REGULAR MEETING
JANUARY 4, 1983
WORK SESSION
9:00 A.M. - The Board began reviewing the Organizational Meeting
Agenda and Regular Meeting Agenda.
EXECUTIVE SESSION
9:30 A.M. The Board mez with Charles Graves to discuss P.B.A.
and C.S.E.A. negotiations.
WORK SESSION
10:25 A.M. The Board resumed reviewing the agenda, and audited
Fishers Island Ferry District outstanding bills. During the review
of the Organizational Meeting Agenda Item 10, authorizing the Super-
visor to invest moneys of the Town, Councilman Nickles suggested
that Supervisor Pell look into investing moneys in money marked funds.
A review of Regular Meeting Agenda Item V-7 from December 28, 1982,
the Board decided not to enter into a maintenance agreement for the
Olivetti typewriter purchased for the Tax Receiver's office, due to
the high cost of such an agreement.
12 Noon Off-Agenda items were discussed.
12:15 P.M. - Mr. John Epidy, Mattit~ck, appeared before the Board
to make them aware that a petition is being circulated in opposition
zo a feasibility study and the formation of a water district in the
Captain Kidd area of Mattituck.
12:45 P.M. - Recess for lunch.
2:30 P.M. - Work Session resumed.
EXECUTIVE SESSION
2:50 P.M. - Mr..Victor Lessard, Executive/Administrator met with
the Board to discuss various violations of the Zoning Code and the
New York State Fire Code, as well as pending litigation.
REGULAR MEETING
A Regular Meeti,~g of the Southold Town Board was held at
7:30 P.M., Tuesday, January 4, 1983 at The Southold Town Hall,
Main Road, Southold, New York. Deputy Supervisor Murphy opened
the meeting with the Pledge of Allegiance to the Flag.

COUNCILMAN MURPHY: Supervisor Bill Pell will not be here tonight,
he had a death in the family, in his wife's family~ and he will be
in ~omorrow morning so that we can continue with the rest o£ the
business. This is the fourth death in his wi£e's family in 20
months, and so needless to say she's quite upset.
Moved by Councilman Nicktes, seconded by Justice Edwards, it was
RESOLVED that audited bills in the amoun~ of $26,125~87 for the
Fishers Island Ferry District be and hereby are ordered paid.

COUNCILMAN MURPHY: These reports are on file in the Tow~ Clerk's
Office for anyone who is interested and they are open for inspection
ac all times.

COUNCILMAN MURDOCK: The Southeld Town Youth Projections did have
a meeting last Wednesday night and some of the newer members of
the Board expressed a little impatience with work in getting the
parking field and hopefully a basketball back court built. Those
are under Year VIII Community Development Funds and they still
haven'~ come through as ye~. Between Jim McMahon and myself we
tried to make them understand how much time it takes for that
fund to be~moved.

COUNCILMAN NICKLES: Yes, just a follow-up on that matter of the
telephone booth at the 7-Eleven Store, I went back and saw ~he
gentleman who operates the 7-Eleven and he is not really interested
in having that phone-~ooth removed'. He would like to keep i~-~h~-
it is where he can keep an eye on it and hopefully we can have a
letter from the Supervisor on hand for him tomorrow before the
phone company comes and rips it out. He has to resolve this with
the Southland Corporation and he's amenable to any clause to be
p~t in there, such as we reserve the right at anytime if we decide
that it's not satisfactory there, either to eliminate it or to
place it over on the w~ll, but I would take his recommendation and

not place it on th~,wall~wh~m~t~ut of his eyesight. He took
me behind his counter and showed me how you could see the phone booth
where it is now and whether Southland had agreed previously with
this kind of informal committee we had tha~ it would be out of his
sight.
COUNCILM~N MURPHY: We'll have that letter tomorrow. Justice
Edwards?
JUSTICE EDWARDS: We.had our second load of cement come over from
New London today on Fishers Island ~o repair the sidewalks, and
these sidewalks have been down for, some of them, for over fifty
years and it's jus~ the broken pads that we're replacing. This
is our second load and a total of abou~ almost 50 five by five
squares. People on the Island are very ~ppy that they're getting
the sidewalks fixed and it's beLn'a ±ong time. Secondly, two weeks
from tomorrow I'll be going up vo the shipyard a~ Rhode Island with
the Fishers Island Ferry Commission and we're going to start to lay
the plans down for a new ferryboat ~o replace the little Olinda that
makes the trips back and forth when the Town fathers come to Fishers
Island. That timeframe is maybe a year from this June we should
have a new ferryboat. Thank you.
COUNCILMAN MURPHY: Thank you, Ray. The only thing further I
have is the clam program we have the final report in from Paul
Flagg. The results were fantastic. They'll be passed out to the
Councilmen. Paul Flagg will be at the next Town Board meeting in
the Work Session for anyone who's interested to hear his actual
report and his recommendations for next year. We would like to
expand--the recommendations are to expand it quite a bit and we're
looking also to go over to Fishers Island with it.
II. PUBLIC NOTICES
1. New York State D.E.C. Notice of Complete Application of
William H. Price, J~. for Karen Bakke to conszruct one family dwell-
ing and associated sanitary system approximately 22 ft. and 75 ft.
from tidal welands respectively. Applicant requests setback variances
of 53 ft. and 25 ft. from Tidal Wetlands Land Use Regulations. The
projecv is located on the north side of Bayshore Road bordering Pipes
Creek on SCTM No. 1000-053-3-11. Any comments to Dan Larken by
January 14, 1983.
2. New York State D.E.C. Notice of Complete Application of
William H. Price, Jr. for Antonio and Eleanora DeMarco ~o construction
of a one family dwelling and associated sanitary system approximately
11 feet and 50 feet from tidal wetlands respectively. Applicant
requests setback variances of 64 ft. and 50 feet from the Tidal Wet-
lands Land Use Regulations. The project is located on the north side
of Bayshore Road bordering Pipes Creek, Southold on SCTM No. 1000-053~'

III. CO~5IUNICATIONS
1. From County Legislator Ferdinand J. Giese concerning the
Rent Stabilization Law. The Town Attorney is going to look into
it and get some information on this to the Town Board for our next
meeting.
2. From the New York State Archaeological Association, The
Incorporated Long Island Chapter in Southold for help'from the Town
Board on project of theirs for 1983.
3. An offer for some assistance from Roger L. ~nz who works
for the Department of Real Estate in the County and we would like to
see if he could help us on the farmland acquisition. He's offered
on farmland preservation, but we'd also like to pick his brains and
see if he could help the Town on 5he new appraisals for the~Farm
Program.
4. An Audit of the Local Public Works Grant for the Town of
Southold by Elaine F. Kaldo.r, C.P.A.,.P.C. This~ is also on file
with the Town Clerk for anyone who would like any information on it.
5. A letter from Boris T. Shaskin in the Captain Kidd Water
District who is opposed to the Town or the residents up'there taking
over the wazer company. We also, az the Work Session, heard from
another man who had a small list of people who-also were opposed to
this and we are going to study it.
6. Letter concerning the Tercentenary Commission and an exhibit
tha~ will be here in the Town Ha'il in August.

7. A group of students for Environmental Quality from~Bellport
High School concerning the Bottle Law that we have in the.County and
the State and would like to make a"Federal Bottle Law. We will replY
to her.
IV. HEARINGS
COUNCILMAN MURPHY: There was a public hearing held today at 3:00
o'clock. We will act on this in resolutions tonight. -- Wetland
application of Enconsultants, Inc. on behalf of Strong,s Harine
Center.
V. RESOLUTIONS
1. Moved by Councilman Townsend, seconded by Councilman. MurdOck, it was~.J
RESOLVED that the Town Board of the .'Eown of Southold hereby aames
Bessie E. Swann as Southold Town's representative on the Board of
Trustees for the establishment of a Black History Museum by the
Suffolk County Human Rights Commission. '

2. Moved by Councilman Nickles, seconded by Justice Edwards, 'it was
RESOLVED that the Town Board of the Town of Southold hereby
establishes a Southold Town Tercentenary Committee ~nd appoints
Historian Magdaline Goodrich Chairperson and the entire Town
Board to serve as Ce-Chairmen on the Committee.

Pamela McCaffer~ her Step 1 salary increase in the amount of $500.00

RESOLVED that the Town Board of the Town of Southold hereby
authorizes the Board of Commissioners of the Fishers Island
Ferry District to amend: the Commodity Rate struct'ure effective
March 6, 1980 for the Fishers Island Ferry District,' by changing
Item 170, Bicycles, each from $1.50 to $5[O0, and be it furt,her
RESOLVED that the Board of CO~missioners of the Fishers Islaind
Ferry District be auzhorized to submit aforesaid rate change.to
the Interstate Commerce Commission for approval.

is authorized and directed to execute an agreement between the
County of Suffolk and the Town of Southold to participate in the
Suffolk Count~ 1983 STOP-DWI Plan, effective November 1, 1982
through October 31, 1983, at an entitlemen5 amount of $2,700.00,
for the purpose of enhancement of its enforcement services, in
the area of drunk driving enforcement.

9. Moved by Councilman Nickles, seconded by Justice Edwards, it was
RESOLyED that the Town Board cf the Town of Southold accept the
donation of two metal desks, three metal framed chairs and one
4-drawer file cabinet for use by the Neighborhood ~h Program
at Southold Town Police Headquarzers, and a Letter of appreciation
be forwarded to Mr. William A. Bannon for this contribution.

10. Moved by Councilman Townsend, seconded by Councilman Murdock,
WHEREAS, Enconsultants, Inc. on behalf of Strong's Marine Center
applied ~o the Southold Town Board for a permit under the provisions
of the Wetland Ordinance of the Town of Southold, application dated
December 1, 1982, and
WHEREAS, said application was referred to the Southotd Town Trustees
and Southold Town Conservation Advisory Council for their findings
and recommendations, and
WHEREAS, a public hearing was held by the Town Board with respect
to said application on the 4th day of January, 1983, at which time
all interested persons were given an opportunity to be heard, now,
therefore, be it
RESOLVED that Enconsuttants, Inc. on behalf of Strong's ~!arine
Center be granted permission under the provisions of the Wetland
Ordinance of the Town of Southold to install a 45 ft. "I" beam on
pilings ~o create a travel-lift slip; dredge approximately 66 cubic
yards from the area to be used as the slip and deposit the spoil on
adjacent upland at James Creek, off Camp Mineoia Road, Mattituck,
NewYOrk, PROVIDED the spartina grass be removed until the work is
completed and then replaced. This permit shall expire on January
4, 1984; there shall be two inspections required; and the Town
Clerk shall be notified when the project is completed.

11. Moved by Councilman Murdock, seconded by Councilman Townsend, it was
RESOLVED that the Town Board of the Town of Southold hereby
appoints Frank Cichanowicz III a member of the Southold Town
Conservation Advisory Council, effective January 11, 1983 through
January 11, 1984.

COUNCILMAN MURPHY: That's the end of the resolutions and prepared
agenda. Is there any Councilman who has anything further to say?

JUSTICE EDWARDS: Thaz resolution regarding the Fishers Island
F.erry District raising the rates from $1.50 to $5.00for bicycles--
the reason for it is ia the summertime the traffic on the Is].an~
is so congested and these bike riders only being able to use on-e-
third of the Island, the other two-thirds being private property,

it has just been too hectic on the weekends over there because
the bicyclists will come over mn groups of thirty or so and they
had to do something and they decided to put the razes up on
bicyclists to discourage them and that's the only reason for that
bike change from $1.50 to $5.00. They have been becoming a nuisance
on the Island and actually in using the public beaches over there,
the Town owned beaches, the people can actually use those by walking
from the ferryboat. They don't need bikes, and that's the reason
for the change. Thank you.
COUNCILMAN MURPHY: The Island got good publicity in a couple of
the papers about this, how it was such a good deal, sO it really
worked I guess. It worked too well. i '

been going in and to try to enlighten the people about the potential
