PROPERTY FACTSMESCRIPTION- The applcant's property is Improved with a new dub house building, swimming pool,tennis courts, golf can storage building, and other improvements as shown on the surveyor map dated March 18, 2004,prepared by Young &Young. BASIS OF APPLICATION: Building Department's March 31, 2004, Notice of Disapproval, citing Code Section 100-231 In Its denial of a building permit application concerning tennis courts with proposed fencing which will exceed the code height[Imitation of six feet when located In a front yard of a nonresidential zone. FINQINOS OF FACT The Zoning Board of Appeals held a.public hearing an this application on May 20, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence,the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applfcane wishes to construct fencing at a height of 9.8 ft. for tennis courts, The tennis courts are located at:east 100 feet from the northerly front property lima Just east of the newly constricted entrance road into the golf club property. REASONS FOR BOARD ACTION, On the basis of testimony presented, materials submitted and personal Inspections,the Beard makes the folouAng findings: 1. Grant of the relief requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The fence in this application measures g,@ feet in height. The two tennis courts locat®d in the vicinity of the Laurel Links Clubhouse is typical In a country club setting. The benefit sought by the applicant cannot be achieved by some method. feasible for the applicant to pursue, other than an area variance. The tennis courts will not be visible from the road. S. Grant of this railef is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of higher fencing for tennis courts,while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community.
