SE RA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.

County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23.
LWRI )DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the
Mirror Actions exempt:list and is not subject to review under Chapter 268.
PROPERTY FACTS/DESCRIPTION: The subject nonconforming 12,566.92 square toot property is located in the
Residential R-40 Zoning District. The northerly property line measures 91.01 'feet, the easterly property late
measures 126.25 feet, the southerly property line measures 107.06 feet and the westerly property line measures
129.00 feet and is adjacent to Navy Street. The parcel is improved with a one-story frame dwelling. There is 12 feet
by 50 feet inground swimming stool located in the rear yard east of the dwelling with a blue shine patio located to
the east of the pool. There is 12.1 feet by 15.1 feet pergola located in the northeast corner of the property along with
a pool heater and pool equipment.. The property is fenced and well screened with a privacy hedge in the front of the
property with lawn between the hedge and Navy Street as shown on the survey map prepared by Kenneth M.
Woychuk, LS last revised April 17, 2024.
BASIS OF APPPLICATION: Request for a Variance from Article XXIII, Sections 280-124; and the Building
Inspector's October 28, 2024 Notice of Disapproval based on an application for a permit to construct additions and
alterations to an existing single-fancily dwelling; at 1) less than the code required minimum front yard setback of 35
feet; located at: 1180 Navy Street, Orient,NY. SCTM No. 1000-25-4-4.
RELIEF RE LEES EED: The applicant requests a variance to construct alterations and additions to an existing single-
family dwelling, The proposed construction, on this nonconforming 12,566.92 square toot parcel located in the
Residential R-40 Zoning District is not permitted pursuant to Article X_Xlll, 'Section 280-1211 which states lots
measuring less than 20,000 square feet in total size require a minimum front yard setback of35 feet. The construction
as shown on the Site Plan has a front yard setback of 23 feet, 11 inches.

The Zoning Board of Appeals held a public hearing on this application on April 3,2025 at which time written and
oral evidence were presented, Based upon all testimony,documentation, personal inspection of the property and
surrounding neighborhood,and other evidence, the Zoning Board finds the following facts to be true and relevant
and makes the following findings:
1. Town Law_§267-b(3)Jb)U Grant of the variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. This landmarked dwelling, which is located in an historic district,
was built prior to the adoption of zoning. Many of the other historic dwellings in this neighborhood have reduced
front yard setbacks. The pre-existing non-con formingfront yard setback of the subject property is 23 feet, I I inches
and the proposed additions will, maintain that setback. The subject side yards are well screened with fencing and
acts to the street
landscaping and there will be no visible adverse imp or adjacent properties. The proposedI s
construction also has an approval from the Town's Historic Preservation Commission sion acknowledgi rig that the design
of the proposed small additions to the existing dwelling are in keeping with the size and character of nearby dwellings
in this historic neighborhood.
2. Town Law.§267-tLj)ffl U2 . Tbe benefit Sought by the applicant cannot be achieved by some method, feasible
for the applicant to pursue, other than an area variance. The existing dwelling has a non-conforming front yard
setback which is being maintained for both the proposed small addition on the north side of the home which will
make the present primary bedroom more functional and the smaller bump out on the south side to accommodate the
construction of a functional basement access to the home, since the existing basement access is in the living room.
3. The variance granted herein is mathematically substantial, representing 34% relief
from the code. However, the proposed construction does not increase the degree of non-conformity of the existing
front yard setback and the project is conforming in all other aspects of the zoning code.
4. Town Law §26�-b3 �b4 . No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
applicant must comply with Chapter 236 of the Town's Storm Water Management Code.
5. Town Laaw 267-b bI The difficulty has been self-created. The applicant purchased the parcel after the
Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase.
6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of a more functional size bedroom and a better functional basement access while
preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.

written request prior to the date of expiration,grant an extension not to exceed three(3)consecutive one(1)
year terms.IT IS' PROPERTY OWNER'S RESPONSIBILITY TO ENSURE COMPLIANCE WITH
THE CODE REQUIRED TI,W- FRAME DESCRIBER HEREIN.Failure to comply in a timely manner
may result in the denial by the Building Department of a Certificate of Occupancy,nullify the approved

WHEREAS, 1180 Navy Street, Orient,NY, is on the Town of Southold Registry of Historic
Landmarks; and
WHEREAS, as set forth inSection 170-6 of the Town Law(Landmarks Preservation Code)of the Town
of Southold, all proposals for material change/alteration must be reviewed and granted a
Certificate of Appropriateness by the Southold Town Historic Preservation Commission
prior to the issuance of a Building Permit; and
WHEREAS, the applicant submitted a proposal on October 31, 2024, requesting permission to
construct alterations and additions to an existing single family dwelling, located at 1180
Navy Street, Orient, SCTM No. 1000-25-4-4; and
WHEREAS, the applicant's representative, Meryl Kramer, Registered :Architect, appeared before the
Commission for a public hearing on January 23,2025 to describe the proposed;alterations
and additions to the existing single family dwelling; and
WHEREAS,the improvements are proposed for a one story addition to a one-story single family

A-003, A-004, A-101, A-102, A-200, and A-300), prepared by Meryl Kramer, Registered
Architect, last revised October 31,2024, meets the criteria for approval under Section 170-
8 (A)of the Southold Town Code; and
BE IT FURTHER RESOLVED,that the Commission approves the request for a Certificate of
Appropriateness, subject to approvals by all involved agencies; and
BE IT FURTHER RESOLVED,that any deviation from the approved plans referenced above may
require further review from the Commission.
