COUNCILMAN RICHTER: "Public Notice is hereby given that there has been presented on the Town Board of the Town of Southold, Suffolk County, New York, on the [}th day of May, 2000 a Local Law entitled "A Local Law in Relation to Parking on the Anchorage, Chapter 92 of the Code of the Town of Southold". Notice is further given that the Town Board of the Town of Southold will hold a public hearing on the aforesaid Local Law at the Southold Town Hall, 53095 Main Road, Southold, New York, and hereby sets 5:08 P.M., Tuesday, June 6, 2000 as the time and place for a public hearing at which time all interested persons will be heard. This proposed "Local Law in Relation to Parking on the Anchorage", Chapter 92 of the Code of the Town of Southold" which reads as follows: A Local Law in Relation to Parking on the Anchorage BE IT ENACTED by the Town Board of the Town of Southold as follows: Chapter 92, Article IV, Section 41 (Vehicles & Traffic) of the Code of the Town of Southold is hereby amended as follows: To install No Parking signs as follows: Between the Name of Street Side Hours of The Anchorage Both 6:00 P.M. to 6:00 A.M. Location in the hamlet of Mattituck o both sides of the street in an Easterly direction for a distance of 465 feet. 2 II. Severability. If any section or subsection paragraph, clause, phrase or provision of this law shall be judged invalid or held unconstitutional by any court of competent jurisdiction, any part thereof other than the part or provision so adjudged to be invalid or unconstitutional. IH. I have affidavits that it was posted on the Town Clerk's Bulletin Board, and the legal notice. There is no other correspondence. SUPERVISOR COCHRAN: Thank you. Is there anyone that would like to address the Town Board either pro or con on the traffic change on the Anchorage? SID OLSTAD: My name is Sid Olstad. I called attention to this last month, and entertained because it was a typo. I have a suggestion. Instead of 6:00 P.M. to 6:00 A.M., why not make it sunset to sunrise? That way in the summer people get more chance to enjoy that place a couple of hours after dinner, or something, and in the winter the neighborhood will get a longer period of no parking. Sunset is at 4:00 o'clock in the wintertime, so it is a win-win situation. If you have to close it at all I hate to see the roads closed. I live across from the Mattituck Town Launching Ramp, and 1 don't complain about noise at 5:00 o'clock in the morning with their trailers, motors that nm out on the water loud. I don't complain about it, and I live there. SUPERVISOR COCHRAN: I realize that. Let's hear what everyone has to say. SID OLSTAD: That could go for all the street closings, Marratooka, Duck Pond. I mean it is just a suggestion. There is one house that looks to be affected, maybe two or three others. I live closer to the Town launching Area than some of these houses. Only a suggestion. SUPERVISOR COCHRAN: Thank you. Usually in V&T, because they can be enforced by the police officer. It certainly is clearer the time, rather than a sunset. That is a judgment call. SID OLSTAD: It is obvious. SUPERVISOR COCHRAN: It is tough to enforce. May we hear from any of the others? SID OLSTAD: We have a highly trained well paid police force. SUPERVISOR COCHRAN: Yes, we do. We will consider it. We will look at it. Who would like to speak? BORGE ESPENSEN: My name is Borge Espensen. I live in the Browers Woods area, and I think there is a little mistake here about this Anchorage. There are two Anchorages in Mattituck. One is the launching ramp, which the gentlemen here has spoken of, and the other one is adjacent to the Browers Woods Association property off WoodcliffDrive. 3 SID OLSTAD: That is one I am speaking of. SUPERVISOR COCHRAN: This isn't a give and take. We have to kind of let him speak, and then you are more than welcome to come back to the mike and share your thoughts. BORGE ESPENSEN: I just wanted to be sure we are talking about the same Anchorage here. That's all. SUPERVISOR COCHRAN: It sounds like we are. Mr. Murphy? PAUL MURPHY: This is a letter I will read it to you. I am representing the Brower Woods Association. The letter that was just handed in dated June 5, 2000. Town Board of the Town of Southold, Town Hall, Southold. To members of the Town Board. As per the legal notice posted pertaining to Local Law No. of 2000 & Chapter 92, Article iV, Section 4, the members of the Brower Woods Association are in agreement with the local law pending. It's a win-win situation for all concerned, safer less crowded streets for our residents and visitors, less maintenance work and waste removal for the Highway Department, lessened Police Department activity and public and private property destruction reduced, and much reduced public nuisances and disorderly conduct by groups of people. SUPERVISOR COCHRAN: Thank you, Mr. Murphy. Anyone else like to address the Town Board? FRED RANGANESCHI: My name is Fred Ranganeschi. I am the Past President of the Brower Woods Association. I don't know, and I was not asked last week whether the fact that this police report indicated that the windows on one of the houses was shot at. I would like to mention that the home belonged to Mr. Baxter, who is in his seventies. He fought a war, was wounded, and dragged across the lines, and still carries shrapnel in his lungs, right across the line by Germans. This man wants a little peace and quiet. His wife was in the house when the bullets, pellets actually, stuck the window in two different places. Those shots came from the Anchorage. Thank you. SUPRVISOR COCHRAN: Thank you, sir. We don't like to hear those kinds of things happening in Southold. We think of ourselves as a different kind of community. Anyone else like to address the Town Board? COUNCILMAN ROMANELLI: Is this a consistent police problem down in that area, or is it pretty much a one-time situation? FRED RENGANESCHI: Constant. It allows residents of that area (tape change) We do have people come in that road, step over the barrier, and fish, pitch a tent is the other thing, and they are on environmentally controlled grassland. They walk through it, fish from it, so it is a problem. Thank you. SUPERVISOR COCHRAN: Anyone else like to address the Town Board? 4 SID OLSTAD: I would like to add that the town road, and the Brower Woods property Association are adjacent to each other. There is no demarcation at all. No one can tell where one begins, and the other ends. In the past we have built a fence, which has gone down. We have planted various types of shrubbery, but they were torn up. We don't know what else we can do to buffer our own property. Most people that come down there, who know there is a Town road there, they consist of the whole area of it, the Town road and Browers Woods property. When you mention it to them that it is private property they just don't know. They hadn't heard it. We also have people come around the fence with the dogs. They live in a truck, or van. Another thing that happens that a lot of people in the area have fences, and some women, who want to walk their dogs, late at night before going to bed, they will not walk down that area when those people are down there. They are afraid to walk down there. That is public property. SUPERVISOR COCHRAN: Is the neighborhood mostly a senior neighborhood? Would a barrier, a guardrail of some sort to divide the properties, and show division be helpful? SID OLSTAD: It would at least delineate one property from another. That would be a step in the right direction. Another thing that can be done, which is an idea I have is that on town property put up a sign, no parking beyond this point, and this would not infringe on anyone. You are allowed to use the property. They could come down. They could drive down, and park their car, and walk out to the water, and enjoy the area. It would cost basically the cost of a sign. COUNCILMAN ROMANELLI: What about what the other man said, no parking after sunset? That sort of enhances the summer a little bit. SD OLSTAD: Sunset to sunrise that is a good idea, too. We had spoken about it. COUNCiLMAN ROMANELLI: I am sure most of the problems happen after dark. SD OLSTAD: One of the things you have to understand is the people who are abusing this property down there are people who don't leave their cars. Without the cars they are dead, so if we could discourage parking down there this would erase them. At the same time they could park towards Blue Cliff Drive. People who wanted to come, and you know have a picnic, or whatever they want to do. SUPERVISOR COCHRAN: Thank you. Mr. Murphy? PAUL V. MURPHY: This whole situation we discussed with the Chief of Police, and discussed with the Highway, and by their suggestions, what we ask for is initially what we would like to do is to restrict parking. Ideally, there would be no parking. Whether we put fences up. That is good, too. We have to restrict the traffic, and make it unattractive. (Unintelligible) The people that go down there that restricts the residents living in the area access to their property. So, all we are asking is to gradually restrict that piece of property, not to take away the beauty, not to restrict people going down there. SUPERVISOR COCHRAN: That is something we hold dear in the Town of Southold is the availability, Paul, of being able to go to access at the road ends to the water and so forth, but there has to be certain controls. Anyone else like to address the Town Board in relation to a change in the Local Law parking on the Anchorage in Mattituck? Yes, sir? SID OLSTAD: Just a reminder that it is a public road. The people of Southold pride themselves on their public beaches, and public access to public beaches, and we don't want to become tourist unfriendly, because a lot of income is derived from tourists, and these people are out to enjoy themselves. SUPERVISOR COCHRAN: Anyone else like to address the Town Board? FRED SELL: Fred Sell from Mattituck. The creek, you don't swim in there today, it is polluted. SUPERVISOR COCHRAN: Okay, gentlemen, not back and forth, please. Sir, you address the Town Board. FRED SELL: There is not clamming there anymore. Once in awhile you see someone come in and clam. SUPERVISOR COCHRAN: The Board will take all the comments into consideration. Thank you. COUNCILMAN MURPHY: What is it presently now, ten to six? COUNCILMAN ROMANELLI: Yes. SUPERVISOR COCHRAN: Anyone else like to address the Town Board in relation to the change of law at the Anchorage parking in Mattituck? We have an affidavit from The Suffolk Times, and it was posted on the Bulletin Board. I see no correspondence, no letters. SUPERVISOR COCHRAN: You have heard the reading of the proposed Local Law. Would anyone like to address the Town Board in relation to the parking restriction on the Anchorage located in Mattituck? SID OLMSTED: My name is Sid Olmsted. I live in Mattituck. I have lived in Mattituck for seven years, I guess. I get upset when I see access to public waterways restricted one way or another. Depot Road in Cutchogue, no parking at night, so the guy in the motel can do his business. Marratooka a couple of rich people decided to restrict parking so they closed those. No parking on Marratooka in Mattituck. There is a couple I can't think of. These are public roads. People do have a right to access to the public waterways. Many people don't know that public waterways are public property anything below the high tide mark on anyone's property. People can walk down there. At any rate I don't understand the reason for this. There is already a sign down that says, no parking at night basically, 10 to 6. Now, you don't want any parking there at all. I understand the Association owns a parcel, but this public road is maintained by the Town of Southold. There is a parcel, I guess it would be just west of that, that the Association owns, that they want as a private piece of property down there, they could fence that thing in, and enjoy it like the people at the end of Sigsbee Road. Sigsbee Road is still accessible to the public at the foot of the road, but the Sigsbee Association has a piece of property on the west side for their own enjoyment, and hold this peacefully like that for fifty years or more that I know about. It is just a shame to see all of these public roads posted above them in the daytime. All right, in the nighttime maybe you don't want the kids carrying on, but what are they going to be doing in the daytime? COUNCILMAN ROMANELLI: I have to be honest with you I didn't notice what we were doing. COUNCILMAN MURPHY: I thought it was the other way around. SID OLSTED: Is it a typo? SUPERVISOR COCHRAN: We are checking, but we feel very strongly one thing that we have done is work very hard to maintain the road ends for public use, because that is public access for our residents of Southold Town to be able to reach the water. In some areas there are restrictions as to parking late at night, or ten at night, until six in the 2 PH 5/23/00 3 morning, and this is understandable within residential areas. Also, we even this past year put in place a fishing permit to allow fishermen that go to fish at three o'clock in the morning to be able to, you know, to park there, so we do strive very hard to maintain and keep open all our road ends. They belong to you and your access. We are checking. Do you have a copy of it? We won't act on this tonight. I will hold the hearing open.
