IN THE MATTER OF A PROPOSED LOCAL LAW ENTITLED, "A LOCAL LAW IN RELATION TO DOG LICENSE FEES." Present: Supervisor Francis J. Murphy Councilman Joseph L. Townsend, Jr. Justice Raymond W. Tasker SUPERVISOR MURPHY: This is a hearing on a"Local Law in relation to dog license Fees," to be read by Councilwoman Cochran. COUNCILWOMAN COCHRAN: "Public Notice is hereby given that there has been presented to the Town Board of the Town of Southold, Suffolk County, New York, on the 26th day of March, 1985, a Local Law entitled, "A Local Law in relation to Dog License Fees," which reads as follows, to wit: BE IT ENACTED by the Town Board of the Town of Southold as follows: (additions indicated by underline; deletions by [brackets].) I. Section' 38-11 (License fees) of Article II of Chapter 38 of the Southold Town Code is amended by adding a new subdivision thereto, to be subdivision C, to read as follows: C. Commencing on July 1, 1985, the annual license fee foE- dogs, inclusive of statutory fees, shall be as follows: (1) Seven dollars and fifty cents ($7.50) for a spayed or neutered dogs. (.2) Twelve dollars and fifty cents '($12.50) for an unspayed or unneutered dog. (3.), ~fty dollars ($50.), if no more than ten registered purebred dogs or purebred dogs eligible for registration over the age of six months are harbored on the owner's premises at the time of application. (4) Seventy-five dollars ($75.) if note more than twenty-five registered purebred dogs or purebred dogs eligible for regisb'ation over the age of six months are harbored on the, o~ner~s premises at the time of application. One Hundred twenty-five d0~lar~ ($125.) if more than twenty- five registered purebred dogs or purebred dogs eligible for regis~rat~on over the age of six months are harbored on the owner'~s premises at the time of application. ii, This Local Law shall take effect upon its filing with the Secretary of State. License Fees Notice is further given that the Town Board of the Town of Southold will hold a public hearing on the aforesaid Local law at the Southold Town Hall, Main Road, Southold, New York, on the 9th day of Aprilr 1985, at 8:'10 o'clock P.M., at which time all inte'rested persons will be heard. I also have an affidavit showing proof of publication by The Long Island Traveler- W~tcl~man. I also have an affidavit from our Southold Town Clerk~Judith Terry that it has been posted on the Town Clerk's Bulletin Board. I also have a copy of the /aw. I don't believe there are any other written comments. SUPERVISOR MLIRPHY: Thank you, Jean. You've heard the officia!' reading of this 'proposed Local Law. Is there anyone in the audience would like to make any comment at all in favor of this proposed Local /aw? (No response.) DIANE BERGMANNt North Road, Peconic: I'd just like to know is this going to help .alleviate packs of dogs that run loose in this town? Or ~s t~b~is just another fee? I've had several dogs chase cows. t~ve had cows out on the highway because I have a pack of dogs there over the weekend. Ifrn all by myself up there and I've got dogs up there. I don't know what the village is like or anything. I know Greenport's got a problem. Is this going to help? The increase of fees? SUPERVISOR MURPHY: I hope so. Anyone else like to comment at all on this proposed Local Law? COUNCILMAN STOLITENBURGH: Yes. I feel it's somewhat unfair in the sense that we're adding an additional fee to help a problem which is probably takin~l care of dogs that are loose and to me this is wrong for the simple reason the people who pay the license shouldn't be paying for the person who doesn't have the licensed dog and the problem of taking care of dogs, so I'm sort of against this. I feel that we st~ould be putting the burden on the person who has the unlicensed dog more and that's the one that we should be following up. I just felt it was wrong and I don't like the law. SUPERVISOR MURPHY: Thank you, Paul. COUNCIl-MAN SCHONDEBARE: Yes, I do too. I think the last time this came on Paul and I were in'agree about it. I don't like it 'eitl-ier. We~are penalizing the person who actually goes out and buys a license and the individual who doesn't buy the license as usual, gets away with it. So I particularly don't like this one and I don't plan on voting in'favor of it either. COUNCILWOMAN COCHRAN: I don't either SUPERVISOR MURPHY: Okay. Anyone else lik~ to comment? JUSTICE EDWARDS: My thoughts too. I have the same feeling, in fact I brought it up that it wasn't fair 'for the honest person to be charged. SUPERVISOR MURPHY: Anyone else like to comment?
