SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to;the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. S PROPERTY FACTS/DESCRIPTION: The subject property encompasses an 18,398-square-foot non-conforming parcel situated within the R-40 Zoning District. The property is a corner parcel with 191.53 feet along Marratooka Road,then turns southwest for 108.95 feet,turning 190 feet northwest to Park Avenue, it then returns for 84.72 feet along Park Avenue. The property is improved with an existing one and one-half story residence. The property also has an accessory frame shed in the rear yard with raised wood planters, and a brick patio behind the house. This description is based upon survey of property prepared by Donald J.Metzger, L.S., last revised January 15,2025. BASIS OF APPLICATION: Request for Variances from Article III, Section 280-15; Article XXII, Section 280- 105A; and the Building Inspector's January 17, 2025, Amended February 6, 2025 Notice of Disapproval based on an application for a permit to construct an accessory in-ground swimming pool with spa and an accessory cabana/pool house, and to construct a six(6)feet high fence in the front yard; at 1) accessory structures located in other than the code permitted rear yard; 2) proposed'fence is more than the code required maximum 4 feet in height when located in the front yard; located at: 2965 Marratooka Road,Mattituck,NY. SCTM No. 1000-123-2-'27. RELIEF REQUESTED: The applicant requests variances for the following: 1. An accessory swimming pool and pool cabana located in the front yard where a rear yard location is required. 2. A proposed 6-foot-high fence located in the front yard,where a maximum of four feet is permitted. ADDITIONAL INFORMATION: At the public hearing held on May 1, 2025, both the property owner and their representative provided testimony regarding the proposed project. During the proceedings,they were asked whether there was a conforming location available for the placement of the pool. It was acknowledged that, by relocating the existing shed, a conforming placement could be achieved. Additionally, questions were raised concerning any previously approved variances for pools located in front yards within the surrounding neighborhood; however, no Page 2, May 15,2025 #8006,Crumm SCTM No. 1000-123-2-27 such prior variances were presented. The owner was also asked whether the proposed six-foot-high fence could be reduced to a conforming height of four feet, to which they agreed. Furthermore, testimony confirmed that none of the existing large trees on the property would be removed as part of the project. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 1, 2025,at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). The granting of the requested variances would result in an undesirable change to the character of the neighborhood and could be detrimental to nearby properties.The area in question is characterized by modest two-story residences,with no accessory structures currently located in the front yards. While there are waterfront properties across the street that feature pools in their front yards, those installations conform to zoning regulations and are situated significantly farther from the street than what is being proposed in this application. Approval of the proposed large 25 feet by 38 feet accessory pool and cabana would establish a precedent for similar structures in a neighborhood where none currently exist. As submitted, the application would clearly alter the existing residential character and likely encourage additional such developments,fundamentally changing the visual context of the neighborhood. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method,feasible for the applicant to pursue, other than an area variance. There is enough room in the rear yard for a modestly sized conforming accessory swimming pool without the need for area variances. Therefore,the granting of an area variance is not necessary to accomplish the owners wish to have an accessory-ground swimming pool. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial: a) The location of the accessory swimming pool, measuring 25 feet by 38 feet in area, and cabana represent a 100%relief from the code. b) The proposed 6-foot height fence represents an approx. 50% increase from the code. However,there are code conforming options to allow the homeowner an accessory in-ground swimming pool. Due to these options, a variance from the existing zoning codes would not be supported by the balancing test that this board is required to make. 4. Town Law$267-b(3)(b)(4). Evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. Given the proposed' placement of the accessory structures in the front yard of a corner lot on a non-waterfront property, the proposed construction is not in keeping with the character of the community. Furthermore,approval of this application would set a precedent that could lead to a proliferation of similar proposals,thereby initiating a cumulative adverse impact. 5. Town Law V67-b(30)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. The relief requested by the applicant does not constitute the minimum variance necessary to afford reasonable use of the property. Moreover, the proposed variance fails to adequately balance the applicant's interests with the obligation to preserve the character of the neighborhood and to protect the health, safety, and general welfare of the community. While I am not opposed to the overall plan,the current conditions do not allow for a 6-foot fence to be erected as proposed without further encroaching on our property. The applicant has already planted trees along the proposed fence line,which presently extend. onto our property—see photos below. This leaves no practical space for the installation of any fence. As shown in the enclosed property survey, our existing fence is fully within our property boundaries,with several inches of clearance.Adding another fence along this line would not only create a physical conflict but would also place the new structure on our property. To accommodate a fence, the newly planted trees will need to be relocated. Also,rather than having 25 feet of 6-foot fencing in our front year, installing the fence on the interior side of the tree line will maintain consistency with the applicant's design along Park Avenue and Marratooka Road, and help preserve the open character and appearance of our front yard—In any case,the trees will need to be moved, as their bases will eventually grow six to eight feet in diameter,press against our fence, and further encroach on our property—as pretty as they are. As previously mentioned,I am not opposed to the addition of a fence,but I believe it should be done tastefully and thoughtfully. The proposed pool and cabana, along with the other renovations made to the property so far,will undoubtedly enhance the overall value and appeal of the neighborhood. However,I ask that the placement of the fence be reconsidered to ensure it aligns with the surrounding character and respects adjacent properties. Additionally, I would appreciate clarification on the type of fence being proposed—not as opposition,but to better understand the materials and style being considered, as it may impact the overall appearance. Lastly, the corner of Marratooka Road and Park Avenue is a low-visibility intersection. I kindly ask that this be taken into consideration during the planning process, as children frequently play in the neighborhood and safety should remain a top priority.
