through 4-10 of thc Final GEIS, thc trend in
agriculture in the Town of Southold is toward crops that require drastically lesser
amounts of irrigation, fertilizer and pesticide, such as vineyards.

It is recommended ~applicants seeking to increase density or change of
use allowed by special exception/special permit in an appropriate zoning disUict
would be required to provide development credits from other more sensi6ve
parcels (clusterS). The parcels from which these credits were taken would

This program is anticipated to prcservc a v~uic~y ofvc~ctative habitat arcas'
provid~ for parkland ~ open ~ main~n agricultural sctivity, and limit
development withill prima~ groundwater recharge areas. As discuas~d on pag~
4-!0 through 4-12 of the Final GELS, h~ payment of money to the Town in retm~
for incentive zoning is not contemplated by the Land Use Study. Further detailed
SEQR review will be necessary to identify potential adverse environmental
impacts;'prior to ibe decision to implzmemt this recommendation.

intended to preclude the construction of agricultural-related structures or
otherwise limit agricultural activity, but rather to preserve the open agricultural
views and vistas from County Route 48 and Sound Avenue.
Orient buildings to limit the interruption of scenic vistas and views.
This recommendation is to be used at the time of site plan review.
Consideration should be given to the orientation, size and h~ight of the building
with respect to its visual impact from perspectives along County Route 48 and
Sound Avenue. This r~omm~ndation is not intended to preclude the construction
of buildings, but ratl~ to examine viable alternative building locations that meet
the needs of the property owner while limiting the interruption of open scenic
views.
Continue enforcement of the Town Code with respect to the type of products
permitted to be sold at furm stands.
This recommendation is intended to help maintain the agricultural character
of the corridor by limiting the products sold at farm stands to only those that are
permitted under the Code. Such llmitations have the effect of limiting the dilution
of consumer activity in the Town, strengthen commercial establishments in
hamlet areas, maintain the character of the area and maintain the safe and efficient
flow of txaffic. It is recognized that the Town has revisited the section of the Code
dealing with farm stands several times. Due to the continually clanging trends in
agriculture and the sale of agriculturally related products, the Town Code must be
periodically updated to provide for viable enterprises while maintaining the
desired character of the Town.
Continue enforcement of the Town Code with respect to the conversion of
agricultural balldin&,s to other commercial uses.
The Town Code contains restrictions on the conversion of agricultural
build/nFs to other commercial uses. It is recommended that thc current provisions

and open areas n.~ well as limit thc potential for the dilution of consume~ activity
in the Town.
Cluster residential development away from the roadway.
To maintain the open character of most of the corridor, it is recommended
that future residential development be clustercd away from thc roadway. Usc of
thc clustering technique allows for retention of naturally vegetated or agricultural
lands. Maintaining a distance between thc dcvclopmcm and the roadway
decreases the apparent mass of the project and maintains at least a portion or,the
open vistas. A recommendation to amend the Town Codc with respect to non-
contiguous clusterin~ (clusteri~ of development usin~ development rights
tnmsfetred from non-contiguous parcels) would ~quir~ detailed SEQR review
prior to implementation.

Require vegetated bu~er~ between residential development and the roadway.
This recommendation may be utilized in conjunction with the clustering
recommendation above. It is sugges~:l that, where possible, agricultural uses be
maintained along thc roadways for scenic vistas and views and then a natural
and/or landscape buffer be provided to screen the new homes. Agricultural uses
along the roadway would maintain the open views and vistas. A landscape buffer
is especially important for screening of distant homes when they arc built on farm
fields. This recommendation may be implemented on a site by site basis on
properties where the size and configuration can support such a layout.
· Develop and implement the use of~isual resource best management practices.
A suggested list of visual resource best management practices is provided in
Appendix B located at thc end of the County Route 48 Land Use Study. These
practices were developed subsequent m the identification of four guiding
principles of the desirable visual character in the Town of Southold. The best
management practices arc intcndcd to be utilized at the time of site plan review or
as othcrwisc dccmad appropriate by the Town. Much of the intent of the practices
is to maintain or enhance the open character oftbe County Route 48 corridor.
· Amend the Town Code with respect to the Residence Office (RO) Dlstrica
The visual and historical character of the hamlet centers are based, in part,
on the existing residential homes. Historically, many of thc homes in thc Town
were consm~ted along the major roadways. As development and population in
thc Town has increased, many of these older homes arc no longer as desirable for
continued residential use due to Lraffic and surrounding land uses. Changes of use
from purely residential to commercial or other use may likely include the removal
of structures that were once a major pan of the character of the hamlet.
Sllvagthcning of the RO district through amcndments to thc Code would help to
prcscrvc thc architectural charactcr of thc hamlets. Rccommendcd code
amendments with respect to the RO district include requiring the adaptive re-use
of cxislillg resldeac~ where appropriate; hlcrease the number of ailowablc uses
permitted in the RO district, particularly those that generate little tr~fflc; increase
the number of uses permitted in the district by special exception; and amend sito
plan requirements with respect to buffers, parking and buildln~ design.
· Amend the Town Code with respect to the Limited Bmlne-~ (LB) Distric~
Thc Town Code is recommended to be emended to allow additional as-of-
right uses in the LB zoning district The site plan requirements as~eiaxed with
LB zoned properties should be amended to provide for better buffering and
screening ofu-ses. Additionally, thc architecture of a p,,,poscd stmeturo in this
district should be in conformance with surrounding area and resemble residential
stmctwes as much as possible.

The Town Code should be amended with respect to non-conforming uses.
In certain areas, parcels can be found where the existing use does not
conform with the existing zoning. In cases where thc use became non-conforming
due to a zone change, provisions can be made to allow for limited expansion of
flint use or permit a change of use to a less intensive non-conforming use.
Applicants r~luesting expansion or change of use could make site improvements
aa mitigation for the request. These site improvements are anticipated to improve
the visual chaxacter of the area as well aa improve traffic flow and other
u~dcsirable effects of the non-conforming use. As stated on pages 4-13 and 4-14
of the Final OEIS, this recommendation allows for non-conforming businesses to
change, grow and remain viable by permitting expansion and change beyond that
which is commonly permitted. The recommendation is not limited to parcels
located within the County Route 48 corridor, but instead is intended to be applied
to parcels throughout the Town.
· Re-zone appropriateparcels adjacent to Mattituck Creek to MI and/or Mll
zoning category.
The 1985 Master Plan Update (RPPW), as well aa other past Town of
Southold plans and studies, recommends the enhancement of water-related
recreational and commercial activities. Opportunities exist in the vicinity of
Mattituck Creek to enhance marine recreational and mafiae business usage. Re-
zoning of ceradn parcels would allow for viable commercial buainesses to thrive
while taking advantage of the Town's proximity to the water. Mattituck Creek is
the only portion of the Couaty Route 48 corridor that may be appropriate for such

Page~ 2 and 3 of the Supplemental Final GElS acknowledged that the southern
end of Mattituck Creek contains anvironmemal resoun:es that are senaifive to
development. It js important to note that the recommendation for a change of
zone does not commit the Town to a course of action that will result in adverse
environmental impacts. Prior to the re-zoning of parcels consistent with the
County Route 48 Corridor Land Uae Study and the Master Plan Update, the
recommem/ation to re-zone should undergo SEQR review to determine that
sufficient developable Isnd exists on the site for reasonable development with
appropriate mitigation measures. The ultimate development plan for thc site
should undergo additional SEQR review and must take into account site-specific
c~stics including, but not limited to, site size, configuration, drainagc,
surrounding land use, noise, traffic and proximity to wetlands. Specific mitigation
measures including site design constraints and limited permitted uses would be
appropriate at that time.
· Preserve the integrity of the Town's vegetative kabitats, includingfreskwater
The Iv. commendations to promote incentive zoning and clustering may be
used to continue to pre,s~rve fr~hwater wetlands, woodlands and other
ecologically important habitats, It may be appropriate to re-zone parcels
contaimng or adjacent to these habitats to allow for lower impact uses. Proposals
to implement incentive zoning and non-contiguous clustering should undergo
SEQR review and public comment period to identify potential adverse
environmental impacts prior to implementation.
· Modify the Town Code to allow other uses in vineyards under special
e~cemptlon/speelal perrntt
Additional uses including restaurants and bed & breakfasts may be allowed
under special exemption/special permit as long as yield ~s provided from other
parcels. This recommendation is intended to draw consumers into the Town of
Southold by promoting thc Town as an agricultural and winemaking region. The
recommendation do,snot suggest the sale of non-agricultural products that would
othetwlse be more appropriately sold in other zoning districts or thc sale of take-
out food.
· Modify the Town Code to limit curb cuts to one per site unless unusual
circumstances exist
Aa i~rease in the number of curb cuts typically ha~ a negative impact on
traffic flow. By limiting the number ofcu~o cuts, particularly along Coanty Route
48 and Sound Avenue, impacts to traffic flow axe anticipated to be limited.

This re~ommcndation can be applied at the time of site plan review for
appropriat~ sit~s. Thc requirement will have the effect of reducing the number of
vclfieles entering and exiting County Route 48 and Sound Avenue.

ENVIRONMENTAL SETTING;
POTENTIAL ADVERSE ENVIRONMENTAL IMPACTS
AND MITIGATION MEASURES
The Env/ronmental Setting for the Land Use Study/GEIS is represented by the existing
natural resources and human resources found within the County Route 48 corridor. The Land
Use Study reviewed the existing conditions in the corridor including existing zoning, existing
land use, non-conforming lots, soils, habitats, economy, historical areas, and traffic conditions.
Past land use plans, studies and Town actions were reviewed in order to identify common
goals for proper development in the Town. These goals were compared to the existing
conditions in the corridor and a subsequent list of outstanding needs was developed, indicating
those areas where the existing conditions were wholly or partially inconsistent with the goals.
The discrepancies between land use goals and actual land uses are considered to be impacts. The
recommendations provided in the Study are intended as mitigation measures to avoid or
minimize any future discrepancies (impacts) between future land use and the land use goals.
.Accordingly, implementation of the recommendations of the Study or similar land use techniques
Is expected to result in significant beneficial environmental and ~ocial impacts. As the
recommendations of the Study are directed at a more comprehensive, coordinated and sensitive
approach to directing land use, the Study is not anticipated to result in any adverse anviroumental
impacts.
In add/tion to the analysis described above, a review of the Study was conducted in
comparison with the Criteria for Determining Significance in Section 617.7 of the SEQRA
regulations. These criteria include impacts to air quality; groundwater quality or quantity;
surface water quality or quantity;, traffic; noise levels; solid waste production; potential for
erosion, flooding, leaching or drainage pwblems; impacts to vegetation, wildlife, signi~ieam
habitat areas; and threatened or endangered species; impa~ts to Critical Environmental Areas;
historical or archaeological re~urces; architectural or aesthetic resources; existing community or
neighbofaood character; energy; and agriculture. This review found that adoption of the Plan
did not exceed any of the thr~holds listed. Accordingly, on this analysis alone, the adoption of
the Plan is not anticipated to result in any significant adverse impacts to any of the criteria
resoIJ_rCas ~xAm~m~d.
Also examined was the potential for adverse growth-inducing actions and any potential
cumulative impacts from two or more related actions, no one of which would have a significant
impact on the environment, but when considered together result in a substantial adverse impact
on the environment. Thc analysis of these types of 4mpacts found that they would not bc
generat~ by the adoption of the Study.
Finally. the Study itself does not, in and of itself, result in any direct physical activity or
direct modification of the environment and, thcrefore, h~ no potential for significant adverse
physical impacts, regardlcss of thc aforcmcnfioncd analyses. In addition, the Study does not

commit the Town to any one course of act/on. Instead thc Study prcscnts, in thc form of
r~comm~ndatious, mitigation measures or a rangc of mitigation measuxes that could be utilized in
future land use decisions to minimize or avoid adver~ impacts caused by past development
patterns.
In conclusion, thc Town of Southold has not identified any significant adverse
cnviwnmcntal impacts for this action. As noel above, the proposed action is expected to result
in long-term beneficial impacts on thc Town of $outhold including those actions which are
cnviwnmcntally-sensitiv¢, socially-desirable and economically feasible.

ALTERNATIVE
The Alternatives section of the DOEIS describes only one alternative, the No action Alternative,
which is required by thc SEQRA regulations. No action herein is determined to mean that land
use and development would continue to occur under the present Town Code, zoning and
regulations, i.e. the status quo. (A No Action alternate entailing a No-Build and no physical
activity scenario is unrealistic and unfeasible). No other alternative was discussed in this section
because no other means of comprehensively addressing the identified land use, transportation,
environmental, cultural resource, hamlet and demographic issues has been determined.
Under a No Action alternative, a more comprehensive, coordinated approach to directing
land usc will not be implemented and the goals of the Town and its citizens will not be addressed
in a cohesive manner. If no action is taken, existing problems and issues identified the existing
problems in the corridor that mn conumy to past land use plans and studies will not be rectified
or addressed and will continue to represent significant areas of concern for all who live and work
in the Town of Southold.

ECONOMIC
Analysis and consideration of economic factors and impacts are not mandated by SEQRA
as they are not directly involved with the determination of environmental impact. Nev~l~cless,
when issuing a Findings Statement for a decision, Pan 617.11 (d) of the SEQRA regulations
requires that the lead agency weigh and balance relevant environmental impacts with economic,
social and other considerations.
The Land Use Study offers comprehensive planning recommcndations which promote
land use that is within sound environmental conslraints and parameters. There have not been any
significant adverse economic impacts identified that would result from the approval of this Land
Use Study.
The Land Usc Study provides ample opportunities for existing business to expand and
new businesses to locate in the Town. Furthermore, the Plan promotes developmcnt of land uses
which result in mAkin_o the Town an attractive place not just in which to work, but in which to
live. The Land Use Study accomplishes this by providing ample ar~as for the growth of
commercial, residential and agricultural uses while maintaining the open space and rural
character of the Town. Measures intended to maintain the existing open and rural character of
thc Town by promoting balanced and cohcrcnt land usc, arc anficipatcd to maintain or enhance
thc draw of tourists and consumers from outside of thc Town, thereby bolstering local
businesses. In addition, Land Use Study recommendations will help to limit infrastructure costs
by promoting commercial uses in existing commcrcial cnclavcs, limiting curb cuts, and
promoting pedestrian-friendly shopping.
Additional SEQRA review will bc pcrformcd for future specific actions which implcmcnt
the recommendations of the Land Use Study ired which may have an economic impact.

REVIEW AND IMPLEMENTATION OF FUTURE SPECIFIC
AND SITE-SPECIFIC ACTIONS RELATED TO THE LAND
USE STUDY
SEQRA regulations 617.10(b) and (¢)state that:
"GEISs and their findings should set forth specific conditions or criteria under
which future actions will be undertaken or approved, including requirements for
any subsequent SEQR compliance. Thts may lnclude thresholds and criteria for
supplemental EISs to reflect specific significant impacts, such as site specific
impacts, that were not adequately addressed or analyzed in the generic EI~
Impacts of individual actions proposed to be carried out in conformance with [the
land Use Study] and the thresholds or conditions identified in the generic EIS
[and findings statementJ may require no or limited SEQR review".
In conformance with this portion of the SEQR regulations, criteria and thresholds have
been established to indicate when additional SEQR review is required for actions carried out in
conformance with the recommendations of the Land Use Study. These criteria and thresholds do
not praclude the Town from reviewing proposed actions, but rather states when SEQR review is
required. These criteria and thresholds are aa follows:
Changing the zoning categovj of a parcel from any one of the industrial or
commercial zones in the Town of Southold to a single-family residential or
Agricultural Conservation zone shall not require further SEQR review.
Changing the zoning category of a parcel from a higher density residential zone to
a lower density residential zone or Agricultural Conservation zone shall not
require further SEQR review.
Challging the zoning estegory of a parcel from one industrial zone to another
industrial zone, or from one cemmcrcial zone to another commercial zone. or
from an industrial zone to commercial zone shall not require further SEQR review
if:
a) the propota:d new zoning category for the subject parcel is consistent
with the zoning of surrounding parcels, or
b) the proposed change of zone does not permit higher intensity use of the
subject parcel as compared to the existing zone in terms of lot
coverage., building height, parking requirements, traffic, impervious
area, drainage, and setbacks, or
c) the proposed change of zone does not take place in a designated
historical area. a critical environmental area. areas of low depth to ~
groundwater, or contain or are adjacent to frashwa~' or tidal v~tlands,
or
d) the propnsea:! change of zone is inconaistent with the County Route 48

CERTIFICATION OF FINDINGS TO APPROVE:
In accordance with Part 617.1 l(d) of the New York State Environmental Quality Review
Act regulations, the Town Board of thc Town of Southold has considered thc Draft Generic and
Final Generic Environmental Impact Statements for the action known as the County Route 4g
Corridor Land Use Study 8nd has met the requirements of this Part. These Findings contain the
facts and conclusions relied upon to support the Town Board's decision and indicate the social,
economic mad other factors and standards which formed the b~is of its decision.
Furthermore, the Town Board finds that consistent with social, economic and other
essential consideratiom in the No Action AlterTmtive, the Land Use Study avoids or minimizes
adverse environmental impacts to the maximum extent practicable. The Study provides an
assessment of existing conditions 8long the corridor end identifies those areas where the existing
condifion~ are inconsistent with the goals ofpa~t land use plans. The Study then offers various
recommendations as mitigation meuures to bring the conditions of the County Route 48 corridor
into conformance with the gosls of the Town. Therefore, 8dverse environmental impacts will be
avoided or minimized by the implementation of all or psrt of the recommendations (mitigation
measures) of the Land Use Study, or the implementation of other land use policies that have the
same effect as the Study recommendations.
It is therefore recommended that the County Route 48 Corridor Land Use Study and its
recommendations be adopted.

the SEQRA review and public comment of the Study; and
WHEREAS a Final Generic Environmental Impact Statement (FGEIS) has been
prepared and adopted by the Town Board; and
WHEREAS a Supplemental Generic Environmental Impact Statement has been
prepared to address the Study; and
RESOLVED that the Town Board of the Town of Southold, acting as lead agency
hereby adopts the annexed Notice of Completion for the Supplemental Generic
Environmental Impact Statement on the Town of Southold County Route 48
