HomeMy WebLinkAboutTB-09/29/1983-SSOUTHOLD TOWN BOARD SPECIAL MEETING SEPTEMBER 27, 1983 Waiver of Notice of Town Board meeting was duly executed by the 'following members of the Southold Town Board who attended this Speci~al Meeting at 4:01 P.M., Tuesday, September 27, 1983 at the Southold Town Hall, Main Road, Southold, New York: Supervisor William R. Pell, III, Councilman John J. Nickles, Councilman Lawrence Murdock, Jr., Councilman Francis J. Murphy, Councilman Joseph L. Townsend, Jr., Justice Raymond W. Edwards. Also present were Deputy Town Clerk Elizabeth A. Neville and Town Attorney Robert W. Tasker. Moved ~y Supervisor Pell, seconded by Councilman Murddck, WHEREAS, Stony Brook Construction Corp.'s bid for the construction of a pre-engineered metal building at the Southold Town Landfill Site at Cutchogue, New York has heretofore been accepted by this Board, now therefore be it RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs Supervisor William R. Petl, III to execute an agreement between the Stony Brook Construction Corp. and the Town.Of Southold for the placement of material and equipment at the Town Landfill Site at Cutchogue, New York and the excavation~ - of material prior to the execution of the agreement between the Town of Southotd in accordance with the bid documents. COUNCILMAN TOWNSEND: Didn't it mention something about insurance certificates? TOWN ATTORNEY TASKER: That's in the agreement. Basically, I can tell ~ou what the agreement is. The agreement permits Stony Brook to enter on the l~andfill site, store materials and equipment, and to do excavation preparatory to the construction of the building. That's the first under- standing. Secondly, Stony Brook will agree that they provide a liability insurance policy in the amount of one million dollars ($1,000,000.00) ~ _ covering the Town of Southold as a named insured against anv accidenz~ that may~ happen prior to the submission of their other insurance pollcies. Number three, Stony Brook agrees to hold the Town of SouthOId free and harmless from any accidents or claims by reason of thei~ occupancy of the site before the signing of the contract. That's basically the agreement.. Vote of the Town Board: Ayes: Justice Edwards, Councilman Townsend, Councilman Murphy, Councilman Murdock, Councilman Nickles, Supervisor Pell. This resolution was declared duly ADOPTED. Moved by Supervisor Pell, seconded by Councilman Murdock, it.was RESOLVED that this Town Board meeting be'~djourned ~t 4:'05 P.M. Vote of the Town Board: Ayes; Justice Edwards, Councilman Townsend, Councilman Murphy, Councilman Murdock, Councilman Nickles, Supervisor Pell. This resolution was declared duly ADOPTED.
