Dear Mrs. Neville,
The recommendations proposed by the Cramer Consulting Group in the above-noted
Study, have been reviewed and discussed by the Planning Board. Collectively we
offer the following observations.
The underlying premise of this Study is to preserve the bypass capability of the CR
48 divided highway. Doing so will prevent the commercial retail sprawl that
characterizes every Long Island town to our west. More specifically, the overall
purpose is to avoid repeating the mistakes made elsewhere on western Long Island,
where unchecked commercial retail development not only resulted in serious traffic
congestion problems, but played a role in the demise of the economic vitality of
do~rntown districts located on State Route 25.
This community's Vision, as stated in many documents and public meetings some
going back to the mid-19~t0s (prior to the adoption of the 1989 Zoning Map), is to
preserve the small-town qualkies that distinguish Southold. In order to achieve this
goal, it is critically important to consolidate future retail business growth around the
existing business centers within each hamlet.
Furthermore, reducing the potential for retail and other traffic-generating uses to be
introduced (or expanded) will have other long-term benefits to the community_ First,
it will ensure a bypass road for through traffic, thereby relieving some congestion on
SR 25. Second, it will boost the economic development potential of the existing and
potential business properties bordering SR 25, where most of the Town's traditional
hamlets are centered. Third, it will preserve a scenic corridor that is a source of
pleasure to residents and tourists.
Therefore, we support the overall study recommendations as proposed. In
recommending their adoption, we recognize there may be reservations about specific

proposed rezonings and that alternate rezoning proposals may be under consideration.
We urge extreme caution in modifying the consultant's recommendations lest the
integrity of'the whole be undermined in the interest of satisfying a few.

Subject: Zoning District changes in the town of Southold
We, the directors of Brower's Woods Association, representing the interests of more than
80 households of the Brower's Woods section of Mattituck as well as residents of the
immediate surrounding areas, object to the some of the local laws to amend the zoning
map of the Town of Southhold. Specifically, we object to changing the parts of the
zoning district designations of SCTM #s:

Residential Low Density to the (RO)Residential Office District;
· 1000-140.00-01.00-002.000 (owners Lemy Heyliger & Wife) from (R40)

Our objections are based upon the following:
1. The increased commercialization will devalue the.properties of residents of Brower's
Woods as well as those of other residents in the area;
Increased marine traffic with its accompanying noise, waste, toxic leach from bottom
paint and considerations of safety would seriously affect the quality of life of all
residents near or on the inlet;
Increased business traffic will cause congestion and require new infrastructure on
W'lcldaam Ave. It is also likely to require additional law enforcement, fire and
emergency personnel anclJor equipment...as well as raising the possibility of a greater
tax burden.
Because of the extreme shallowness of the inlet at this point, the districts in question
could only be used as a dry land marina such as seen on rte 25, wherein boats will be
displayed facing R48 which would slow east/west traffic flow and create the
ambiance of a car-lot such as we now see along Rte 25 in Riverhead;
Furthermore, in order to use the districts in question for a water service marina, the
inlet would have to be dredged (a practice now under moratorium), thus destroying
one of the last remaining natural inlets on the sound side of the North Fork;
Mattituck Creek is mentioned by the Southold Draft Local Waterfront Revitalization
Pro~am/Townwide Inventory and Analysis as one of 15 Long Island wetlands in
need of restoration_ There are presently two boat romps now in operation at the south
end of Mattituck for residents. Increased boat traffic and other boat related activities
such as bottom scraping would have the opposite effect on this xmlnerable natural
resource;
7. The clam seeding operation on the south end of Matt/tuck Creek would suffer from
increased pollution caused by more commercial boating operations.

BE IT ENACTED BY THE TOWN BOARD OF THE TOWN OF SOU]~OLD AS FOLLOWS:
Section 1. Legislative Intent
Consistent with our comprehensive land use plan and our established objectives and goals as
reflected by the existing zoning patterns within the Town, and based upon our current County Route
48 Land use study as well as numerous land use studies and plans developed heretofore, we hereby
determine that it is necessary and desirable to re~se and amend the zoning designation applicable to
the parcel identified herein as well as other lands; thus, we hereby identi~- and adopt the following
overall themes of (1) Preservation of Farmland and Agriculture; (2) Preservation of Open and
Recreational Space; (3) Preservation of the Rural, Cultural, Commercial and Historical Character of
the Hamlets and Surrounding Areas; (4) Peeservatian of the Natural Em~ronment; which derive
from the shared vision held by residents and local public off'lClals of the Town and which are
intended to foster a strong economy and which encourage and preserve the existing high quality of
life, as more specifically set forth herein below:
1. Preser~'ation of Farmland and Agriculture
Farmland is a x-aluable and dynamic mduslxy in the Town of Southold. The open
farmlands are not only highly cberished for their economic value, but for the scenic vistas the)' provide.
The open space and scenery created by farmland addilionally conlxibutes to the quality of life of the
residents, widle promoting tourism and recreation_
2. Preservation of Open and Recreational Space
The Toxxm of Southn[d relies he, avily upon its scenic beaut3, and open landscapes for
recreation clean air and xx~ter, as well as for its attraction to tourists and recrea6on-seekers. The
Town has am-acted man), second homeowners because of its "natural resources, abundance of
open space, farms, picturesque villages, and the ever-present wateffronC fMaster Plan Update.
1985). Due to this open space, the Town has a tremendous development potential. Bleak pictures
ltave been painted in a few documents, warning of strip-type des'elopmenl, suburban spm~sq and
water supply issues. The presen,ation of open and recreational space is not on[5' aesthetic, but a~so
a necessity for the present ned' future needs of the Town.
3. Preservation of the Rural, Cultural, Commercial and Historical Character of the
Hamlets and Surrounding Areas
The Tox~ of Southold is renowned for its rural cultural, commercia/and historic
character. This unique character is recognized in all of the documents rexaewed. Based on the input of
Town residents, the Final Report and Recommendal~ons states that the two most prevalex~t and key issues
are Keeping gro~th m rite existing hamlet centers and preserving the enbancing rile surrounding rural areas.
Additionally, the l~ster Plan Update recommends the prox4sion for "a cemmunity of residential hamlets
that are comprised of a variety of housing opportunities, commercial, service and cultatal acti~ifies, set in
an open or rmal almosphere and supported by a dixersified economic base (including agriculture, marine
commercial and seasonal recreation activities)."

Preservation of the Natural En¥ironment
Accommodating "gro~di and clmnge within rile Town without destxo34ng its traditional
economic base, the natural environmem of which lhat base rests_ and the unique character
and rite way of life that defines the Town" is ofutmast importance" (Grotmd Wmetshed
Protection and Water Supply Management Strategy). The Master Plan Update
recommends presen~fiun of the Town's natural environment from wetlands to
woodlands and"to "achieve a land use pattern that is se~sitive to the limited indigenous
water supply ant will not degrade the subsurface water quality.
The outstanding needs enarnerated below are the culmination of careful comparison of the intent and
objectives of the town (as stated-in, past land · ~use-pl~gand studies),and the currently existing conditions
along the Coum3, Route 48 corridor. These needs reflect abe past and present ~sion of the Town and the
work that sull needs to be done due 1o the proximity of County Route 4g to the hamlet commercial centers
and to avoid potentially coifl]icting development slrategies for such areas. These outstanding needs we find
exist throughout the Town and are specifically identified as follows:
1 ) to provide for viable land use development al. levels of intensifies wlfich are sensitive to subsurface
water quality ,and quantity
2) To maintain and strengthen hamlet centers as the focus of commercial, residenttal, and cultural
activity:
3) To preserve the oper[ agricultural and rural character of areas outside of the l~alct centers',
4) to provide for a variety of housing opportunities for citizens of different incomes and age levels:
5) to enhance the oppommities for pedestrian-friendly shopping;
6) to continue to the support of the Tmrn's agricultural economy;
7) to maxinUze the Town's natural assets, inchiding its coastal location and agricultural base, by
balancing commercial, residential and recreational uses;
8) to strengthen the Town's me-recreational and manne-commercial actix4ties;
9) to encourage the preservation of parkland and public access to the waterfront;
10) to support tourismby mahtaiulng and stxangthenthg the Toam's assets that foster a tourist trade,
nmnely lmnflet center businesses, historic heritage, architecture, a sense of place, of rural and open
character, agriculture; and manne acfivifies;
11) to preserve prime farmim~:l; and encourage the dix~ersification of agficultare:
12) to pmsen,e the historic, cultural architectural and archaeological resources of the Toaaa;

consideration of the recorrm~endations and commmtts of our planning Board. the Suffolk Cotmty Plamting
Comm/ssinn, oar planning consultant (CCG) and the public comment taken at the public hearing and
otherwise, ae hereby change rite zoning dislxict designation for the parcel knox~n as

BEGINNING at a point distant South 44 degrees 47 minutes West 87.4 feet from the
southwesterly side of Maiden Lane, measured along the southeasterly line ora 10 foot fight of
way which southeasterly line is the northwesterly line of land now or formerly of Ella B. Jones;
and from said point ofbegirming running thence South 44 degrees 47 minutes West along the
northwesterly line of land now or formerly of Ella B. Jones 87.60 feet to a monument and land
now or formerly of Lloyd Hamilton;
THENCE North 47 degrees 35 minutes 20 seconds West along said last mentioned land 160 feet,
more or less, to the approximate location of the original high water mark of Mattituck Creek;
