Railroad Company and the West line of land formerly of Sidor, later of Stella Radford and now of

THENCE, North 49 degrees 17 minutes 00 seconds West, 135.00 feet to a monument;
THENCE, North 67 degrees 03 minutes 00 seconds West, 120.00 feet more or less along lands of
Urist and lands formerly of Louis Dohm to a point which lies 20 feet South of the Northwest

THENCE Westerly on a straight line about 313 feet to an iron pipe on the East line of Westphalia
Avenue;
THENCE Southerly along the East line of Westphalia Avenue 134 feet more or less to the North
line of a right of way or private road 25 feet in width;
THENCE, Easterly along the north line of said private road 193.97 feet to a point;

THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION WAS ADOPTED AT
THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD HELD ON
SEPTEMBER 12, 2000:
WHEREAS the Town Board of the Town of Southold is considering a change in the zoning
designation from LI Light Industrial Zoning District Designation to the
LB Limited Business Zoning District Designation ora certain parcel of land lying in the Town
of Sonthold identified by SCTM # 1000-141.00-03.00-029.001; and
WHEREAS, GElS which said "no further SEQRA review required" when "Changing the
Zoning Category of a parcel from one industrial zone to another industrial zone, or from one
commercial zone to another commercial zone, of from an industrial zone to a commercial zone
shall not require further SEQRA review if:
a) the proposed new zoning category for the subject parcel is consistent with the
zoning of surrounding parcels, or
b) the proposed change of zone does not permit higher intensity use of the subject
parcel as compared to the existing zone in terms of lot coverage, building height,
parking requirements, traffic, impervious area, drainage, and setbacks, or
c) the proposed change zone does not take place in a designated historical .area, a
critical environmental area, areas of low depth to groundwater, or contam or are
adjacent to freshwater wetlands or tidal wetlands, or
d) the proposed change of zone is consistent with the County Road 48 Corridor Land
Use Study and past land usc plans of the Town of Southold and this proposed
action meets this criteria/threshold"; and
WHEREAS, the Town Board nevertheless conducted a LEAF pursuant to SEQP,-A in addition to
the GEIS findings statement; and
RESOLVED the Town Board found that for the above action there is no other involved agency,
that for the above action the Town Board is Lead Agency; that this action is an Unlisted Action;
all pursuant to SEQRA Rules and Regulations 6 NYCRR 617.1 et. Seq. and Chapter 44 of the
Southold Town Code; and be it
RESOLVED by the Town Board that this proposed project will not have any significant adverse
environmental impacts and therefore the Town Board issues a NEGAT1VE DECLARATION
pursuant to the SEQRA roles and regulations.

The Planning Board has again reviewed the recommendations of the Cramer Consulting
Group in the above study. Our conclusions are the same as contained in the Board's letter
to you of October 8, 2000, (attached).
Several changes were given careful review as to reasons and fairness for the
recommended change. However, recognizing that the underlining premise of this study is
to preserve the bypass capability of the CR 48 divided highway and to prevent retail
sprawl, the Board has no option but to support the overall recommendations which we
feel will accomplish this objective.

Dear Mrs. Neville,
The recommendations proposed by the Cramer Consulting Group in the above-noted
Study, have been reviewed and discussed by the Planning Board. Collectively we
offer the following observations.
The underlying premise of this Study is to preserve the bypass capability of the CR
48 divided highway. Doing so will prevent the commercial retail sprawl that
characterizes every Long Island town to our west. More specifically, the overall
purpose is to avoid repeating the mistakes made elsewhere on western Long Island,
where unchecked commercial retail development not only resulted in serious traffic
congestion problems, but played a role in the demise of the economic vitality of
downtown districts located on State Route 25.
This community's Vision, as stated in many documents and public meetings some
going back to the mid- 1980s (prior to the adoption of the 1989 Zoning Map), is to
preserve the small-town qualities that distinguish Southold In order to achieve this
goal, it is critically important to consolidate future retail business growth around the
existing business centers within each hamlet.
Furthermore, reducing the potential for retail and other traffic-generating uses to be
introduced (or expanded) will have other long-term benefits to the community. First,
it will ensure a bypass road for through traffic, thereby relieving some congestion on
SR 25. Second, it will boost the economic development potential of the existing and
potential business properties bordering SR 25, where most of the Town's traditional
hamlets are centered. Third, it will preserve a scenic corridor that is a source of
pleasure to residents and tourists.
Therefore, we support the overall study recommendations as proposed. In
recommending their adoption, we recognize there may be reservations about specific

District") to LB ("Limited Business District").
Notice of the proposed change of zone was issued by the Town Clerk on August
16, 2000.
The undersigned are all of the owners of the entire property identified above
which would be affected by such proposed change of zone. The andersigned does hereby
protest to the Town Board of the Town of Southold against said change of zone.
This instrument is a protest against such change of zone made pursuant to Section
265 of the Town Law of the State of New York.

On behalf of John Sidor, Jr. and Martin Sidor, Jr., we submit an additional basis
for the objection to the proposed rezoning. We submit that the proposal is not necessary
to the goal of strengthening hamlet centers.
The Cramer study's attempt to strengthen the hamlet centers would not be defeated
by retaining the present LI zoning. Hamlet businesses can be strengthened not only by
providing more HB zoned parcels, but by providing nearby uses which generate
customers to the HB areas. If the Sidor property is developed as LI, there would likely be
a sizeable number of employees who would frequent the downtown area before and after
work and during lunch or other breaks. The area developed as LI would provide a pool of
employees to provide a steady traffic to the nearby business areas without the need for
them to utilize their automobiles. The existing businesses which are located near but not
on Love Lane currently provide this source of customers to the Love Lane center.
Further, a review of the zoning map shows a large amount of liB zoning already in the
area. Development of that property, where the zoning is already in place, would
strengthen the HB area. Oversaturation of the area with HB zoning would not be
beneficial.

Dear Mrs. Neville,
The recommendations proposed by the Cramer Consulting Group in the above-noted
Study, have been reviewed and discussed by the Planning Board. Collectively we
offer the following observations.
The underlying premise of this Study is to preserve the bypass capability of the CR
48 divided highway. Doing so will prevent the commercial retail sprawl that
characterizes every Long Island town to our west. More specifically, the overall
purpose is to avoid repeating the mistakes made elsewhere on western Long Island,
where unchecked commercial retail development not only resulted in serious traffic
congestion problems, but played a role in the demise of the economic vitality of
downtown districts located on State Route 25.
This community's Vision, as stated in many documents and public meetings some
going back to the mid-1980s (prior to the adoption of the 1989 Zoning Map), is to
preserve the small-town qualities that distinguish Southold. In order to achieve this
goal, it is critically important to consolidate future retail business growth around the
existing business centers within each hamlet.
Furthermore, reducing the potential for retail and other traffic-generating uses to be
introduced (or expanded) will have other long-term benefits to the community First,
it will ensure a bypass road for through traffic, thereby relieving some congestion on
SR 25. Second, it will boost the economic development potential of the existing and
potential business properties bordering SR 25, where most of the Town's traditional
hamlets are centered. Third, it will preserve a scenic corridor that is a source of
pleasure to residents and tourists.
Therefore, we support the overall study recommendations as proposed. In
recommending their adoption, we recognize there may be reservations about specific

proposed rezonings and that alternate rezoning proposals may be under consideration.
We urge extreme caution in modifying the consultant's recommendations lest the
integrity of the whole be undermined in the interest of satisfying a few.

Ladies and Gentlemen:
On behalf of John Sidor, Jr. and Martin Sidor, Jr., we enclose a protest pertaining
to their property which is the subject of your rezoning proposal.
The Sidors object to the proposed rezoning because the resulting uses to which
their property could be pm (a) will be drastically reduced, (b) are not suitable to the size
and area of the parcel, (c) are not in conformity with the stated goals of preserving vistas
and reducing traffic, and (d) will substantially diminish the value of the property.
The Sidors have used all this property for many years for their potato grading
operation. The building is very large and is located very close to the southerly property
line on the boundary of the Long Island Railroad property. The property is bounded on
the west by Westphalia Road, across from which is LI zoning improved with several
concrete block buildings located on the street line and a large brick warehouse. The
property is bounded on the North by Raymond F. Nine's sand and gravel operation.
If the property is rezoned, it would significantly devalue the property because
many uses now permitted would no longer be permitted. These uses are much better
suited to the size and location of the property and to the large building on it than those in
LB or RO zones. The uses now permitted by the LI zone, which would be lost by the
proposed rezoning, include machine and equipment workshops; publishing and priming
plants' light industrial usage; boat building, service and storage; cold storage, food
processing and packaging plants; contractor's businesses or yards; research laboratories;
laundry and dry cleaning plants; conference facilities; bus and truck terminals and boat
repair. We refer you to Section 100-140 of the Town Law for an exact description for
these uses, which are currently permitted under LI zoning.
The very limited retail use and other uses which would be permitted by LB zoning
would not compensate for the devaluation of the property. The retail uses permitted are
extremely restricted and are not of the type where a substantial property value is
attainable. Those uses are antiques, arts and crafts, garden shops and galleries.
Moreover, by permitting such retail zoning, which is not now allowed, you would be
aggravating the traffic considerations. The LI zoning uses generally involve limited
traffic flow. The size of the main building also lends itself to the larger buildings
required by an LI use. Given current screening and other site plan requirements, these
uses would be constructed to be shielded from other properties. A change in use to any
other use permitted in the LI zone would be less imposing on the area than the noise, dirt
and dust, and heavy truck traffic associated with the current potato grading operation.
Another objection is that the location of the property bears absolutely no
relationship to the vistas from Rt. 48 or the Rt. 48 traffic considerations. The property
does not have any frontage on Rt. 48 and the LB uses would generate more traffic than
those in the LI zone.
The location of the property is not advantageous to Limited Business uses.
Located at the Mattituck LIRR station, with the building only a few feet from the tracks,
the businesses would be subjected to the noise and vibration associated with the train
traffic. Also, the only frontage, along Westphalia on the north side of the tracks, does not
make for a viable retail site nor would it afford professional offices any visibility.
Until your Board holds hearings and decides on the proposed changes to the uses
in the LB zone, we have no way of knowing what uses would be allowed. Moreover, the
proposed uses are very limited in relation to those which would be lost by the mzoning.
Further, the proposed uses to be added to the LB zoning would require a special
exception, whereas such an approval is not now required under LI zoning. To hold a
hearing on changing zone districts while use changes to those districts are proposed but
have not been scheduled for hearing is prejudicial to the property owner as the ultimate
permitted uses of his property is not known.
For the above reasons, the Sidors strenuously object to the proposed rezoning of
their property.

The Town Board of the Town of Southold, on its own motion, has proposed a
change of zone for a certain parcel in the Town of Southold at Peconic, which parcel is
shown on the Suffolk County Tax Map as 1000-141-3-29.1 from LI ("Light Industrial
District") to LB ("L±ra±ted Bus±nessn) .
Notice of the proposed change of zone was issued by the Town Clerk on
September 14, 1999.
The undersigned are all of the owners of the entire property identified above
which would be affected by such proposed change of zone. The undersigned does hereby
protest to the Town Board of the Town of Southold against said change of zone.
This instrument is a protest against such change of zone made pursuant to Section
265 of the Town Law of the State of New York.
