Dear Mrs. Neville,
The recommendations proposed by the Cramer Consulting Group in the above-noted
Study, have been reviewed and discussed by the Planning Board. Collectively we
offer the following observations
The underlying premise of this Study is to preserve the bypass capability of the CR
48 divided highway. Doing so will prevent the commercial retail sprawl that
characterizes every Long Island town to our west. IVlore specifically, the overall
purpose is to avoid repeating the mistakes made elsewhere on western Long Island,
where unchecked commercial retail development not only resulted in serious traffic
congestion problems, but played a role in the demise of the economic vitality of
downtown districts located on State Route 25.
This community's Vision, as stated in many documents and public meetings some
going back to the mid-1980s (prior to the adoption of the 1989 Zoning Map), is to
preserve the small-town qualities that distinguish Southold. In order to achieve this
goal, it is critically important to consolidate future retail business growth around the
existing business centers within each hamlet.
Furthermore, reducing the potential for retail and other traffic-generating uses to be
introduced (or expanded) will have other long-term benefits to the community. First,
it will ensure a bypass road for through traffic, thereby relieving some congestion on
SR 25. Second, it will boost the economic development potential of the existing and
potential business properties bordering SR 25, where most of the Town's traditional
hamlets are centered. Third, it will preserve a scenic corridor that is a source of
pleasure to residents and tourists.
Therefore, we support the overall study recommendations as proposed. In
recommending their adoption, we recognize there may be reservations about specific

We urge extreme caution in modifying the cot~su/tant's recommendations lest the
integrity of the whole be undermined in the interest of satisfying a few.

We, the directors of Brower's Woods Association, representing the interests of more than
80 households of the Brower's Woods section of Mattituck as well a~ residents of the
inm~ediate surrounding areas, object to the some of the loca[ laws to amend the zoning
map of the Town of Southhol& Specific~ly, we object to changing the parts of the
zoning district designations of SCTM #s:

Our objections are based upon the following:
1_ The increased commercialization will devalue the properties of residents of Brower's
Woods as well as those of other residents in the area;
2_ Increased marine traffic with its accompanying noise, waste, toxac leach from bottom
paint and considerations of safety would seriously affect the quality of life of all
residents near or on the inlet;
Increased business traffic will cause congestion and require new infrastructure on
Wicklxaxn Ave. It is also likely to require additional law enforcement, fire and
emergency personnel andJor equipment...as well as raising the possibiIit_y of a greater
tax burden.
Because of the extreme shallowness of the inlet at this point, the districts in question
could only be used as a dry land marina such as seen on rte 25, wherein boats will be
displayed facing R48 which would slow east/west 'traffic flow and create the
ambiance of a car-lot such as we now see along Rte 25 in Riverhead;
Furthermore, in order to use the districts in question for a water service marina, the
inlet would have to be dredged (a practice now under moratorium), thus destroying
one of the last remaining natural inlets on the sound side of the North Fork;
Mattituck Creek is mentioned by the Southold Draft Local Waterfront Revitalization
Prograrrffrownwide Inventory and Analysis as one of 15 Long Island wetlands in
need of restoration. There are presently two boat ramps now in operation at the south
end of Mattituck for residents. Increased boat traffic and other boat related activities
such as bottom scraping would have the opposite effect on this vulnerable natural
resource;
7. The clam seeding operation on the south end of Mattituck Creek would suffer from
increased pollution caused by more commercial boating operations.

BE IT ENACTED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD AS FOLLOWS:
Section 1. Legisladve Intent
Consistent with our comprehensive land use plan and our established objectives and goals as
reflected by the existing zoning patterns n~thin the Town, and based upon our current Count>' Route
48 Land use study as well as numerous land use studies and plans developed heretofore, we hereby
determine that it is necessary and desirable to resSse and amend the zoning designation applicable to
the parcel identified herein as well as other lands; thus, we hereby identify and adopt the following
overall themes of (I) Preservation of Farmland and Agriculture; (2) Preservation of Open and
Recreational Space; (3) Preservation of the Rural, Cultural, Commercial and Historical Character of
the Hamlets and Surrounding Areas; (4) Preservation of the Natural Environment; which derive
from the shared vision held by residents and local public officials of the Town and which are
intended to foster a strong ceonomy and which encourage and preserve the existing high quality of
life, as more spe~iflcally set forth herein below:
1. Preservation of Farmland and Agriculture
Farmland is a xmlnable and dymmfic indusl~y in the Tox~m of Southold. The open
farmlands are not only highly cherished for their economic value, but for the scenic vistas they provide.
The open space and scenery crea~d by farmland additionally contributes to the quality of life of the
residents, while promoting tourism and recreation.
2. Preservation of Open and Recreational Space
Thc Totem of Southold relics heavily upon its scenic beauty and open landscapes for
recreation, clean air and water, as well as for its am-action to tourists and recreation-seekers. The
Town has attracted many second homeo~n,ncrs because of its "natural resources, abundance of
open space, farms, picturesque villages, and the ever-present waterfront" (Master Plan Update,
1985). Duc to this open space, the Town has a I~emeadous development potential. Bleak pictures
have been painted in a few documents, warning of snip-type development, suburban sprawl and
water supply issues. The presenraQon of open and recreational space is not only aesthetic, but also
a necessity for the present and future needs of the To,va.
3_ Presem'ation o[ the Rural, Cultural, Commercial and Historical Character of the
Hamlets and Surrounding Areas
The Town of Southold is renowned for its rural, cultural, commercial m~d tdstori¢
character. This unique character is recognized in all of the documents re'~-icwed. Based on thc input of
Town residents, the Final Report and Recommendations states that the two most prevalent and key issues
are keeping gro~x~th in the existing hamlet centers.and presetxdng the erthaocing the surrounding rural areas.
Additionally, the Master Plan Update recontmends the pro~4sion for "a community of residential hamlets
that are comprised of a variety of housing opport~mities, commercial, service and cultural activities, set in
an open or rural atmosphere and supported by a diversified economic base (inchiding agriculture, manne
commercial and seasona/recreation activities)."
Preservation of the Natural Environment
Accommodating ~gro'a~h and change wlihin thc Town without destroying its traditional
economic base, the natural environment of wkich that base rests, and the unique character
and the wa? of life that defines the Tox~m" is of uanost importance" (Ground Watershed
Protection and Water Supply Management Sh-atugy). The Master Plan Update
recommends preservation of the Town's natural environment from wetlands to
woodlands and to "achies,e a land use pattern that is sensitive to the limited indigenous
water supply and will not degrade the subsurface u~ler quality.
The outstanding needs enumerated below are the culminalion of careful comparison of the mtunt and
objectives of the town (as stated in past land use plans and studies) and the currently existing conditioits
along the Count3, Route 48 corridor. These needs reflect the past and present visian of the Tovm and the
work that still needs to be done duc to the proximity of County Route 48 to the hamlet commercial centers
and to axoid potentially conflicting development strategies for such areas. These outstmuliag uceda we find
exist throughout thc Toxen and are specifically identified as follows:
l ) to provide for viable land use development at levels of intensifies which are sensitive to subsurface
water quality and quantity
2) To maintain and strengthen hamlet centers as the focus of commercial, residential, and cultural
activity;
3 ) To preserve the open, agricultural and rural character of areas outside of the hamlet centers;

5) to enba~ce the opportumfies for pedestrian-friendly shopping;
6) to continue to the support of rite Town's agricultural economy;
7) to maximize the Town's natural assets, including its coastal location and agricultural base, by
balancing commercial, residential and recreafianal uses;
8) to strengtben the Town's marine-recreational and marine-commercial activities:
9) to encourage the preservation of parkland and public access to the waterfront;
10) to support teunsm by maintaining and strengthening the Town's assets chat foster a tourist Uade,
namely hamlet center businesses, historic heritage, architecture, a sense of place, of meal and open
character, agriculture, and me activities;
11) to preserve prime farmland; and encourage the diversification of agriculture;
12) to preserve the historic, cultural, architectural and arcbacological resources of the To'am;
13) to ensurevisnalqualityofhamleteeniers;
14) to encourage approprmte land uses both inside and out of hamlet centers;
15) to promote balanced economy and tax base;
· 16) to preserve the integrity of the Town's vegetative habitats, including fi'eshwater wetlands and
woodlands.

INTRODUCTION
On September 8, 1998, the Town Board oft. he Town of Southold filed a moratorium on
thc issuance of approvals and permits for business-zoned properties within the County Route 48
corridor. The moratorium was intended to allow for thc italy of the corridor and to make
amendmcms with regard to the "level and nature of business uses that are appropriate along
Route 48, such that these uses compliment existing hamlet ~concmie centers and that business
uses appropriate outside hamlet centers are provided ample location in which to be situated".
The County Route 4g Coaidor r~,d Usc Study was subsequently conducted and submitted to the
Town Board on April I3, 1999.
The study corridor is situated entirely within the Town of Southold and includes portions
of Sound Avenue, County Rom 48 and State Route 25. The corridor begins on Sound Avenue
at the western Southold Town line and continues along Sound Avenue to its junction with
County Route 48 in Mattimck hamlet. The study corridor then follows County Route 48 until its
junction with State Route 25 in thc hamlet of Greenport. Thc corridor then terminates at the
intersection of Manhasset Avenue.and County Route 48/Stale Route 25. All parcels located
within 1,000 feet of the above portions of these roadways are included in thc study, with the
exception of those parcels lhat are within the jurisdiction of the Village of G-reenport.
A Positive Declaration, Notice of Public Hearing.and Draft Generic Environmental
Impact Statement on the Land Usc Study were adopted by the Town Board of the Town of
Sou~hold on April 20, 1999. A Public Hearing on the Draft C~ncric Environmental Impact
Statement was held on May 6, 1999 and public comments were accepted until May 20, 1999. A
Final Generic Environmental Impact Statement (FOEIS) was adopted by the Town Board on July
20, 1099. A Supplemental Final Generic Environmental Impact Statement (FGEIS) was adopted
bylha Town Board on August 3, 1999.

In its SEQRA review of thc County Route 48 Corridor Land Usc Study, the Town of
Southold has not identified any si~ificant adverse environmental impacts. Nevertheless, the
Town of $outhold chose to usc thc format ora Generic Environmental Impact Staxcment (GEIS)
in its subsequent SEQRA review of anti public comment on ~ Stugly it provided for the most
comprehensive ~n¥irolunental r, vi~v of the Study and allowed for the greatest degree ofpubllc
awareness and input. Furthermore, even though no significant advise environmental impacts
w~re id,ratified as a result of the Study, Section 617.10 of thc SEQRA ~gulations ~*~*~, that
GEISs may be used "to assess the environmental impacts of.' an entire program or plan having
wide application...iacluding new or significant changss to existing land ~ plans.,.' regardless of
whether or not the action is expacted to possibly result in adverse unvironmental impacts.
COUNTY ROUTE 48 CORRIDOR LAND USE STUDY
The Counly Rout~ 48 .Corridor Iand Use Study provides recommendations to the Town
Board regarcting appropriat~ land usc'and zoning within thc corridor. These recommendations
m'~ the final step i~ a four_Step planning and study process that was intended ~ provide a
methodical and comprehensive look at land use and zoning L~ the corridor. The ftr~ s~p in the
Study was to identify the characteristics of the corridor and surmuncling a~eas that thc Town and
its citizens believe are important ~nd valuable. These characteristics were garnered from past
Towri land use plane and studies as well as from the intent of Town actions, particularly previous
land use de~isions, re-zonings and code changes. Subsequent to the identification of desirable
~raeteristics of the.exnridor, an analysis of existing ~onditious along the corridor was

seekers- The Town has attracted many second homeowners because of its "natm'al
reseurce~, abundance of open space, farms, picturesque villages, and the ever-present
waterfront" (Master Plan Update, 1985). Due to this open space, the Town has a
tremendous development potential. Bleak pi~'ures have been painted in a few
documents, warning of strip-tyl~ development, suburban sprawl and water supply
issues. The preservation of open and recreational space is not only aesthetic, but
also a n~esslty for the present and future needs of the Town.
Preservation of the Rnrnl, CaltaraI, Cammercinl and Historical Character of
the Hamlete and Surroundin~ Areas
The Town of Southold ia renown~i for its rural, cultural, commercial and historic
character_ This unique character is recognize~l in all of the documents reviewed.
Based on the input of Town £esidant& the Final Keport and Recommendations states
that thc two most prevalent and key issues ar~ keeping growth in the existing hamlet
centers and preserving and enhancing thc surrounding rural a~a~. Additionally, the
Master Plan Update recommends the provision for ~a community of residential
hamleVa that are comprised of a variety of bossing opportunities, commercial, secvice
and cultural activities, set in an open or rural atmosphere and supported by a
diversified economic base (including agricultar~, marine commercial and seasonal
recreation a~tivities)."
Preeervalion of the Natural Environment
Accommodating ~gmv~ and change within the Town without destroying ks
traflitioual economic base, the natural environment on which that base rests, Md the
unique character and the way of life that defines the Town" is of utmost importance"
(Ground Watershed Protection and Water Supply Management Strategy). The
Master Plan Update recommends preservation oft.he Town's natural environment
· fix~m wetlands to woodlands and to "achieve a land use paaern that is sensitive to the
limit~ indigenous water supply and will not degrade the subsurface water quality.
Outstaeatnl Needs
The outstanding needs ~aumeraIed below are the culmination of careful comparison of
the intern and goals of the town (as st~*.,4 in pa~t land use plans and.studies) and tl~
existing conditions dong the County Route 48 corridor. Therefore, the needs are not
new, but rather reflect the ?~t and present vision of the Town and th~ work that still
creeds to be done. Due to the proximity of County Route 48 to the hamlet centers and to
avoid potentially conflicting development strategies for the two areas, the outstanding
needs are intended to be valid du-oughout the Town. The outstanding needs for the Town
of Southold arc found to be:
· Provide for viable land usg development at intensities sensitive to subsurface water
quality and quantity.
· Maintain and ~heugthen hamlet c~nt~.rs as the foc~ of commercial, residential, and
cultural activity,
· Preserve thc open, agricultural and rural character of a~as outside of thc hamlet ccnte~.
· Provide for a variety of housing opportunities for citizens of diffar~m incomes and age

Re-zoning~ are intended to balance the residential, commercial,
cnvironm~zl and rccremfional needs of the Town. Existing enclaves of
commercial use may be enhanced by additional appropriate commercial parcels.
Similarly, existing agricultural or residential areas may be enhanced by the
zoning of nearby vacant commereially-zoned parcels. By concentrating futu~
commcrcial u~s in are~ of existing commercial activity (particularly hamlet
centers) results in a more viable and ordered land usc pattern and helps to prevent
the dilution of.consumer activity in the Town. The humlet centers currently act as
~¢ commcreial centers of thc Town and provide a sense of place. In
aroa~ outside of the hamlet centers generally portray a more open and agricultural
clutractcr, with small areas of commercial ac6vity. The contrasting characteriszics
ofthesc areas are highly prized by thc residents of the Town. $outhold is one of
thc only towns on Long Island wMrc hamlet ~nters still exist for the most part.
Thc re-zoning of certain parcels withia the corridor to more appropriate uses will
have the effect of enhancing the basic clmracteristics of the hamlet centers and
areas along the corridor.
The statement on page 50 of the Land Usc Study stating that "a reduction in
the potantial intensity of land use ia this a~a is anticipated to have a beneficial
impa~t in terms ofwatcr usage and potential groundwater impact" is rescinded. It
is noted that agricultural us~ may, under ccaain scenarios, result in groundwater
u.~gc and/or contamination above that associated with commercial uses.
However, as stated on pages 4-8 through 4-10 of the Final GELS, thc trend in
agriculture in the Town of Southold is toward crops that require drastically lesser
amounts of irrigation, fertilizer and pesticide, such as vineyards.
· Promote incentive zoning as a means to preserve agricultural and other
desirable parcels, and as mitigatlon for ckange of me where appropriate.
It is recommended that applicants seeking to increase density or change of
use allowed by special exception/special permit in an appropriate zoning dislxict

This recommendation may be utilized in conjunction with the clustering
recommendation above. It is suggested that, where possible, agricultural uses be
maintained along the roadways for scenic vistas and views and then a natural
and/or landscape buffer be provided to screen the new homes. Agricultural uses
along the roadway would maintain the open views and vistas. A landscape buffer
is especially important for screening ofdistunt homes when they are built on farm
fields. This recommendation may be implemented on a site by site basis on
properties where the size and cunftguration can support such a layom.
Develop and implement the u~e of visual resource best management practices.
A suggested list of visual resource best management practices is provided in
Appendix B located at the end of the County Route 48 Land Use Study. These
practices were developed subsequent to the idenfifJvmion of four guiding
principles of the desirable visual char~ter in the Town of Southold. The best
management practices are intended to be utilized at the time of site plan review or
as otherwise deemed appropriate by the Town. Much of the intent of the practices
is to maintain or enhance the open character of the County Rome 48 corridor.

The visual and historical charactex of the hamlet centers a~e based, in part,

were constructed along the major roadways, As development and population in
the Town has increased, many of these older homes are no longer as desirable for
continued residential use due to traffic and surrounding land uses. Changes of use
fxom purely residential to commercial or other use may likely include the removal
of structures that were once a major part of the charamer of the hamlet_
Strengthening of the RO district through amendments to the Code would help to
preserve the architectural character of the hamlets. Recommended code
amendments with respect to the RO district include requiring the adaptive re-use
of existing residences where approlaiale; increa~ the number of allowable uses
permitted in the RO dis~ct, particularly those that ganemte little traffic; increase
the umber of uses permitted in the district by special exception; and ~mend site
plan requirements with respect to buffers, parking and building design.
Amend the Town Cod~ with respect to the Limited Business (LB) Distric&
The Town Coda is r~ommanded to be amended to allow additional a.s-of-
fight uses in the LB zoning district. The site plan requirements associated with
LB zoned properties should be amended to provide for better buffering and
screening of uses. Additionally, the architectmm ora proposed structure in this
district should be in conformance with surrounding area and resemble residential
structures as much ~ possible.

Similar to tim recommendation above, the use of common drives effectively
reduces the number of curb cuts on County Route 411 and Sound Avenue.
ENVIRONMENTAL SETTING; .
POTENTIAL ADVERSE ENVIRONMENTAl, IMPACTS
AND MITIGATION MEASURES
Thc Environmental Setting for the Land Use Study/GEIS is represented by the existing
natuxal resources and human resou&ea found within the County Roun: 48 corridor. The Land
Use Study'reviewed the existin~ COnditions in the COrridor including existing zoning, existing
land use, non-conforming lots, soils, habitats, eeooomy, historical an:ax, and traffic conditions_
Past land use plans, studies and Town actions wen: reviewed in order w identify COmmon
goals for proper development in the Town. These goals were COmpared to the existing
COnditions inthe COrridor and a subsequent list of outstanding needs was developad, indicating
those areas where the exLsting conditions w~re wholly or partially inconsistent with the goals.
Thc diserepancies between land use goals and actual land uses amconsidered to be impacts. The
recommendati.ons provided in the Study are intondcd as mitigation measures to avoid or
minimize any.future discrepancies (impacts) betWeen future land use and the land use goals.

In addition to the analysis described above, a review of the Study was conducted in
comparison with the Griteria for Determining Significance in Section 617.7 of the SEQRA
regulations. Tbese criteria include impacts to air quality; groundwater quality or quantity;
surfac~wat~r quality or 9uantity; traffic; noise levels; solid waste production; potential for
crmion, flooding, lcachlng or drainage problems; impacts to vegetation, wildlife, significant
habitat are~; and threatened or endangered species; impacts to Critical Environmental Areas;
historical or'archaeological resources; architectural or acsthetie resources; existing community or
neighborhood character, energy; and agriculture. This review found that adoption of the Plan
did not exceedany ofthe.threshold~ listed. Accordingly, on.this analysis alone, the adoption of
the Plan is not :anti¢ipaled to result in any significant adverse impacts to any of the criteria
resources~ examined.
· Also :eXamined was the potential for adverse growth-inducing actions and any potential
cumulative i~npacts.from two or more related amions, no one of which would have a significant
impact on the ~nvirunment, but when considered together result in a substantial adverse impact
on thc environment. The analysis of these types of impacts found that they would not be
gcnera~d: bid the adoption of the Study.
Finally,~ the study itself does not, in and of itself, rcsult in any dkact physical activity or
dkect modification of the environment and, therefon:, haq no potential for significant adverse
physical, i~p;,o~, regardless of the aforementioned snalyses. In addition, thc Study docs not

commit the Town to any one course of a~tion. Instead the Study presents, in the form of
reeommen~fions, mitigation measures or a range of mitigation measures that could be utilized in
future land use decisions to minimize or avoid edverse impacts caused by past development
In conclusion, the Town of Southold has not identified any significant m:lverse
environmental impams for this action. As noted above, the proposed act/on is expected to result
in long-term beneficial impa~ts on the Town of Southold including those actions which are
environmentally-sensitive, socially4esirable and economically feasible.
AI,TERNATIVE
The Alternatives section of thc DGEIS describes only one altemat, ive, thc No a~tion Alternative,
which is requir~I by th~ SEQRA regulations. No action hen:in is determined to mean that land
use and deVelopment would eontinue to occur under the present Town Code,. zoning and
regulations, i.e. the status quo. (A No Action alternate entailing a No-Balld and no physical
activity scenario is unrealistic and ur~feasible). No other alternative was discussed in this section

ECONOMIC
Analysis and consideration of economic factors and impacts are not mandated by SEQKA
as they are not directly revolved with the determination of environmental impact. Nevertheless,
when issuing a Findings Statement for a decision. Part 617.1 I(d) of the S EQRA regulations
requires that the lead agency weigh and balance relevant environmental impacts with economic,
social and other considerations.
The Land Use Study offers comprehensive planning recommendations which promote
land use that is within sound environmental constraints and pereractexs. There have not been any
significant adverse economic impacts identified that would result from the approval o£this L~ud
Use Study,
The Land Use Study provides ample opportunities for existing business to expand and
new businesses to locate in the Toutn. Furthermore, the Plan promotes development of land uses
which result in making the Town an attractive place not just in which to work, but in which to
live. The Land Use Study accomplishes this by providing ample areas for the growth of
commercial, residential and agricultural uses while maintaining the open space and rural
char~er o£the Town. Measures intended to maintain the existing open and rural character of
the Town by promoting bal&uced and coherent laud use, are anticipated to maintain or enhance
the draw of tourists and consumers from outside of the Town, thereby bolstering local
businesses_ In addition, Laud Use Study recommendations will help to limit infrasu'ucture costs
by promoting commeaxfial uses in existing commercial enclaves, limiting curb cuts, and
promoting pedestrian-friendly shopping.
Additional SEQRA review will be performed for future specific actions which implement
the recommendations ofthe Land Use Study and which may have an economic impact.

The Town of Southold shall adhere to the above statement and thresholds for review and
implementation of specific actions relate! to thc County Routc 48 Corridor Land Use Study.

CERTIFICATION OF FINDINGS TO APPROVE:
In accordance with Part 617.1 l(d) of the New York State Envirom-nental Quality Review
Act regulations, ~e Town Board of the Town of Southold has considered thc Draft Genetic and
Final Generic Environmental Impact Statements for the action known as the County Route 4g
Corridor Laad U~e Study and has met the requirements of this Part. These Findings contain the
facts end conclusions relied upon ~a support the Town Board's decision and indicate the social,
economic and other factora and standards which formed the basis of its decision.
Furthermore, the Town Board finds that consistent with social, economic and other
essential considerations in the No Action Alternative, the Land Use Study avoids or minimizes
adverse environmental impacts to the maximum extent practicable. The Study provides an
assessment of existing conditions along the corridor and identifies those areas where the exi~ng
conditions are inconsistent with the goals of past land use plans. The Study then offers various
recommendationz as mitigation measures to bring the conditions of the County Rome 48 corridor
into conformance with the goals of the Town. Therefore, adverse environmental impactz will be
avoided or minimized by the implementation of all or part of the recommendations (mitigation
measures) of the Land Use Study, or the implementation of other land use policies that have the
same effect as the Study recommendations.
It is then:fore recommended that the County Route 48 Corridor Land Use Study and its
recommendations be adopted.
