ORGANIZATIONAL MEETING
JANUARY 5, 1982
WORK SESSION
9:30 A.M. The Board began reviewing the agenda of the Organiza-
tional meeting and agenda of the Regular meeting. Outstanding
bills were audited.
Councilman Murphy reported on two public notices which were on
the Dec. 29th agenda, Kreh and Allen,concerning minor subdivision
applications before the DEC. A letter will be sent to the DEC
requesting that they examine the water supply situation closely.
The Town Board will meet at 10:00 A.M., Friday, January 15, 1982
for the purpose of discussing solid waste management in the Town.
11:55 A.M. - Recess for lunch.
1:30 P.M. - Work session reconvened and the Board continued reviewin~
the agendas.
2:25 P.M. - Reverend Frederick Hummel of the Mattituck Presbyterian
Church, accompanied by Edward Slaga (Richard Keogh, President of
the North Fork Conununity Theatre was also present) appeared before
the Board to ask the Board not to reconsider appealing the decision
in the matter of the Mattituck Presbyterian Church v. The Southold
Town Board of Assessors. The Church will not defend the appeal and
the N.F. Community Theatre does not have the funds to appeal, therefore,
they will be asked to vacate the premises and the theatre will fold.
His argument was that it is a matter of one non-profit organization
allowing another not-for-profit organization to use their property.
Mr. Keogh concurred with Reverend Hummel's statements.
EXECUTIVE SESSION
2:35 P.M. - Richard J. Cron met with the Town Board to discuss the
matter of the Mattituck Presbyterian Church v. The Southold Town
Board of Assessors. This discussion concluded at 3:30 P.M.
ORGANIZATIONAL MEETING
The Organizational Meeting of the Southold Town Board was
held on Tuesday, January 5, 1982 at the Southold Town Hall, Main
Road, Southold, New York. Supervisor Pell opened the meeting at
3:30 P.M. with the Pledge of Allegiance to the Flag.

SUPERVISOR PELL: The first order of business today is special
resolutions for four of our elected officials who have retired
from the service to their Town.
Moved by Councilman Nickles, seconded by Supervisor Pell,
WHEREAS, JAMES H. RICH. JR., a most esteemed officer of the Town
of Southold did retire from public service on December 31, 1981,
and
WHEREAS, JAMES H. RICH, JR. has given generously of his time and
talents in his faithful service to the Town of Southold residents
as a Councilman from January t, 1970 to December 31, 1977 and Town
Justice from January l, 1978 to December 31, 1981, and
WHEREAS, his record of fine service, diligence to duty and dedicatio!
to the Town of Southold and its people deserves the sincere gratitud~
of those with whom and for whom he worked, and
WHEREAS, the Town of Southold will be deprived of his wise counsel
and judgment as an Officer of the Town of Southold, now, therefore,
be it
RESOLVED that the Town of Southold hereby expresses their most
sincere appreciation to JAMES H. RICH, JR. for his unselfish and
wholehearted cooperation and untiring efforts on behalf of the Town,

WHEREAS, it is required by Section 27, Subdivision 1 of the Town
Law that the Town Board fix, from time to time, the salaries of
all officers and employees of the Town, whether elected or appointed,
and determine when the same shall be payable, now, therefore, be it
RESOLVED that the annual salary of Francis J. Murphy, Deputy Super-
visor be and hereby is set at $1,600.00 per annum effective as of
January 1, 1982 and the same shall be paid in regular semi-monthly
payments.

Moved by Supervisor Pell, seconded by Councilman Nickles,
WHEREAS, Section 64 of the Town Law requires the Town Board to
designate, by resolution, banks in the State in which the Supervisor
or any other officer of the Town shall deposit all moneys coming
into their hands by virtue of their offices, and
~HEREAS, the Town Board may require any bank, so designated to
deposit with such Board bonds or certificates of the United States,
of the State of New York, or any county, town, city, village or
school district of the State of New York as security for such funds
so deposited, but such bond or certificate shall be subject to the
approval of the Town Board and shall be deposited in such place and
held under such conditions as the Town Board may determine, now,
therefore, be it
RESOLVED that the following banks are hereby designated as
depositories and the following amounts of securities are hereby
required, to wit:

official newspaper of the Town of Southold for the publication of
all notices, resolutions, ordinances and other matter required to

RESOLVED that The Suffolk Times, Greenport, New York, a newspaper
regularly published in the Town of Southold, which has been entered
as a second class mail matter, be and the same is hereby designated
as an additional newspaper of the Town of Southold for the publicati~
of all notices, resolutions, ordinances and other matter required to
be published.

On motion of Supervisor Pell, seconded by Councilman Murdock, it was
RESOLVED that pursuant to Section 64(1-a) of the Town Law, a petty
cash fund is hereby established in the following amounts for the
following officers, to wit:

On motion of Councilman Murphy, seconded by Justice Edwards, it was
RESOLVED that pursuant to Section 142(la) of the Highway Law the
Southold Town Superintendent of Highways be and he hereby is author-
ized to purchase equipment, tools, snow plows and other implements
and devices without prior approval of the Town Board in the amount
not to exceed $3,000.00 for any one item, during the period from
January 1, 1982 to December 31, 1982.

Supervisor William R. Pell III appointed Councilman Francis J. Murphy
as his Deputy Emergency Preparedness Coordinator for the Town of
Southold for the term January l, 1982 through December 31, 1983,
to serve in such capacity without compensation.
Supervisor William R. Pell, III appointed Justice Raymond W. Edwards,
Jr. as his Deputy Emergency Preparedness Coordinator for Fishers
Island for the term January l, 1982 through December 31, 1983, to
serve in such capacity without compensation.
On motion of Councilman Murdock, seconded by Justice Edwards, it was
RESOLVED that Supervisor William R. Pell, III be and he hereby is
designated to represent the Town of Southold at the annual meeting
of the Association of Towns of the State of New York to be held in
New York City on February 14, 15, 16, 17, 1982, and to cast the vote
of the aforesaid Town of Southold pursuant to Section 6 of Article III
of the Constitution and By-Laws of said Association of Towns, and be
it further

RESOLVED that Councilman John J. Nickles be and he hereby is designated
to act as an alternate to cast the vote of the Town of Southold at the
annual meeting of the Association of Towns in the absence of Supervisor
William R. Pell, III.

On motion of Councilman Townsend, seconded by Councilman Murdock, it was
RESOLVED that those officers and employees of the Town of Southold
attending the annual meeting of the Associa'tion of Towns of the State
of New York be and hereby are allowed $250.00 per officer and employee
for the actual and necessary expenses to travel, meals, and lodging
incurred while attending said meeting.

On motion of Supervisor Pell, seconded by Councilman Nickles, it was
RESOLVED that any Town official elected or appointed who is required
to use his own automobile in the performance of his duty, be compen-
sated for travel expenses necessarily and actually incurred in carrying
out the duties of his office, at a rate not to exceed twenty ($.20)
cents per mile.

Moved by Councilman Nickles, seconded by Councilman Murphy,
WHEREAS, Section 123 of the Town Law provides that town officials
and employees who receive and disburse moneys of the Town shall
on or before January 20th account to the Town Board for all moneys
received and disbursed by them in the previous fiscal year, unless
the Town shall engage the services of a certified public accountant
or public accountant prior to January 20th, and
WHEREAS, the Town Board deems it necessary to engage a public
accountant to prepare the aforesaid annual account for all Town
officers and employees, now, therefore, be it
RESOLVED that the Town Board of the Town of Southold engage the
services of Elaine F. Kaldor, C.P.A., P.C. to make the annual audit
of the books and records of officers and employees of the Town of
Southold for the fiscal year 1981 at a contract fee of $3,000.00,
said audit to be completed within 60 days after the close of the
1981 fiscal year.

Moved by Councilman Murphy, seconded by Justice Edwards,
WHEREAS, Section 11 of the General Municipal Law provides that
the To%~ Board may authorize the Supervisor, the chief fiscal
officer of the Town, to invest moneys not required for immediate
expenditure, now, therefore, it is
RESOLVED that the Supervisor is hereby authorized to deposit or
invest moneys not required for immediate expenditure in special
time deposit accounts, or certificates of deposit issued by a
bank or trust company located and authorized to do business in
this state, provided, however, that such time deposit accounts
or certificates of deposit shall be payable within such time
as the proceeds shall be needed to meet expenditures for which
such moneys were obtained, and provided further that such time
deposit accounts or certificates of deposit be secured in the
manner provided in Section 11 of the General Municipal Law.

RESOLVED that in accordance with Section 4121, Article 41 of the
Public Health Law, the Town Board of the Town of Southold hereby
appoints Judith T. Terry Registrar of Vital Statistics for the
Town of Southold for the term beginning January 1, 1982 and ending
December 31, 1985, and be it further
RESOLVED that the salary of Judith T. Terry, Registrar of Vital
Statistics for the Town of Southold be set at $3,000.00 per annum,
and the same shall be paid in regular semi-monthly payments, and
be it further
RESOLVED that the Town Clerk be and she hereby is instructed to
file such certificates with the proper parties as are required by
Section 30, Subdivision 3 of the Town Law.

Southold appointed Elizabeth A. Neville as Deputy Registrar of
Vital Statistics for the period beginning January 1, 1982 through
December 31, 1985.

RESOLVED that the Town Board of the Town of Southold hereby appoints
Raymond C. Dean as Commissioner of Public Works for the Town of
Southold for the term beginning January 1, 1982 and ending December
31, 1983, and be it further
RESOLVED that the salary of Raymond C. Dean, Commissioner of Public
Works for the Town of Southold be set at $3,000.00 per annum, and
that the same shall be paid in regular semi-monthly payments, and
be it further
RESOLVED that the Town Clerk be and she hereby is instructed to
file such certificates with the proper parties as are required by
Section 30, Subdivision 3 of the Town Law.

Raymond C. Dean, Superintendent of Highways of the Town of Southold
appointed Raymond Jacobs as Deputy Superintendent of Highways of the
Town of Southold for the period beginning January 1, 1982 through
December 31, 1983.
On motion of Councilman Murdock, seconded by Councilman Townsend, it was
RESOLVED that the salary of Raymond Jacobs, Deputy Superintendent
of Highways of the Town of Southold be and hereby is set at
$23,400.00 per annum effective January l, 1982 through December 31,
1982 and the same shall be paid in regular semi-monthly payments.

Moved by Supervisor Pell, seconded by Justice Edwards,
WHEREAS, Section 22B of the Town Law allows the Town Board of any
town having more than one assessor to establish the office of
Chairman of the Town Assessors, who in addition to his regular
duties shall perform such services in connection with assessment
and taxation of property for State, County and Town purposes as
the Board shall direct, now, therefore, be it
RESOLVED that Assessor Henry F. Moisa be and he hereby is designated
to hold the office of Chairman of the Board of Assessors until the
first day of January next succeeding such designation, at the
pleasure of the Town Board, all in accordance with Section 22B
of the Town Law, and be it further
RESOLVED that the compensation for such appointment be fixed at
$1,000.00 per year payable in regular semi-monthly payments.

WHEREAS, it is required by Section 27, Subdivision i of the Town
Law that the Town Board fix, from time to time, the salaries of
all officers and employees of the Town, whether elected or

RESOLVED that the annual salary of Robert W. Tasker, Town Attorney,
be and hereby is set at $25,155.00 per annum effective as of
January 1, 1982 and the same shall be paid in regular semi-monthly
payments.

SUPERVISOR PELL: That is a two year appointment (January 1, 1982
through December 31, 1983.)
On motion of Justice Edwards, seconded by Councilman Nickles, it was
RESOLVED that pursuant to Section 272 of the Town Law, Henry E.
Raynor, Jr. is hereby designated Chairman of the Southold Town
Planning Board for the calendar year 1982, and be it further
RESOLVED that the Chairman of the Southold Town Planning Board
be paid a salary of $2,000.00 effective as of January 1, 1982,
and the same shall be paid in regular semi-monthly payments.
