EXECUTIVE SESSION 9:45 A.M. - The Board met with Charles Graves to discuss the possibility of engaging his services for the 1983 CSEA and PBA contract negotiations. WORK SESSION- 10:05 A.M. - The Board began reviewing the agenda. 11:00 A.M. -' Don Sioss, engineer for Holzmacher, ~cLendon and Murrell. P.C. met with the Board to explain the reasons f~r cost overruns for the reconstruction of New SuffOlk Avenue, ~attituck. Mr. Sioss explained that the original grant agree,~e~' with the State of New York was entered in to~about~.si~X~:ye~go ~ith certain set guidelines for constructiOn ma~er~k~'~?~he costs have risen considerably since that time'and is,~!~t[j~r reason for cost overruns.---The-new bid for street ligh~has been prepared and after approval by Town Attorney Taske~ Hig~ay Superintendent Dean a~d the Town Board Street. Light, Committee will be adveruised by Town Clerk Terry. 11:25 A.M. - Charles Randall, President, Eastern Long Island Brach of National Association for the Advancement of Colored People with the Town Board to review ~he proposed Town of Southod A~f!i~mative Action Plan which is on the Town Board agenda for adoptionl at ~he regular meeting. Mr. Randall was satisfied with the proRosed ~lan. 11:45 A.'M. - The Board resumed reviewing the agenda. Discussed proposed park'ing lot at ~t'tit'uck business district. 12:15 P.M. - Recess for lunch. 2:00 P.M. - Work Session reconvened and the Board resumed reviewing the agenda. 3:00 P.M. ~'ork Session 'recessed 'for publ'i'c' ~he~ri'n.g on appliclation of E. M. Kontokosta for Jem Realty Co. for a soil removal permit. 3:55 P.M. - Work Session reconvened. Councilman Townsend suggested that the~Town hire a . consultant to evaluate the proposals received on muni'ci'PaI !so~id waste management, and evaluation o~ the ~nd'f'i'l'I 'site and preparation of a time schedule for the process, He would like to write to several~ consultants inviting them to meet with the Board to discuss~ this. Councilman Murdock stated he feels H2M has given the Town tihat informa~.~ tion in terms of the characteristics of the landfill area.--The Land~ fill Committee will mee~ to further discuss this. Councilman Townsend suggested that the Town~Attorne~ prepare an agreement to be entered into with the Village of Greenporr for the solution of the scavanger waste problem. Town Attorney Tasker stated that the Town and~Vilta, ge Boards must first reach an agreement on specific points of the agreement before he can draw Such a document, Councilman Townsend will arrange a meeting between a committee from the Town and Village Boards. 4:30 P.M, Account Clerk~ Joan Ri'chter and Y. outh Director James NcMahon met with the Board to review a new program to be initiated March 1, 1982 - Division of YoUth Juvenile Aide Program MARCH 9, 1982 ~ Y3 · ,~!~'~,:;~?~.~ 4:35 P.M. - Councilman Murdock submitted and discussed his March :5, 1982 meeting of the Building, Zone and Planni'ng Committee and made the following recommendations: (1) Hire a clerk-typist for the Building Department; (2) Plan to expand the Town Hall on easterly end and (a) Temporarily move the Zoning Board into the Councilmen's office; (b) Move the Councilmen,s ffice next to the Town Historian's office; (3) Begin the up-date of the Master Plan; (4) Discuss co-revision costs relative to adopting the Code changes already worked on under Chairman Drum as well as new fee schedules and overall Code changes. After reviewing Councilman MUrdock's recommendations, it was the decision'of the Town Board to move the Zoning Board of Appeals into Building Inspector Fisher's office and relocate Mr, Fisher in the outer Building Department office and enclose his desk with a partition.--With reference ~o the ~iaster Plan up-date and Code revisions, Planning Board Chairman Henry Raynor will be requested to contact planning experts to meet with the Town Board for interviews. Councilman Murdock will set a date for a meeting with ~epresentatives of the Building Department, Planning Board and Board of Appeals, as well as Town Attorney Tasker and the Building, Zoning and Planning Committee to begin reviewing Code revisions. 5:40 P.M. - Work Session adjourned. 7:15 P.M. - The Town Board met with Sybil Mizzi and Paul Fink of Pan Tech Management Corp. to discuss the 7:30 hearing for Citizens' Ideas on the Town of Southold Federal Community Development Block Gran~ Funds. We had a meeting of the Town Board Committee on Zoning, the ZBA~ Building Department and Planning Board. i had that me~tin~ on Eridav. The meeting lasted approximately two hours and I made a report to the Town Board today which was two pages tong which I do no~ want to read to the entire membership here tonight. Part of the report was some recommendations that I made ~o the Town Board. I will read the recommendations I made just to give the people an idea of the scope of the meeting. The recommendations were discussed~ by the Town Board and I will not say that:the Tow~ Board. is going ~o do them, .but I just wanted the public to understand ~he type of' problems we're trying to-address. One is to hire a clerk-typist for the Building Department. Number 2 was to plan to expand the Town Hall, to build on the northeasterly end. 2(a) was to ~emporarily move the Zoning Board of Appeals into-the Councilmen's Office and (b) move the Councilmen's Office next to the Town Historian's Office. 3. Begin the update of the Mas~er Plan and 4. To discuss the co-revision costs relative to adopting the Code changes that were already worked out under Chairman Drum last year, and new fee schedules and overall Code changes. Those are a fast summary of what we consider to be very important problems in ~he Town and the Town Board did spend a great deal of time discussing these problems and in the near future you will see a few moves made by the Town to ~ry and ameliorate some of the problems that we have. Letter from the Planning Board recommending changes ~n our Town Code and asks the Board to review them and see if they would like to act upon them. -We are in the process of reviewing all the Town Code. It is our intent'ion to come up this sprin~ or summer with a package to change several parts of our Code that is outdated and revise it while we are working on the Master Plan a~ the same time perhaps. 2~ Letter that Councilman Murdock, Chairman o.~ our Land[ill Committee, received concerning a booklet that Resour~Ce Technol~ogy COrporation is putting out and how they are going to list Southold Town and our landfill. : : i i.i~- 3. Letter from Federal Emergency Management AgenCy i~ regards to the wave height on our shores. As you know,there is a ~Tood plan oat for insurance under-the Flood Plan; YOu h~Ve to meet certain requirements and one of'the things that they have c.~me up with is the wave height of the waves in ease'of ~:bad storm~, hurricane. Our Town Engineer disputed some of thei~ facts an~ he has been in touch with them and we have been told by this letter they are going to revise some of them in Southold Town. 4. Letter from the Laurel Elementary School advising us any money that the Town makes on interested while it holds the school district's moneys please turn over to t?~em. It is state law ~hat 'went into ~effect this year. 5. Letter concerning the dredging of Cedar Beach Inlet. A request to have it dredged and an update on the jetty situation, Letter is from Paul Birman. 6. Regarding Robins Island from The-Nature. Conservancy giving their views. 7. By amending Section 52-54 (Heating) by adding thereto a new subdivision J, to read as follows: J. Approved Portable Kerosene Heaters. Notwithstanding any other provisions of this Chaoter, approved portable kerosene heaters, as defined in Artlce 7-A of the Real Property Law, are permitted provided that such heaters comply with the provisions of such law. 2. This resolution was declared duly ADOPTED. COUNCILMAN T~VNSEND: Bill, I'd like to comment on this. At the hearing we received communications from both building inspectors and there's been some other letters written in opposition to this .and they had some good points. There's some danger in the use of kerosene hea~ers but it was thought that since the New York State Building Code was amended to allow portable kerosene heaters and since they were in such common use in Southold Town that it was really useless for us to continue to have in our law under our present Local Law. The face is that it does allow some people to have inexpensive heating and in that sense I think in the long run it Will be a greater advantage to Southold Town than a threa~. I think that's why the Town Board moved to include the kerosene heaters in their approved methods of heating. COUNCILMAN MURDOCK: At that rate with Joe's explanation I feel in light of how I voted I should also say that I am deeply distressed with the communications from the Building Department that none of the suppliers of kerosene as fuel for these stoves will certify that they are serving, for this area, K-1 fuel. Without the K-1 fuel these heaters put off a lot more carbon monoxide and a lot more danger to the public and with all due respect to the rest of the state using heaters that are approved in this fashion I find no fault with the heaters but I do if I cannot get the peoDle of this~Town kerosene that is sufficient to be burned safely. That one fact bothers me more than all the others. But I am still not at peace and I believe that that is probably the major consideration that mos~ of the fire chiefs and fire departments in. the Town of Southold are against these heaters being used unvented. And I wish there was some way we could force suppliers to give to this Town tha~ which we in the Town believe we are paying for. The persons who receives the fuel from his supplier and sells it to the homeowner in all honesty believes he is getting K-1 fuel and that's what he buys and he's paying for and that's what we the public pay for, but the supplier will not verify and'will not attest to the fac~ that he supplies K-1 fuel and I think that's a very important item for the safety of the people Of this Town. FRANK BEAR, Southold: I'd like to say that the Town Board _~. having been in session since 9:00 o'clock this morning I think has shown a remarkable amounz of alertness in spite of a couple of slips here tonight and of course Ruth Oliva and I have been here most of the time too but that's something else. There's something that came up today that I'd like to comment on if I may and that is the matter of a grant application for federal funding assistance for the Airport Site Selection Master.Plan Study in the Town of Southold. This came up as a result of a letter from PRC Speas which was chosen to represent the Town in this matter back in September of 1980 and this letter then was referred to the Chairman of the Southold Airpark Committee David Spohn to prepare a response to that and he did prepare this response because he is a person who has been behind-the effor~ to ge~ an airpart in the Town of Southold since approx- imately the year One. This, as I understand from the Work Session today, was to be used as a response from the Town to PRC Speas to renew the effort for funding. The letter from PRC Specs has said it's quite clear that whatever federal moneys will be available for airport planning and construction will be limited. All indications are that an extension of the current AP legislation will be passed mmking 450 million dollars available for airpark developmen~ nationwide. :Competition among municipalities for these ..... funds will be great, and so on. I'd like tc point out that this ~ effort toward getting an airpark for the Town has been going on without any real public participation now for a few years and after .~ the action taken in September of 1980 to appoint PRC Specs I wrote a letter to the Board in which I said, "I urge the Southold Town Board to arrange for public participation in 'relation to the Town proposed Airpark Master Planning/Site Selection S~udy." You'll note that says, "Airpark Master Planning/Site Selection". The word feasibility does not appear. In my letter I said, "The public can be involved in two ways: (1) At public meetings conducted by the Town Board and (2) through a citizens advisory committee. This committee could work in cooperation with the consulting firm of Specs..." which would give the public an opportunity to participate early. Until now as stated in the letter the~onty public involvemen~ in terms of this proposal for a Southold Town Airpark has been by local flying enthusiasts who call themselves the Airpark Committee · and they are David C. Spohn and John Duelt who are airline pi~ots 85 86 MARCH 9, 1982 and some assistants to them. I'd like to say also~ or point out that in that letter I said, "The unofficial 'Airpark Committee' has in fact superseded the Town Airport Committee which came into being in January 1979, with Town Board authorization. That officially appoint- ed committee has not been-consulted or informed at any time of the 'Airpark Committee's' negotiations with the Town Board ..... The official Town Airport Committee l~ade a study of costs and conditions for the possible establishment of a Town airport. Its assignment did not include the question of feasibility. That matter was expected to be addressed by the Tri-State Planning Commissioner," which was going to make a study of the need for airports on Long Island. Now, we pointed out in there that it to. 100 acres of land needed for the airport, at" a C! to $1,165,000," of which 95½%. or possibly more at that time would have been funded by federal and state governments. But they did not include such costs "as,.an estimated $160,000 for a possible eventual office-terminal, or the unestimated annual expenses of maintenance, snow removal, and liability insurance." Now again"t'he Southold Town Development Plan does not include the plan that now exists, does not include or provide for an airport at all. In fact, a proposal by the consulting firm of Raymond and May that the plan include an airport was deleted before the plan's adoption....because of Opposition both from town officials and the public. In this connection, ithe Town Planning Board" %vas then, now still is, taking "steps to revise and update the town plan," Now, how am I to"separate Airport Master Planning/Site Selection Study relate to a new master plan for the entire town?" I wind up by saying, "Let us not assume now,..;. that a Southold-Town airport is feasible and desirable," "Neither should we assume now that Southold should not have an airport. Just let us be certain ........ That what is done is what we need ..... ment. The bill is very specific when it says an.airport project may not be approved without a public hearing for the:--purpose of considering economic, social and environmentaI<effects of an airport location. Now here we are, this is now:-1982, quite a long time later and the so-called Airpark Committee has been work- ing with the Town Board in an attempt to get an airport going and here we go again and I think some of the points which I made at that time about the necessity for public participation early in the game, not later, would tend to offset the possibility of a lot of difficulties later on the public and otherwise and possibly provide for input which would be helpful. I think feasibility is something which has not been addressed and should be addressed before we go too far. I do hope that this Town Board will take into consideration these points which were made in September of 1980, as well as what I am trying to say today, that we should not be moving forward to get an airport on a site study before we determine a feasibility of an airport for the Town of SouthOld. HENRY LYTLE, Peconic: Mr. Supervisor, may I refer you to Item No. ? under Communications, the letter from Greg Blass about Pine Crest Dunes. Could we have that for the record? SILPERVISOR PELL: I can give you a copy of it. right after the meeting if you like. MR. LYTLE: It's not neoessary, just the general sentiments. COUNCILMAN NICKLES: This is to Supervisor Wilti~m Pell regarding Peconic Dunes Camp. "To the Honorable Supervisor and Members of the Town Board: Please be advised that a decision has not yet been made by the County as to whether the above facility will operate as a camp during the summer months of 1982. The County Purchasing Department is on the verge of sending out to public bidding a proposal for operation of the camp by a private contractor. When the bidding proposals are received from the general public, the County will be in a position to decide the Camp's s~atus for this sun~ner. Accordingly, such a decision is by.the end of March. In the meantime, plans for the MARCH 9, 1982 ~ 87 operation of the Outdoor Lear~:~L~6~atory by SCOPE will not be disturbed for this Spring. Continuation of the Outdoor Learn- ing Laboratory in future years is still under consideration. Please do not hesitate to contact the First District Office in connection with any questions relating to the Peconic Dunes Camp." MR. LYTLE: Thank you very much.
