IT ENACTED, by the Town Board of the Town of Southold as follows:
Chapter 65 (Parking at Beaches) of the Code of the Town of Southold
is hereby amended as follows:
1. Section 65-2-A. (Designation of parking areas requiring permits.)
is hereby amended by addin9 the following:
{22) Aquaview Avenue, East Marion, both sides, from the
· intersection of Rocky Point Road easterly for a distance
of three hundred (300) feet.
This Local Law shall take effect upon its filing with the Secretary of
State.

SUPERVISOR WICKHAM: We'll go on to the third public hearing regarding
the "Local Law in Relation to Aquav|ew Avenue".
COUNCILWOMAN OLIVA: Public Notice is hereby given that there has been
presented to the Town Board of the Town of Southold, Suffolk County, New
York, on the 9th day of August, 1991~, a Local Law entitled, "A Local
Law in Relation to Aquavlew Avenue". Notice is further given that the
Town Board of the Town of Southold will hold a public hearing on the
aforesaid Local Law at the Southold Town Hall, Main Road, Southold, New
York,on the 23rd day of August, 199~, at $:07 P.M., at which time all
interested persons will be heard. This proposed "Local Law in Relation to
Aquaview Avenue" reads as follows:

Would anyone like to address the E~oard on the
VINCENT GERosA: I'm Vincent Gerosa. I live at 315 Aquaview
Avenue, and I petition the Board for consideration of the alteration of
parking permits. It is my understanding, that generally if there are no
restrictions parking is allowed on County Roads such as Aquaview
Avenue. The Town passed a law a few years ago, I believe, that permitted
parking on Rocky Point Road, which is a road ending on a bluff overlooking
the Long Island Sound, and allowed parking there only by permit. What
oc~curred after that is that cars that normally park there started parking on
Aquaview Avenue, and created in our view, accident hazards, and
obstructions, so that we asked that the restriction be extended to some
extent to Aquav|ew Avenue to discourage people from parking there.

the letter occupy the first five houses, most directly affected. However,
th. ere are other interested that say that say, there should be ~o parking at
afl' of Aquaview at any time, and there are other people here who will
state that- The concern is multiple, and there is congestion that make it
pb'gsible to have accidents on the beach, as a result of the parking misuse,
as people try to drive or walk up and down the road. However, the letter
that I did write asked only for restriction in terms of parking by permit
only.

RECI WEILE: My name is Regi Weile, and Pd like to pass these
photographs to you. J~ve written a memo to the Town Board, and I~d like to
read it- This represents the views of others of us, who live on
Aquaview, and others who have spoken with us on Rocky Point Road, so
~t begins. According to the stated purpose of'the Code of the Town of
Southold section 100-10, which is set forth, in the interest of the
protection and promotion of public health, safety and welfare, which shall
be deemed to specifically include the following among other, specifically A,
D, E, G, H, which I will read from the Code. A is the facilitation of the
efficient and adequate provision of public facilities and services- B is
the prevention and reduction of traffic congestion so as to promote
efficient and safe circulation of vehicles and pedestrians. E is the maximum
protection of residential areas. C is the enhancement of the appearance of
the Town of Southold as a whole. H is the encouragement of flexibility in
the design and development of land in such a way as to produce the most
appropriate use of lands, to facilitate the adequat~ and economical
provision of streets and utilities and to preserve the natural and scenic
qualities of open lands for Southold. ' We find the proposed Amendment, this
number 22 subdivision, to be in direct conflict of the goals and purposes of
the, Southold Town Code as follows, and I have two major issues. The first
one. deals with efficient and safe circulation of vehicles and pedestrians.
The standard and accepted minimum width of a two lane road, two way
street, is 22 feet. The standard minimum for a one lane street is 13 feet.
.Aq~Jaview Avenue, a two way street, ranges from 21 feet to 23 feet. It
has no paved shoulder and only approximately 3 feet clearance to the utility
poles. This clearance rises way above the level of the road and is not
cor~clucive to parking for most of it's length. In o£her words, if you were
par~ed on the shoulder, which is 3 feet, your car would be at a 45' angle-

As per the attached drawing, which I will give you, proposed parking to
either side of Aquaview Avenue, even we accept the use of untenable 3
feet clearance, and we park the cars on that piece, would cause the cars to
infringe upon the road a minimum of twelve feet, six feet on each side, and
thereby reduce the road to a one lane road. Assuming that the road is
reduced to one lane for its first 300 feet, two unsafe conditions become
· apparent. The fist is related to the fact that the right hand .turn onto
Aqauview from Rocky Point Road is a blind turn. The road drops below
the height of the easterly lawns. A driver taking this turn cannot see what
await~ her or him upon completing the turn. Perhaps a parked car is pulling
out of a space, car door is open or beach furniture is resting in the road.
A second major concern is related to the possibility of a single car passing
between the two parked cars, on this now one lane road, and accidentally
endar!gering the llfe and weiJ being of children entering or /eaving their
vehlc[es. Assuming that parking is permitted on both sides of AquavJew
Avenue, as per the attached drawing, the turning radius of emergency,
service and sanitation vehicles will be restricted, and the turn 'rendered
in, pOssible. This in turn would act as a deterrent to alt emergency and fire
serV|ces now providing protection for those residing on Aquaview
/~venue. The seconded issue involved protection of natural and scenic
q.ual~ties of open lands. The so cai/ed public [~each at the end of Rocky
Point Road, and the reason I'm saying so tailed is because fences keep
geihg up, and signs, and then they keep com'l~ng down~ so we really donJt
know what the status of it. The so called public beach at the end of Rocky
P~:~t Road is to be served by this additional 300 feet of parking on both
s[d~ of the street, and even though [tfs restricted it does say restricted
p~rk[ng, but people know they can park there, so i.t will encourage more
cars to come in. Should this parking be utilized it will allow ~the addition
of approximately ~0 cars and, then say L~ people per car, which would 160
people. This so called public, beach ~s appro~ate/y 30 feet wide and 50
fee~: to the water at Iow tide. Access to the beach is by way of a 70 foot
cliff that is badly eroded, and does not have a sta;ir or Walkway down. One
mast make their way down via a sand path at a 60 degr~ee angle with loose
boulders. There are no safety measures for the. protection of the public,
and this appears to be an extreme hazard. The area sur:ro~nd the path has
be~n used by visitors as a garbage dump and [~trine, ~endering it unsafe,
un'~ealthy and unsightly. With the potentia~l increase of ~60 visiting
res.~dents Southold Town is leaving itself open to unnecessary accidents,
whi~h could be attributed to negligence. We propose that this Local /aw be
tabled, and a responsible analysis of goals in regard to the use of this
site, and it's parking, be made by the Town Board after which parking
resbluti0ns can be determined.
SUPERVISOR WICKHAM: Is there anyone else who would like to address the
Board on this public hearing? (No response.) Hearing no further
comments, I declare this hearing closed.
