Neville Town Attorney Gregory A. Yakaboski SUPERVISOR HORTON: Moving to our next public heating regard to a Local Law. JUSTICE EVANS: We had a similar public hearing two weeks ago, and I am afraid we are going to have another public hearing on the same law, because we already decided there are some changes that need to be made. This is Local Law on Parking Regulations and the Ticket. "NOTICE IS HEREBY GIVEN that there has been presented to the Town Board of the Town of Southold, Suffolk County, New York on the 4th day of December, 2001, a Local Law entitled "A Local Law in relation to Parking Offenses and Penalties, Chapter 92, Articles IV and VI, Vehicles and Traffic, of the Code of the Town of Southold', now, therefore, be it NOTICE IS HEREBY FURTHER GIVEN that the Town Board of the Town of Southold will hold a public hearing on the aforesaid Local Law at the Southold Town Hall, 53095 Main Road, Southold, New York on the 15th day of January, 2001 at 7:37 p.m., at which time all interested persons will be given an opportunity to be heard. The proposed "A Local Law in relation to Parking Offenses and Penalties, Chapter 92, Articles IV and VI, Vehicles and Traffic, of the Code of the Town of Southold" which includes the following: LOCAL LAW NO. 2001 A Local Law in relation to Parking Offenses and Penalties, Chapter 92, Articles 1V and VI, Vehicles and Traffic, of the Code of the Town of Southold BE IT ENACTED by the Town Board of the Town of Southold, as follows: Chapter 92, Articles IV and VI, Vehicles and Traffic, of the Code of the Town of Southold is hereby amended as follows: ARTICLE IV, Parking, Standing and Stopping {}92-49. Additional parking regulations. A. No person shall park a vehicle so as to obstruct a fire hydrant. B. No person shall double park a vehicle on any Town highway or roadway. 2 C. No person shall park a vehicle in whole or part on a sidewalk located adjacent to a highway. D. No vehicle shall be parked upon any highway without first being registered and inspected pursuant to the Vehicle and Traffic Law of the State of New York. E. On a one-way roadway vehicles shall be parked facing in the direction of authorized traffic movement; on a two-way roadway such motor vehicle shall be facing in the direction of authorized traffic movement on that portion of the roadway on which the roadway exists. F. No person shall park a vehicle so as to obstruct any driveway. G. No person shall park a vehicle in a position not entirely within the area designated by parking space pavement markings. §92-49A. No Stopping Zone. The parking of vehicles is prohibited at all times in the following areas designated as "No Stopping Zones": Area Description (Reserved) §92-49B. Fire Zone The parking of vehicles is prohibited at all times in the following areas designated as "Fire Zones": Area Description (Reserved) §92-49C. Bus Stops. The parking of vehicles is prohibited at all times in the following areas designated as "Bus Stops": Area Description (Reserved) ARTICLE IV, Penalties §92-60. Penalties for offenses. [Amended 5-13-1997 by L.L. No. 10-1997] B. All persons cited on a town parking summons for violation of this chapter, permit parking or parking related violations shall be subject to a fine ~f $25 as set forth below and shall answer and/or appear on or before the designated return date 30 days after the issuance of the summons. Persons failing to a~Fcar on or before the designated return dam answer before the expiration of 30 days after issuance of the summons shall be subject to the fc!!c, wing surcharges penalties set forth in the Penalty Schedule below, in addition to the prescribed fines: (1) For failing to answer and/or appear ~vithin three monthz of the return date: $20. (2) For failing to answer and/or appear within six months of tho return date: an additional $20 in addition to the sumhargo imposed in Subsection B(1) above. TOWN ATTORNY YAKABOSKI: Basically it just sets forth a graduated fine schedule. It sets forth some additional violations in the Town Code. I think it is going to be a system which is much more systematic, uniformly applied and hopefully achieve the goals of the parking provisions. JUSTICE EVANS: There is an affidavit that it was published in The Suffolk Times, and that it was put on the Town Clerk's Bulletin Board. There is no correspondence. As I said we are going to have a similar hearing two weeks from now. TOWN ATTORNEY YAKABOSKI: It is probably going to another month. There were some procedural situations that Mary Wilson and myself came up with, and we were a little concerned about, so we just want to make sure those are all clarified We are going to ask the Board to hold it tonight. If there are any comments we appreciate them, We have to incorporate them, so we will do this one last time and be done. I have an affidavit that it was on the Town Clerk's Bulletin Board, and also that it was published in the local paper. SUPERVISOR COCHRAN: You have heard the reading of the public notice. Anyone like to address the Town Board on this particular Local Law? (No response.) This had been advertised, and we felt it was important to still hold the hearing, but the Board itself in discussion feels that there is still some revisions that should be made on this, and some are major, so I will close the heating, but this will come back again. It will probably be re-advertised because the corrections or the additions, not corrections, the additions are major in scope. Elizabeth A.
