Dear Mrs. Neville,
The recommendations proposed by the Cromer Consulting Group in the above-noted
Study, have been reviewed and discussed by the Planning Board. Collectively we
offer the following observations.
The underlying premise of this Study is to preserve the bypass capability of the CR
48 divided highway. Doing so will prevem the commercial retail sprawl that
characterizes every Long Island town to our west. More specifically, the overall
purpose is to avoid repeating the mistakes made elsewhere on western Long Island,
where unchecked commercial retail development not only resulted in serious traffic
congestion problems, but played a role in the demise of the economic vitality of
downtown districts located on State Route 25.
This community's Vision, as stated in many documents and public meetings some
going back to the mid-1980s (prior to the adoption of the 1989 Zoning Map), is to
preserve the small-town qualities that distinguish Southold. In order to achieve this
goal, it is critically important to consolidate future retail business growth around the
existing business centers within each hamlet.
Furthermore, reducing the potential for retail and other traffic-generating uses to be
introduced (or expanded) will have other long-term benefits to the community. First,
it will ensure a bypass road for through traffic, thereby relieving some congestion on
SR 25. Second, k will boost the economic development potential of the existing and
potential business properties bordering SR 25, where most of the Town's traditional
hamlets are centered Third, it will preserve a scenic corridor that is a source of
pleasure to residents and tourists
Therefore, we support the overall study recommendations as proposed. In
recommending their adoption, we recognize there may be reservations about specific

proposed rezonings and that alternate rezoning proposals may be under consideration.
We urge extreme caution in mod~fym,, the consultant s recommendations lest the

Subject: Zoning District changes in the town of Southold
We, the directors of Brower's Woods Association, representing the interests of more than
80 households of the Brower's Woods section of Mattituck as well as residents of the
immediate surrounding areas, object to the some of the local laws to amend the zoning
map of the Town of Southhold. Specifically, we object to chan~ug the parts of the
zoning district designations of SCTM

Our objections are based upon the following:
l- The increased commereialization xvill devalue the properties of residents of grower's
Woods as well as those of other residents in the area;
Increased marine traff'tc with its accompanying noise, waste, tox/e leach from bottom
paint and considerations of safety would seriously affect the quulity of life of all
residents near or on the inlet;
Increased business traffic will cause congestion and require new infrastructure on
Wick/am P~ve. It is also likely to require additional law enforcement, fire and
emergency personnel and/or equipment...as well as raising the possibility of a greater
tax burden.
Because of the extreme shallowness of the inlet at this point, the districts in question
could only be used as a dry land marina such as seen on rte 25, wherein boats will be
displayed facing R48 which would slow east/west traffic flow and create the
ambiance of a car-lot such as we now see along Rte 25 in Rivethead;
Furthermore, in order to use the districts in question for a water service marina, the
inlet would have to be dredged (a practice now under moratorium), thus destroying
one of the last remaining natural inlets on the sound side of the North Fork;
Mattiruck Creek is mentioned by the Southold Draft Local Waterfront Revitalization
Program/Townwide Inventory and Analysis as one of 15 Long Island wetlands in
need of restoration. There are presendy two boat ramps now in operation at the south
end of Mattituck for residents. Increased boat traffic and other boat related activities
such as bottom scraping would have the opposite effect on this 5mlnerable natural
resource;
7. The clam seeding operation on the south end of Mattituck Creek would suffer from
increased pollution caused by more commercial boating operations.

WHEREAS the Town Board,of the Town of Southold is considering a change in the
zoning designation from (R40) Residemial Low-Density District to (PO) Residential
Office District of certain parcels of land lying in the Town of Southold identified by

BE it ENACTED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD AS FOLLOWS:
Section 1. Legislative Intent
Consistent with our comprehensive land use plan and our established objectives and goals as
reflected by the existing zoning patterns ~ithin the Town, and based upon our current Count3' Route
48 Land use study as well as numerous land use studies and plans developed heretofore, we hereby
determine that it is necessar3- and desirable to revise and amend the zoning designation applicable to
the parcel identified herein as well as other lands; thus, we hereby identify and adopt the following
overall themes of (I) Preservation of Farmland and Agriculture; (2) Preservation of Open and
Recreational Space; (3) Presen'ation of the Rural, Cultural, Commercial and Historical Character of
the Hamlets and Surrounding Areas; (4) Preservation of the Natural Environment; which derive
from the shared xision held by residents and local public officials of the Town and which are
intended to foster a strong economy and which encourage and preserve the existing high quality of
life, as more specifically set forth herein below:
1. Preservation of Farmland and Agriculture
Farmland is a valuable and dynamic niduslty in the Town of Southold. The open
farmlands are not only highly cherished for their economic ~ue, but for the scenic vistas they provide.
The open space and scenet3' created by farmland additionally contn'outes to the quality of life of the
residents, wlfile promoting tourism and recreatiom
2. Preservation of Open and Recreational Space
TIle Town of Southold relies heavily upon ill scemc beauty and open landscapes for
recreatior~ clean air and water, as well as for its a~'acfion to tourists and recreation-seekers. The
Town has attracted man)' second homeownem because of its "natural resources, abundance of
open space, farms, picturesque villages, and the ever-present wateffronf' (Ma~ter Plan Update.
19 8 5 ). Due to this open space, the Town bas a txemendous development potential. Bleak pictures
have been painted in a few documents, warning of strip-Pspe development, suburban sprawl and
water suppl_v issues. The preser~:afion of open and recreational space is not only aesthetic, but also
a necessity for rite present and future needs of the Town.
3. Preservulion of the Rural~ Cultural, Commercial and Historical Character of the
Hamlets and Surrounding Areas
The Town of Southold is mnmvned f~or its rumk cultural, eamrflen,--'ial and historic
character. This unique character ts recognized in all of the documents reviewed_ Based on the input of
To.aa residenll, the Final Report and Recommendatioas slates that the iwo most prevalent and key issues
are keeping growth in the e~sting hamlet centers and presen, ing the eultancing the surrounding raral areas.
Additionally, the Master Plan Update reenmmends the provision for "a conununity of residential hamlets
that are comprised of a variety of housing oppenunities, commercml, sen, ice and cultural actix4fies, set in
an open or rural atmosphere and supported by a diversified economic base (including agriculture, marine
commercial and seasenal recreation actMues)."
Preservation of the Natural En~4ronment
Accommodating "gro~da and change within the Town without destroying its lraditional
econotnic base, the natural environment of which flk~t base rests: and the unique character
and the win_, of life that defines the Town" is of utmost importance" (Ground Watershed
Protection and Water Supply Management Straleg'3_,) The Master Plan Update
recmmnends preservation of the Town' s natural emqronment from.wetlands to
woodlands and to "achieve a land use pattern that is seusifive to the limited i~digenous
water supply and will not degrade the subsurface water quality.
The outslanding needs enumerated below are the culmination oi' careful comparison of the intent and
objectives of the town (as stated in past lanct use!plans axd studies) and the cunenfly existing conditions'
along the County Route 48 corridor. These needs reflect the past and present ¥ision of the Town and the
work that still needs to be done due to the proximfi3, of Cannty Route 48 to the hamlet commercial centers
and to a~oid potentially conflichng development strategies for such areas. These outstanding needs we find
e.,dst throughout the Town and are specifically idemified as follows:
1) to provide for viable land use development al. levels of intensities wkich are sensitive to subsurface
water quality and quamit3,
2) To maintain and strengthen hamlet centers as rite focus of commercial, residential, and cultural
activity;
3) To preserve the open_ agriculttwal and rural cltaracter of area5 outside of the hamlet centers;
4) to provide for a variety of housing oppemmlties for citizens of different incomes and age levels:
5) to enhance the opportunities for pedestrian-friendly shopping:
6) to continue to the support of rite To~'s agricultural economy;
7) to maximize the To~axt's natural assets, ianludmg its coastal location and agricultural base, by
balancing commercial, residential and recreatmnal uses;
8) to slxengthen the Toxt~'s manne-reereational and matUre-commercial acfix4ties;
9) to encourage the Preservation of parkland and public access to the waterfront;..
10) to rapport tourism by maintaining and strengthening rite Town's assets that foster a tourist Ixade.

Therefore, based upon the aforementioned goals and identified needs of the Town and upon our

othem'ise, we hereby change the zoning district designation for the parcel kno~vn as
