Dear Supervisor Cochran,
A trip overseas will prevent us from attending the August 18 hearing relevant to a local law in
relation to No Parking signs on Mare Street in New Suffolk. We are all aware ora bad situation
due to heavy traffic and parking at the Legends Restaurant that needs to be addressed. However, a
No Parking Zone on Main Street will result in more traffic and parking on all side streets in the
residential village. Our side streets are not ready to absorb Main Street parking. For example one
Main Street resident has his own home plus 3 rental cottages-- where would he park if there were
to be a No Parking Zone?
If Legends parking is a problem, then Legends has to find a solution to organize and provide
parking for its customers--but local and long time residents and taxpayers should not be
penalized,

Dear Ms. Cochran:
We are unable to attend the board meeting on August 18, 1998 due
to prior commitments. We do feel we must write regarding the pending
changes with the ultimate result of restricting parking on Main
Street in New Suffolk. Our concern as residents for the past 7
years begins with what is sure to create insurmountable problems
with the residents of our community.
The parking restriction concerns for the most part the successful
restaurant/sports bar, Legends. 'No Parking' on Main Street will
naturally force Legends patrons to park at the next accessible parking
areas, which are our residential side streets.
Because it has been determined by town officials that the popularity
of this business is creating parking problems on the streets of
our community, it should not be the residents of the community who
bear the responsibility.

We are newcomers to the New Suffolk area as we bought the residence at 965 King St three
years ago. We are invested not only financially but emotionally in this beautiful and peaceful
part of the world and plan to be there as good neighbors and contributors to this community.
We were recently told of the resolution to make a No Parking zone on Main St. I am confused
why a proposal wasn't first made, rather then immediately going to a resolution. I can't
understand what reasons would support such a decision in the first place. I also feel that
diverting parking from Main St. which of course leads to New Suffolk's commercially zoned
area would damp this parking overflow onto the residential side streets which is simply unfair
and not a good solution to parking overloads related to business traffic.
My wife and my working schedules absorb us in New York during the weekdays often, however,
I will make every effort to be able to attend this hearing on the 18th. In the event that I am
unable, I would like our voices to be heard and I want to keep abreast of this situation and help
find a solution for this parking problem. However, I think that the one which is proposed is not
the best one.

Dear Madam:
As the property owner of record at the eastern side of Jackson,
Fifth &
Main Streets, I am writing you in opposition to this August 18th hearing on
the NO PARKING ON MAIN STREET RESOLUTION°
The "WHITECAP" rentals, my neighbor on Main & Fourth Streets, and another
4-cabin rental, at Main & Second Streets, have guests who park on Main Street.
No parking would result in the "WHITECAP" tenants who normally would park on
Main Street would now park in front of my property on Fifth Street; tenants
at the cabin site would have to park in front of homes not on Main Street.
If Main Street gets "NO PARKINGT" why shouldn't other streets get the same
"NO PARKING?"
This "NO PARKING" will mushroom and if not granted to others if Main Street
gets it, "arbitrary & capricious" litigation will no doubt begin by those not
treated "equitably."
Main STreet, east of First Street, needs to the parking to remain for the
commercial strip and would only cause those parkers to utilize other streets
if the no parking proposal is accepted.
Again, I oppose this resolution for the reasons stated above and further
state that I have not seen any notification of this meeting's agenda in the
legal notices in the TRAVELER-WATCHMAN.

COUNCILMAN ROMANELLI: "Public Notice is hereby given that there has
been presented to the Town Board of the Town of Southold, Suffolk
County, New York, on the 4th day of August, 1998, a Local Law
entitled, "A Local Law in Relation to No Parking Signs at Main Street, New
Suffolk". Notice is further given that the Town Board of the Town of
Southold will hold a public hearing on the aforesaid Local Law at the
Southold Town Hall, 53095 Main Road, Southold, New York, on the 18th
day of August. 1998. at 8:10 P.M., at which time all interested persons
will be heard. This proposed "Local Law in Relation to No Parking Signs at

State." I have affidav|ts that it was posted on the Bulletin Board, and
also that it published in the local paper, and that is it.
SUPERVISOR COCHRAN: Is there anyone that would like to speak in
relation to this Local Law?
JOAN ROBBINS: My name is Joan Robbins, and the Zamphiroffs have
been friends and neighbors of ours for many years. They have a problem.
I am afraid that the resolution as proposed gives me some personal concern.
We live, also, on the North side of Main Street in New Suffolk on the block
between Second and Third Street. I am afraid of the domino effect if
people can't park between First and Second they may begin to park between
Second and Third, and then I will be asking for no parking signs, and so
it goes. New Suffolk is almost totally built now. The lots are very small.
Some of them an acre or even less, and some of us live practically at the
street. I would hate to see no parking all along Main Street. However, if
that is going to happen we will live with it. My main concern is that the
Zamphiroff I can understand their frustration of a situation that has
become intolerable to them, but the proposed solution is a band-aid
approach. It doesn't really identify the problem much less address it, and I
don't think they are the ones that should be made to find the solution.
The people who park on that block are not there to look at the waterfront.
They are customers of Legends. Legends is one of our favorite restaurants.
That is the trouble. It is everybody's favorite restaurant. If they were
open for breakfast there would be thirty cars down there in the morning,
but is insufficient off-street parking. Early on, as soon as it became
possible, because the property was in limbo, I think they made some
arrangement to use part of the Raynor property across the street on First
Street. I don't know anything about the arrangement, or the extent of the
footage, but last Tuesday evening, August 11th, about 6:00 P.M. I
counted 25 cars in that space, perpendicular to the street, in the space
allotted between the back, the very back of Captain Martyrs and Main
Street, and another ten cars in front of the restaurant, and the decrepit
building adjacent, if that ever has a new life it will probably be even
worse, and two private homes. I don't know what could be done, but it
seems to me that it is not just the Zamphlroff or the residents, but also
the Harkoffs and the Town Department should try to find a way. I don~t
know if more space could be made available on the Raynor property. The
last thing in the world I would ever want to see is the waterfront paved
over, but I don~t know if some of Captain Martyrs space could be
available, but there are also enough signs there to tell people where to go.
There is nothing that says, parking for Legends only in the space allotted.
I don't know if they can be directed down First Street towards the bay, or
down Main Street instead of up. Is there such a thing as parking for
residents only? I think one neighbor had a suggestion. I don't know if it
would be acceptable to the Zamphiroffs, but would it be possible to block
off what would be his driveway, you know, do not block driveway? If you
take the ferry back to Greenport from Shelter Island, and have been on
that ferry line, you just see sign after sign, do not block driveway. I
just think that some effort has to be made by everybody to find a way to
help us out.

SUPERVISOR COCHRAN: Thank you. Before we go any further I would
like to just share something with you. Normally when the Highway
Superintendent receives a request or several requests for a change in
parking and so forth, it then gets sent down to the Town Board, and it is
then put on for a public hearing, which is happening now. I would like
the record to show that these petitions, there is 24 names on them, in
addition to the correspondence we received, there is a overwhelming
opposition to putting a no parking zone on Main Street. Mr. Jacobs has
withdrawn his request, and I support him in this, and if the Town Board
also supports this, it is a dead issue. Yes. There will be no signs down
there, but you did make a good suggestion. Henry Raynor, we are friends
of such, that we can talk back and forth in honesty, and perhaps we can
do something with a little bit more land somewhere down there for municipal
parking.
DENNIS HARKOFF: I already rent land from Henry Raynor. Bill from
Captain Marty's has no problem with my cars parking over there. I mean,
I walk around the block, and I am not saying people don't park going up
towards the west. All this week I walked around a couple of times, you
know, during the night. On Friday and Saturday night I will say there was
one or two cars there. I don't understand the problem. Mostly it is my
people that work for me.
SUPERVISOR COCHRAN: Dennis is owner of Legend down in New Suffolk,
which we all enjoy.
DENNIS HARKOFF: I tell my employees to park on Main Street, but down
by the Raynor property between his two lots, and I, myself, park
anywhere away from the restaurant for one purpose to give my customers
room to park. I have walked between First and Second, and I don't really
see an issue. There is not many cars. I mean, I don't understand. I am
sorry. I am a little ignorant on the issue, but I don't know where the
people are going to park that stay in the cabins where the person doesn't
want parking. I mean they rent out cabins, I mean little cottages.
SUPERVISOR COCHRAN: Dennis, the Board supports the will of the people
in New Suffolk that they would prefer not to have no parking signs there.
So, as far as we are concerned it is a dead issue.
DENNIS HARKOFF: I am trying my best. If Henry would rent me more
land I would do it. I pay for that land, and if he ever withdraws I don't
know where they are going to park, but it is a community, it is a business
district, and Main Street, U.S.A. has parking. I'm sorry.
COUNCILMAN MURPHY: Jean, could I just say something quickly? I
thought this lady who just spoke a few minutes might have had a partial
solution to this, and is what they do on Shelter Island is they kind of X
the front of the driveways for no parking.
DENNIS HARKOFF: How about cones or something?

COUNCILMAN MURPHY: Cones might have to be moved, and stuff, but
even if they just painted the X's they way they do on Shelter Island
along the ferry line in front of the driveways. I mean, that is a no parking
area. If somebody parks in there, and the police come down, and if you are
parked in one of those x zones, bang you are going to get a ticket.
DENNIS HARKOFF: But that is a no parking sign.
COUNCILMAN MURPHY: But it is only in front of the driveway, Dennis. I
am not saying any of the others. So, the man has access coming in and out
of her driveway.
SUPERVISOR COCHRAN: Something we will have to look at. Evidently
additional parking is needed, so we will begin to look at that.
ABIGAIL WICKHAM: Good evening, my name is Abigail Wickham. I
represent the Zamphiroffs, who have asked me to bring a letter to the
Town Board in anticipation of a public hearing, but we like to ask that we
would be allowed to read it in any event, so that you can be aware of their
position on that. It is addressed by the Zamphlroffs to the Town Board of
Southold. We are not very good public speakers, so please bear with us
while we give to you the reasons for our request that a no parking sign be
placed in New Suffolk on the north side of Main Street between First and
Second Street. We have been coming to New Suffolk since 1959, and have
lived at 17195 New Suffolk Avenue since 1954. We are both 76 years of age,
and retired. Mr. Zamphiroffs has a pacemaker, and all this
unpleasantness is not doing him any good. We would like to enjoy our
retirement years in New Suffolk, and we do not want our property to
become a parking lot. The last year and a half has been the most
unpleasant time we have had in New Suffolk. Customers of Legends are
parking all over New Suffolk, but particularly along our property. When we
go shopping many times we will not have a parking space to unload. We
can't park in front of our house should others be allowed to do so, who are
just here temporarily. We live in a small quiet community, and have the
expectation that our home should not be overrun by commercial enterprise.
People park in our driveway although we have a sign on the gate not to
park there, but if we say anything we are being screamed at with four
letter words, and other unpleasantries, including threatening physical
harm. We do not need this aggravation. Also, we can not keep the
sidewalk and the grass in order with people driving over newly seeded
grass. The side along the grass is eroding, and anyone who stumbles or
falls we feel we may be liable. We are happy for Legends to be so
successful, but shouldn't a restaurant have enough parking space to
accommodate it's customer. What about renting more space on the
waterfront, or use the beach parking lot? In addition the noise and
pollution are very disturbing as the sidewalk and our fence, where people
park are very close to our house, and we have to put up with it from noon
until after midnight with car doors being slammed, motors being revved,
loud conversation by slightly intoxicated people who throw bottles and cans
over the fence, or on to the sidewalk. Anyone who walks by can see how
badly our sidewalk looks compared to others along Main Street. The level of
parking is now significantly greater than it has been for many, many years
in prior businesses at this location. We hope we are not becoming another

case where we are being pushed out of our houses
and properties to accommodate businesses. We do pay taxes, too.

problem down there that does need to be addressed. I think perhaps the
suggestion of no parking in the driveway might be a partial solution, but
necessarily the full one.
SUPERVISOR COCHRAN: I agree. I will contact Ray Jacobs from the
Highway Department, and we will look immediately as far as marking more
distinctly the driving area, and then we will look at it as a problem,
parking in the area. Anyone else like to address the Board in relation to
no parking on Main Street in New Suffolk? (No response.) If not, I am
going to close the hearing.

As I shall be unable to athmd the ,August 18 hearing concerning thc proposed resolution
regard'rog on-street parking on Main Street, New Suffolk. I would like to contribute the following
comments in written form:
1. I am well aware of the parking problem tlmt the resolution is intended to address, but I do
no*. believe that the proposed resolution, which prohibits parking just on the north side of Main Street
betwccn First and Second Street, represents an adequate solution. Its main effect willl be only to divert
parking to the south side of Main Street (where my own house is located), or to other sections of Main
Street or to other streets in the immediate vicinity.
2. A resolution whose primary effect is to shift the problem will only invite subsequent
proposals for on-street parking restrictions.

wonld be unreasonable in a place like New Suffolk-as well as unfair to residents who do not have
driveways.
4. As far as that particular section of Mum Street is conceme& a less drastic solution would be

5. So far as the sonrce ofthe problem is the existence of highly successful restaurants
at or near thc ba~ of Main Street, thc solution seems to lie in having the rcstaurmats provide adequate
off-street parking for their patrons.

I want to thank your department for listening and giving
me important information relevant ct a local law in relation to No parking
sign on Main Street New Suffolk. This is an important issue for the
Community that desrves more imput with the concerned citizens who
have not been informed in due time. I took it upon myself to post a
notification on a bulletin board near the New Suffolk post office yesterday.
I shall be out of the country till August 22 but someone is trying to
get a petition that will be brought to the hearing on August 18.
