TERMS AND CONDITIONS The Permittee JOY KILPATRICK&JOSHUA HERRENKOHL 750 Cedar Point Drive East Southold,New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 36 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work-herein authorized, or if, in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and donsents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. "11. And a newly proposed swimming pool is located on the landward side of the dwelling, 88 feet from the top of bank and only partially within wetlands jurisdiction. The project has thus been designed to avoid creation of any new wetland encroachments and slightly increase the existing wetland setback. Additionally, compliant with Town Code Section 275-11(A)(3), the reconstructed dwelling would remain landward of the "pier line" drawn between the adjacent dwellings; all proposed construction is compliant with Town zoning,including building height, sky plane, and GFA; and Town-defined lot coverage would increase by only 759 sf to 14.6 percent, with a net decrease in lot coverage occurring within 100 feet of the top of bank. All construction would also occur outside the flood zone (FEMA Zone X) and landward of the bulkhead that stabilizes the embankment fronting Peconic Bay. Several environmental mitigation measures are also proposed to ensure compliance with the standards for permit issuance set forth in Town Code Section 275-12 and consistency with the goals of LWRP Policies 5 and 6, particularly the protection of water quality and the quality and function of the adjacent Peconic Bay beach and tidal wetland ecosystem. Specifically, the below described mitigation measures would decrease the area of, and increase wetland setbacks to, maintained turf lawn; reduce the quantity and improve the quality of potential stormwater runoff through improved site drainage and increased buffers; and improve groundwater and surface water quality through improved septic treatment, all resulting in the protection of, and avoidance of adverse impacts to, Town wetlands and tidal waters. 1) The existing conventional septic system would be removed and replaced with a low-nitrogen, I/A sanitary system,whose components meet the recently established top of bank setbacks set forth by Section 275-3(D)(1)(a)(3 &4). Unlike conventional systems,which are not designed or equipped to treat nutrients such as nitrogen,UA systems are designed to significantly reduce nitrogen loading into the groundwater and ultimately surface waters. 2) A proposed stormwater drainage system is designed to capture and recharge roof runoff from the reconstructed dwelling and the accessory structures proposed outside wetlands jurisdiction; and backwash from the proposed swimming pool. 3) A 10' wide vegetated non-turf buffer area is proposed to be established and permanently maintained in place of existing lawn landward of the top of bank, effectively increasing the depth of the naturally vegetated area behind the bulkhead to 25—35 feet. 4) A project limiting fence would be installed to contain site disturbance and potential surface runoff during construction. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable JOY KILPATRICK& JOSHUA HERRENKOHL 750 CEDAR POINT DRIVE E SOUTHOLD, NY SCTM#1000-90-2-18 The proposed project seeks to substantially reconstruct an existing dwelling mostly within the same footprint, including over an existing full basement to remain, except that 1) the new habitable dwelling footprint will be smaller(1,781 sf proposed versus 2,199 sf existing); 2)the westerly encroachment of the dwelling will be reduced by almost 2 feet, thereby eliminating an existing zoning nonconformity; 3) the seaward edge of the dwelling will be relocated landward, thereby increasing the existing wetland setback by 2 feet; and 4) an unroofed deck addition is proposed on the waterfront side of the house, in line with the seaward edge of the dwelling. And a newly proposed swimming pool is located on the landward side of the dwelling, 88 feet from the top of bank and only partially within wetlands jurisdiction. The project has thus been designed to avoid creation of any new wetland encroachments and:slightly increase the existing wetland setback. Additionally, compliant with Town Code Section 275-11(A)(3), the reconstructed dwelling would remain landward of the "pier line" drawn between the adjacent dwellings;all proposed construction is compliant with Town zoning,including building height, sky plane, and GFA; and Town-defined lot coverage would increase by only 759 sf to 14.6 percent, with a net decrease in lot coverage occurring within 100 feet of the top of bank. All construction would also occur outside the flood zone (FEMA Zone X) and landward of the bulkhead that stabilizes the embankment fronting Peconic Bay. Several environmental mitigation measures are also proposed to ensure compliance with the standards for permit issuance set forth in Town Code Section 275-12 and consistency with the goals of LWRP Policies 5 and 6, particularly the protection of water quality and the quality and function of the adjacent Peconic Bay beach and tidal wetland ecosystem. Specifically, the below described mitigation measures would decrease the area of, and increase wetland setbacks to, maintained turf lawn; reduce the quantity and improve the quality of potential stormwater runoff through improved site drainage and increased buffers; and improve groundwater and surface water quality through improved septic treatment,all resulting in the protection of, and avoidance of adverse impacts to, Town wetlands and tidal waters. 1) The existing conventional septic system would be removed and replaced with a low-nitrogen, I/A sanitary system,whose components meet the recently established top of bank setbacks set forth by Section 275-3(D)(1)(a)(3 &4). Unlike conventional systems,which are not designed or equipped to treat nutrients such as nitrogen,I/A systems are designed to significantly reduce nitrogen loading into the groundwater and ultimately surface waters. 2) A proposed stormwater drainage system is designed to capture and recharge roof runoff from the reconstructed dwelling and the accessory structures proposed outside wetlands jurisdiction; and backwash from the proposed swimming pool. 3) A 10' wide vegetated non-turf buffer area is proposed to be established and permanently maintained in place of existing lawn landward of the top of bank, effectively increasing the depth of the naturally vegetated area behind the bulkhead to 25—35 feet. 4) A project limiting fence would be installed to contain site disturbance and potential surface runoff during construction. i See attached addendum.
