SOUTHOLD TOWN BOARD

WORK SESSION
Present: Supervisor William R. Pell, 111, Councilman John J. Nickles,
Councilman Lawrence Murdock, Jr., Councilman Francis J. Murphy, Justice
Raymond W. Edwards.

11:30 A.M. - Began reviewing the agenda.
12:05 P.M. - Recess for lunch.
2;25 P.M. - Work Session reconvened and the Board reviewed off-agenda items.
2:55 P.M. - Assessor Chairman Henry F. Moisa, and Assessor Charles Watts
appeared before the Board to discuss their report concerning projected assess-
ment gain for 1984. Mr. Moisa reviewed his report which indicated the projection
is $1,600,000.00 for 1984, which is included in the taxable assessed valuation
of $77,605. 764.00. For the projection for the 1985 tax roll, it is much to early
for any estimation as the permits received so far by the Assessors are only for
six months. The figures indicated on the issued building permits are of no value
for assessing, because of the disparity in costs of construction on similar types
of construction. Also, a certain percentage of these permits will not be used
and a good percentage will be carried over to another year as partials because
of different stages of construction by tax status day, June 1st. The assessments
are based on 25% of the building costs, as well as values of 1967. If the State
Equalization rate is being used, it indicates that they are assessing at less than
10% of full value.
REGULAR MEETING
A Regular Meeting of the Southold Town Board was held on Tuesday,
December 27, 1983 at the Southold Town Hall, Main Road, $outhold, New
York. Deputy Supervisor Francis J. Murphy opened the meeting at 3:00
P.M. with the Pledge of Allegiance to the Flag.

DEPUTY SUPERVISOR MURPHY: The Supervisor Bill Pell regrets that he can't
be here. He was here this morning for his last meeting, but he does send his
regrets to everybody and thanks for their cooperation over the year. The Town
Board will meet next on January 1st, 1984 at 2:00 o'clock. There will be an
inauguration of the elected officials. All past officials will be invited to attend.
We would like the public to attend this on New Years Day right here in Town
Hall and there will be, any one who would like to, is welcome to come back to
my house for refreshments after down in Mattituck.

RESOLVED that the Organizational Meetincj of the Southold Town Board will be
held at 3:00 P.M., Tuesday, January 3, 1984 at the Southold Town Hall, Main
Road, Southold, New York.

This resolution was declared duly ADOPTED.

RESOLVED that the next Regular Meeting of the Southold Town Board will be
held at 7:30 P.M., Tuesday, January 3, 1984 at the Southold Town Hall, Main
Road, Southold, New York.

This resolution was declared duly ADOPTED.
Moved by Councilman Murdock, seconded by Justice Edwards, it was
RESOLVED that the following audited bills be and hereby are ordered paid:
General Fund Whole Town bills in the amount of $30,313.45; General Fund
Part Town bills in the amount of $24,477.13; Highway Department bills in
the amount of $10,288.88; Fishers Island Ferry District bills in the amount
of $21,004.49; and Capital Account -Landfill Equipment & Building bills in
the amount of $2,570.00.

RESOLVED that the minutes of the December 13, 1983 Southold Town Board
meeting be and hereby are approved.,

3. Councilmen's reports. Starting with Councilman Townsend.
COUNCILMAN TOWNSEND: I have nothing, Frank, except that I had a peaceful
and fattening Christmas and I hope everybody else had the same.
DEPUTY SUPERVISOR MURPHY: Councilman Murdock.
COUNCILMAN MURDOCK: Of course, my wishes for everybody, also would be
the same as Joe's for Christmas. I would like to express my satisfaction of
havinc~ been with this Town Board for the last four years. I think during the
last four years we've seen the start of a new type of operation to the Town
Board. It's no longer where Town Board members show up on meeting day and
are given a stack of papers and say this is what happened in the two weeks
while you were gone and this is what you're going to vote on today and an
hour later they go home. I think this Town Board has been part of the melding
of state, county and federal jurisdictions that are tending to make this a full-
time job. I don't think there is a member of the Board who have served in the
last four years who have not put in a greast deal more time than what they had
anticipated at the time. I am grateful for the time the four years have been
handled. I think the Town of Southold has done well during that four years
and I think all of the members of the Board that I have served with in the four
years have understood each other and understood their job in the relationship
with the changing times. I've been pleased to see this Town Board accept more
citizen input. I think the average person in the Town of Southold feels more
comfortable coming before the Town Board and feels that they participate a
great deal more in local government and I certainly look forward to that
continuing in the future in the Town of Southold. Thank you, Frank.
DEPUTY SUPERVISOR MURPHY; Thank you, Larry. John? (Nothing.) Ray?
(Nothing, thank you.) Okay, I would like to make just a couple of announcements.
One, Whitey Howard, former Chief of Police here for many years, and a policeman
for many years, died this morning. The visiting hours will be at Horton's on
Wednesday from 2:00 to 4:00 and 7:00 to 9:30, and the service will be at 1:00
P.M~ at Horton's will burial following at Sterling Cemetery. It's sad that it
happens always at the holiday season it seems. I would also, leaving as
Councilman echo the sentiments of Councilman Murdock. I think it was very
gratifying to work, and tremendous experience to work with this Town Board
for the last three years. I'll miss the three people who are leaving, but look
forward to working with the two additional members that are coming on. I
think that we can continue the programs that we have started and working
towards. We have a lot of work to do in the future. Again I'd like to wish
the very best holiday greetings to everyone and for a healthy and happy New
Year.
II. PUBLIC NOTICES.
COUNCILMAN MURDOCK: 1. From the U. S. Army Corps of Encjineers. The
applicant is Jerry Bady on Calves Neck Road, Southold, New York, and the
activity is the reconstruction of a pier and bulkhead and dredging with upland
disposal on Town Creek, on Calves Neck Road, Southold. Comments regarding
the permit application must be prepared in writing and mailed to reach that office
before the expiration date of the notice, which is 9 January 1984.
2. From the U. S. Army Corps of Encjineers. The applicant is Peter
Micciche of Harvard Avenue, Smithtown, New York. The activity is a ramp and
~-~'TR-t~-~-d reconstruction on an unnamed canal off of Corey Creek, Bayview Road,
Southold. Comments regarding the permit application must be prepared in
writing and mailed to reach that office before the expiration date which is the
9th day of January 1984.
3. Notice of Complete Application on behalf of Wilhelm Franken, Michael
/evison, Donald Bayles, c/o J. Geideman, East Marion, New York, Tidal Wetlands,
N.Y.S.-D.E.C., to dredge three areas in a 375 ft. area south of Tarpon Drive to
a depth of S feet below mean Iow water. Two of the areas will include dredging
of intertidal fringe marshes adjacent to the property of Weisman. Place resultant
spoil (200 cubic yards) behind bulkhead at the southwest corner of canal. Project
is located on canal off Southold Bay, south of Tarpon Drive, Southold. Comments
are due no later than January 6, 1984. The contact person is Daniel J. Larkin,
NYSDEC, Bldg. 40, SUNY--Room 219, Stony Brook, New York.
4. From the U.S. Army Corps of Engineers. Applicant is Ernest Wilsberg,
Ole Jule Road, Mattituck, New York, to construct a bulkhead, and maintenance
dredge with upland disposal in a canal off James Creek, Mattituck, New York.
All comments regarding the permit should be mailed to reach that office before
the expiration date which is the 15th of January 1984.
III. COMMUNICATIONS.
DEPUTY SUPERVISOR MURPHY: 1. From the Southold Town Promotion Committee.
The last ditch effort to look to see if there are any allocated funds or surplus
funds left in the Town budget this year. They have some two very worthwhile
projects that they would like to do. Unfortunately we're short on our planned
balance by about $23,000.00 in Whole Town it looks like this year, so we won't
be able to really allocate any additional funds to them, but we will sit down
with the new Town Board and this group and see what we can work out.
2. From our friends in Lon9 Island Cablevision notifying us that
.Spotlight will be 9oin9 out of business January 31st and will be replaced
Immediately by Showtime on February 1st.
3. From H2M Corporation concerning the contract with Southold Scavenger
Waste Pretreatment Facility. The reason we put it on here is because if anyone
is concerned, it is the coming up with the rules and regulations that are a
necessary part of the federal grant that we have to live by when this treat-
ment plant is finished in Greenport, probably two to three years, and it's
part of the work that has to be done beforehand and it definitely has to be
part of the contract before we're going to get any federal aid on this, and
the Town Attorney is reviewing it. We've instigated some of these suggestions
already in the landfill and as soon as our building is operational down there,
these permits will be effective.
IV. PUBLIC HEARINGS. (None).
V. RESOLUTIONS.

RESOLVED that the Town Board of the Town of Southold hereby accepts the
bid of Burt's Reliable Fuel Corp. for supplying the Town of Southold (Fiscal
Year 1984) with fuel oil, at the price of $.0293 above the Northville Industries,
Corp. L.I., Tank Car Consumer Price, as published in the Journal of Commerce
on the date of delivery.

Councilman Murdock, Councilman Murphy, Councilman Nickles.

RESOLVED that the Town Board of the Town of Southold hereby accepts the
bid of Goldsmith & Tuthill, Inc. for supplyin9 the Town of Southold (Fiscal
Year 1984) with diesel fuel, at the price of $.07 above the Northvill Industries,
Corp. L.I. Tank Car Consumer Price, as published in the Journal of Commerce
on the date of delivery.

Councilman Murdock, Councilman Murphy, Councilman Nickles.

Moved by Councilman Townsend, seconded by Councilman Murdock, it was
RESOLVED that the Town Board of the Town of Southold hereby accepts the
bid of Agway Petroleum Corporation for supplying the Town of Southold (Fiscal
Year 1984) with regular leaded gasoline, at the price of $.0415, and unleaded
regular gasoline at the price of $.0400 above the Northville Industries, Corp.
L.I. Tank Car Consumer Price, as published in the Journal of Commerce on the
date of delivery.

Councilman Murdock, Councilman Murphy, Councilman Nickles.
This resolution was declared duly ADOPTED.
Moved by Councilman Murdock, seconded by Councilman Nickles, it was
RESOLVED that the Town Clerk be and she hereby is authorized and directed
to advertise for bids for the purchase of five (5) new 1984 Special Police Type
automobiles, as per specifications, with trade-in allowance for six (6) vehicles
presently owned by the Town of Southold. These vehicles to be paid from the
1984 Police Department Budget.

Moved by Justice Edwards, seconded by Councilman Nickles, it was
RESOLVED that the Southold Town Board declare itself lead agency in regard
· to the State Environmental Quality Review Act in the matter of the application
of Enconsultants, Inc., on behalf of Lewis Edson, for a Wetland Permit on
certain property located on the south side of Clearview Avenue, on Goose
Creek, Southold, New York.
Vote of the Town Board: Ayes: Justice Edwards, Councilman Townsend,
Councilman Murphy, Councilman Nickles. Abstain: Councilman Murdock.
This resolution was declared duly ADOPTED.
DEPUTY SUPERVISOR MURPHY: Number 6 is to apply for a grant that hopefully
will reimburse most of the Town Bay Constable's expenses, or about 90%, if we
could get the grant. Jim McMahon has been most instrumental in bringing this
about.

RESOLVED that the Supervisor be and he hereby is authorized and directed
to file an application with the New York State Office of Parks, Recreation and
Historic Preservation, Bureau of Marine and Recreational Vehicles for special

Grant-in-Aid for expansion of the Municipal Boating Law Enforcement Program
for Fiscal Year 1984.

Moved by Councilman Townsend, seconded by Councilman Murdock, it was
RESOLVED that pursuant to Article 8 of the Environmental Conservation
Law State Environmental Quality Review and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice is
hereby given that the Southold Town Board, as lead agency for the action
described below, has determined that the project, which is unlisted, will
not have a significant effect on the environment.
Description of Action: Application of Michael Carlucci for a wetland permit
to construct bulkhead and floating dock at Conkling Point Creek, off south
side of Island View Lane, Greenport, New York.
The project has been determined not to have a significant effect on the
environment for the following reasons:
An environmental assessment has been submitted which indicated that no
significant adverse effect to the environment are likely to occur should the
project be implemented as planned.
Because there has been a response from the Board of Southold Town
Trustees and Southold Town Conservation Advisory Council indicating that
this proiect would not have a significant effect on the environment.
Because there has been no response in the allotted time from the New York
State Department of Environmental Conservation and the $outhold Town Building
Department, it is assumed that there are no objections nor comments from those
agencies.
Vote of the Town Board: Ayes: Justice Edwards, Councilman Townsend,
Councilman Murdock, Councilman Murphy, Councilman Nickles.

RESOLVED that pursuant to Article 8 of the Environmental Conservation
Law State Environmental Quality Review and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice is
hereby given that the Southold Town Board, as lead agency for the action
described below, has determined that the project, which is unlisted, will
not have a significant effect on the environment.

RESOLVED that the Town Board of the Town of Southold hereby sets Tuesday,
January 17, 1984, Southold Town Hall, Main Road, Southold, New York, as
date and place for hearings upon the followinq applications for a Wetland Permit:
3:30 P.M. - in the matter of the application of Michael Carlucci for a
permit under the provisions of the Wetland Ordinance of the Town of $outhold
to construct a bulkhead and floating dock at Conkling Point Creek, off south
side of Island View Lane, Greenport, New York.
3:32 P.M. - in the matter of the application of Grace A. Finora for a
permit under the provisions of the Wetland Ordinance of the Town of Southold
to construct a floating dock and ramp at James Creek, on the east side of
East Legion Avenue, Mattituck, New York.
Vote of the Town Board: Ayes: Justice Edwards, Councilman Townsend,
Councilman Murdock, Councilman Murphy, Councilman Nickles.

10. Moved by Councilman Murdock, seconded by Justice Edwards,
WHEREAS, Nicholas Schick, on November 21, 1983, filed a Final Environmental
Impact Statement in connection with his petition for a change of zone from "A"
Residential and Agricultural District to "M-I" General Multiple Residence District
on certain property at Orient, in the Town of Southold, New York, now there-
fore, be it
RESOLVED that the Town Board of the Town of Southold hereby determined
thal~ said proposed change of zone by Nicholas Schick will have a siqnificant
effect on the environment, and can reasonably be expected to lead to the
following consequences:
(a) A substantial adverse change to the water quality and quantity
of the area.
(b) A substantial adverse change in the use, or intensity of use of
the land or other natural resources in their capacity to support
sewage disposal.
(c) The change of zone would likely cause a change in the intensity
of the use of the property by increasing the number of people
that would reside and occupy the land.
Vote of the Town Board: Ayes: Justice Edwards, Councilman Townsend,
Councilman Murphy, Councilman Murdock, Councilman Nickles.

Moved by Councilman Townsend, seconded by Councilman Murdock,
WHEREAS, Nicholas Schick, by petition dated July 2, 1982 petitioned the
Town Board of the Town of Southold for a chanqe of zone from "A" Residential
and Agricultural District to "M-I" General Multiple Residence District, and
WHEREAS, said petition was referred to the Southold Town Planning Board
and Suffolk County Department of Planning for official recommendation and
report, and
WHEREAS, the Town Board, pursuant to due notice, held a public hearing
thereon on the 9th day of November, 1982, at 8:00 P.M., at which time all
interested persons were given an opportunity to be heard, and recessed sai.d
hearing and reconvened on the 7th day of December, 1982, at 8:00 P.M., at
which time all interested persons were again given an opportunity to be heard,
now, therefore, be it
RESOLVED that Nicholas Schick be and hereby is Denied the relief demanded
in said petition. The Board has determined that this is not a proper area for
a "M-I" Multiple Residence District, and such a district would be inconsistent
with the Southold Town Master Plan.

Councilman Murphy, Councilman Murdock, Councilman Nickles.
This resolution was declared duly ADOPTED.
Moved by Councilman Murdock, seconded by Justice Edwards, it was
RESOLVED that the Town Board of the Town of Southold hereby authorizes
Wayne Moore, Greenport, New York, to install a soda vending machine in the
east wing basement lunch room of the Southold Town Hall, and Mr. Moore to
be responsible for the maintenance, operation, and insurance coverage for
said machine.

Councilman Murphy, Councilman Murdock, Councilman Nickles.

Moved by Councilman Nickles, seconded by Justice Edwards, it was
RESOLVED that the Supervisor be and he hereby is authorized and directed
to request the Suffolk County Department of Civil Service to provide the
Town with the current Building Inspector List, with a starting salary of
~13,000.00 per annum, 35 hours per week.
Vote of the Town Board: Ayes: Justice Edwards, Councilman Townsend,
Councilman Murphy, Councilman Murdock, Councilman Nickles.
This resolution was declared duly ADOPTED.
Moved by Justice Edwards, seconded by Councilman Murphy, it was
RESOLVED that the Town Board of the Town of Southold hereby rescinds
their Resolution No. 8 adopted at the December 20, 1983 regular me----~'~'i-n-g
of the Board. Said resolution reads as follows:
"WHEREAS, the Town of Southold, by resolution adopted by this
Board on September 6, 1983, authorized the purchase of two parcels of
surplus U. S. Government property at Fishers Island, New York to be
used for the purposes of the Fishers Island Ferry District, and
WHEREAS, a portion of one parcel has erected thereon a four family
residence building which the Commissioners of the Fishers Island Ferry
District have determined will not be needed for District purposes, and
WHEREAS, the said Commissioners have received an offer to purchase
said four family residence building together with approximately 39,106 sq.
ft. of land upon whcih said building is erected for the sum of $150,765.00, and
WHEREAS, this Board hereby determines that it is in the best interest
of the Town of Southold and the Fishers Island Ferry District that said land
and building, which is not required for Town and Ferry District purposes, be
sold for the sum of $150,765o00.
NOW, THEREFORE, IT IS RESOLVED that the sale of the aforesaid land
and building for the sum of $150,765.00 is hereby authorized, said sale to be
made pursuant to the terms and conditions of the Contract of Sale approved by
the Town Attorney, and it is further
RESOLVED that this resolution is subject to a permissive referendum."

This resolution was declared duly ADOPTED.
COUNCILMAN MURPHY: Number 15 now is to make this resolution again. The
reason it had to be done is because of the timing in advertising. The paper
wasn't published this week and the legal time limit would expire.

WHEREAS, the Town of Southold, by resolution adopted by this Board on
September 6, 1983, authorized the purchase of two parcels of surplus U.S.
Government property at Fishers Island, New York, to be used for the
purposes of the Fishers Island Ferry District, and

by the Town Attorney, and it is further
RESOLVED that this resolution is subject to a permissive referendum.

RESOLVED tht the Town Board of the Town of Southold hereby hires the
followin9 part-time Police Officers, effective January 17, 1984, at a salary
of $5.00 per hour: Edward Grathwohl, Charles T. King, Vincent Tirelli,
Henry F. Santacroce, Jr., Joseph A. Conway, Jr., and be it further
RESOLVED that Edward Grathwohl, Charles T. Kin9, Vincent Tirelli, Henry
F. Santacroce, Jr., Joseph A. Conway, Jr., and Donald Dzenkowski, be and
hereby are authorized to attend Police Officer Trainin9 School at the Suffolk
County Police Academy, Westhampton, New York, beginning January 17, 1984
for a period of 285 hours; the Town to provide transportation only.

Councilman Murphy, Councilman Murdock, Councilman Nickles.

WHEREAS, the Town of Southold, Suffolk County, New York, herein called
the "Applicant", after thorough consideration of the various aspects of the
problem and study of available data, has hereby determined that the planning,
desic~n and construction of certain works, required for the treatment o---Ir
sewage, generally, described as the construction of the scavenger waste pre-
treatment facility, and identified as Project Number C.-36-1120-02-0, herein
called the "Project," is desirable and in the public interest, and to that end
it is necessary that action preliminary to the planning, design and construction
of said Project be taken immediately; and
WHEREAS, under the Federal Water Pollution Control Act, as amended, the
United States of America has authorized the making of grants to aid in financing
the cost of planning, design and construction of necessary treatment works to
prevent the discharge of untreated or inadequately treated sewage or other waste
into any waters and for the purpose of reports, plans and specifications in
connection therewith; and
WHEREAS, Chapter 659 of the Laws of 1972 of the State of New York provide
financial aid for the planning, design and construction of Water Quality Improve-
ment Projects; and
WHEREAS, the Applicant has examined and duly considered the Water Pollution
Control Act, as amended and Chapter 659 of the Laws of 1972 of the State of
New York and the applicant deems it to be in the public interest and benefit
to file an application under these laws and to authorize other action in
connection therewith;
NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town of
Southold that the filing of application in the form required by the State of
New York and the United States and in conformity with the Water Pollution
Control Act, as amended and Chapter 659 of the Laws of 1972 of the State
of New York is hereby authorized including all understandings and assurances
contained in said applications. That Holzmacher, McLendon & Murrell, P.C.,
125 Baylis Road, Suite 140, Melville, New York 11747 is directed and authorized
as the official representative of the applicant to act in connection with the
applications and to provide such additional information as may be required;
that, for the purposes of New York State Finance Law, Francis J. Murphy,
Supervisor, be designated as Fiscal Officer of said Applicant to receive and
distribute funds as the authorized Fiscal Officer of the Applicant in connection
with said Project; that the Applicant ac~rees that it will fund its portion of the
cost of said Water Quality Improvement Project; that one (1) certified copy of
this rLoolution be prepared and sent to the New York State Department of

for the selection of an environmentally acceptable site for a new airport,
develops a set of airport layout plan drawings, develops financial plan and
performs an environmental assessment for the proposed airport.

COUNCILMAN MURPHY: That, I believe, is the end of our prepared and

COUNCILMAN TOWNSEND: I just wish the departing Councilmen and other
elected Town officials the best of luck in the future and my sincere gratitude
to the help they gave me as a new Councilman coming on the Board.
COUNCILMAN NICKLES: It has taken four and half years, but I finally
got the last vote on this Town Board. I thank Bill Pell for that. I'd like
to share in the Town Board's good wishes for 1984 and all the new elected
officials that are coming on board and I hope Frank, the new Supervisor,
success and is able to get along with the new people. I know he's going
to be able to get along with one of them. If you have any problems, Frank,
you can phone it in to me on your telephone.
COUNCILMAN MURPHY: I'll use my car phone.
COUNCILMAN NICKLES: It has been a privilege to be an elected official.
I think we all share in that, and I think one of the pleasures that we have
is we find out we have so many resources in the Town, which is basically
which has made my job easier. I'd like to thank all of them, I'm not going
to go through all the names, but all the different departments in the Town.
I think the main thing of being a Councilman is being able to find answers,
and if you know who to go to you can get the answers and we're fortunate
to have people that are knowledgable, that are full-time people here, that
we can rely on. Especially like to thank the Town Clerk, who has been
like my Town Hall mother, and has really helped me a lot, and the Town
Attorney, Bob Tasker, who has been very helpful in any legislation that
I proposed. Other than that, have a happy 1984 and Joe, in case you don't
have anybody to debate with next year, I'll stop in now and then and give it
a go.
JUSTICE EDWARDS: I just want to wish my departing brothers well, and what
John next to me here said, it's going to be a privilege for me next year to
get my name off the first call on the vote. I hope I'm moved up. It's quite
difficult at times to wonder how something goes like that, being the first one.
Happy New Year to all of you, I'll see you next year.

Southold Town Police Chief THEODORE B. HOWARD, and
WHEREAS, in his service to the people of the Town of Southold as a Southold
Town Police Officer for over twenty years, retiring on October 26, 1971, during
which time he served as Sergeant and Chief of Police, and prior to that time a
Police Officer for the Village of Greenport, beginning on April 1, 1933, Mr.
Howard distinguished himself as a dedicated and conscientious public servant, and
WHEREAS, the Town Board of the Town of Southold wishes to give formal
expression of its loss in the death of THEODORE B. HOWARD, a man esteemed
by his associates and respected by all, now, therefore, be it
RESOLVED that when the Town Board adjourns this day, it does so out of
respect to the memory of THEODORE B. HOWARD, and be it further
RESOLVED that a copy of this resolution be spread upon the minutes of this
Town Board meeting and a copy be transmitted to the family of THEODORE B.
