The Board audited a bill of Otto Wo VanTuyl in the amount omF
$200.00.

RESOLVED: That General Bill in the amount of $200.00 be and
the same is hereby ordered paid.

Patrick~Gorman appeared before the To~ Board in regard to a letter
he hhd recently written the Board alleging that on or about December
l~ 195~ at approximately ~:30 P.M. at the Cutchgoeu Service Station'
Chief Otto Anrig had used vile~ obscene and threatening language ~
~oohim~ and stating that the requirements of the Town Law required
that Chief Anrig be brought up on charges within 60 days after he
had made known the facts. The Supervisor read the Town Board Mr.
Gorman's letter~ undated~ which is as follows:

Gentlemen:
As a law-abiding resident of the Town of Southold ~nd ~or
the benefit of all residents of the Town~ I feel obliged to prefer
charges against~Chief of Police Otto Anrig of conduct so serious as
to a~ffect his fitness for office and conduct to the predjudice of
the good order~ efficiency and discipline of the Southold Town
Police Department.
On December 15~ 195l+~ at about ~:30 P.M. at the Cutchogue
Service Station~ in the presence of two other indiv~duals~ and while
he was in uniform~ Chief Anrig used vile and obscene language twmrds
me an~ made threats a~ainst me. I will not put the exact words used
in this let~er~ but I shall attend the next Town Board meeting and
personally inform you of the language used and the threats made~ and
I shall be available to testify under oath at the time you conduct
a hearing on the charges.
Your attention is respectfully directed to the require-
ments of the Town Law that the charges must be brought within sixty
(60) days after I have made the facts known to you.

On Mr. Gorman's request~ the SuperViser indicated that he had no
objection to M~. Gorman speaking to the Town Board berbally on the
matter~ but informed Mr. Gorman that if it were his desire to bring
anyone up on charges~ he should submit a written complaiht i~ the
proper form and state the section of the Town'Law he had referred
to in his letter. The Supervisor further states that when the charges
were submitted in writing and the proper form~ the Town Board would
act on the matter.

Dear Mr. Klipp~
In accordance with your request~ I attended the above
mentioned hearing at Mineola on December 22~ 1951+~ and ~f~ have the

following to report:
Because of the poor attendance the meeting did not start
until'about lO:~, at which time it was opened by Senator John H. Cooke
who immediately turned the meeting over to Senator Edward P. Larkin.
Other members of the committee who were present were Assemblyman Ward,
Assemblyman Eagan~ Senator Donovan~ Mr. Morgan Stroh and Mr. Edward
F. N. Utho who~ as you know, is the Executive Secretary of the &ssoc-
iation of Towns. Also present were the counsel amd assistant counsel
to th~ committee~ )~. John Delius~ who is the Town Attorney of the
Town fo ~maroneck~ and .Mr. Harold Kelly, an attorney o~f Depew~ New
York.
The first person to be heard was Mr. William 9arrott~
who is the ~illage Clerk of Patchogue~ andi~in addition to appearing
on behalf 'of the ~illage he also representsd the Suffolk C0~ty
Village Officials. Association which had previously met on December
9th and authorized him to appear. Mr. Parrott confined his tal~ pri-
marily to the Town of Brookhaven~ and presented to the C&mmission a
table representing the services that the Village claims to receive
from the Town. His main concern seemed to be with items numbered 2~
3 and 4 of the highway budget and in that regard he indicated that
the Village Officials Association had passed a resolution recommending
that there be some form of equalization to provide relief tothe Village
( a point which I felt was rather ably rebutted by Mr. Edward Utho
by the questions which he put to Mr. Parrott at the end of his talk).
Mr. Parrott also requested that the villages be excluded from paying
town charges for police and also mentioned the matters of home relief~
and schOOl district superintendents~ about which he did not appear to
be too familiar.
After Mr. Parrott had spoken~ the Chairman asked if there
was anyone else from Suffolk ~ounty who wished to be heard~ whereupon
I stated to the Co~misSion that I appeared as attorney for the Town
of Southold on behalf of Supervisor Klipp~ who at the last minute found
himself unable to be present. I spoke very briefly as far as the Town
Police charges were concerned~ and that you wished to let the Com-
mission know that you hoped they would not go too far in the matter
of changing the existing Town Law. I then indicated that a matter of
grave concern to us was the provisions relative to the extention of
village boundaries and explained that while you did not wish to hamper
the growth of ~illages the Town Board felt that the expansion should
be accomplished in an orderly manner withou~' any gerrymandering inso-
far as possible. The only questions put to me were whether I was
familiar with Chapter 18 of the Laws of 195l+ relative to the extention
of village boundaries in Nassau County~ which I had to indicate that
I was not~ and questions a~ to the m~nner and technical operation of
the collection of school distrct taxes.
Supervisor Paul Gibbon of Smithtown then spoke very brief-
ly indicating that he has three incorporated villages in his tow~. He
did not appear to have anything to offer and was apparently not seeking
any information either.
John P. Dohalan~ Es~.~ attorney for the Town of Islip~
then spoke briefly on the matter of special districts and indicated
that he is taking up with Assemblyman Barrett a proposal to empower
the townbb~d~ subject to a permissive referendum~ to set up special
districts such as garbage collection districts~ etc.~ without the
elaborate procedure of petitions as now required (I have mentioned
this matter to Senator Horton and he has indicated that he is well
aware that such proposal is being offered). Mr. Charles Matthews~
Deputy Town Attorney for the Town of Huntington then spoke briefly;
and he was followed by Richard J. Fraf~ Village Attorney of the
Village of Northport, who supported Mr. Parrott and recommended
that the s~udy of the Commission be continued.
There being no further representa$ives from Suffolk ~ounty~ the
Commission then stated that it would hear from representatives of
Nassau County; and the first man to speak was Mayer W. Harry Lister
of R0ckville Centre (who is the owner of property known as Boat-
men'~S Harbor~ Fleets' Neck~ Cutchogue~ in the Town of Southold).~
Mr. Lister was not too familiar with matters pertaining to town
government~ but was concerned about state aid distribution ~o
villages~ the formula used for apportionment of mortgage taxes~
and certain annexation problem$~ his main complaint being that
every year his p0pulati~n increases bN~ his state aid de~reases..
He was questioned by Mr. ~nthony Sansone~ Counsel of the Village
of Mam~on~ck~ in regard to his annexation oroblems~ ~nd he ~s
followed by a Mr. Harry ~ellable who represented the Nassau County
Village Officials .~sseeiation and requested reconsideration of the
so-called ~Meore Plan~. He suggested that the use of the word
~aid~ be'discontinued ~nd indicated that he liked to ~efer to it
as state collected taxes.
It w~s now 12:30 and the Commission asked whether
we wished to continue or to adjourn for lunch ~nd then resume after
lunch. Since there was apparently only one speaker left~ the
Commission continued and John A. Morhouse~ Esq. Town Attorney
of the Town of Hempstead~ read a prepared statement concerning
principally the mat{er of annexation and~ection 3~8 or.the
Village Law: which he called basically unsound~ ~.~d Section
3~.20 of the NaSsau'Administr~tive Code. He indicated that~
the Appellate DiVisiSn of the ~econd Depar~ent has held that the
town board has no pQwer to withhold its consent and is relegated
to the position of town clerk in the matter of giving consent
under Section 3~8 of the Village Law~ and that he feels very
strongly that this section should be changed and should also
contain some provisions for continuing liability for previous,
ly incurred debts by the area which is annexed. Aside from the~fact
of reading his memorandum~ Mr. Morhous~s talk was host pertinent
and ably presented; and before the hearing adjourned I again
indicated to themembers present that the Town of Southo~d
wholeheartedly suppor~ted the position taken by i~. Morhouse and
requested that the Co~mi~sion give serious consideration to
changing the provisions relative to'annexation. After the
adjournment at 1:30~ I spoke to Mr. Morhouse and he agreed to
send me a copy of his memorandum~ which I will make available to
you as soon as it arrives.
