HomeMy WebLinkAboutTB-05/04/1982124 SOUTHOLD TOWN BOARD MAY 4, 1982 WORK SESSION 9:30 A.M. - Receiver of Taxes George Metlas met with the Board to discuss the plan being considered by the committee to revise the Suffolk County Tax Act whereby school taxes would be paid to the County. Another proposal is a four payment system starting with the first payment in October.--Councilman Murdock favored that proposal stating it would save the Town of Southold money.--Council- man Townsend opposed the proposal indicating it would cost more money county-wide.--Supervisor Petl said the majority of the Suffolk County Supervisor Association members opposed the four payment system as being more costly county-wide. Mr./Mellas said he has spoken with the North Fork Bank & Trust Co. relative to computerizing the tax office. Over a seven year period he can save the Town approximately $25,000,00 in labor costs. This will be discussed further in the near future. Supervisor Pell asked. Mr. Mellas about furniture he has been advised was donated to the Town of Southold by the North Fork Bank & Trust~ Co. and Mr. Mellas had picked up by the Highway D~rtment and delivered to the Town Halt.and distributed to various-~ffices as .well as his own. The Bank in a letter to Supervisor Pe~t sz, ated the furniture was offered, donated, and accepted by Mr. M~Yas. Mr. Metlas assured the Board that he personally purchase~he furniture and has the cancelled check at home to prove it. 9:55 A,..M. - The Board audited the outstanding vouchers. 10:25 A.M. - Lynne M. Gordon, Attorney, of Schechter, Schechter, Lamb & Kenney, appeared before the'Town Board on behalf of-No' Number Naugles Drive. Ms. Gordon was accompanied by Sam AYt'en, prospective purchaser of the property; they wished'to discuss the re~air~ ~o the tank at the property in question which was the subject ~.a,,~ring on February723, 1982 under Chapter 90 of the Code of[th ~f Southotd, "UnSafe Buildings". Building Inspector H~nde had submitted a report to the Town Board on March 23rd citin~;~[~ck of compliance with the Town Board's resolution at the conclusion of the hearing. On April 21st Building Inspector Hindermann submitted a report stating that most of the conditions of the resolution had been complied with, however, repair was not made to the top of the tank, but he would accept it as having been done as a temporary measure until permanent repair is made. Mr. Allen described to the Town Board the method of temporary repair to prevent the skin from coming off the tank and stated such a repair should last for twenty years. The Board was inclined to accept the adequacy of the repairs, but reserved the right to inspect the premises and make a final decision at their May 18th meeting. Mr. Allen advised that at the present time he does not have a plan of how he will use the property, but he expects to take title by June and will return to meet with the Board in mid-summer to discuss his long-range plans, 10:50 A.M. - Robert Traugott of Energy Development Corporation met with the Board to discuss his previous involvement with the Town to contruct -a municipal solid waste to energy facility - MSW-Southold, New York, Ltd. Mr. Traugott was interested in determining .what the status of Energy Development Corp. is with the Town--where does he go from here. He traced EDC's past involvement with the Town, includ- ing proposals, hearings, application to the DEC, funding proposals. EDC has received a permit from the D.E.C. to construct a municipal solid waste to energy facility in the Town of Southold. The letter from the D,E.C. indicated there were general and special conditions attached to each permit and. Mr. Traugott explained that the permit for the water would require meters, air emissions - meet all regulations, construction site - all final drawings must be submitted to the D.E.C. Traugott was advised by Councilman Murdock that the Land- fill Committee ~has been invited to.~meet with the North Fork Environmen~taI Cou~ciI .on Thursday, May 13th at whi6h time. they will hear a presentation by Laytz America representative Richard Greenfield,--The Board discussed with Town Attorney Tasker the procedure for seeking requests for proposals from solid waste management firms. However, before taking that step, the Board will await the reporm of Holzmacher, McLendon and Murrell to determine the quantities of solid waste disposed of at the landfill site, and determine existing and projected costs of disposal of solid waste by landfilling. 12:30 P.M. - Recess for lu~ch. 1:50 P.~. - Work Session reconvened. Board began reviewing the agenda. 3%00 P.M. - Work Session recessed for the purpose of holding ~wo public hearings - 3:00 P.M. - application of Long Island Lighting Company for a gas franchise; 3:05 P.M. - application of Enconsultants, ~nc. on -behaif of Muriel Baldwin for a wetland permit. 3:15 P.M. - Work Session reconvened. BQard continued reviewing the agenda and the following Off-agenda items: Confirmation that the N.Y.S. Disaster Preparedness Commission will send its representatives to Southold on September 15 and 16 to provide assistance to appropriate staff members in preparing a disaster preparedness plan and implementing procedures. Prior to September the Commission will collecting data toward use in preparing the plan. The Board discussed the request by Senior Building Inspector'George Fisher to permit Building Inspector Edward Hindermann to attend the New York State Concrete Masonry Association seminar in Smithtown on May 18th. This request was denied.--Discussed.the request of C.S.E.A. President Curtis Horton to use ~he Recreatibn Center at Peconic for the C.S.E.A. installation of officers o~ May 19th. This request was denied on the basis that it has been the policy of-:.the Town Board to allow the building to be used only by civic groups, and the C.S.E.A. does not quality under the guidelines established by the Town Board. COUNCILMAN TOWNSE~N-D: The Landfill Committee met, of which I'minot chairman, but since Larry's got one I'm going to take this one. - Basically what we decided to do is hire Holzmacher, McLendon and Murrell to d-o..a two part'study in preparation for coming to a decisio~ on what to do with the landfill. The first part is tO monitor the volume going in~o the landfill. One of the questions we keep coming up against is how much solid waste is actually going into the landfill and that can affect the viability of incineration plants or the cost of solid waste by maintaining a landfill. So that is the first step. The second step is to analyze the cost involved in maintaining ~ landfill with various levels of volume reduction, resource recovery and that sort of thing. The first part of that study is going to cost us $1,500.00 and the second part is $5,800.00. That's all I have to report. SUPERVISOR PELL: Thank you. Councilman Murdock what do you have to report? COUNCILMAN MURDOCK: In continuation of that we will have a resolution later on where we are going to sDlit our Land,il! committee. One half of the Landfill Committee ~wilt go to"Alban¥...Qn a Seminar on iandfilting, composting, etc. and the other half of the LandfitI~committee will be going either to Toronto. or Houston, depending on where the company involved thinks it's ea-sie~ for them to put a demonstration '~,on for us. The process of a lot of source separation of garbage and looks very interesting.to-us in the brochures we got. We will also engaging al surveyor. We've reached a tentative agreement to MAY 4, 1982 'i~i~'~ ........ -. purchase more property. The Landfill Committee ~as been rather active the last three or four weeks~ We also meet Thursday night again with the North .!F6rk Envmr6~a~l ~o~ncm! and R~chard Green- field to ialk about Lantz America. Certainly anybody is welcome to come. That is ail on the Land~ill. SD~ERVISOR PELL: Any other committee you wan~ to report on? COUNCILMAN MURDOCK: On the Code Committee. We will have a meeting Tuesday night with the Building Department, Planning Board and Zoning Board of Appeals. Today at the Work Session the Town Attorney is going to put forth all the recommendations of the Code Committee that worked on this previous to this year and we'll probably adopt those, and put the Code Committee on hold Until we decide at the Town's Master Plan update. Most of the Code reviews will be gone over in that forum anyway and I don't see any sense in doing it twice. SUPERVISOR PELL: Thank you. Any other Councilman wish to report anything? John? COUNCIL~N NICKLES: I would just like to announce that I met with the Commissioner of Public Works and we are going to open the beaches up basically the same sequence as we did last year, which means that Gull Pond and the Town Beach, known as Jack's Shack Beach, will open on June 26th and al! other beaches on Julv !st. ~. Muir has been no~ified so that he'll have lifeguards on hand. SUPERVISOR PELL: Any ovher Councilmen? Councilman Murphy? COD~CILMAN-MURPHY: Yes, I'd like to report Bill, for the record, the rafts for the Clam Seed Program are going to start to be put in the water tomorrow (May 5th). Paul Flagg is coming over. He's also meeting with interested students:and adults and teachers to explain the program. Paul expects to be working here two or three days to get the rafts all set up and the clam seed will be delivered here, I believe next Wednesday, a week from tomorrow. So it's going along fine and looks good. We have a lot of interest and I would like to publicly thank, and we will send them a letter, the Mattituck High School Shop Department, the whole Mattituck High School really, the Shop Department and the Science Department for a great job of coopera- tion and the fine job they did making these rafts. COMMUNICATIONS SD~ERVISOR PELL: These communications are on file in my office and the Off!ce of the Town Clerk. 1. From the Federal Emergency Management Agency informing us that the preliminary draft of the ~lood InsUrance Study report was sent to the Town Hall. They will contact us to arrange for a meet- ing to come out here and go over it with us. We are not in agreeance with all of it. Some of it we are. Our Town Engineer is going to review it and reply to them. Tell them the parts we are not in agreement with. 2. From our Congressman William Carney, a. letter on nuclear weapons and a bill attached to it, House Bill 297. He asks us to review it and if we have comments we can make them back to him. 3. From the New York State Department of Environmental Conserva- tion. Councilman Nickles will get in touch with the D.E.C. They would like to open up part of Laurel Lake which is state owned. They ask cooperation of the Town and Councilman Nickles will sit down and see what they plan to do there. 4. A letter from Islip Township, Supervisor Michael A. L~Grande, saying if the Town's are goi:ng to take over the' railroad stations they should be reimbursed from the MTA. 5. From Assemblyman John Behan~ sa'ying the $11,000 we noted two weeks ago that the Town would receive from the Special MuniC~iPal Aid Act was being held up and it would not be coming at this time. He says~ the Governor has vetoed the measure. 6. From the Southold Town Fire DistriCt Officers Association 'giving us their views on the kerosene heater law that we did p~ss. I will respond to it. 7. F~om the Southold Town Baymen's Association~ I~i~ '~f~ming us that they oppose any shellfish racks placed in pu~li~,~!~ on the bottom under water. A permit has been applied for '~~. 'placed on Fishers Island. ~ think this is what brought it aztention. It is not against the seed clam floating racks. It iS racks that will be on the bottom. IV. Description of Action: Application of Kenneth 'Strachan, Jr. for a wetland permit to construct a 240 ft. catwalk across the marshland to provide access ~o the beach at Orient Harbor, east of King Street, Orient, New York. '~- The project has been'determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effect%to the environment are likely to occur should the project be implemented as planned. Because there has been no response in the allotted time from the New York Sta~e Department of Environmental Conservation, it is assumed that there is no objection nor con~aents by that agency. I would like to comment a little on our meeting with 'Robert Traugott here today who is the President of Energy Development Corporation of Norwich, Connecticut. On behalf of MSW-Southold he gave us a copy of a letter signed by David DeRidder of the New York Department of Environmental Conservation saying, "Enclosed herewith are the necessary permits required by this Department for the construction of the above noted facility"~ There were three permits issued by the New York State Department of Environmental Conservation for the burning of manicipal solid waste in the Town of Southold. I believe this is the first and probably the only permit at the present time in the State of New York for a modular system. The Town of Southold right now is in the unique position-- this Board, not just the committee, b~t this Board has long hours in~o discussing municipal solid waste and thereof and at the present time we probably are in role in the entire State of New York and certainly on Long and evidenced by the number of resolutions we · still not satisfied that this is ~we do not wan~ to close ou~ any options, build and operate a plant to burn ~ ~a~ I say agamn, this is the only Town in the a permit by the New York Department of Environmental Conse~tion t.o b~rn in a modular system based on producing etectricity~a~s ~ by-product. I was awarded the bid and detive~O0 tons of bluestone to the Highway Department. This year Dean on a number of occasions and in the beginning he had~ld- me that they might go under a county bid as far as delivery of blue- stone. Today again I also had spoken to hSm and he was rather annoyed at me for trying to find out from him if there was going to be a bid or if'they were going to go under the county bid. I did express to him today that the county bid would be higher than what my price would be to him. At that time he did not seem tO care if the price was going to be any cheaper or not. Now, last year I saved the Town almost-$800.00 over the price of the closest bidder and he still would not give me an answer if the Town was going to have a bid this year or if they were going to go under a county bid. Does the Town Board knoW? SUPERVISOR PELL: No, the Town Board-'-unless somebody on the Board does--I do no~ know. Mr. Dean has not brought this up to my attention~-~ yet. He has not asked the Town to go out to b~d yet. I just don t know. Does anyone know? COUNCILMAN MURPHY: Ray mentioned it to me today and he said he's no~ ready-to decide on how much he wants and. how he's going to handle it and where he wants to go to. I don't think he's made the decision yet. I don't think it's a T~wn Board decision. I witl talk to him for you as I will see him tomorrow and see if I can ge~ some information for Mou. ~ITE: Okay, because as I say, I know what the county bids are. ~ matter of fact in this area for the county bid as far as for gravel I'm tied-with somebody else.
