Ward of Ward Associates, ~.C., who is working on a recreation and parks pro,ram grant for the Town, met with the Board to discuss their progress. Mr. Ward stated that they will do one half of the project by making an inventory of all recreation areas in the Town and make a recou~endation tolthe Town Board. A grant application will not be made at this time. 9:15 A.M. - The Board audited the outstanding bills. 10:15 A.M. - Began reviewing the sgenda~ 10:35, A.M. - Mr. William Price of McMann-Price Insurance Agency met with the Board to discuss whether police assault and battery insurance is covered under the basic policy issued by Utica Mutual pertaining to bodily injuryJ If there is coverage under Utica in this area, the Sheriff's policy, which costs the Town approximately $8,200.00 per year, could be dropped.--Mr. Price left the meeting and checked with Utica Mutual by telephone. He was~informed by Utica Mutual that assault and b~ttery is covered under the bodi'ly injury clause of their policy. propose to join forces to initiate a petition to the New York state Public Service Commission. There will be a resolution on the evening agenda concerning Southold Town's part in this action. The use of the Senior/Youth Center was also discussed by Supervisor Pel!. 11:20 A.M. - Chief Carl Cataldo met with the Board to discuss his February, 1981 monthly report, hiring of matrons for the Police Department, the cost to refurbish a boat and motor which have become property of the Town and'could be used by the Bay Constable, and a letter from the Department of Civil Service inquiring ~s to whether the Town would like their police officers to take a sergeant's.test. The Board decided to reply in the affirmative in that respect. 11:40 A.M. - Mr. James NcMahon, Director of Southold Town's Delineuency Diversion and Prevention Program. met with the Board to distuss grants- manship seminars'which he is interested in attending. The Crimina~l Justice Coordinating Council, Riverhead~ has reviwed the budget for the DD&PP grant and put in an additional $900.00 to cover a seminar, but asks that the Town pick up an additional $375.00, if needed, to cover the expenses.of a 5 day seminar. The Board .agreed.to such a proposal and'placed a resolution on the evening agenda. 12:00 Noon - Recess for lunch~ 1:30 P.M.- The Board resumed reviewing.the agenda. * * * EXECUTIVE 8ESS ION 3:15 P.M. - Discussion o~ personnel and possible land acquisition. Doyen SUPERVISOR PELL: we are going to jump Out' of order tonight for a minute, if we can, while the two girls are here. This is Girl Scout Week and Sunday up at the rec center on Peconic Lane, the entire Southold Town Girl Scouts and Brownie Troops put a program on. They were joined by Shelter Island Girl Scouts and there were close to 400 people there, adults .and girls. It was very well done, 'the theme was International Week and each scout troop did a little act or sang a song in French~ Spanish or Spanish dance. It was very welt done'and I want to congratulate the girls and their leaders who are here with us tonight. Mrs. Carol Bauman and Mrs. Conte who did a very good job up there. We have a proclamation which I will ask Councilman Nickles to read, then we will present it to the girls. V-1. Moved by Supervisor. COUNCILMAN MURDOCK:~' We ha~ea report--a study done by the League of Women Voters of Riverhead-Southold on a Five To~rn East End.So~id~ Waste Management Study which was prepared by Holzmacher, McLendon, and it in general is not really in agreement with the recommendation of Holzmacher, McLendon. They would like to see a little more effort at recycling and source separation,.but the major thrust being that the Holzmacher, McLendon suggestion is'much too expensive for the type of service and wha% the Town would get out of it. They recommend that we look for an alternative alternative and they suggest a few things of their own. Of' course, the Town Board would have tO consider them before they would adopt anything. SUPERVISOR PELL: These reports, are all placed on file in the Town Clerk's Office. Anybody who wishes to review them can go there to review them. 2. On the Councilmen's reports, I will ask the Councilmen if any of them care to make any reports on any committees? Larry, I'll start with you. COUNCILNANMURDOCK: I would make a comment, Bill, about, tb~meeting that You and also'the Board attended with County Execut'i~e iC~halan and his aide Mr. Brotherton and had to do with the'Tth'~'~&ua~ and the problems arising therefrom and'I'know we'haven't sa~ group about it, we were busier today, maybe, but I for~one was ~ry pleased with the meeting, the tone of the meeting. It has been my position since we started this discussion back in April that it~is covered in the County Charter that detective service shall be available to the-five.towns as an all-county expense. Mr. Brotherton is the first person that I have heard Come up'with a definitive discussion about the 7th Squad and what has evolved in the type of service the 7th S~uad has been providing. If you recall, Mr. Brotherton quoted to us the intent of the County Char~er and told us that it was and is and will be the purpose of the'county to provide detective service in the terms of the specialized fields- murder, arson, and it was his opinion that the 7th Squad had evdlved into a squad that was used more for general detective work in aid and assistance to the five east end towns'and I agree with him wholeheartedly that. that was not the intent of the charter and while I can appreciate very fully the help that the county has given us it is really not the intent of the County Charter the way the 7th Squad is constituted today and I think you and'the four of us that were there feel very fortunate that the County Executive is not in the mood.to just'lop everything off and stop all the services and leave us hanging in mid air~ This use of the 7th Squad has evolved over the last ten or twelve'years and-all of the towns have availed themselves of the servic~S~ withOut'-ma~in~provision on our own and I think it is the intent of our Town Board to rectify the way we handle our own police services and handle our own day to day detective work and as I say I was very pleased that Mr. Brotherton had made this .assessment and his explaining it in a way that I hope will out to rest all the hard feelings. There's a lot of talk about the cas% is paying too little-and.the west is going to'do away with it, that they are going to saddle'us with the whole 450 detectives that the six precincts have, because it has been my feeling alt along that neither the legis- lators~ as individuals, nor the County Executive's Office as-individuals really bears any ill feeling towards the east end and Mr. Brotherton, to me, delineated all of the problems and the cause of the problems. The effective course has to be very siraPly that the east end to~ns must get more active and take care of their own in-town problems and I think we all will address that. I was very very pleased with Mr. Brotherton's attitude and, of course, he deeply reflects the attitude of our County Executive and I think in a matter of due time all of our little differences:,.are going to be resolved very amicably. MARCH 10, 1981 SUPEi~VISOR PELL: ny ~ther re COUNCILMAN MURDOCK: Not now, thank you. SUPERVISOR PELL: COuncilman Drum? COUNCILMAN DRUM: I might say while Larry was speaking on the 7th Squad and in relatibn to the meeting with the. County ExecUtive and his Deputy Mr~ Brotherton, the County Executive could'give us no guarantee that the Legislature would approve of the Dian whereby we would actually pay for the services receivin~this year through taxe~ next year, which woutd~be the ideal way. We currently are using the 7th Squa4. It is my opinion and my feeling and I feel very Strongly that wes~eutd phase out the 7th Squad and thereby giving our Police Department, our own Police Department advancement opportunity. We have stagnation at the top at present, but this would mean we would have our detectives or some of our senior policemen becoming plain clothesmen 'or detectives. Where we would replace them would be with the youth coming in, and~I feel this is the way we should definitely go~ Now, how we pay for this cost is something that we haven't decided, and as Larry'brought out, and I bring out, Mr. Cohalan can give us no guarantee that'that would be the ideal way to pay for what we are receiving in services this year through taxes next year. SUPERVISOR PELL: Any other report, Hank? COUNCILMAN DRUM: We did discuss kCedar Beach to a certain extent concerning the dreding and considering putting jetties ouT. I mfght say there is a-- the Legislature has before it a motion whereby they appropriate $35,000.00 and they have discussed it today,. $35,000.00 for the dredging of Cedar Beach. SUPERVISOR PELL: You are going to bring that up again next~ Town Board meeting, right? The 24th that wilt be on the agenda in resolution form. Councilman Nickles? COUNCILMAN NICKLES: I'd just like to add to that on this meeting with Mr. Cohalan and Mr. Brotherton, that the Town does have this situation where we can enter into a contract for the services of the th S~_k~this year for approximately $25,000.00 to $27,000.00~and t would like the record to reflect and the people to be aware Of-- the Town Board did inquire as to how many y~ars~'they would provide the service at this fee because I am sure everybody on. the Town Board is aware, and the people might not be aware, for that fee it is far less than to hire one patrolman. So, as Mr. Drum-stated, I think The Town Board or. the Police Committee is certainly going to make the final recommendation to the Town Board. It is our feelings we are leaning to the direction of going on our own. We are investigat~ing tke avenue of continuing with the 7th Squad and certainly at $25,000.00 or $27,000.00 a year we would not produce the number of men that they provide us. But the County Executive made it quite clear that this is a one year offer. I think we started out sometime in December or January at $871,000.00 as a cost to the five east end towns and miraculously that .has come down to $171,000.00, so I think we are at a point now where we probably cannot procrastinate .too much longer and are probably going to move ahead' with entering'~into some kind of agreement with the COunty relative to the 7th Squad. ' SUPERVISOR PELL: Thank you. Councilman ~rphy? Something besides the 7th Squad, maybe? ~ .~ . COUNCILMAN MURPHY: I think we better get off that subject. Last night we had a meeting here of the Ferry Advisory Commission and it was a public forum where people came to present input into the State. We had Austin Emory here who is the Regional Director of the Department of Transportation and Mr, Wilson Campbell who is the Director of Planning for the State DOT. We had about 75 people that spoke. They were people who were interested in the environment; they were people who were inter- ested in tourism, restaurant trade, horticultural industry, florists, nursery, vegetable farmers, farmers and there was a tremendous amount of input given to the Department of Transportation. It w~s one of their better hearings. They appreciated coming out here and hearing from the people on the type of service that we do have, what it's like, are there needs for improving, should we improve, should new. service be ad~pted and all~ Very good input and I think it will held this area, the whole east end economically. It think it will be a great 88 MARCH 10, 1981 benefit for us and it looks very good. The final meeting of this commission is Thursday and reports will be going up to the two governors of the State of Connecticut and New York. Thank you. SUPERVISORPELL: Depnty Supervisor Marie Johnson? Anything but the 7th Squad. . 13. '.'DEPUTY SUPERVISOR JOHNSON: The County Legislature's Heat~h Committe~ which met last Friday. The greater part of the meeting was devoted to problems of families .in Yaphank who's wells have been found to have carcinogens ~which came from the County Public Works Department lab0~at0ryl The County is probably aping to have to pay to bring the County' water:into the homes but the families will be burdened with paying, for'their water from~then~on. There was a great deal of discussion about what other towns are doing to locate and deal with those business and industries which dispose of polluting materials into the ground and therefore down into our ground water. There's a great deal to be done to improve the procedures here. Most towns in the County do have seem to begun programs to map these offenders but this is in kind of the beginning stage and I think perhaps~Southold should get in to it. Our own ground water situation, whether we realize it or not, is just about the most fragile in all of Suffolk County. We're in a worse position for finding water when our shallow aquifer becomes polluted, than any other town in the County. It was reported that an alarming number of people and businesses are mixing waste oils with their number two oil and burning it and this is creating considerable air pollution which the CoUnty has no mea~s of:detecting or check on. However, it is probably going to be helped somewhat with a laboratory van which is going to be fitied out for the County Health Department and will' be used to detect air pollution. It's in the current Capital BUdget and will probably be coming into use very :shortly. Thank you. SUPERVISOR PELL: 'Thank you, Marie. The Supervisor's Report, number 14. The Supervisor has been at many meetings and there are many things going on and I was to go into each one we would be here all night long. I will tell you just one real short one. The Town, books are bein. ~ . g'audited by'NeW, , York State. .. This is the'first time in six or seven years it has been done. This gentleman Will be here fdr four months auditing the Town records. If I don't~end up in jail I feel I done a good job. This is a_four months audit. JuSt for the information sake of the girls, we are going to go through this rather.quickly', a lot of this. We started at 9:00 o'ctock today and every one of these line items you see in your agenda we discussed during the day time so if we move along a little rapidly, we d-id discuss and give each item a lot of time during the daytime. II. PUBLIC NOTICES'- COUNCILMAN NICKLES: We have nine public notices tonight as you can see on your agenda. They are all on fite with the Town Clerk. You will notice that on each item you are allowed to make commenis to the respective agencies that are handling the application on the date by when you must respond. All these are pretty much the-same. They involve piers, ramps~ floating docks. 1. I'll let the Supervisor explain that as he is a little bit more familiar with it than I am. SUPERVISOR PELL: Number 7 is the Winterization O~eatherization) Program in Southold Town. If you qualify for it, if your income is below a certain amount, I have it back on my desk, you can get up to$1,000.00 to winterize your home, such as insulation, storm windows, storm door, anything for your home. The Village of Greenport has received $112,000.00 to do this to help people out. If you qualify. There are certain stipulations. They anticipate they will use'half of that amount of money, the other half they have received permission to use.in Southold Town's jurisdiction and the Village of G~eenport has agreed to administer the program. I have the qualifications on my desk if anybody cares to look at them. COUNCILMAN NICKLES: 8. Letter to the Supervisor and Town Board inviting-them to a meeting at 8:00 P.M., March 19. 1981 here at the Town Hall. This letter indicates that Mr..Obenkuer, of of our DEC officers will present a talk and slide show on his responsibilities.and what-the public can do to assist the Department. However~ Mrs. Oliva, who is the President (North Fork Environmental Council, Inc.) was present at our work session today and it is really a bit more involved than that. As she explained to the Town Board 'today, it's not so much what the public can do to assist the Department, but-really what the Department can do to assist.the public. In Other words,~ if you have any intentions of putting in a bulkhead or jetty or dock you might start with them to get their input before you get i~voIved_with a contractor who' might tell you you need 150 foot jetty, whereas the DEC might get you off on the right foot. So there will be three people from the DEC present at this meeting and the public is~invited. 9. Again an open pile pier and floating dock and I don't think there is any.need to go into that anv further. Thank you. On number 4 which was the application of Mr. Carl Boos. This is the brother of the man that has the marina on ~roadwaters Cove. This brother's home is just a private dock, not a marina, in Cutchogue. Unless somebody comes down and tries to rent dock space. This is just for a private dock. III. COMMUNICATIONS - SUPERVISOR PELL: 1. From Mary Fiedter pertaining to Founders Beach and Park.' She has a lot of good ideas and-she did suggest to-me one time about a separation recycling plant in New B~unswick, Maine. We have wrote for information and it has not come back yet. 2. Resolution from the Riverhead Town Board opposing the~ 24 hour sale of liquor. The Town Board has instructed me to. write a letter opposing thi~-[~, even though the governor-has Said h~ · s gomng to veto it if it came to his desk. 3. A letter from BrookhaVen Town SuperVisor to our County Exec requesting £ina~cial aid to help solve the water problem; drinking water problems they have. If this was to be adopted, Southold Town would receive $60,000.00~ 4. From Mr. Brush in reference to the asphalt tanks in Mattituck to the'~.'Town!-Board. 5. This is a County resolution trying to be introduced to have pre-inspections of rental homes that are going to be rented to welfare recipients. It's a resolution~before the CoUnty Legislature in it's committee. They have not come out of committee yet. 90 MARCH 10, 198I 6. From Suffolk Community D~veloDment C~rporation reference what we call Section 8 Housing Program. The Town migh~ have ~o get involved with this slightly to a very limited number because of the federal block grant that we nave.received through the County of ' ' $220,000.00. 7. Again a letter from Babylon.supporting the pre-insoection of welfare homes. 8. Something that affects all.of us in the Town, throughout the State. The Association of Towns have recommended against a certain proposal when we were in Ne~ York. Now they ask us to write to our Congressman and our Senators asking them to vote against the proposed ruling that would take the interest from the banks. In regards to the interes~ that the banks, make on money and it would affect our Town because-we wouldn't get the interest money. We will send a letter out on that one. (IRS Rulihg 8055). 9. Request from our County Executive asking each of the ten toes in Suffolk to apprise him of the extent of damage done to our piers and docks because of the ice this past winter and see if he should ask for federal disaster area. Your Town Board, each of us, reviewed our own areas and it is our view perhaps you can say, that we do not consider Southold Town to be in a critical stage to ask for disaster relief. I will so inform the County Exec. IV. HEARINGS AND DECISIONS" SUPERVISOR PELL: There are no hearings or ~cisions. We move to resolutions. V. RESOLUTIONS 1. On motion of Councilman Nickles, seconded by Councilman Murphy, it was RESOLVED that pursuant to Article'8 of the Environmental Conservation Law State EnVironmental Quality Review and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the Code~of the Town of Southold, notice is hereby given that the Southold Town Board, as lead'agenCy ~or the action described below, has determined that the project, which is unlisted, will not have a significant effect on the ~envi,ronment. DESCRIPTION OF ACTION Application of Enconsultants, Inc. for Eugene Bolter for a wet- land permit. Permission is requested to construct a ti~6er dock consisting of a 14 ft. by 14 ft. deck, 60 ft. by 4 ft. fixed catwalk, 12 ft. by 4 ft. hinged ramp, and 16 ft. by 6 ft. float plus associated pilings at north side of Broadwaters Road on Broadwaters Cove, Nassau Point, Cutchogue, New York. The project has been determined not to have a significant effect on the~environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effect to the environment are likely to occur should the p.roject be'implemented'as planned. Because there has been no response in the allotted time from the New York State Department of Environmental Conservation, it is assumed that there is no objection nor comments by that agency. SUPERVISOR PELL: Number 2 we already did at the beginning of the' program. We move ahead to Number 3 to declare the month of March as'American Red Cross month in. their t00th year. 3. Moved by Supervisor Pell, seconded by Councilman Drum, WHEREAS, the Board of Directors of the American Red CroSs have designated the month of March as American Red Cross month t,o honor those men and women for their-professional achievements and humanitarian work; and WHEREAS, the Suffolk' County Chapter of the American Red Cross gives notice to the residents of Southold Town that the American Red Cross is honored this month, for they have indeed made an important everlasting contribution toward the betterment of all people; a~d WHEREAS, the American Red Cross is deeply committed to serving mankind and is attempting to expand.its services to all factions of this.Town, now, therefore, be it that the Town Board of the Town of Southold does here~y aim March 1981 as Southold Town American Red Cross Mont~ and he'American Red Cross Centennial Celebration Year and urge alt citizens to join in s~pport of our Red Cross with money, blood donations and-volunteer service. Two weeks ago the ten town supervisors met in Northport, of the county. One person came a little bit late. He was up with the county exec in Nassau Ccunty meeting with County Exec Purcell up there. The two county execs are asking all the towns in their county to join with them in forming a group to fight the .~¢lephon~ company's new rate increase. The County of Nassau will spearhead this. 'They have asked all Of us when we pay our phone bilks of the municipalities to write "paid under protest" on them. At this time I will offer a resolution to join with Suffolk County and Nassau to fight the telephone rate increase and at no cost to the Town at this time. 16. They're talking of the soft detergents, biodegradable as acceptable. Until this is proven, let's keep the ban on. I'm not saying that these 24 lights aren't justified, but I think to justify them we at least should know what the Town is going to pay in'terms of installation, in terms of the annual energy costs pole rentals and so forth. We live down on Indian Neck and use the ~acilities of the small boat ramo and beach at the end on Indian Neck~ I was just wondering what was possible there. I read something to the effect that the Town was in the process.of adopting some type of codes as far as town beaches are concerned. I don't know what the status.of that code is and if something like that is adopted on beaches , how residents who live or border on a ~ark district or something that would be similar to a park district, if possible to get a town ordinance for that park district. COI/NCILMAN MURPHY: It's up to the individual park district, if they want to incorporate the Town rules and.regulations as their .... a park district is like a- private owner. I'm involved in Mat%i.tuck Park District for years. You're the same as a private owner of property. If you want to have the rules and regulations that the Town adopted, the park district themselves has to vote on it and it's very easy to do. Then everybody---and I strongly recommend it; because then every- b~dy will have the same rules and regulations-and make it a heck of a lot easier for the police if they are called out on occasion to enforce the law. COUNCILMAN DRUM: I think that's a Town ramp. MR. BAUMAN: I was wondering. SUPERVISOR PELL: That's a Town area. MR. BAUMAN: ~What is it, a park or a:Town Or what? SUPERVISOR PELL: Town ramp.
