No. 5465 - FR. JOHN MCGUIRE Property Location: 3630 North Sea Drive, Orient; Parcel 15-1-1. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 29,626+- sq. ft. parcel has 110 ft. frontage along the north side of North Sea Drive in Southold. The property is improved with a single-family, two-story frame dwelling as shown on the October 31, 1979 survey prepared by Roderick VanTuyl, P.C. BASIS OF APPLICATION: Building Department's November 17, 2003 Notice of Disapproval, amended November 21, 2003, citing Sections 100-242A and 100-244 in its denial of a building permit application concerning additions and alterations proposed at less than 15 feet on one side and less than a total of 35 feet for both side yards. The applicant has submitted a former survey and site plan information to indicate the setback from the top of the bluff at 65 feet. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on January 22, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct a second-floor addition over the existing westerly one-story section of the house. The proposed setback reduction area involves 3 feet on the west side, at the same 12 ft, side setback, and a 4 ft. reduction on the total of both side yards, to ft same 31 ft. total. No reduction on the bluff side of the house is requested, and the applicant proposes the addition to remain within the existing building line of the house in order to provide for a handicap bathroom and bedroom. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the relief requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant's house is one of the few single- 4`t Page 2-February 12, 2004 Appl. No. 5465—Fr. John Maguire CTM 1000-15-1-1 story houses left among the larger two-story houses in the neighborhood along North Sea Drive. The existing side yard setback of 12 feet on the west side of the house will remain the same, as well as the existing total side yards, unchanged, at 31 feet. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance. This particular lot is narrow and long, which leaves the side yards with little room for expansion, leaving the most feasible design over the first story of the existing house. 3. The requested area variances are minimal, resulting in 11.4% reduction from the total side yards, and 20% reduction on the single side setback. The addition, as applied for, is not proposed to extend closer toward the bluff than the existing dwelling. 4. The difficulty was self-created when the property was purchased with the knowledge of tight side yard tolerance 5. There is no evidence that the grant of the relief will have an adverse effect or impact on physical or environmental conditions in the neighborhood or district. The area slopes slightly slopes away from the bluff toward the house, and overland water flow is directed away from the bluff. The applicant will be installing gutters with down spouts and drywells to properly contain water and to reduce any threat of erosion on the bluff or flooding around the house. 6. Grant of the side yard setback relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Orlando, seconded by Chairwoman Oliva, and duly carried, to GRANT the variances as applied for, as shown on the site plan (received and stamped December 2, 2003), and elevation drawing prepared by Jeffery T. Butler, P.E. November 3, 2003, SUBJECT TO THE FOLLOWING: Installation of gutters with down spouts and drywells to properly contain water and to reduce any threat of erosion on the bluff or flooding around the house.
