Box 1179 Southold, New York I 19714)959 CONSERVATION ADVISORY COUNCIL TOWN OF SOUTHOLD MINUTES Tuesday, June 15, 2004 6:00 PM A meeting of the Southold Town Conservation Advisory Council was held Tuesday, June 15, 2004 at Down's Farm Preserve. Present Were: Absent Was: Don Wilder, Chairman Dods McGreevy, Member Jack McGreevy, Member Lauren Standish, Secretary Tom Schlichter, Member William H. Cook, Jr., Member Nicholas Dickerson, Junior Member Madeline Bdsotti, Junior Member Peggy Dickerson, Trustee CALL TO ORDER Chairman Don Wilder called the meeting to order at 6:00 PM. CHAIRMAN'S ANNOUNCEMENTS Chairman Don Wilder welcomed Jack McGreevy as a new member of the Council. REPORTS Jack McGreevy started the road-end project and made an inspection of James Creek. He will submit a report to the council at the next regularly scheduled meeting. 2 APPROVAL OF MINUTES Moved by Don Wilder, seconded by Doris McGreevy, to Approve the Minutes of May 11,2004. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by Don Wilder, seconded by Doris McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CONDITIONS of the Wetland Permit application of SANDFORD BERNHARDT to construct a single-family dwelling and deck. Located: 4340 Ole Jule Lane, Mattituck. SCTM#122-4-30 The CAC recommends Approval of the application with the following Conditions: - a 20' non-disturbance buffer the grading is sloped away from the water - save as many of the large trees as possible. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Doris McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit application of MATINE, INC. to construct 4'X 145'+/- CCA timber beach access stairs with an 8'X 6' platform. Located: 590 North View Dr., Orient. SCTM#13-1-5.1 The CAC recommends Disapproval of the application because the size of the platform is not in accordance with Chapter 97 of the Wetland Code, CCA lumber is prohibited, and the construction would cause damage to the bluff. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Doris McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit application of BRUNO FRANKOLA to construct a 1,120 sq. ft. single-family dwelling and sanitary system. Located: Northfield Rd., Southold. SCTM#71-1-19 The CAC recommends Disapproval of the application because the proposed house is too close to the wetlands and would have a negative impact on the wetlands. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Doris McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of JLH ASSOCIATES, INC. to construct a single-family dwelling with attached garage, open porch, pervious driveway and sanitary system. Located: Albacore Dr., Southold. SCTM#56-7-14 The CAC recommends Approval of the application with the Condition of a maximum buffer area. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Doris McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit application of JOHN HURTADO, SR. to construct 4'X 53'+/- CCA timber beach access stairs with an 8'X 6' platform and a 4'X 4' platform. Located: 19625 Soundview Ave., Southold. SCTM#51-1-22.2 The CAC recommends Disapproval of the application because the platform is too large and CCA lumber is prohibited, in accordance with Chapter 97 of the Wetland Code. Vote of Council: Ayes: All Motion Carried Moved by Doris McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of MARK SAPORITA & CHRISTOPHER BRODERICK to construct a 4'X 22' dock, 3'X 15' ramp and 6'X 20' float, create a wood chip path and parking area, and construct a gazebo. Located: Cedar Point Dr. West, Southold. SCTM#90-1-1 Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Doris McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit application of JOAN & WILLIAM CORWlN to maintain the lawn, 4 trim shrubs and phragmites, and APPROVAL of the application to spread bluestone on existing driveway. Located: 14915 New Suffolk Ave., New Suffolk. SCTM#116-3-17 The CAC recommends Disapproval of the application to conduct activity in the wetlands and recommends the area be left to re-vegetate naturally. Vote of Council: Ayes:All Motion Carried PETER RUTTURA to construct 4'X 4' steps leading to a 4'X 40' fixed dock constructed 4' above grade of existing marsh, 3'X 16' ramp, a 6'X 20' float, and two mooring piles. Located: 835 Waterview Dr., Southold. SCTM#78-7-12 The CAC did not make an inspection, therefore no recommendation was made. Moved by Don Wilder, seconded by Doris McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of JAMES & EILEEN BUGLION to construct a single-family dwelling with a deck, pervious driveway, fencing, sanitary system, and a 4' wide path to the water. Located: 2520 Clearview Ave., Southold. SCTM#70-10-29.1 The CAC recommends Approval of the application with the Condition there is no fence or walkway in the non-disturbance buffer. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Doris. McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit application of JOSEPH K. LOGIUDICE to construct a 4'X 108' fixed timber catwalk with a boat-lift. The catwalk is proposed to be elevated a min. of 4' above the AHWM and will utilize (4) 4"X 4" piles with a depth of penetration 6'+, and (26) 6" dia. timber piles with a depth of penetration of 10'+. The boat-lift is proposed to be an "Alum-A-Vator" utilizing (8) 10" dia. timber piles with a depth of penetration of 10'+. Located: 10995 North Bayview Rd., Southold. SCTM#79-5-20.13 The CAC recommends Disapproval of the application because boats-lifts are prohibited in Chapter 97 of the Wetland Code. Vote of Council: Ayes: All Motion Carried Moved by Doris McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the WetJand Permit application of ROBERT & KATHLEEN LAWRENCE to remove a one-story frame house and construct a two-story frame house with attached two-car garage. Extend driveway, construct dry stone retaining wall, and excavate and fill as required. Located: 800 West Creek Ave., Cutchogue. SCTM#103-13-6 The CAC recommends Approval of the application with the Condition of a 20' non-turf buffer and drywells and gutters are installed to contain the roof run-off. Vote of Council: Ayes: All Motion Carried Moved by Doris McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit application of RICHARD MULLEN to construct a 4'X 35' level dock leading to a 32"X 12' ramp and ending with a 6'X 20' floating dock, secured by (3) l-pile dolphins. Located: 1775 Mill Creek Dr., Southold. SCTM#51-6-33 The CAC recommends Disapproval of the application because the docking facility exceeds 1/3 the width of the creek and should be in line with the neighboring docks. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Doris McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of KEVlN MCGILLOWAY to remove and replace (in-place) approx. 135 linear ft. of existing timber bulkhead with vinyl bulkhead and restore any disturbed adjacent marsh with spartina alterniflora plugs (18" on center). Replace (within 18") approx. 138 linear ft. of existing timber bulkhead with vinyl bulkhead and dredge 10'X 24' area adjacent to easterly 62' section to max. depth of-3' ALW, using approx. 10 cy. sand spoil as backfill. Remove and replace existing 4' wide (and variable) X 138' timber walkways. Located: 430 Sailors Needle Rd., Maftituck. SCTM#144-5-30.1 The CAC recommends Approval with the Condition of a 10' non-turf buffer. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Doris McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Coastal Erosion Permit application of PAUL ORLICK to construct a single-family dwelling and shift footprint of home 6' towards the water and cantilever rear deck into CEHA with no footings in coastal erosion area. Located: 1300 Leeton Dr., Southold. SCTM#58-2-1 The CAC recommends Approval of the application with the Condition there is no disturbance seaward of the house. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Doris McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of ANTHONY GRAZlANO to renovate and construct an addition to the existing dwelling. Located: 915 Lakeside Dr. North, Southold. SCTM#90-4-5&6 Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Doris McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of YVETTE LANG EINCZIG to reconstruct in-place +/-128' of smooth faced timber bulkhead navy style and to backfill structure with 5 cy. clean sand to be trucked in from an upland source. Located: 3055 Wells Rd., Southold. SCTM#70-4-11 The CAC recommends Approval of the application with the Condition of a 15' non-turf buffer. Vote of Council: Ayes: All Motion Carried Moved by Doris McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of MARGARET HEIDENRY to remove and re-build the existing porch, repair roof and repair siding on existing dwelling, and replace doors and windows. Located: 29 Sage Blvd., Greenport. SCTM#53-5-12.6 Vote of Council: Ayes: All 7 Motion Carried Moved by Doris McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of THOMAS PETROSlNO to remove and replace (in-place) approx. 252 linear ft. of existing timber bulkhead (including 40' and 6' returns) with vinyl bulkhead and backfill with approx. 100 cy. of clean sand fill to be trucked in from an upland source. Located: 900 Rogers Rd., Southold. SCTM#66-2-38 The CAC recommends Approval of the application with the Condition the area seaward of the bulkhead is restored with wetland vegetation. Vote of Council: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATION OF APPLICATIONS TO AMEND PERMITS Moved by Doris McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Amendment application THOMAS JORDAN to Amend Permit #5572 to construct a two- story dwelling and attached garage; install a pervious driveway, sanitary system, and public water service; and establish a 42' non-disturbance/non-fertilization buffer adjacent to the freshwater wetland boundary. Located: 1680 Brigantine Dr. Southold. SCTM#79-4-25 Vote of Council: Ayes: All Motion Carried The next meeting of the Conservation Advisory Council has been scheduled for Tues., July 13, 2004 at 6:00 PM.
