Dear Supervisor Murphy:
We have reviewed the Town of Southold solid waste ordinance, and
recommend the following changes/additions:
1. Change title from "GARBAGE, RUBBISH ~ND REFUSE" to "SOLID
WASTE".
2. Change Index, "S.48-3. Town refuse disposal area" to "S.48-3.
Town solid waste disposal facility".
3. S.48-1. Definitions Change/add the following definitions:
ATTENDANT - Any employee of the Town of Southold placed in
charge of a town solid waste disposal facility under the di-
rection of the To~rn Board.
COMPOSTING FACILITY - Any facility used to provide aerobic,
thermophilic decomposition of the solid organic constituents
of solid waste to produce a stable, humus-like material.
CONSTRUCTION AND DEMOLITION DEBRIS - Wastes resulting from
construction, remodeling, repair and demolition of structures,
road building and land clearing. Such wastes include, but are
not limited to, bricks, concrete and other masonry material,
soil, rock and lumber, road spoils, paving material and tree
and brush stumps.
GARBAGE - Putrescible solid waste, including animal and
vegetable waste resulting from the handling, storage, sale,
preparation, cooking or serving of foods. Garbage originates
primarily in home kitchens~ stores, markets, restaurants and
other places where food is stored, prepared or served.
HAZARDOUS WASTE - Any hazardous waste as defined in NYCRR
Title 6 Chapter 371.

PERSON - Any individual, public or private corporation,
political subdivision, government agency, department or
bureau of the state or federal government, municipality,
industry, co-partnership, association, firm, trust, es-
tate or any other legal entity.
RECLAIM, RECOVER OR RECYCLE - Any method, technique or
process utilized to separate, process, modify, convert,
treat or otherwise prepare solid waste so that its com-
ponents may be beneficially used or reused as raw ma-
terial or energy sources.
REFUSE - Any human, animal or vegetable refuse, offal,.
swill, compost or incinerator residue, paper, junk,
trash, rubbish, waste, of whatever material composed,
discarded machinerY or parts thereof and an unlicensed
motor vehicle parked, stored or standing outside an en-
closed building in an inoperative condition for more
than thirty (30) days.
SANITARY LANDFILL - A land disposal site employing an
engineered method of disposing of solid wastes on land
in a manner that minimizes environmental hazards.
SOLID WASTE - Any garbage, refuse, demolition debris or
stabilized sludge, but not ~ncluding any hazardous waste,
sewage or other highly diluted water carried materials or
substances and those in gaseous form.
SOLID WASTE DISPOSAL FACILITY - The sanitary landfill
site owned and operated by the Town of Southold located
north of County Route 48 at C~tchogue, New York, and any
premises designated by the To~n Board as a "solid waste
disposal area" of the town for the disposal of solid
waste by the residents of the town.
STABILIZED SLUDGE - Sludge that has been treated by a
process to reduce putrescibility, significantly reduce
pathogenic organisms.and, except for lime stabilization,
reduce the volatile solids content.
TRANSPORTER - A person engaged in the off-site transport-
ation of solid waste.

6. S.48-4. Fees; issuance and duration of permits and licenses.
Change "refuse" to "solid waste"; change "refuse disposal
area" to "solid waste disposal facility".

fee"
(4) Delete in its entirety
(5) Change "contractor's" to "transporter's".
(8) Delete "(garbage)"

In addition to th~ above, the Town of Southold should consider
banning certain materials'(or .certain m~teri~ls in excess of some
minimum quantity), increased fee structure and development of a
manifest system, certifying that waste brought to the site has
been collected within the Town of Southold. As more towns ban
construction and demolition waste from their landfills, the
possibility of the Town receiving out-of-town waste will esca-
~late. By copy of this letter, we are providing same to R~ymond
Jacobs, commissioner of Public Works, and Robert Tasker, Esq.,
for their concurrent review.
