SOUTHOLD TOWN BOARD
ORGANIZATIONAL MEETING
JANUARY 4, 1983
The Organizational Meeting of the Southold Town Board was held
on Tuesday, Januarys4, 1983 at the Southold Town Hall, Main Road,
Southold, New York. Deputy Supervisor Murphy opened the meeting at
3:00 P.M. with the Pledge of Allegiance to the Flag.
Present: Councilman Francis J. Murphy, Deputy Supervisor
Councilman John J. Nickles
Councilman Lawrence Murdock, Jr.
Councilman Joseph L. Townsend, Jr.

Absent: Supervisor William R. Pell, III (death in the family)
COUNCIL~N MURPHY: Supervisor ~Bill Pell can't be here today, he
had a death in his family and he asked me to take over. On this
Organizational Meeting it's basically to set appointments and
designate various salaries for Town officials and employees.
l(a) - Appointment of Deputy Supervisor could not be made as this
is made by Supervisor Peil. Resolution l(b) - set salary of the
Deputy Supervisor - was held in abeyance until the appointment is
made.
2. Moved by Councilman Townsend, seconded by Justice' Edwards,
WHEREAS, ~ection 64 of the Town Law requires the Town Board to
designate, by resolution, banks in the State in which the Supervisor
or any other office of the Town shall deposit all moneys coming into
their hands by virtue of their officers, and
~EREAS, the Town Board may require any bank, so designated to
deposit with such Board bonds or certificates of the United States,
of the State of New York, or any county, town, city, village or
school district of the State of New York as secuirty for such funds
so deposited, but such bond or certificate shall be subject to the
approval of the Town Board and shall be deposited in such place and
held under such conditions as the Town Board may determine, now,
therefore, be it
RESOLVED that the following banks are hereby designated as
depositories and the following amounts of securities are hereby
required, to vit:

3. Moved by Councilman Murdock, seconded by Councilman Nickles, it was
(a) RESOLVED that The Suffolk Times, Greenport, New York, a newspaper
regularly published in the Town of Southold, which has been entered
as a second class mail matter, be and the same is hereby designated,
effective February 1, 1983, as the official newspaper of the To~%m of
Southold for the publication of ali notmces, resolutions, ordinances
and other matter required to be published.

~ RESOLVED that The Long Island TravelerzWatchman, Southold, New York,
a newspaper regularly published in the Town of Southold, which has
been entered as a second class mail matter, be and the same is
hereby designated as an additional newspaper of the Town of Southold
for the publication of all notices, resolutions, ordinances and
other matter required to be published.

5. Moved by Councilman Townsend, seconded by Councilman Murdock, it was
(a) RESOLVED that pursuant to Section 142(1-a) of the Highway Law~, the
Southold Town SuPerintendent of Highways be and hereby is authorized
to purchase equipmenT, tools, snow plows and other implemenz---~ a{d
devices withoUt prior approval of the Town Board in the~Z~amounz not
to exceed $3,000.00 for any one item during the period from January
1, 1983 to December 31, 1983.

5. Moved by Councilman Nickles, seconded by Councilman Mur'dock, it was
(b) RESOLVED that pursuant to the provisions of Section 284 Of ~he
Highway Law, the Town Board of the Town of Southold agrees that
moneys levied and collected for the repair and improvements of
hi. ghways, and received from the state for the repair and~i~pr~ve-
menz of the highways shall be exp.ended as follows: General Repairs.
The sum of $1,035,332.00 may be expended for general repairs ~pon
180.80 miles of town highways, including sluices, culverts an~
bridges having a span of less than five feet and boardwalks or
the renewals thereof. No moneys set aside for such improvements
shall be expended, nor shall any work be undertaken on such improve-
ments, until the County Superintendenv approves the plans, spe~ifica~
tions and estimates for such construction.

6. Moved by Councilman Nickles, seconded by Councilman Murdock, it was
RESOLVED that Supervisor William R. Pelt, III be and he hereby is
designated to represent the Town of Southold at the a~nual meeting
of the Association of Towns of the State of New York to be held in
New York City on February 20, '21, 22, 23, 1983, and to cast the vote
of the aforesaid Town of Southold pursuant to Section 6 of Article
of the Constitution and By-Laws of said Association'of Towns, and be
it further
RESOLVED that Justice Raymond W. Edwards be and he hereby is
desig~ated to act as a~"~ternate to cast the vote of the Town Of'
Southold at the annual meeting of the Association of Towns in the
absence of Supervisor William R. PeI1, III.

7. Moved by Councilman Mui~ibck, seconf~'d" by Councilman Townsend, it was
RESOLVED that those officers and employees of the Town of Southotd
a~tending the annual meeting of the Association of Towns of the
Stare o.f New York be and hereby are allowed $250.00 per officer and
employee for the actual and necessary expenses to travel, meals,
and lodging incurred while attending said meeting.

8. Moved by Justice Edwards, seccnded by Councilman Nickles, it was
RESOLVED that any Town official, elected or appointed, who is
required to use his own automobile in the perl?~rmance of his
-- duty, be compensated~fo~ travel expenses necessarily end actually
incurred in carrying out the duties of his office, at a rate not
to exceed $.20 cents per mile.

9. Moved by Councilman Murdock, seconded by Jugtice Edwards,
~HEREAS, Section 123 of the Town Law provides that town officials
and employees who receive and disburse moneys of the Town shall
on or before January 2Oth account to the Town Board for all moneys
received and disbursed by them in the previous fiscal year, unless
the Town shall engage the services of a certified public accountant
or public accountant prior to January 20th, and
WHEREAS, the Town Board deems it necessary to engage a public
accountant to prepare the aforesaid annual account for all Town
officers and employees, now, therefore, be it
RESOLVED that the Town-Board of the Town of Southotd engage the
services of Elaine F. Kaldor, C.P.A., P.C. to make the annual audit
of the books and records of officers and employees of the Town of
Southold for the fiscal year 1982 at a conzract fee of $3,000.00,
~ said audit to be completed within 60 days after the close of the
1982 fiscal year.

10. Moved by Councilman Townsend, seconded by Councilman Murdock,
WHEREAS, Section 11 of the General Municipal Law provides that
the TOwn Board may authorize the Supervisor, the chief f~scal
officer of the Town, to invest moneys not required for immediate
expenditure, now, therefore, be it
RESOLVED that the Supervisor is hereby authorized to dePOsit or
invest moneys not required for immediate expenditure in special
time deposit accounts, or certificates of deposit issued by a
bank or trust company located and authorized to do business in
this state, provided, however, that such time deposit accounts
or certificates of deposit shall be payable within such time
as the proceeds shall be needed to meet expenditures for which
such moneys were obtained, and provided further that such time
deposit accounts or certificates of deposit b~ secured in the
manner provided in Section 11 of the General Municipal Law.

11. Moved by Councilman Nickles, seconded by Justice Edwards,
~EREAS, it is required by Section 27, Subdivision I of the Town
Law that the Town Board fix, from time to time, the salaries of
all officers and employees of the Town, whether elected or appointed,
and determine when the same shall be payable and that the salaries
of the members of the Town Board, the elected Town Clerk and an
elected Superintendent of Highways shall not be fixed in an amount
in excess of the amounts respectively specified in the notice of
hearing in the preliminary budgez published pursuant to Section
108 of the Town Law, now, therefore, be it
RESOLVED that the annual salaries for the following elected town
officials shall be as follows:

AND BE IT FURTHER RESOLVED that the aforesaid salaries shall be paid
in regular' semi-monthly payments, and the Town Clerk be and she hereby -
is instructed To file such certificates with the proper parties as are
required by Section 30, Subdivision 3 of the Town Law.

12. Moved by Justice Edwards, seconded by Councilman Nickles, it was
RESOLVED that the salary of Raymond Jacobs, DepuTy Superintendent
of Highways of the Town of Southotd be and hereby is set at
$24, 570.00 per annum effective January 1, I9~3 through I~ecember
31, 1983~ and the same shatt be paid in regular semi-m~thly
payments.

13. Moved by Councilman Nickles, seconded by Councilman Mu~dock,
WHEREAS, Section 22B of the Town Law allows the Town Board of any
town having more than one assessor vo establish the office of
Chairman of the Towh Assessors, who in addition to his regular
duties shall perform such services in connection with ass~essment
and ~axation of property for State, County and Town purpas~s as
the Board shall direct, now, there£ore, be it
RESOLVED that Assessor Henry F. Moisa be and he hereby is .designated
to hold the office of Chairman of the Board of Assessors until the
first day of January nex~ succeeding such designation, at the
pleasure of the Town Board, all in accordance with Section 22B
of the Town Law, and be it further
RESOLVED that the compensation for such appointment be fixed a~
$I,0OO.00 per annum payable in regular semi-monthly paymenTa.

RESOLVED that the Chairman o£ the Southold Town Planning Board
be paid a salary of $2,000.00 effective as of January 1, 1983,
and the same shall be paid in regular semi-monthly payments.

paid a salary of $2,000.00 effective as of January 1, 1983, and the

RESOLVED that the annual salary of Robert W. Tusker, Town Attorney,
be and hereby is se~ at $27,670.00 per annum effective as of January
1, 1983 and the same shall be paid in regular semi-monthly payments.

all officers and employees of the Town, whether elected or appointed,
and determine when the same shall be payable, now, therefore, be it
RESOLVED that the annual salary of Magdaline Goodrich, part-time
Historian, be fixed at $3,360.00, and she to hold such appointed
office or position at the pleasure of the Town Board unless otherwise
provided for by law, and be it further
RESOLVED that this salary be effective as of January 1, 1983 and
the same shall be paid in regular semi-monthly payments, and be it
further
RESOLVED that the Town Clerk be instructed to ~file such certificates
with the proper parties as required by Section 30, Subdivision 3 of
the Town Law.

21. Moved by Councilman Townsend, seconded by Councilman Murdock,
WHEREAS, the position of Police Chief in the Southold Town PoIice
Department is not within the employee organization which represents
the uniformed police officers of the Town and, accordingly, the
terms and conditions of employment of the Southold Town Police Chief
are not provided for by the PBA Contracz between the Town and the
PBA, and
WHEREAS, the Town Board desires to provide for the terms and con-
ditionS~of .£mPloymen~ of~th~ Chief of Police of zhe Town,

I. Thav the Chief of Police shall be required to perform all
of the duties of such position as shall be prescribed by law, rule
or regulation, together with such ozher duties and assignments as
may, from time to time, be prescribed by the Town Board or any
committee thereof.
2. That the Chief of Police shall receive such compensation
for such employment as shall, from time to time, be established by
the Southold Town Board.
3. That the Chief of Police shall be entitled to the same
vacation, sick leave, retirement, longevity, hospitalization,
dental and uniform allowance benefits provided zo uniformed police
officers in the Southold Town Police Departmenz.

Law that the Town Board fix, from time to time, the salaries of
