Special Conditions: None. Inspections: Final Inspection. If the proposed activities do not meet the requirements for issuance of an Administrative Permit set forth in Chapter 275 of the Southold Town Code, a Wetland Permit will be required. SCTM# 1000-145-2-7 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the as-built structures are INCONSISTENT with LWRP Policies and with the LWRP. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction I. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The as-built structures were constructed without a Wetlands Permit. If the action is approved, it is recommended that the buffer be vegetated to further policy 6. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Based on aerial photographs,the previously existing deck was constructed prior to 2007,at least 16 years prior to the applicant's purchase. And based on a recently updated survey,dated March 11,2025,the existing deck maintains the same dimensions as the prior deck and remains set back the same 50-foot distance from the bulkhead,based on a survey showing the previously existing deck,dated December 19,2023.
