Mr. Driscoll stated the Buliding Department would'not give them a building permit until they received permission from the Planning Board. Mr. Driscolt did this and the Planning Board approved a permit for Lot No. 6 and the Building Department issued it. Mr. Driscolt does not feel ir'necessary to go tOe-the Planning Board each time they wish.to secure a permit on the roads which'have not been completed. He appealed to the Town Board to intervene in this matter. Town Attorney Tasker and Councilman Nickles pointed out to Mr. Driscoll that he is before the wrong Board. He should go back to the Planning Board. According to New York State Law, Section 280A, no building permit shall be issued in a subdivision until the roads have been improved to the satisfaction of the Planning Board 10:30 A.M~ - Mr. William Multen, Jr.., insurance advisor for the Town brought the Board up to date on his studies concerning medical insurance coverage for Town employees. He has accomplished a very important task concerning Blue Cross, making it possible for the Town to pay only six days in advance, rather than two months as in the past. He is still in touch with Mr. Cart at BOCES concerning a joint.program, but this does not .look hopefut.~Mr~'~Mullen did read about a new plan in the Wall Street= Journal wi~h?~ih~ best.- coverage possible. If he could ~interest Suffolk~:County~in t~his progra~i~i~ would be beneficial to Southold Town.'i'SuPer~isor agreed to arrange a meeting with the health insUrance~Officer in the County and Mr. Mullen. Mr. Mullen f~rther advised'the Board that .he recommends that other insurance coverage for ~he To~n should go to a three year bid which ~ould save the ~o~n a Considerable amount~ of m6ney. The Board favored this proposal. 10:45 A.M. - Mrs. Venetia McKe~ghan, Site. ~anager of the Southold Town Nutrition Program met with the Board to advise them that unless additional employees are provided, the program must close. At the present time she is functioning with only Gerald King, Cook and four part-time senior workers who work four hours a day, three days a week. Mr. King has informed Mrs. McKeighan that he will leave the program on Thursday if he does'not receive help in the kitchen. He is single handedly preparing an average of 130 meals per day. They have a total of five full-time and four part-time people running the program. When asked what she would need to continue, Mrs. ~cKeighan stated'it would be-necessary to have an assistant cook for Mr. King, at least one bus driver for home meal delivery (more people will be encouraged to use the Feeder Bus System), and full time employment of Pam McCaffery in the office who has been responsible for aiding the.elderly complete and file forms for various types of financial relief. The Board is concerned about closing the program, but feel~ it could still function if there were certain cutbacks.' Mrs. McKeighan was asked to return to the Board on April 21st with a priority. list of services that will enable the program to continue. In the mean- time it was agreed to place a resolution on the agenda to hire Dorothy Mysliborski as an assistant cook. EXECUTIVE SESSION 11:30 A.M. - the Board met with Mr. Rh~r]es GraVes, Southold Town's labor consultant, concerning C SEA negotiations. APRIL 7, 1981 12:30. P.M. -.Chief Carl ~' ..... ~1~ Cataldo appeared before the Board to discuss ~ete~tive ±r~in~n~ ~h~l. which is tentatively set to begin on May 18th. Chief Cataldo was advised to reserve four seats at the school in the event that many were needed. The Chief al:so spoke about using seasonal police of£icer~ to aid in transporting patients to mental institutions and the fact tha~ a letter should be requested from the mental health designee which would request the Town to transport these patients and possibly the Town can be reimbursed for their services.--Chief Cataldo stated that the .7th Squad is definitely out of Southold Town.-~Chief CataIdo was asked to presen~ a proposed program for the future investigative unit and what individuals he would assign to this unit. The Chief stated he feels the assignment of personnel within the POlice Department is his job. The Town Board does not actually know what is involved, i.e. performance, characteristics of the police officer to qualify as an investigative officer. The Board renewed their request for a proposed program. 12:50 P.M. - The Board recessed for lunch. 2:30 P.M. - Mr. James McMahon, Director of the Southold Town ~ D~version and Prevention Program made a pTesentation to the Board concerning a proposed application for a $75,000.00 grant for a Southold Town Police Juven~ie Bureau. The Board wished more time to study the proposal and a resolution will be placed on the Aoril 14th agenda.--~r. NcMahon advised the Board that the $3,000.00 D~ug Abuse should be accepted by the end of April. He said Riverhead, Southampton and East Hampton already have juvenile bureaus in their towns. 2:55 P.M. - The Board began reviewing the agenda. 3:35 P.M. - James Bitses, Esq. ~opeared before the Board with his client Demetrios Pavlidis concerning the possible rental of ~he refreshment .building at Southold Town Beach, Arshamomaque. Mr. BitseS has presented a proposal to rent the building and would like the Board to reconsider their proposal to demolish or remove the building. This matter will be discussed further at the April 21st meeting after the bids are opened (April 20th). Supervisor Pell asked for the Board's feelings concerning the proposed residences for potential community residence s~tes by ~he New York State Office of Mental Retardatio~:~and Developmental Disabilities. The proposed residence on Route 48. Mattitu¢k was approved by the Board and Supervisor Pell will notify OMRDD. The proposed residence on Short RoaQ was discussed and Supervisor Pell will notify OMRDD that there has been one complaint regarding that site. The proposed residence on Plum Island Lane, Orien~ will be discussed further at the next Board meeting. 4:00 P.M. - A group from the Mattituck Inlet Advisory Committee (Michael Cortese, Lydia Tortora, Alfred Kirby, Peter Maione and Frank Bear), met with the Town Board to advise them that the Long Island Regional Planning Board has completed Phase I of Study at Mattituck Inlet and they will be meeting with them for a preliminary presentation at 7:00 on April 23rd. They would like to have an open meeting on April 30th for presentation of the study to the public. The Board agreed to such a meeting. Mrs. Tortora said that following Phas~ I the L. I. R~gional Planning Board will be able to go into the Site plan.--There was some discussion r~lative to lack of communication between the Advisory Committee and the Town Board and Mr. Cortese said that would be corrected and their minutes would be supplied to the Town Board regularly. Councilman Murdock wished it noted for the record t~hat he requests legal advice from the Town Attorney relative to abolishing the ~osition of Deputv Supervisor, o~-restricting the powers to only signing checks. Town Attorney Tasker said that under Town Law the duties of Deputy Supervisor cannot be restricted. The Deputy Supervisor is empowered to act in all capacities in the absence or inability to serve of the Supervisor. To abolish the oosition would merely be by resolution of the Town Board, however,-'$his would be inadvisable because if the Supervisor were unable to function, employees would not be paid and other transactions of the Town would halt.inasfar as the position of Supervisor were concerned. 128 APRIL 7, 1981 128 A regular meeting of the Southold Town Board was held on Tuesday, April 7, 1981 at the Southold Town Hall, Main Road, Southotd, New York. SUPERVISOR PELL: Next meeting of the Town Board has been changed from what it says in the agenda. Today a couple of Board membeys brought up to me and I concur with them~that we have so much going on today we did not devote time to everything we have to in the amount of time. It happened to us two weeks ago when the Board met, so therefore we have called a meeting on April t4th, one week from today at 5:00 P.M. There will be a working session of the Town Board which will start at 1:00 in th~ afternoon. The official meeting will be at 5:0OP.M. at night. It will be in a meeting we are going to have at 4:00 o'clock with the Village of Greenport in studying the waste management problems we have and I think it will be brought up later on today under Councilmen Reports. SUPERVISOR PELL: Next we have a ~necial event~ We would like to honor some people tonight and I woul~ like to describe the event a little bit if t could. I think I have most of the details in it. Saturday, a week ago, two young people were out in ~ boat in a little lake down behind Kenneys Beach. The boat' caDsized and the two people of seven and nine year~ old went into the water. Two yonng boys who were visiting our township from Islip Township were in the ar'ea~ They went into approximately 37 degree termperature wazer and pulled .out the nine year old girl who is with us tonight. There she is right over there. The two young boys pulled her out, ran to a ho~se to call for aid. A gentleman was in his house taking care of his little child, left the child in the house, ran down, called the police. The police responded, the Sou~hold Fire Department Rescue Team came out with a man who is not here yet, and I hope he will be here, got on APRIL 7, 1981 ~ '~'~ the scene, Sergeant Droskoski. He's transporting blood right now is the reason he is not here. He was on the. scene with other folks and at that time made the tall to go out in the little boat and look for the missing young man. They went out, two people went out, and found this young man in eight feet of water, approximately twenty minutes submerged. The p~rents are here tonight. I talked to the £ather a little while ago and he said little Lance is slightly better than he was yesterday. Lance has a long ways to come but he is coming. After that the firemen took him to ELI, what is known as Eastern Long Island Hospital in Greenpo~t. He stayed there for several days and then they pu~ him up in St. Charles Hospital where he is now and the mother is here and she was up there today. These people all involved are here tonight with us and at this time the 129 Town Board would like to recognize alt of them, individually. Each Councilman will take a turn and I will present them with a resolution. Council, man~urdock .... O~ motion of.Councilman Murdock, seconded by Councilman Drum, WHEREAS, the sancity and value of human life is treasured and honored as a basic tenet of American life, and ~EREAS, it is in the highest pursuit and maintenance of th~ belief that a person should expend all his knowledge, ability and efforts toward that goal, even at the risk of his o%~ life and Welfare, and ~ WHEREAS, on the twenty-eighth day of March, nineteen hundred and eighty one, did exemplify the character, ability, knowledge, selflessness, courage and devotion necessary to meet the challenge in that he did without concern for his own safety, plunge into the frigid waters of Great Pond and rescue a drowning child and pull her to shore and then displayed the presence of mind to run to a nearby home to have additional aid summoned in order to rescue another child who had slipped beneath the waters, and WHEREAS, his efforts contributed to the saving of two lives and is a credit to himself and to his parents, NOW, TItEREFO.RE, BE' IT RESOLVED that the Town Board of the Town of Southold does hereby commend and thank him for his actions, and BE IT FURTHER RESOLVED that the Town Board of the Town of Southold does by this resolution desire that the knowledge of his acts be brought to the attention of the community so that the citizens thereof may be aware of the courage and service of this youth. On motion of Councilman Nickles, seconded-by Councilman Murphy, WHEREAS, the sanctity and Value of human-life is treasured and honored as a basic tenet of American life, and WHEREAS, it is in the highest pursuit and maintenance of that belief that a person should expend all his knowledge, ability and efforts toward that goal, even at the risk to his own life and welfare, and WHEREAS, on the twenty-eighth day of March, nineteen hundred and eighty one, ._CARLISLE "TY" COCHRAN JR. did exemplify the character, ability, knowledge, selflessness, courage and devotion necessary to meet the challenge in that he did enter a small boat' with another person and search fora child who had fallen off a boat and was under the water. Upon the child being found and brought to the surface, he brought the child into the boat and immediately initiated cario-pulmonary resusitation, keeping it up until reachi~ Shore. Once on shore he continued, along with others, to administer CPR, then entering the ambUlance to continue such administration until the arrival at the hospital. Without the oxygen and blood circulation provided by the CPR on a continuing basis there is no doubt that the chitd would have died, and WHEREAS, his timely and effective action, skill and determination resulted in the saving of the life of the child, NOW, THEREFORE,. BE IT RESOLVED that the Town Board of the Town of Southold does hereby ~ommend him for his actions and in doing so extends recognition nd appreciation for the dedication and services of all its volunteer firemen. (Carlisle Cochran, Jr. came forward and received his resolution and congratulations from the Town Board, Town C~erk, Town Attorney ~nd all others present.) ~ On motion of Councilman Murphy, seconded by Justice Doyen, WHEREAS, this nation was built.upon the spirit of cooperation and community service and the sanctity and value of human life, and WHEREAS, it is in that honorable tradition that our citizens devote their time and e£fort in community endeavors, and WHEREAS, the active membership in the volunteer firematic service of the community is of the highest order wherein the members thereof not only give of their time and labors but also place their lives and welfare in danger-for the benefit of their fellow citizens, and WHEREAS, such service was exemplified recently when a child who had been submerged beneath the water for twenty minutes was resusitated and restored to life by members, of the Fire Department and others, NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Southold.does hereby commend the SOUTHOLD FIRE DEPARTMENT and the. members thereof for their dedication and service to the people of the Southold Fire District, and in doing so states its respect, admiration and appreciationto zll the volunteer firemen of the Town of Southold. Councilman Murdock, WHEREAS, the sanctity and value of human life is treasured and honored as a basic tenet of American life, and WHEREAS, it is in the highest pursuit and maintenance of that belief that a person should expend all his knowledge, ability and efforts toward that goal, even at the risk to his own life and welfare, and WHEREAS, on the twenty~eighth day of March, nineteen hundred and eighty one, ~DWA~D J. BOYD 5~ did exemplify, the character, ability, knowledge, selflessness, courage and devotion necessary to meet the challenge in that he did immediately assist in the administration of cardio-pulmonary resusitation to z child who had fallen into the water and had been submerged for about twenty minutes. Although the child showed no discernible pulse or respiration, he did not cease in the efforts to save the child's life all the way to the hospital, thus contributing to continuing the flow of oxygen and bloo~ to the child's body, and the saving of the child's life, and WHEREAS, his timely action, skill and determination result~di"i~~' the saving of the life of the child, NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Southold does hereby commend him for his action-~nd in doing so extends recognition and appreciation for the dedication and service of all its volunteer firemen. On motion of Supervisor Pell, seconded by Councilman Drum, WHEREAS, the sanctity and value..of human life is treasured~and honored as a basic tenet of American'life, and WHEREAS, it is in the highest pursuit and maintenance of that belief that a person should expend all his knowledge, ability and efforts towards that goal, even at the risk to his own life and welfare, and WHEREAS, on the twenty-eightN day of March,1'/nineteen hundred and eighty one, ~OLICE OFFICER DENNIS B~NNON did exemplify the character, ability, knowledge, selflessness, ~ courage and devotion necessary to meet the challenge in that he display excellent judgment in using a small boat to enter upon the waters of Great Pond to institu%e ~ithout delay a search for a young child who had fallen into the water and gone under. Upon seeing the child submerged in eight feet of water, he did not hesitate to dive into the frigid pond and retrieve the child thereby permitting immediate resusitation efforts to commence. His quick action and proper response and his willingness to enter the water at risk to himself aided in the successful efforts to save the life of the child who had been submerged for about twenty minutes, and WHEREAS, his acts contributed to the saving of a life and are a tribute.to his devotion and skill as a police officer of the Town of Southold, NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Southold does hereby commend him for his actions and note its pride in the quality and dedication of his service to the Town of Southold. This resolution was declared duly adopted.- SUPERVISOR PELL: I would like to tell you all that the Town Board has authorized Dennis to have one extra personal day this year~ (Police Officer Dennis Bannon came forward and received .his resolution and congratulations of the Town Board, Town Clerk, Town Attorney and all others'present.) SUPERVISOR PELL: I'have two other things I would like to say while I'm standing here. The gentleman who made the judgment call on this whole affair, we did not single him out tonight. 132 APRIL 7, 198~ I asked him to stop in. I would like to recognize him at this time. Sergeant in charge of the operation who made the judgment call of the boat to go out, Sergeant Stanley Droskoski. (Sergeant Droskoski was applauded by the audience;) They say there is some good that comes out of everything and I think there is a lot of good that come out of the experience we just went through.. Last week I was asked to attend a meeting in the Cutchogue Fire House. The volunteer firemen throughout the Town were there, except Fishers Island and East Marion could not be there. They are going to form a volunteer, I'm going~to call it ",diver's team~' so they can be on call in each department. They have elected a chairman of this. The county 'will train them in Yaphank and Brookhaven and Cutchogue Fire House and I know there is a spokesman here for that firm or group of firemen who are going to do this. I will ask him'to get up 'and tell us basically what it is all about. Fred, where are you? Fred, come up here. MR. PETE NATHANSON: I'-m Assistant Chief, Orient Fire DeparTment, I have been appointed, volunteered and therefore appointed, coordinator of what I' think I'll call,..for lack of any other formal name, The North Fork Sc~b,~ ~¢scue Team. The firemen from the volunteer fire departments from Orient up to and including River- head. Not only the Town of Southold we are going on the North Fork. We started this initially aSout five months ago with a little coaxing from myself to Waiter ~ilet Who works for the Department of Agriculture. He is a retired New York City police diver. At the time we asked for volunteers and we 'kot a bunch of fellows together as a kind of side line for a little while and a couple of weeks ago we started again.on formalizing this and with the events of a week ago Saturday we're going full steam ahead on this now. We are going to be trained by an instructor from the Suffolk County · ~ ' S, a SCU~ Department of Fire Services ~nd Chief Gary Grave who is instructor. Ho~efull~ we're getting written ~ermission and okay to use Brookhaven Labs' pool, We'll be renting equipment temporarily during the training sessions and after that purchasing through the individual districts scuba equipment for each~man~ .... It's going to be working on the individual department basis initially with the call from the chief of that department for mutual aid from other departments to get the entire team together in case~an~emergency comes~along. Any suggestions from the Board, any help from the Board, any help from the Town itself towards this group would be greatly appreciated now and until whenever. But we are going full steam ahead on this, in fact our training s~arts on April 15th,~ is our first class. Thank you. POLICE SERGEANT STANLEY DROSKOSKI, JR.: I don't know what's been said before, but'I was proud to be a part of the bunch that were responsible for the young man being ali~ve. The guys did a hell of a nice job. SUPERVISOR PELL: Thank you, Stash. I'd like to add one thing to Dennis Bannon. Seems in the last week Dennis and I have crossed three times. Last Friday night I was trying to duck the press on an item they were after me on, so I told my wife, let's go out to eat. We went to Rosses Restaurant. We were sitting in the window. Dennis was there. Ail of a sudden my wife hears a crash. She looks outside and a~car that hit a car at Orient Point, side- swiped another car in front of Soundview Restaurant, went down Boisseau and hit another car there, but this time he couldn't get away and Car 805 comes up with~the lights on ~nd makes a lot of noise and.I look up and Dennis is jumping out of his car chasing somebody that ran down the road. They got him and brought him back. Saturday night was one of the few nights I'm home Without somewhere to go and I told my wife, about half past eight, let's t~ke a walk, We walked from my house up to what is called the fish dock.. It's about .eight tenths of a mile. On the way back down comes the police car again going into one of the yachts that's tied up along side the road there. I stopped to see who's--what's going on and out of the boat comes Officer~Bannon again..My wife says, that's three times in about a week. -Dennis, we're very very proud of your work. You're doing a fine job and the day off can no% ever express the desire of this Board to teI1 you you're doing . a fine job. At this time I will-call for a five minute recess. COUNCILMAN MURDOCK: As I told the Board this afternoon, we have had a proposal from the Energy Development Corporation relative To operating a municipal solid waste disposal system at our town landfill. We will discuss it further on the 14th of the month, at our next meeting. We also have a proposal t.hat we will look into on the 21st of the month from an engineering firm. Again relative to the disposal area and municipal so]~d w~.~t~_. As you know we will also have a report from the H2M. We a~e going to have ~ meeting relative to the sludge and the septic removal. .~ The work at the disposal areg is moving rapidly a~ong. Thank you, Bill. SUPERVISOR PELL: Councilman Drum. COUNCILMAN DRUM: Very briefly I had reported that some of our .dredminm pro~at~ we've gone forward to the County Executive and at present all the budget projects, major projects, are being held in the budget office and the outcome of the review of the budget due to cutbacks. It is hoped that we can get some of these essential dredging projects finished before the summer is upon us. We've also taken a close look at Goldsmith Inlet and perhaps we will move some of the spoil there, which will be done by a crane, dredge, dragline,~ I should say, and some of the spoil would be put down at Kenneys Beach to assist with that erosion. That's about it. SUPERVISOR PELL: Thank you. Councilman Nickles. COUNCILMAN NICKLES: .The P~.~ an~ Beach-Committee met on March 30th at 9:00 A.M. at the Highway Superintendent's Office. The purpose of this meeting was to discuss with Legislator Wehrenberg, who is Chairman of the Legislative Committee on Public Works, to discuss GQldsmith's I_nl¢~ ~hich you just heard Councilman Dru~ describe, and also to look at the erosion problem that is existing at Kenneys Beach on the Sound. The legislator had several suggestions that he's pursuing. In the meantime the Beach Committee is pursuing other avenues and we hope to meet with a gentleman from Sea Grant who's in charge of extension service, where they come out and give advisory information to towns or individuals concerning erosion on the waterfront. We hope to meet with him next Tuesday and as you heard earlier there is a Town Board me,ting that afternoon and if he comes up with some viable information I"m sure we'll have him meet with the Town Board either on the 14th or the following Town Board meeting on the 21st. Also, I have the report that~'I met with George Fisher, head of the B~il~ing ~aps.rtment and the~ Inspectors last week and I'm happy to report that they've designed 134 APRIL 7, 1981 a survey sheet for the Deputy Fire Inspectors to make surveys of pla'ces of assembly in the Town which basically,.by places of assem6iy, we're talking about restaurants and they hope to begin the survey process starting April t8th. I~think Chat concludes my report. Also, I might add on the Building Department and the Fire Inspectors, they will be sending out a letter to all the_ Places of assembly notifying them of the Deputy Fire Inspectors who will be coming by to conduct this survey. SUPERVISOR PELL: Thank you. Councilman Murphy. COUNCILMAN MURPHY: On the ~tr~ir,ightComm~ti¢~, I turned in a report for four different meetings last month and basically what is being done is a physical inventory i~ being taken of ail lights and trying ~o establish policy and set the guidelines and priorities for-the installation of 'lights. We are working on this. There is still quite a bit more work to be done~and we have also inspected various locations that are what we consider extremely dangerous and where lights should have been placed and we are asking that these lightsbe placed. JUSTICE DOYEN: We are getting very close at this time to finalizing a sen~or c~iizen progr~.~on Fishers Island and hope to be tied in to the program you have in Southold and in a month or two we should have it all together. COUNCILMAN MURDOCK: Yes, thank you, B~ll, I neglected to talk about the M~t~k I~ ~dv~ory Committee~ We hope to have a public information meeting here on the night of April 30th to discuss with the people in the Town the findings of the Suffolk County Planning Board who has been working with us and helpinglus!i0 get a survey of the entire problems inVolving'the Matt'~tuck:Inle~:~.:-i~- Will ~eal with the road runoff, causes of'pollution, some poSsib~!i~Commendations dealing with the entire area from County Road 48 wh~r~ the ToW~. Park District launching ramp is to the mouth of the :Inlet and-certainly anybody who's interested in the Mattituck Inlet and the preservation of our waterway is welcome 'and their input will be welcome and ~'m sure everybody would like to 'see a big'crowd~here that night, Thank you, Bill. SUPERVISOR PELL: Thank ~ou. I have two articles I would like to comment on. Both of them concern money. First of all, I received a check last.'night that was delivered to my house fromthe Southold Town B~v~en's Assoc~ation~. Every year the Town, for the last S~veral years, has taken a matching funds program with the federal government. It works through the state to bring in clams to help make clams in our township. Last year they gave us $500.00 towards this and again this year they came through with the same $500.00 check. This will enable'us to spend approximately $5,000.00 on this project. $2,000.00 of Town money, $500.00 of.Baymen~s money, matched by the federal government~ It is a program they feel very strong about because they give up their own fUnds to do this. The.other check is $100.00 donation to the Southold Town Youth Proiection Committee from some parents whose youth are involved in the rec center up on Peconic Lane. The parents donated $100.00 to the committee and we,will send them a thank you. II. PUBLIC NOTICES - COUNCILMAN NICKLES: 1. ~he first public notice is from the Department of the Army, New York District, ~orDs of Engineers regarding an application by the--t~e notice indicates'the Mattituck Park Commission. ~r. ~urDhy is a Mattituck Park Commissioner and ~0ints out the notice is in error, it is really the Mattituck Yacht Club. The work that they wish to do ~s to put a floating p~er)out ~nto Great Peconic Bay for the p~rpose of sailboats coming and ~oing. The response date on that is April 24th. 2. This is a notice from the CorDs of Engineers relative to the ice damage this year and how you go about getting a general permit for the redrivi-ng of spiles, lifting of docks, that type of thing. Any damage incurred and the instructions that you have to go through in order to get this general permit that will be given APRIL ?, 1981 135 both by the Department of Environmental Conservation and the Corps of Engineers. These permits are a special permit due to this ice damage and they will expire on June 30th, 1981. So if anybody has ice dama~ it would behoove them to get their permit and get the work done before this .special general Dermi~ runs out because if any of you are familiar with doing this work on the water,' it is quite a lengthy process to get a permit. Both of these notices are with the Town Clerk and you may examine them at your leisure during the week. III'. COILMUNICATIONS - SUPERVISOR PELL: 1. The first one is a resolution passed by the Village of Babylon concerning the pre-inspection of rental homes for social services recipients. 2. Letter addressed, and a copy sent to Southold Town Board, to Congressman Carney pertaining to a fishing boat that does fish out of Greenport at c~rtain times of the year, going aground at Montauk Point and being--the CoaSt Guard not coming out fast enough To save the boat. The three men did put on their survival suits that they have and had to swim ashore about a quarter of a mile. A copy6f the letter was sent to us. I' copied it and sent a note to Admiral Price, who's on Governors Island, who I happened to know through some Of my fishery committees that I serve on. Admiral Price's staff did call up and they are going to investigate the incident and make a report back to us on it. I will be with Admiral Price's captain of his staff tomorrow morning at a meeting on fishing matters and I will bring it up to his attention at that time again. 3. This is what I mentioned before when I stood down here, about the ~ operate throughout the North Fork, I said Southold Town~ It is going to be the North Fork. This group of firemen volunteers, and I will talk it over with the Police Committee. I know a couple of our police officers were at the meeting that. I did attend, with them and a couple of them would like to get involved also. You know, I want to digress here. I found something out from this. Comes up with articles that I heard abo~t the other night that people have been submerged as much as 45 minutes and have been brought back to normal life, in cold water. Something about the blood, when the water hits your face the blood will pump oxygen to your brain and your heart for a given time and if you are brought up, we have a doctor here who knows ~the best phraseology more than I do. But it was a Very worthwhile meeting that I attended in Cutchogue Fire House and it is a program, as I told the Town Board today. In the course of my life I think I pulled up anywhere from fourteen to fifteen, sixteen bodies out of the water and I know if some of these facts were known in those days, and I'm going back to 1954, '53 when I worked on a fishing boat, I know if some of those facts, if we had known them then, some of those people would be alive today. Some of them had only been in the water for five minutes or less when we pulled them out. That is why I am so enthused about this diving getting set and this little boy being saved. 4. One of our Town employees suggested that the Peconic Lane building we look into solar energy to heat that. Mr. Dean will be looking into it to see if that can be worked out. 5. Information on Town aid for safe drinking v, ater. If this is approved and sent for:t~h I think, Larry, you said our share will be $65,000.00? COUNCILMAN MURDOCK: Either $60,000.00 or $65,000.00, yes. SUPERVISOR PELL: That the Town will get.if it follows along. 6. A street light reeuest which~.is turned over to the Street Light Committee (.from Anton Jurkovich, 1675 Tuckers Lane, Southold). 7. Request for ~ixing a fence down at a boat launching ram~l (Ninnehaha Boulevard). I~m~not~sure the Town even owns it, We'll turn that over to the Departmen~..of Pubti¢ Works and look into it. IV. PUBL/CtLEARINGS. SUPERVISOR PELL: We had two public hearings at the last Town Board meeting and it is time to make a decision on them. RESOLUTIONS SUPERVISOR PELL: Number one was recommended by the Street Light Committee. Are you prepared to offer a resolution? COUNCILMAN MURPHY: Yes. I would like to make a statement first, Bill. At a meeting held on March-10th COuncilman John Nickles questioned the resolution I made, and it was a good question. What does it cost? I disagreed with John's question at the time because the actual figures were'available during the work session and it was not asked for. At the Town Board meeting the best the previous ~ .....-----~-airm~u, 'members and the three present Councilmen who served last year could come up with, was a guess at the cost and we ' knew that was not good enough. As I have stated, the only file turned over to me by the previous chairman in January had only a few old light requests that had not been acted upon. No cost factors, no policy, no report of Jim Homart, nothin~ until the last Town Board meeting when M r. Homan's report made its re-entry. I have taken the interest to start to develop a policy, take an inventory, set up priorities, etc., with .the great help and support of Henry Drum, Ray Dean and his department. Mr. Murdock, you challenged the Supervisor and took great offense, because he said he thought :- that Councilman Nickles' comment was political. You have since accused him of acting in bad faith and being politically motivated ~hen he appointed me to this Committee because we had some money to spend this year; When, in fact, Larry, if you and the members of the previous committee and Town Board had given more thought:;to the proper placement and size of lights, we might not have had to spend any money at ali this year and would not have a so called po'litical advantage. I question why the' main thoroughfares Of this Town are not yet adequately lighted when some small side streets look like, using your phrase Larry, an airport runway from the sky? I. queStion why some very serious curves, and inter- sections are not lighted yet when we are paying for over-powered lights on every pole in some towns, lights on long straight roads in open fields, when reflectors could have done a better job with no energy cost to the Town. Why have areas of high traffic fatalities still not been lighted? Larry, if you want to play politics, I don't. I care about Southold Town, not oolitics. I want this Board and this Co~nittee to work hard £o~ all the people of Southold Town and t intend to do just that. Depot Lane, Cutchogue, LILCO Pole 17. COUNCILMAN DRUM:'-Comment. SUPERVISOR PELL: Discussion. COUNCILMAN Drum: I thought--I'm a member of the Street Light Committee, and it was my understanding, ~' at least it was my thought that during the work session that we were going to'with- hold this resolution. I did not realize Frank, that you were going to Offer it at this time. I thought we were going to complete our inventory of all of the areas which some of these .... you'know you and I have not gone into--we looked at some of these. I mentioned this to you earlier, yesterday I believe, and I thought it was our understanding today, this afternoon, that w~ were going to hold and wait until we complete the whole package. '~ COUNCILMAN MURPHY: It wasn't my understanding. You asked me to hold a couple that you haven't seen. We've had this for two months and I would like the resolution to stand the way it is. COUNCILMAN MURDOCK: During the working session today I was given a list with the agenda of resolution dated April 7, 1981. I worked on that resolution over the weekend. I had questions pertaining to that resolution, the lights on that resolution. The resolution was changed during the working session. The committee chairman handed out another resolution. At that time I protested that it was unfair to give a member of the Board a list to peruse, to think about over the weekend and then change the list. Our discussion then centered around whether we should have another opportunity to go over this list and which resolution was the list that we were suppose to persue and act on. In the light of the fact 'that' I did not get this new resolution 'that Frank just wrote or jus~ read to the Board. In light of the fact that we did discuss this at the working session. We got into quite an involved discussion about how resolutions should be handled, through the Town Clerk and through the Supervisor, I am not prepared to vote on this resolution because I do not know of all the light poles and their location in reference to the resolution that I looked at. For example, on Main Road it goes from Hobson Drive and those poles are on the wrong side of the road, they're too far off the road and the street light would not really reflect on the road for safety. Now, I don't know, because these are different pole numbers again, which poles and which lights we're talking. I think it's unfair ~or the chairman of the committee to not give the rest of the~Board members ample oppdrtunity ~o inspect or look at the lights. There was one light, it happens to be Item No. 9 on both lists, the Knights.of ColumbUs--near Knights o~ Columbus Hall on Depot Lane. I was going .to recommend to the Chairman at 138 APRIL 7, 1981 that time that instead of installing a new pole, a new light, on pole no. 17, remove a pole--a light from a pole that is in front of a farm lot. We didn't get to that discussion because it was agreed that we would not act on this motion tonight. I would still like to see a light transferred as opposed to'putting a new light out. I would respectfully ask the Chairman, in light of all the.confusion, to withdraw his motion and put it on the next meeting of April the 14th as we had discussed, otherwise I'll have no alternative but to vote my conscience which would then be to vote no because I am not sure of these lights and the new resolution. SUPERVISOR PELL: Councilman Nickles? COUNCILMAN NICKLES: Thank you, Mr. Chairman. I respectfully request that at the last Town Board meeting when this same resolution or one very similar'to it was proposed, it was discussed at the work session, and the result-of the discussion was that any installation of street lights would be held until such time as the Holzmacher, McLendon report was completed and the survey of the Street Light Committee, consisting of Mr. Murphy and Mr. Drum, and a revaluation of the prior plan, master plan for street lights of ~his Town which consisted of three phases, be reviewed and brought up to date. To my knowledge, no street light'~rogram prior to within about ten days ago, was instituted by this committee and I respectfully sugges% also that at the time that I asked in the public session what the street lights cost that information wasn't available that evening, nor was it available that afternOon, because I'm sure if the cost were available in the afternoon and nobody asked the question, it still would have been available that evening. Therefore, since the Board should be working together, and we agreed that those things I just. enumerated would be completed, I call for this resolution to be tabled. COUNCILMAN DRUM: And I do feel, and I had mentioned Frank and I had discussed this and my thoughts were that in the interest of economy that we take a look at what we need and what.we have that we feel are surplus and at the time that we Submit~ur needs to the Board we submit those--a list of those lights which we have come up with a large number, be eliminated that are not needed, that are surplus. I felt that this was the proper approach. Of course, we do not have The fixtures at present as it is, ~Ut I too feel that I cannot approve this resoiu~ion as it ~s. ~ COUNCILMAN NICKLES: Do you second my motion to table? COUNCILMAN DRUM: I will second your motion to table. COUNCILMAN NICKI~S: If there is no further discussion, Mr. Chairman, would you please call the roll. SUPERVISOR PELL: Can I have my equal time? Street lights are an important thing to our Town. We have put three up in December, I think, it was, correct me if I am not ~igh~. Didn't we put three up in the month of December, I don't have the figures in front of me. COUNCILMAN DRUM: Whether they went up then, we approved them. SUPERVISOR PELL: We approved three to go up. We have been talking street lights since the last three months. We approved $15,000.00 in October, I believe it was, for acquisition of-new street light equipment to be used to give us mone_y to operate to put street lights where we felt-they were needed. There are nine requests on here, two are different from the original resolution that was presented two months ago or two weeks ago or three weeks ago. Two differences ou~ of the nine. I feel that we have talked about street lights for six months. Last fall when street lights came in I wrote letters out, last summer, we had no money to buy streets, we were out, we had to wait until. we got some money. The Town Board felt it important enough in October to put $15,000.00 towards this goal. As I said, we put three up and I feel it is time that we get moving forward with the street lights and I do not want to see any more delay in them and I will vote against the motion to table.~ Judy, call the rol~ on the motion to table the motion made for the street lights~ This is a motion to table it. COUNCILMAN NICKLES: I would just ask the Street Light Committee that if they should complete the studies as have been indicated at the last Town Board meeting, before they submit this street light request to the Town Board. I think we are all in agreement that street lights is an important item. One, they save energy and consider the safety aspect of it. Get our program squared away before we charge off and do these lights. SUPERVISOR PELL: .ResolUtion number 2, sand pit renewal of Leander Glover, Jr. The Town Board did spend a lot of time with this today and reviewed it with counsel and. I believe we are ready to act upon it. On motion of CoUncilman Murphy, seconded by Councilman Nickles, it was RESOLVED that the Town Board of the Town of Southold grant permission to the B~y ~a~t~ of America Peconic Bay District to ~ T~wn ~oads for a ~arade in connection with their ~on Saturday, ~May 2, 1981 at 12:00 Noon; provided said organization secures the necessary insurance to hold the Town of Southold harmless. This resolution was declared duly adopted. 139 140 APRIL ?, 1981 SUPERVISOR PELL: Number 4. The fee for a trailer permit for six months has been $5.00 in the Town of Southold since'1957; before zoning went in. That means instead of collecting taxes every six months the collector would have to work twelve months and we feel it would be a great hardship and money for the Town budget to have. We did oppose it once before but we want to oppose it again. We will do that on the 14th. 141 10. Nutrition Center, at a salary of $3.77 per hour, six hours per day, f~'ve days per week, effective Apri~ 9, 1981. SUPERVISOR PELL: CETA funds have been cut. The N~trition Program is going to have to be curtailed. We are going to have to evaluate it an'd perhaps make some cutNacks in it. W~ have one cook there, a Mr. Jerry King. He is a senior citizen, he is working there and he cannot work alone. Right now he has prepared about 150 meals per day. Mrs. McKeighan was before the Town Board today explaining her plight to us with the cutback in CETA, cutback in staff she had to go through and one thing the Board did-agree today was to give her an assistant cook. She will be back to the Town Board in two weeks and I and the Town Board will be working with her to see how we can have the program we have but realize we do have to make cuts and it might be curtailed the best way to work it. One of them mentioned today was using the Feeder Bus instead of the present bus tha{~icks-fh'~m"~p. -There are several areas we are going to look into, but with the prices in government and everybody trying to cut from the President right on down to the Town Board, we.have to evaluate certain programs and this is what we will do and Mrs. McKeighan will be back to reoort to us in two weeks. 16. APRIL 7, 1981 SUPERVISOR PELL: I am~,going tD~.~.~:~tatemept before I sav mv President of the United States is curtailing. He has asked every state, every municipality to curtail government. We are facing it with our Nutrition Program to curtail. If'a Constitutional Convention was formed, one member would have to serve from each Congressional District. We-have approximately 450 congressmen now, that means 450 people would have to serve. Two delegates from each state at large, fhat's 550 people getting involved. What support st~ff they would need, wha{ economics would be involved. I sympathize and agree with the people trying to get the Constitutional Convention. I believe there are other ways to seek your goal. As fiscal officer of this Town I cannot support a call to the Constitutional Convention with the unknown factor of the economy, the money it is going to cost and I think your goals Can be reached another way. I was asked by the newspapers last week regarding the appointment of our Supervisor, appointment of Mr. Frank Murphy and I consider Frank a close friend of mine and these comments are not directed towards Frank, but I felt that the SuDervisor's appointment of Frank ~rDhy as Deputy Supervisor, I felt that the Supervisor made a political appointment. t43 SUPERVISOR PELL: As I told Councilman Drum when he made this, I made the same remark two weeks~ago, if the shoe fits you wear it. In this case the shoe don't fit and I don't wear it and I don't disagree with you. Councilman Nickles? COUNCILMAN NICKLES: SUPERVISORPELL: COUNCILMAN DRUM: SUPERVISOR PELL: That is a ma~ter of judgment. My judgment, yes. You said you don't disagree with me. I do. I do. Correct the record. COUNCILMAN NICKLES: I don't have anything to say about the Deity Supervisor, although I was disappointed because Bill, as you read in the papers, has been working closely with the Board and over the past 15 months or so, whenever he gets in a room with a reporter or somebody from the public he always says, here's Henry Drum, my right hand man, here's John Nickles, my left hand man. I want to know what the hell happened we didn't get to be--one of us didn't ge~ to be Deputy Supervisor? COUNCILMAN MURPHY: He couldn't afford to lose you, John. COUNCILMAN NICKLES: And because I'm somewhat piqued, I offer a resolution that we take the Deputy Supervisor's car away from him and' banish it to Fishers Island. Fishers Island needs the car for our departments~when they go over there and we take what is called the Black Mercury or Horia or what- ever it is called, we are going to transfer it for the next month or tw~-over to Fishers Island so when our departments go over there, George, you asked me, there will be a car there for you to use. BETTY SCHLOSS: I have a group of listed names here of ....... ~ residents and interested persons from the Cedar Beach area who seriously request that you protect and preserve the natural salt marshland located at Cedar_.Deach Creek and Inlet. We appreciate this ecologically valuable marsh and environmentally beautiful wetland area and we strongly feel'encouraged by a plan for a complete marine life study to be conducted by marine scientists. We further request that you, the Board and the Suoervisor, act carefully and slowly and refrain from permitting the construction of any kind of jetty, breakwater or any other means to control or change the natural drift of beach sand and tidal activity by either the County, tSe Town of Southold or the Army Corps of Engineers.
