EXECUTIVE SESSIQN 8:50 A.M. - Mr. Charles Graves, Town negotiator, met with the Board to discuss upcoming CSEA and PBA contract negotiations. WORK SESSION 9:55 A.M. - Mr. Richard Wilton, accompanied by Mr. Joseph Henry, spoke to the Board about problems he has been having at the K.O.A. camp, Greenport, with loose packs of dogs, some of which come from the neighboring migrant labor camp. Mr. Wilton stated he has ca!led the Police Department but was told it was not their responsibility. When he calls the North Fork .Animal Welfare League he has received abuse and no help and doesn't know where to turn except vo the Town Board. The Board listened to Mr. Wiiton'.s problems and advised him tha~ Mrs. Tejo will be in to talk to the Board at 1!:00 A.M. and this will be discussed further. 10:10 A.M. - Receiver of Taxes George Mellas-met with the Board to advise them (1) that the ALUM Ssytem has a change in format and it is not compatable to the machinery he has now, and (2) the County Charter Revision Commission has voted to go to a four-payment tax payin~ system and if their recommendation is adopted it will go into effect within 18 months to two years. Mr. Metlas has reconmended that the Town go into a computes system to tax receipting. Town Attorney Tasker suggested that an opinion be drawn up making the four-pa)~ent optional to each individual town. 10:20 A.M. - The Board began reviewing the agenda. 11:05 A.M. - Executive Administrator Victor Lessard me~ with the Board to discuss some suggested amendments to the Zoning Ordinance, requesv for a part-time clerk-typist to help him clear up numerous pending requests for certiciate of occupancy, and recommendation for a part-time building inspector on Fishers Island, this was rejected. Supervisor Peli advised Mr. Lessard ay this time that sometime in late June the Board has made a decision to move the Building Department into the Office of the Receiver of Taxes, the Office of the Receiver of Taxes into the Town Clerk's Office, and the Town Clerk's Office into the Building Department. The Board of Appeals' office will be relocated from their present private office ~n the Building Department to the new Building Department private office in the east wing. --As far as the request for a Dart-time clerk- typist, Supervisor PpI1 will assien Jane Moffatt ~ .... to 2 d~ys in the Build- EXECUTIVE SESSION epartment and 2 days in the Supervisor's Office~ ~as, needed. 11:40 A.M. - The Board discussed personnel with Mr. Lessard. 12:05 P.M. - Mrs. Maria Tejo and Mrs. Gladys Csajko of the North Fork Animal Welfare League, Inc. met with the Board to discuss pending convract negotiations. Mrs. Tejo also explained problems concerning the migrant labor camp referred to by Mr. Wilton earlier mn the day, and what contaczs she has had with the Village of Greenport relative to a con~ract with them. Town Attorney Tasker poinzed out to Mrs. Tejo that under the Agricultural and ~arkets Law the League musm pick up unlicensed dogs in the Village of Greenpor~. Mrs. Tejo said she would check with Agricultural and Markets in Albany for a legal opinion on this before entering the Village. 1:05 P.M. - The Board recessed for lunch. 150 JUNE 8, 1982 2:45 P.M. - Work Session reconvened and the Board resumed reviewing the agenda. 3:00 P.M. - Recess to hold three public' he'arfngs on wetland applica- tions of: 3:00 P.M. - Patrick Carrig on behalf of Barbara Rader Punch. 3:05 P.M. - Ellen M. and ~ugene G. Steigerwald 3:10 P.M. - Gerald P. McGinty 3:12 P.M. - Work Session reconvened and the Board met~with Frank Kujawski, Southold Town Trustee relative to the proposed ~urvey of one of the Sbuthold Town creeks. Councilman Murdock stated he thinks a lot of money is being expended on behalf'of the Trustees, case in point - a law suit presently pending. It was pointed out that this law suit has been dropped. Town Clerk Terry pointed out it was her understanding this proposed survey would require hiring a temporary employee zo do the survey, and this survey would be working with Trustee SecreTary Marian Goubeaud researching a~d revising the files and at the present time Mrs. Goubeaud is working one hour overtime each day to keep up with the Trustee work. This will be a further burden on her and will take time from her regular duties in the Town Clerk's Office. Further, at the present time there isn't room in the Town Clerk's Office to place another desk or table for another individual.--Mr. Kujawski said that the Trustees wish to hire Lori Brooks of Mattftuck to do the survey. The methodof employment was discussed,and it was decided to hire Ms. Brooks on a con~rac~ual basis at $1,000.00. Town Attorney Tasker will prepare the contract for presentation to the Board at the June 22nd meeting.--Mr. Kujawski was asked how this survey will be updated and he stated it will be kept up to date by the Trustees who will make inspections. 3:40 P.M. - The Board resumed reviewing the agenda. 3:50 P.M. Board of Appeals Chairman Gerald'Goehringer mem with the Board to bring the Board up to date on the Board's current Of reviewing,' at the request Of the Planning Board and Gedrg~i~her, access under Section 280A of the Town Law. Mr. Goehringer~vised ~a~-~ ~-~e~o~--~peals is mqeting_on Fish :;~n 15th. He also presented statistical information concerning of the Board during the years of 1980 and 1981; noting of work over 1981. · At their next meeting they have 24 i~t!e~s $~ address. Mr. Goehringer said they expect the Board of Appeals' O~!~'~e ~ be totally swa~ped throughout the summer and requested the Board hire a part-time clerk-typist for ten weeks during the summe~,.to ~mrk 18 hours per week, or three days. There is money in the B~d o£ Appeals' budget for this expenditure. COUNCILMAN TO~{NSEND: I'll defer ~o Councilman Murdock on the Landfill. SUPERVISOR PELL: Councilman Murdock? COUNCILMAN MURDOCK: Councilman Townsend and I went to Tor'onto last week to see a faci'lity run as a joint venture by the Country of Canada and Bro~vning Ferris Industries as to handling municipal solid waste. It is an experimental station and they process garbage in many ways and p~epare it.~ Almost like a gourmet school~ They do many things with garbage that we dreamed were never possible. It was a very interesting, very enlightening experience. I do believe that we will be able to adapt some of the things we saw to Southold's refuse s~ream when we're ready. It just so happens the gentleman who is running this facility will run multi-town's facility in Deer Park when multi-town comes on line in about four years. It was very en- lightening to see the things that they can do and the ways that they can separate garbage and how workable it is. Thank you. SUPERVISOR PELL: Thank you. Councilman Townsend, anything you wan~ to add to that? COUNCILMAN TOWNSEND: We!l, just the fact that processing Solid waste is not cheap. Up there they're funded by the Canadian governmenm. It's an experimental plant so they do go to-somewhat more expense than they would have to if they were jusm looking for the most efficient way to handle garbage. The tipping that they're paying is $19.00 a ton and then it's subsidized by some unknown amount. The fellow that ran the thing mentioned to us that technology for small areas like 152 JUNE 8, 1982 ours has not had a result yet so it will be a difficult task for us to decide exactly which way to go. We did see a lot of things that I felt were immediately applicable in ~erms of compacting and some source separation devices, but it was a fantastic array Of technology and we were talking with some of the most knowledgable people in the field. I thought it was very beneficial. It was worth the hysteria in the end. We were supposed to fey out of there around 2:00. We finally got a plane in Montreal around i0:00. It turns out there was a psychiatrist's convention and 25,000 psychiatrists all trying to go to New York. COUNCIL~N NURDOCK: We tried to get plane--we couldn't get a plane from Toronto, We tried to go to Buffalo, we tried to go to Rochester, we tried to go to Boston, Philadelphia, Washington, Baltimore. We couldn't get a plan anywhere within striking distance of New York City. These 10,000 psychiatrists were all leaving Toronto at the same time. I guess most of them must come to New York City. It was a real horror scene. SLrPERVISOR PELL: Councilman Nick!es? COD~CIL~AN NICKLES: I'd just like to report that the County is dredging Goldsmith Inlet and the Town is moving the sand so'ii from that area down to Kennv's Beach in an e£fort to have the beach in. order so it may be used this summer. SUPERVISOR PELL: When did that start? COUNCILMAN NICEI~S: It started the end of last week. SUPERVISOR PELL: Councilman Murphy? COUNCIL~N MURPHY: I'd like to report I ~et with Jim Monsel~ from the Village of Greenport, and I represented ihe Town at the D.E.C. hearing which thee had 3~to critique their waste water ~reatment plant proposal. I was most impressed with the way D.E.C. did this and the expertise that they put into questioning~H2M, who is:©ur' consultant who is putting this proposal in. We stand to rese~i~e funding about 92½% and we ha~e an extremely high priority:;bemause of our very critical water situation here. So it is going a~ong very well and that's it. ' ' SUPERVISOR PELL: Judge Edwards? JUSTICE EDWARDS: Just going along with the garbage plant, Ks. Oliva and myself flew down to New Jersey. The flying arrangements were tremendous, I le£t the Island at quarter of seven, Ms. Oliva was at ~ttituck a~ quarter after seven, we kept right on going. It was beautiful and we got down to New Jersey, looked the plant over, learned a lot abou~ it, it was very educational, and had a beautiful flight back. All in att there are better ways to get rid of garbage than burying i~ that's for sure. Thank you~ SUPERVISOR PELL: The only thing I have to report is that I have set in this chair for two and a half yea~s and I have received more telephone calls this past weekend over the flooding and rain storm than I have received a~ home in two and a half years. I think every Councilman up her said, "Call the Supervisor", because 'I did get a lot of phone calls. Also I want to add I have lived in the same house for seventeen years and this is the first time I had water in my basement. We had a lot of rain and a lot of problems did arise and some people are here tonight to address the Board about theirs and we will get to that at the end of the meeting. Also I would like to recognize the fact we have two scouts here working on their Communication Badge I believe. Is that correct? '(Yes.) What are your names? (Michael Schroeder and Scott Gannon). For you people and the boy's information, the Town Board started at 8:00 o'clock this morning~ broke for an hour and a half for lunch, we quit at 6:00 o'clock tonight. You might think we are going through this kind of fast, but we spent from 8:00 o'clock this morning until 6:00 o'clock tonight discussing every item that is brought up tonight, the pros and cons. So government doesn't move quite this fast as you will see us moving in the nexr hour. It took all day to get to this point. JUNE 8, 1982 ., ~,~.~.~.:~i.¥~,~ ~. 153 II. PUBLIC NOTICES COUNCILMAN MURPHY: These notices are all on file in the Town Clerk's Office and are posted on the Town Clerk's Bulletin Board. !. Department of Army, Corps of Engineers concerning the application of Suffolk County D.P.W. for the work around the rail- road terminal which the County and the Town and the Village Of Greenpor~ has been so actively trying to get through. 2. Application by Jack Italiano by Enconsultants, Inc. to construct a one family dwelling landward of tidal wetland boundary. Comments by June 9th to the New York D,E.C. 3. Public Notice, Corps of Engineers, application of Fred Cowan for floats, ramp and walkway on Mapes Creek in Mattituck. Comments by June 21st. 4. New York State D.E.C. pursuant to Tidal Wetland Land Use Regulations, please take notice that a public hearing will be held on the 24th day of June to consider a proposed map change in an area of jurisdiction. This is posted also. This is concerning for anyone on Mattituck Inlet the Howard Petersen property and Cavalier. This is Number 5 concerning Cavalier. They are two adjoining properties that D.E.C. is going to have a public hearing together to receive input. Anyone on that Inlet or anyone in the Town concerned with this please come. 6. I need help on this Bill, what is that? SQTERVISOR PELL: Number 6 is the federal government has issued a Wave Height Study and it effects your insurance rates. If ~ou live in a zone where the waves do come up and effect your'real estate, your property, you have insurance available to you through the flood plan. We dispute and .have disputed some of the areas they claim, through our town engineers. They did amend some of the disputed areas throughout.the Town, not.all of them. We have asked for them before they hold a public hearing on the areas involved to meet with us again. They said no, they would want to have a public hearing on the amendments already to the town-wide plan. It effect us now, but it effects all coastline areas throughout the country, this is federal government. The hearing will be held on the 15th of June at 7:30 at. night. They're having one on the 14th of June in the Village of Greenport. Then we have 90 days to file amendments after the hearing is held. Basically that's it, Frank. COD~CILMAN MURPHY: Number 7 is an application, D.E.C. application of Thomas and Jacqueline Occhiogrosso concerning tidal wetlands. Location of property here is on Corey Creek. Comments~by June 23rd to the D.E.C. III. COMMUNICATIONS SUPERVISOR PELL: There are five communications. 1. 1982 Aviation Capital Program. We are involved in this because we own an airport on Fishers Island, Elizabeth Airport and they have a plan ~o repave it and improving the lights over there and we have been after them for federal funds on this. This airport is leased to the Fishers Island Ferry District and they manage it. 2. Request from the Green~ort Public Schools again this year to take the recreational money that we give them through the. state, it's a pass through, ~o use it in the wintertime instead of the summertime. The state has approved thins in the past and we are sure they will aDprove it again this year. Or they have, we made the request already. 3. An exhibit' that will be placed in Town Hall during the month of July 14th through August 4th. It's"100 Years of Small Town Jewish Life". We have some people who live in Southold Town who will be involved in this photographic expo. Mr. Rothman who just passed away last year will be involved, Mr. Abe Brown from Greenport will be involved, and there are some more but I'm not sure of the names. There will be a display put up here in the summertime for three weeks. 4. Suffolk C~U~--T-~-x Act Comm~tte~ has recommended a four payment tax plan which we in the Town are opposed to. Some other towns are for it but it's st'ilt a split on their part of how it will go through. It will have to be ruled by Albany. JUNE 8. 1982 5. RESOLUTIONS Moved by Councilman Townsend, seconded by Councilman Murphy, it was RESOLVED that pursuant to Article 8 of the Environmental Conservaton Law State Environmental Quality Review and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that the Southold Town Board, as lead agency for the action described below, has determined that the project, which is unlisted, will not have a significant effect on the environment. Description of A~ion: Application of Gerald P. McGinty for a wet- land permit. Approval is requested for installation of a floating dock and catwalk on Long Creek from applicant's property located at 355 Westview Drive, Mattituck, New York. Pell, III be and he hereby is authorized and directed to enter into an agreement with Kenneth L. Edwards as part-time Bay Constable for the Town of Southoid at ' Fishers Island, at a sum of $1,000.00 for the period commencing June 15, 1982 and ending on September 15, 1982; Mr. Edwards to furnish a suitable boat together with the necessary outboard motor and required equipment for the operation of said boat and be responsible for any and all expenses for the repair and maintenance of said equipment; the Town to pay all expenses for fuel required for the operation of the boat of Kenneth L. Edwards while performing services for the Town during the term of the agreement. Councilman Townsend, Councilman ~rdock, Councilman Nickles-- COL~CILMAN NICK~ES: I just think that that one communication on Kennys Road we ought to request a safety report from the Police Deparzment on the intersection of Kennys Road and Soundview Avenue for the four-way stop sign. SL~ERVISOR PELL: We will requesz it be done. JUSTICE EDWARDS: I'd like to talk to the ~wo Scouts when the meeting is over, do don't run away. SUPERVISOR PELL: At this time what we do is we open up the meeting to the public. Does anybody wish ~o address the Town Board? i~m going to start with the two scouts first. Anything you would like to address the Town Board on? (No response.) Does anyone else wish to address the Town Board? Gary Lillis. MR. GARY LILLIS: Gentlemen, I'm here to address the Town Board on a current problem that exists along the Old North Road, Southold. With me tonight are some of several neighbors who live in the area, Mr. and ~s. Cahill, Mrs. Ward, my wife Nancy, ~. and Mrs. Schaeffer, and Mrs. Sanders. Some of us that live there are affected a great deal more than others, myself in particular, but the problem that JUNE 8, 1982 163 does exist does affec~ a~l of us,to an extent. I would like to thank you for the opportunity to addre,~u%~d~I also would like to thank you for listening to my telephone calls ove~ the weekend and for returning my call. The problem that does exist there, for the benefit of the people in the audience, is that currently the read ior perhaps a stretch of 600 - 700 fee~ is under water and the Town Highway Depart- ~ent has been working on it, we do appreciate their assistance. Several of the workers for the Town spent the entire night pumping last night which was greatly appreciated. A dent in the road was made. In fact a great deal of water was removed from the road. The road perhaps now is passable. It's still under wa~er but at least it's passable, and basically what I would like to do--Mr. Dean the Highway Superintendent was up yesterday and I spoke ~o him. We drove around the area and I asked him if there was a worse problem that existed in Southoid Town. I said,"Mr. Dean, please just level with me, is there a more serious problem in the Town?" I realize as ~¢r. Pall said earlier in the even- ing we did have unusual circumstances over the weekend, however, I do feel that our problem is perhaDs a little more unique than most of the problems that exist in Town. Seemingly most of the problems now have subsided or actually ended, whereas our problem will probably be there for quite some days. I'll give an example, personally I'we been without drinking water--we turn on our water and we get the color of farm runoff. It comes out of our sink, faucets and so forth. We had to evacuate the children from the home. The house was completely encircled with water. Needless to say, on the news I hear problems that exist in other places, but it seems like the weight of the world is on your shoulders at times like that. I understand that compared ~o people in Connecticut and so forth, perhaps we should feel fortunate, but I do feel tha~ we have one of the more serious problems in Southold ~own. In discussing it with Mr. Dean I asked him if something perhaps could be done to rectify the situation that exists there and he said that'he would-- he said in fact tha~ I could describe the &ituation in any way that I chose and he would agree with me; that any description I could make was agreeable to him. I asked him if something could be done, could the problem be resolved and he said,"Well, yes, you know if you can land a man on the moon, I'm sure it could be rectified." Well, anyway, Mr. Dean said that he would propose to the Town Board that a study be made of the area, an engineering study, test borings and so forth, that might entail quite a complicated study, but that a study of the area be made and that a solution to the problem be presented to the Board and I would like at this time to say that personally I have--my future is in Southold Town. I've made a commitment with my family to stay here. We enjoy Southold Town, and I would hope that I have the faith and confidence in our elected officials that they will go along with ~{r. Dean for a study of the area and that hopefully a solution to the continuing problem can be arrived az. I wan~ ~o emphasize the continuing problem, we have had times in the paso--we lived there s~nce 1979--this is probably the third time that the road has been impassable. There have been several times when it has been very threatening, rain has stopped fortunately at jus% the right moment before the road was about to go under and so forth. It is a hardship living under those con- ditions. As I say, I do feel confiden~ that a solution to the problem can be arrived at, a solution that all people ~n the area, the farmers, the residents of the area can reach an agreement on. That's basically what I wanted to address the Board with this evening and once again thank you for your time, thank you for answering my phone calls. I asked you if a~ all possible--I do have photographs from previous episodes but I felt if yo~ gentlemen could possihly--I' realize that your time is usually very well taken-- I did ask you that if you did have the opportunity if you could s~op by and see first-hand because t feel that they do say a picture is ~vor~h a thousand words but I feel seeing the problem with your own eyes is much more impressive than seeing any photographs that I could presen~ of the area. So, in summary I would jus~ like ~o say thank you for this opportunity tonight to address you gentlemen a~d I do hope that something can be instituted to a~ least start rectifying the problem. Anybody else want to be heard? ~. GREG CAHILL: I've been there I guess about two years before Gary came and there are at least two other instances where the same thing happened. There are six kids who live on that particular stretch of road. There's no way that you can let them out. I had 164 JUNE 8, 1982 to carry my youngest son,who is eight years old,out of the house on my back to get to my car which had to be parked 200 yards up the road. That's how bad it gets. It's very deceiving. When the road is covered with water if you took a step of£ one side of that road onto the other side you would be submerged in about four feet of 'water. If a child fell into it it would be extremely dangerous. If a driver came down and decided that he couldn't go all the way through and try to make a "U" Turn it would be very easy for him just to get his front wheels off that road onto the shoulder and his car would be under wager too. I think it's very dangerous situation. I think in a case of emergency we'd be hard pressed to get out of there fast. For myself I know we've gone t~ considerable expense. We've had a couple of disaster loans in years past. I'm sure--I've already called the flood insurance people and I'll have to go through the same thing with this case. I had, as of yesterday, about two and a half feet of water in my basement. It gets very discouraging. Every time there's a hard rain-~Gary and I discussed this--the tension is so much that you can't sleep because you're worried. Is it going to happen again? Is it going to happen again? We love the area. My wife and I, we've discussed it before, we would have sold that house before but we feel there is no way that I could stick it on~ someone else with a fair conscience. So, we're more or less trapped unless something can be done. SUPERVISOR PELL: Thank you. Anyone else wish to address the Board? Mr. Dean did address the Board today and requested funds to have an engineering study made and test borings. Back in '79 that Gary spoke of,~,~. Dean did take some steps at that time to help alleviate some of the problems. Now, the Board did tell Mr. Dean to come back on the 22nd with a concrete preposal for .the Board to evaluate to see wha~ could be done up there and what it would cosT. So it is under way. He will be reporting back to us in two weeks. At that time the Board will have the da~a to see what it is going to cost and see where they are going to get the fun~s from and wha~ can be done. i ~ ~. LiLLIS: ~ill we be informed of the ongoing-- SUPERVISOR PELL: Just keep calling my office like you ha~done in the past and we will keep you informed, yes. COUNCILMAN MURPHY: I really don't know if the firm would be able to do the survey in that two weeks, but he is contacting aa emgineer- ing firm who does site work as their specialty, ~o come over and look at the situation. I don't know if we will have an answer ~er yoU in two weeks. We're working on it. SUPERVISOR PELL: In two weeks we'll know if we are going to engage the firm to do it. ~rs. Ward-- MRS. WARD: We still have water there and the Town has stopped pumping on reques~ of one of the farmers in the area and we're afraid that if it~ starts to rain again, because we have a head start, we're going to be in the same position, we're going ~o be pumping water from our basements for the next month. That's with two sump pumps going. We keep water there longer than anyone else does in the Town. SL~ERVISOR PELL: I'm aware, Mr. Dean did mention that today, I had three pumps going in my house to keep it dry. Anybody else wish ~o address the Board? (No response.)
