Collectively we offer the following observations. The underlying premise of this Study is to preserve the bypass capability of the CR 48 divided highway. Doing so will prevent the commercial retail sprawl that characterizes every Long Island town to our west. More specifically, the overall purpose is to avoid repeating the mistakes made elsewhere on western Long Island, where unchecked commercial retail development not only resulted in serious traffic congestion problems, but played a role in the demise of the economic vitality of downtown districts located on State Route 25. This community's Vision, as stated in many documents and public meetings some going back to the mid-1980s (prior to the adoption of the 1989 Zoning Map), is to preserve the small-town qualities that distinguish Southold. In order to achieve this goal, k is critically important to consolidate future retail business growth around the existing business centers within each hamlet. Furthermore, reducing the potential for retail and other traffic-generating uses to be introduced (or expanded) will have other long-term benefits to the community. First, it will ensure a bypass road for through traffic, thereby relieving some congestion on SR 25. Second, it will boost the economic development potential of the existing and potential business properties bordering SR 25, where most of the Town's traditional hamlets are centered. Third, it will preserve a scenic corridor that is a source of pleasure to residents and tourists. Therefore, we support the overall study recommendations as proposed. In recommending their adoption, we recognize there may be reservations about specific October8, lggg proposed rezonings and that alternate rezoning proposals may be under consideration. NEVILLE SOUTHOLD TOWN CLERK RECEIVED BROW£R'S WOODS ASSOCIATION, INCORPORATED Mattituck, Suffolk County, New York October 4, 1999 The Town Board of the town of Southold: Subject: Zoning District changes in the tonvn of Southold We, the directors of Brower's Woods Association, representing the interests of more than 80 households of the Brower's Woods section of Mattituck as well as residents of the immediate surrounding areas, object to the some of the local laws to amend the zoning map of the Town of Southhold. Specifically, we object to charting the parts of the zoning district designations of SCTM #s: · 1000-140.00-01.00-001.000 (residential owner Stephanie Gulatt) from (R40) Residential Low Density to the (RO)Residential Office District; ; 1000-140.00-01.00-002.000 (owners Leroy Heyliger & Wife) from (R40) Residential Low Density to the (RO)Residential Office District; · 1000-140.00-01.00-003.000 (owners William Stars & Wife) from (R40) Residential Low Density to the (RO)Residential Office District; · 1000-140.00-01.00-006.000 (owners Harold Reeve & Sons, Inc.) from (B) General Business and (R40) Residential Low Density to the (MII)Marine II District; · 1000-140.00-01.00-007.000 (owner Rita Poneiglione) from (R40) Residential LOw Density to the (Mil)Marine II District; · and 1000-140.00-01.00-008.000 (owner Rita Helen Reeve) from (R40) Residential LOw Density to the (MII)Maxine II District. Our objections are based upon the following: 1_ The increased commercialization will devalue the properties of residents of Brower's Woods as well as those of other residents in the a~ea; Increased marine traf£~c with its accompanying noise, waste, toxic leach from bottom paint and considerations of safety would seriously affect the quality of life of all residents near or on the inlet; Increased business traffic will cause congestion and require new infrastructure on Wickham Ave. It is also likely to require additional law enforcement, f~re and emergency persoxmel and/or equipment...as well as raising the possibility of a greater tax burden. Because of the extreme shallowness of the inlet at this point, the districts in question could only be used as a dry land marina such as seen on rte 25, wherein boats will be displayed facing R48 which would slow east/west traffic flow and create the ambiance of a c~r-lot such as we now see along Rte 25 in Riverhead; Furthermore, in order to use the districts in question for a water service marina, the inlet would have to be dredged (a practice now under moratorium), thus destroying one of the last remaining natural inlets on the sound side of the North Fork; Mattituck Creek is mentioned by the Southold Draft Local Waterfront Revitalization Pro~arn/Townwide Invantory and Analysis as one of 1_5 Long Island wetlands in need of restoration. There are presently two boat ramps now in operation at the south end of Mattitnck for residents. Increased boat traffic and other boat [elated activities such as bottom scraping would have the opposite effect on this vulnerable natural resource; 7. The clam seeding operation on the south end of Mattituck Creek would suffer from increased pollution caused by more commercial boating operations. Very truly yours, ELIZABETH A. This parcel is part of a proposed change of zone designated by the Town Board as "Mattituck 2G." Notice of the proposed change of zone was issued by the Town Clerk on September 14, 1999. The undersigned owner(s) of propelXy within that part of the Town of Southold which would be affected by such proposed change of zone, do(es) hereby and herewith protest to the Town Board of the Town of Southold agah~st said change of zone. Legislative Intent Consistent with our comprehensive land use plan and our established objectives and goals as reflected by the existing zoning patterns within the Town, and based upon our current Count}' Route 48 Land use stud)- as well as numerous land use studies and plans developed heretofore, we hereby determine that it is necessar}' and desirable to re*ise and amend the zoning designation applicable to the parcel identified herein as well as other lauds; thus, we hereby identify and adopt the following overall themes of (1) Preserva/ion of Farmland and Agriculture; (2) Preservation of Open and Recreational Space; (3) Preservation of the Rural, Cultural, Commercial and Historical Character of the Hamlets and Surrounding Areas; (4) Preservation of the Natural Environment; which derive from the shared vision held by residents and local public officials of the Town and which are intended to foster a strong economy and which encourage and preserve the existing high quality of life, as more specificall3- set forth herein below: 1. Preservatian of Farmland and Agriculture Farmland is a valuable and dynamic industry in the Town of Southold. The open farmlands are not oaly highly cherished for their economic value, but for 'the scenic xistas they prox4de. The open space and scenc~, created by farmland additionally contributes to the quality of life of the residents, while promoting tourism and recreatmm 2. Preservation of Open and Recreational Space The Town of Sonthold relies hea'~41y upon its scenic beauty, and open landscapes for recreatiom clean air and water, as well as for its attraction to tourists and recreation-seekers. The Towxt has am-acted many second homeo~xa~ers because of its "natural resources, abundance of open space, farms, picturesque villages, and the ever-present waterfi-onC (Master Plan Update. 1985). Due to this open space, the Town has a tremendous development potential Bleak pictures have been painted in a few documents, warning of strip-isle developmenL suburban sprawl and water.supply issues. The preservation of open and recreational space is not only aesthetic, but also a necessiB., for the present and future needs of the Toxin. 3. Preservation of the Rural, Cultural, Commercial and Historical Character of the Hamlets and Surrounding Areas The Town of Sonthold is renowned for its rural, cultural, commercial and historic character. This unique character is recognized in all of the documents reviewed. Based on the input of Toxin residents, the Final Report and Recommendations slates that the two most prevalent and key issues are keeping gro~lh in the existing hamlet centers and preserving the enhancing the strrroanding rural areas. Additionally. the Master Plan Update recommends the provision for "a community of residential hamlets fl~t are comprised of a variety of housing opportunities, commercial, service and cultural actMfies, set ia an open or rural almosphere and supported b3 a dix. ersified ecoanmic base (including agriculture_ marine commercial and seasonal recreation actixifies) * Pre~rvation of the Natural Environment Accommodating '~growth and change within the Town without destxo}Sng its fa'aditioanl economic,base, the natural em, ironmeut of whicli tim base rests, and rite umque character and the way of life that defines the Town" is of utmost impommce" (Ground Watershed Protection and Water Supply Maangetneut Strategy). The Master Plan Update recommends presem'ation of the Town's natural emSronment from wetlands to 'woodlands and to "achieve a land u, se pattern that is sensitive to the limited indigenous water supply arid aah not degrade the subsurface water quality. The outstanding needs eanmemted below a~e the culmination of careful comparison of the intent and objectives of the town (as stated in past land use plans augstudies) and tlte ct~¢nfly ~ exisling conditions along the County Route 48 corridor. These needs reflect the past and present vision of the Tm and the work that sti!l needs to be done due to the pro~dmity of Cotmty Route 48 to the hamlet commercial centers and to avoid potentially conflicting development sWategies for such areas.
