A special meeting of the Southold Town Board was held'on. Tuesday,
March 31, 1981 at the Southold Town Hall, Main Road, Southold,
New York. Supervisor Pell~opened the meeting at 8:30 A.M, with
the following present:
Supervisor William R. Pell, III
Councilman Henry W. Drum
Councilman John J. Nickles
Councilman Lawrence Murdock, Jr.
Councilman Francis J. Murphy

Supervisor Pell announced to the Board that effective March 31,
1981 he has relieved Marie Bauer Johnsop of her duties of'
Deputy Suoervisor.
Supervisor Pell aooointed Counci]m~.n Francis J. ~urphqv as
Deputy S~oerv~o~, Town of Southold, effective April 1, 1981.
CouncilmanMurdock stated that he wished it understood that
the sole purpose of the office of Deputy Supervisor is to
sign checks and serve in the absence of the Supervisor. He
feels thmt it would better serve the Town if the services
the Deputy supervisor are kept within the range cY those~
duties.
Supervisor Pell stated~that if he steps outside of the duties
prescribed in the Town Law Mr. Murdock.should feel free ~to
challange him on it.
Councilman Murdock said he does not agree with the original
resolution creating the position of Deputy Supervisor "for- ,~
............. ~_~epurpose of signing checks, etc". He was going to make
a move to disban the ofiice of DePuty Supervisor because of the
phraseology which should not be allowed in a Town resolutfon.
He restated that the office of Deputy Supervisor was created
for the purpose of signing checks and~acting in the absence of
the Supervisor.
The Board met with .Greenport Village Mayor George Hubbard to
discuss the-~~ which is still owed the. Village. Mayor
Hubbard would like the loan to be repaid as soon as possible.
He cannot take $10,000.00 and charge the other $~0~000~00 to the
police radio contract which the Village owes the Town, as he has
shown the $20,000.00 as income in his budget. He wili pay the
$10,000.00 for the police radio contract at the beginning of their
fiscal ~ear which is June 1, 1981. It was agreed that the Board
would adopt the amended Federal Revenue Sharing budget on-April
7th, pay. the Village $10,000.00, and Supervisor ?ell will review
the budget to determine where he can find the additional $10 000.00
This was agreeable to Mayor Hubbard. ' '

The Board met with Char~e~ Graves who presented a status
report on CSE~ negotiations and ~d negotiations.
Chief Cataldo met with the Board to discuss the imoact,
on the Town o£ Southold, of the 7th Eq~d being disbanded
effective March 31, t981-

Special Meeting reconvened at 11:15 A.M.
On motion of Supervisor Pell, seconded by Councilman Murdock, it was.
RESOLVED that the Town Board of the Town of Southold transfer.
for January, February, March, and a bill to Harrows for equip-
~ment in the amount of $299.00. ~
Vote of the Town Board: Ayes: Councilman Murphy, Councilman
MUrdock, Councilman. Nickles, Councilman Drum~ Supervisor PelI.
This resolution was declared duly adopted.
On motion of Supervisor Pell, seconded ~y Councilman Nickles, i% was
RESOLVED that the Town Board of. the Tow~ of Southold hire _Patrici~
J~hn~on as a.part-time Radio Ooerato~ at $5.00 per hour;~f~tive
April 1, 1981.
Vote of the Town Board: Ayes: Councilman Murphy, Councilman
Murdock, Councilman Nick~es, Councilman Drum, Supervisor~Pell.
This resolution was declared duly adopted.
Councilman Murdock discussed the need for the services of Jac~
,~ at the New Suffolk Beach~sometime in mid April. He was
advised to tell Mr. Lake to keep a watch on the traffic at the
beach and contact Supervisor Pell or Councilman Murdock for
permission to start work. ~
Moved by Councilman Murphy, seconded by Councilman Nickl~es,
WHEREAS, the Town Board, as lead agency, herel
that the reconstructiqn of~Mud Creek, t creek
· Bridges by-the Suffolk County Department o~ was
mental Statement (DEIS), and
WHEREAS, the applicant thereafter prepared and filedJa DEIS
and notice of its completion has been prepared, filed, circulated,
~osted and published pursuant to Chapter 44 0f the Town Code (Code)
nd Article 8 of the Environmental Conservation Law, and rUles
(ECL), and ~ ~
WHEREAS, the~ circulation, posting and publication of the notice
of the completion o£ the DEIS~has not resulted in Such public
response~s to necessitate a public hearing to aid the Board in
making its determination., and
WHEREAS, the Board has reviewed the contents of the DEIS,
NOW, THEREFORE, it is hereby determined that:
~ (a) A public hearing on the DEIS will not be held.
(b) The action proposed by the applicant in the reconstruction
of bridges at Mud Creek, Downs Creek and West Creek, in the manner
set forth in the DEIS will not have a significant effect on the
environment.
(c) No final environmental impact statement need be '
prepared.
(d) The proposed action may be processed withoUt'further ~
regard to the-Code and ECL.
Vote of the Town Board:: ~Ayes: Councilman Murphy, Councilman
Murdock, Councilman Nickles, Councilman Drum,' Supervisor Pell.
This ~esolution Was declared duly adopted.
On motion of Supervisor Pell, seconded by Councilman Murdock, it was
RESOLVED that Councilman Lawrence Murdock, Jr. and Councilman Francis
J. Murphy be and they hereby are granted permission to attend
Workshop on Resource Recovery Procurement and ~inanciug sponsored
by the New York State Department of Environmental Conservation
Division of ~olid Waste in coopel~ation with Blyth Eastman Pain~
Webber. Inc. on May 4, 1981 at Westbury, New York, and the work-
sh~P fee for each individual and necessary expenses fo~ travel
be a legal charge against the Town of Southold.

This resolution was declared, duly adopted.

.The Board discussed their recent resolution_ authorizing the Town
Clerk to advertise for bids for two ~ax receipting machines for
the Receiver of Taxes. It'has been determined that there are
not sufficient funds in the equipment budget of the Receiver of
Taxes, therefore the resolution should be withdrawn.until'such
time as the funds are available.
On motion of Supervisor Pell, seconded by Councilman Murphy, it was
RESOLVED that the Town Board of the Town of SouIhold RESCIND the
following resolUtion which was adopted on FebrUary 10, 1981~
"RESOLVED that the Town Clerk be and she hereby is
authorized to~.advertise for bids for the purchase
of two new Olivetti Receiotin~ Machine~ for the
Receiver of Taxe~, trading in the two existing
receipting machines in the Office of the Receiver
of Taxes."
Vote o~f the Town Board: Ayes: Councilman Murphy~ Councilman
Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell.
This-resolution was declared duly adopted.
Councilman Murdock asked that the Board consider hiring a
grantsmanship person.
Councilman Drum advised the Board that Lawrence Tuthill has
filed an application with Suffolk County for a~ deed
to some of the bottom land of School Ho~e Creek. He recommended
that the Town request the County to withhold dredging which is
planned at School House Creek until a determination is made as to
what bottom land is owned by the Town and if any is owned by Mr.
Tuthill.
Councilman Nickles reported on his meeting with Legislator John
C. Wehrenberg, Highwa~Superintendent~Dean, Councilman Murphy
and Legislative Aide Scott Harris concerning erosion at
.~ Legislator Wehrenberg is going to look into the possibility
of putting in Iow profile groins or jacks ~nto the beach every
two hundred feet beginning at Kennys Beach all the way past_
McCabes Beach. Mr. Harris questioned putting groins in stat~
waters in front of private beaches. :This~will be discussed
further at the April 7th meeting. Legislator Wehrenberg also
expressed an interest in Goldsmiths Inlet and is going to see
about reviving the permit to open the inlet. Councilman Drum
is going to look into ~his, as it is the general feeling of
the Board that Goldsmiths Inlet be opened just for tidal flow;
nothing extensive as Legislator Wehrenberg suggests.
On motion of Supervisor Pell, seconded by Councilman Nickles, it was
RESOLVED that there being no further business to come before this
Town Board meeting adjournment be called at 12:05 P.M.
