Dear Mrs. Neville,
The recommendations proposed by the Cramer Consulting Group in the above-noted
Study, have been reviewed and discussed by the Planning Board. Collectively we
offer the following observations.
The underlying premise of this Study is to preserve the bypass capability of the CR
48 divided highway. Doing so will prevent the commercial retail sprawl that
characterizes every Long Island town to our west. More specifically, the overall
purpose is to avoid repeating the mistakes made elsewhere on western Long Island,
where unchecked commercial retail development not only resulted in serious traffic
congestion problems, but played a role in the demise of the economic vitality of
downtown districts located on State Route 25.
This community's Vision, as stated in many documents and public meetings some
going back to the mid-1980s (prior to the adoption of the 1989 Zoning Map), is to
preserve the small-town qualities that distinguish Southold. In order to achieve this
goal, it is critically important to consolidate future retail business growth around the
existing business centers within each hamlet.
Furthermore, reducing the potential for retail and other traffic-generating uses to be
introduced {or expanded) will have other long-term benefits to the community. First,
it will ensure a bypass road for through traffic, thereby relieving some congestion on
SR 25. Second, it will boost the economic development potential of the existing and
potential business properties bordering SR 25, where most of the Town's traditional
hamlets are centered. Third, it will preserve a scenic corridor that is a source of
pleasure to residents and tourists.
Therefore, we support the overall study recommendations as proposed. In
recommending their adoption, we recognize there may be reservations about specific

proposed rezonings and that alternate rezoning proposals may be under consideration.
We urge extreme caution in modifying the consultant's recommendations lest the
integrity of the whole be undermined in the interest of satisfying a few.

Zoning District changes in the tow~ of Southold
We, the directors of Brower's Woods Association, representing the interests of more than
80 households of the Brower's Woods section of Mattituck as well as residents of the
immediate surrounding areas, object to the some of the local laws to amend the zoning
map of the Town of Southhold. Specifically, we object to chan~ng the parts of the
zoning district designations of SCTM #s:
· 1000-140.00-01.00-001.000 (residential owner Smphanie Gulatt) from (R40)
Residential Low Density to the (RO)Residential Office District;
· 1000-140.00-01.00-002.000 (owners Leroy Heyliger & Wife) from (R40)

Our objections are based upon the following:
1. The increased commercialization will devalue the properties of residents of Brower's
Woods as well as those of other residents in the area;
Increased marine tm/ftc with its accompanying noise, waste, toxic leach from bottom
paint and considerations of safety would seriously affect the quality of life of all
residents near or on the inlet;
Increased business traffic will cause congestion and require new infrastructure on
Wickham Ave. It is also likely to require additional law enforcement, fire and
emergency personnel and/or equipment...as welt as raising the possibility of a ~eater
tax burden.
Because of the extreme shallowness of the inlet at this point, the districts in question
could only be used as a dry land marina such as seen on rte 25, wherein boats will be
displayed facing R48 which would slow east/west traffic flow and create the
ambiance of a car-lot such as we now see along Rte 25 in Riverhead;
Furthermore, in order to use the districts in question for a water service marina, the
inlet would have to be dredged (a practice now under moratorium), thus destroying
one of the last remaining natural inlets on the sound side of the North Fork;
Mattituck Creek is mentioned by the Southold Draft Local Waterfront Revitalization
Program/Townwide Inventory and Analysis as one of 15 Long Island wetlands in
need of restoration_ There are presently two boat ramps now in operation at the south
end of Mattituck for residents. Increased boat traffic and other boat related activities
such as bottom scraping would have the opposite effect on this vulnerable natural
resource;
7. The clam seeding operation on the south end of Matfituck Creek would suffer from
increased pollution caused by more commercial boating operations.

WHEREAS the Town Board of the Town of Southold is considering a change in the
zoning designation from (R40) Residential Low-Density District to (M/I) Marine 1I
District of part of certain parcels of land lying in the Town of Southold identified by

BE IT ENAC'Ii~D BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD AS FOLLOWS:
Section 1. Legislative Intent
Consistent with our comprehensive land use plan and our established objectives and goals as
reflected by the existing zoning patterns x~Sthin the Town, and based upon our current County Route
48 Land use study as well as numerous land use studies and plans developed heretofore, we hereby
determine that it is necessary and desirable to re,Sse and amend the zoning designation applicable to
the parcel identified herein as well as other lands; thus, we hereby identify and adopt the following
overall themes of (1) Preservation of Farmland and Agriculture; (2) Preservation of Open and
Recreational Space; (3) Preservation of the Rural, Cultural, Commercial and Historical Character of
the Hamlets and Surrounding Areas; (4) Prescrvatiou of the Natural Environment; which derive
from the shared vision held by residents and local public officials of the Town and which are
intended to foster a strong economy and which encoucagc and preserve the existing high quality of
life, as more specifically set forth herein below:
1. Preservation of Farmland and Agriculture
Farm]and is a valuable and d_'mamic industry in the Town of Southold. The opan
farmlands are not only highly cherished for theh- economic value, but for the scenic xSstas they provide.
The open space and scenery created by farmland addilionally conlributes to the quality of life of the
residents, wldle promoting tourism and recreatioo~
2. Preservation of Open and Recreational Space
The Town of Southold relies heavily upon its scenic beauty and open landscapes for
recreation, clean air and water, as well as for its attraction to tourisls and recreation-seekers. The
Tovm has am'acted many second homeo'~ters because of its "natural msottrces, abundance of
open space, farms, picturesque villages, and the ever-present waterfronC (Master Plan Update,
1985). Due to this open space, the Town has a tremendous development potential. Bleak pictures
have been painted in a few documents, warning of strip-V,_~e development, suburban sprawl and
water supply issues. The preservation of open and recreational space is not only aesthetic, but also
a necessiD' for the pmseni and future needs of the Town.
3. Preservation of the Rural, Cultural, Commercial and Historical Character of the
Hamlets and Surrounding Areas
The Tcm~n of Southold is renowned for its rural, cnltmal, commercial and historic
chamctec Tiffs unique character is recognized in all of the documents reviewed. Based on rite input of
Town residents, the Final Report and Recommendations states that the two most prevalent and key issues
are keeping growth in rite existing hamlet centers and preseti'ing the enhancing the surrounding rural areas.
Additionally, the Master Plan Update recommends the pro~iston for L'a communi~- of residential hamlets
tha~ are comprised of a variety of houging opportunities, conunerciak service and cultural activities, set in
an open or rural atmosphere and supported by a diversffted economic base (including agriculture_ marine
conunercial and seasonal recreation activities)."
Peeservafion of the Natural En~fronment
Accommodating "grex~th and change within the Town ~s4thout deslxo34ng its lraditiounl
economic base, the natural environment of which that base rests, and the unique chanacter
and the way_ of life that defines the Town" is of utmost importance" (Ground Watershed
Protection and Water Supply Managemem Str~egy). The Master Plan Update
recommends preservation of the Tenor's natural environment from wetlands to
woodlands and to ~-achieve a land use pattern that is sensitave to the limited indigenous
warer supply and x~411 not degrade rite subsurface water quatity.
The or, standing needs enumerated below are the culmination o~ careful comparison of the intent and
..... objectives oftbe to~m-(as stated in past land use plans and studies) and the~currenfly, ex~sting ~o~difioas , .~ 9¥~ ~ .........
along the County Route 48 comdor. These needs reflect the past and present x4sion of the Toga and the
work that still needs to be done due to the proximity of Count3_' Route 48 to the hamlet commercial centers
and to avoid potentially conflicting development sta-alegies for such areas. These outstanding neoq~s we find
exist throughout the Town and are specifically identified as follows:
1) to provide for viable land use developmer~t al levels of intensifies which are sensitive to subsurface
water qualit5 and quantit3
2) To mmnlmn and s~'engthen hamlet centers as the focus of commercial residential, and cultural
activity;
3 ) To preserve rite open, agricultural and rural character of areas outside of the hamlet centers;
4) to provide for a varie~ ofbeusing opportunities for citizens ofthfferent incomes and age levels:
5) to enhance the opportunities for pedestrianffriendly shopprog;
6) to continue to the support of the Town's agricultural economy;
7) to maximize the Town's natural assets, including its coastal location and agricultural base, by
balanqing commereial, residential and recreational uses;
8) to strengthen the Toma's me-recreational and me-commercial actixffies;
9) to encourage the presen'ation ofparldand and public access to the 'aateffront;
10) to support tourism by maintaining and strengthening the Town's assets that foster a tourist trade,
namel_v hamiet center businesses, historic heritage, arclfitecture, a sense of place, of rural and open
character, agnenlture, and marine activrties;
11) to prese~-e prime farmland; aM encourage the diveralfieatian of agriculture:
12) to presen,e the histotic, cultural, arclatecmmi and archaeological resources of the Town:
13) to ensure visual quality oflmmlet centers;
14) to encourage appropriate land uses both inside and out of hamlet centers:
15) to promote balanced economy and tax base:
16) to preserve the integrity of the Tox~t's xegetative habitats, including fireshwater weflunds and
woodiands.
Section 2. Enactment
· Therefore, based upon the aforementioned goals and identified needs of the Town and upon our
consideration ol' rite recommendations and comments of our planmng Board, the Suffolk County Planning
Commission_ our planning consu/tant (CCG) and the public comment taken at the public heanng and
