Murnane PROPERTY LOCATION: 125 Bow Road, Southold,NY SCTM No. 1000-87-2-33 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject nonconforming 18,858 square foot property is located in the .Residential R-40 Zoning District. The northerly property line measures 210 feet and is adjacent to Bow Road, the easterly property line measures 69.04 feet and is adjacent to Arrow Lane, the southerly property line measures in total 232.22 feet(116.00 feet runs southerly then runs northerly 116.22 feet)and the westerly property line measures 87.73 feet and is adjacent to Tepee Trail. The parcel is improved with a two-story frame dwelling. There is a two- car free standing accessory garage located to the east of the dwelling. A brick patio is located at the rear of the dwelling with a bar-be-que area with a temporary unanchored pergola.The property is fenced as shown on the survey map prepared by Paul Barylski, LS and last revised January 11, 2025. BASIS OF APPLICATION: Request for Variance from Article III, Sections 280-15; and the Building Inspector's January 14, 2025 Notice of Disapproval based on an application,for a permit to construct an accessory in-ground swimming pool; at 1) swimming pool located in other than the code permitted rear yard; located at: 125 Bow Road, Southold,NY, SCTM No. 1000-87-2-33. RELIEF REQUESTED: The applicant requests a variance to construct an in-ground swimming pool accessory to an existing single-family dwelling on a 18,858 square feet lot located in the Residential R-40 Zoning District. The accessory structure is not permitted, pursuant to Article III, Section 280-15, which states accessory buildings and structures shall be located in the required rear yard. The survey prepared by Paul Barylski,LS.proposes the accessory in-ground swimming pool to be located in the front yard. ADDITIONAL INFORMATION: This parcel is part of the Nunnakoma Waters Subdivision and as noted on the prepared survey;the property has three front yards with the primary front yard facing Bow Road. r Page 2,May 15,2025 #8004,Murnane SCTM No. 1000-87-2-33 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 1, 2025 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject property is located in the Nunnakoma Waters Subdivision which has similar sized lots that contain various accessory structures. The subject lot is bound by Bow Road, Tepee Trail, and Arrow Lane and therefore has three front yards and is further constrained by.the lot depth. The southern part of the parcel is well screened,the rear yard abuts wooded property,and the proposed pool will not be visible to the neighbor's view or interfere with the character of the neighborhood. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be,achieved by some method, feasible for the applicant to pursue,other than an area variance. The narrow depth of the property along with the lot containing three front yards makes it impossible to fully.locate the pool entirely in the rear yard. The proposed in-ground swimming pool is a small precast fiberglass 8.5 feet x 18 feet structure. The property as shown on the survey is improved with a code compliant fence. The applicant has proposed the location as close to the rear yard as possible given the three front yard configuration of the property. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 100%relief from the code. However,the lot containing three front yards without a useable rear yard brings the applicant to this Board for relief. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to'or at the time of purchase. 6. Town Law V67-b. Grant of the requested relief is the minimum action necessary and adequate to,enable the applicant to enjoy the benefit of an in-ground swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD:In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Acampora, seconded by Member Planamento, and duly carried,to GRANT the variance as applied for,as shown on Survey prepared by Paul Barylski, L.S., last revised January 11, 2025. SUBJECT TO THE FOLLOWING CONDITIONS: 1. Pool pump equipment/mechanicals must be located a minimum of 20 feet from any property line or be contained in a shed type enclosure with a lot line set back that is in conformance with the bulk schedule for accessory structures 2. Drywell for pool de-watering shall be installed. The subject parcel is a non-conforming .43acre (18,858 SF) lot in the R- 40 zoning district. The parcel is part of the Nunnakoma Waters Subdivision and is located on Bow Road in Southold. As depicted on the survey provided, the parcel has three front yards with the primary front yard facing Bow Road and a depth of 87' on the west side and 69' on the east side. The proposed project involves the construction of an 8.5'x 18' inground swimming pool with a perimeter patio on grade. The property is already improved with a code compliant fence and the pool mechanicals are proposed to be installed within the fence behind the existing garage. The proposed location of the pool is compliant with the accessory structure setbacks and is located as close to the "rear yard" as possible. It is noteworthy that the Applicant was granted prior variance relief for an accessory structure in the front yard, by way of ZBA Determination # 7027 of 2017, based in part on the Board's recognition of the hardship created by the property's frontage on three town roads. The Board also noted that there was prior precedent for granting relief from the rear yard requirement for accessory structures in this neighborhood on a similar parcel with three front yards. (See, ZBA #2916). For the following reasons, the Applicant submits that a variance from the accessory structure in rear yard requirement of§280-15 is warranted. 1. An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: The surrounding Nunnakoma Waters community is characterized by similarly sized sized lots that are improved with single family residences and various accessory structures. But for the multiple front yards and the limited depth of the parcel, the proposed swimming pool would be constructed substantially in the rear yard of the parcel and existing vegetation on the southern end of the lot provides screening for the neighboring parcel. The pool is also modestly sized (153 SF) and as such, the granting of relief will not result in an undesirable change or detriment of any kind to the character of the surrounding neighborhood. 2. The surrounding community consists of many non-conforming improved parcels of similar size. The agent for the applicant provided the Board with ZBA prior determinations for six(6) similar setback variances granted by this Board; one of which relates to an accessory garage. In addition, included with the six determinations is one variance for a property that has three front yards, which is similar to the applicants' property. The agent agreed to provide this Board with the corrected site plan showing the rear yard setback of 22 feet(shows 26.1 feet in error). During the public hearing, the applicants' agent testified that the second story of the proposed accessory garage will be used solely for storage. When asked about the dimensions of the proposed garage dormers, it was affirmed that the proposed dormers conform to the Town Code requirements. One neighbor submitted a written objection regarding the proposed detached accessory garage structure in the front yard, because the Nunnakoma Waters Homeowners Association covenants and restrictions states "No structure shall be permitted on the premises other than a single family residential dwelling with one private garage,"and an attached garage already exists.Additionally,the proposed two story accessory garage is"out of character with the scale of the adjacent one story residences."However,the Board notes that the existing attached garage is proposed to be converted to habitable space. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on 3March 2,2017 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject property is close to the northern end of the subdivision. The lot is long and narrow fronting on three roads. The proposed second story addition over an existing one story attached garage, which is proposed to become habitable space on both floors, will not change the existing footprint of the subject dwelling. Based upon personal inspection of the subject neighbor by the Board membdrs, accessory garages do not appear to be characteristic of this neighborhood 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant to construct the accessory garage cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. There is insufficient area in the conforming rear yard to construct an accessory garage, and an attached screened porch exists on the easterly side of the as built dwelling which makes attaching a garage there impractical. Since the applicant proposes to build a second story over the existing attached one story garage for additional habitable space on both floors, the non-conforming setbacks of 34.8 feet front yard and 22 feet rear yard already exists; therefore approval to add a second floor cannot be achieved by any method other than area variances. 3. Town Law 4267-b(3)(b)(3). The variance granted herein for the proposed accessory garage in the front yard is mathematically substantial,representing 100%relief from the code.However,the applicants' property has three front yards and no functional rear yard which creates hardships when proposing to further improve the property. Further mitigation for variance relief results from the proposed front yard setbacks of 35 feet and 43.9 feet which are the setbacks required for a principal structure. The variance for the front yard setback of 34.8 feet where the code requires 35 feet is de minimus. The proposed rear yard setback of 22 feet where 35 feet is required by code is 37% relief and is substantial. However, no increase in the degree of nonconformity is being proposed and the designated rear yard of the property actually functions as a side yard for the as built dwelling. . 4. Town Law �267-b(30)(4) No evidence has been submitted to suggest that variances for the proposed additions and alterations to the dwelling in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. However, since accessory garages are not typical in the subject neighborhood, the proposed two story 3 car accessory garage in the proposed front yard location would adversely impact the character of the neighborhood. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the rear yard and side yard setbacks and the accessory structure location are the minimum actions necessary and adequate to enable the applicant to enjoy the benefit of a newly renovated home with detached garage in the front yard area while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community.
