SUFFOLK COUNTY ADMINISTRATIVE CODE,. This application was not required to be referred to the Suffolk County Department of Planning under Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION.` The subject property is located at the intersection of Equestrian Avenue and Athol Crescent Avenue, Fishers Island. and located in an R- 0 Zoning District on 3.32 acres(144,619.2 sq.ft.) with 2.8% lot coverage on the existing and proposed site. The northerly property line measures 331.43 feet and borders Mansions House Drive; the easterly property line measures 438.48 feet; the southerly property line measures 464.76 feet and boarders Athol Crescent Drive; and the westerly property line measures 238.08 feet and boarders Equestrian Avenue. The odd shaped triangular corner property has two front yards and wetlands on the northerly portion of the property. The property is owned by the Fishers Island Fire District and is improved with two connected structures. One structure is used to store the trucks and the other connected building has been used for meetings and training. The larger building that stores the fire trucks is approximately 2550 square feet and the smaller connected building is currently 1,280 square feet with an existing basement as shown on the survey map (Sheet 2 of 2 of the Site Development Plan) by Richard H. Strouse, LLS, of CME Engineering, Land Surveying & Associates, dated January 3, 2018. BASIS OF APPLICATION: Request for Variances under Article 111, Section 280 -14; and the Building Inspector's September 19, 2018 Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing fire house, at; 1) less than the code required minima ri front yard setback of 60 feet (Equestrian Avenue); 2) less than the code required minimum front yard setback of 60 feet (Crescent Avenue); at Crescent Avenue, Fisher Island,NY. SCTM#1000-9-2-4.1. The proposed construction on this conforming 144,619.2 square foot lot with two front yards in the Residential R-80 District, is not permitted pursuant to the Bulk Schedule, which requires a front yard setback of 60 feet. The survey notes a front yard setback of 58 feet (Equestrian Avenue and a front yard setback of 52.4 feet (Crescent Avenue). The proposed construction would add a. second story addition over the si'naller portion of the existing building and a small first story entryway addition as shown in the Site Development Plan (Sheet l of 2)prepared by Richard H. Strouse,LLS of CME Associates Engineering, landscaping,, & Architecture, PIA.,C, last revised ..March 5, 2018.. The second story addition will include the creation of three new bedrooms,two bathrooms, a kitchen and a living area. MEND Q APPLLCCATIOI^ : During the hearing, the applicant's representative discussed the Fire District amending this application for the same setback relief as applied for if a partial demolition is.required because they are unable to add the proposed second story addition to the existing 1280 sq. ft. portion of the existing firehouse due to its age and condition. The Board agreed at the hearing to address that option by also granting variance relief to demolish and reconstruct in place and in kind with the proposed two story 2,560 sq. ft.. addition with a. basement. ADDITIONAL INFORMATION: During the public heanng, the applicant's representative informed the Board that there currently is no overnight accommodation in the Fire Station building for training personnel,firelighters or other emergency service workers. Due to the lack of housing on Fishers Island,the Fire District is planning for both its current use and anticipated future housing needs. It may be necessary at some point for the Fire District to house a full-time paramedic (perhaps with a family) or shifts of professional firefighters if there are fewer volunteers. On August 22, 2018,a letter to Richard H. Strouse, P.E., L,S. of CME Associates Engineering, Land Surveying& Architecture, PLLC was sent by the Board of Trustees of Southold Town regarding the proposed construction in the existing,building of a second story and including the abandoncne�at of the existing septic arid tlae proposed installation of a new.sewer line and septic system along with installation of new drywells for the roof leaders. The Board responded that no permit was needed for this project under Chapter 275 of the Town Wetland Code and Chapter I I I of the Town Code. 1wTl1I711WJf m C"'AC 1` 1 1 A C';1NS IITITC).1 BOARD ACT LQN. The Zoning Board of Appeals held a public hearing on this application on April 11, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law '267-1a b I .. Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. 'The subject property is located in an R-80 District. The Fishers Island Fire Department has been in this location for many years. The existing non-conforming fi"ont yard setbacks from both roads will be maintained. The proposed architectural design is more in keeping with the aesthetic of the other buildings in the immediate neighborhood. 2, Town Law §267-bLjh1jK2 .. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Even if the Fire District may have to demolish the existing structure, the footprint would remain the same and variances would still be needed. Town Law 267-b b 'd The variances granted herein are not mathematically substantial, representing 12.6% relief on the front yard setback on Crescent Avenue, and 3.3% relief from the front yard setback on Equestrian Avenue from the code. The variances are for the benefit of a public service and the importance of the Fire House is vital to the health and safety of all the residents and visitors to Fishers Island when emergency services are needed. Living on an island substantially makes the emergency services even more essential. 4. Town Law 267-b b . No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The Fire House has been in the same location for many years and is essential to the community and the public interest will be served by the proposed improvements. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 267-1a b The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of'"the parcel under the Zoning Code in effect prior to or at the time of purchase. However, the community has grown over the years in population along with increased summer visitors. The Fire Department needs to have the improved infrastructure in order to satisfy the safety needs of the community. 6. Town Law 267—b.. Grant of requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of providing vital emergency services and housing for training, meeting and housing of emergency personnel while protecting and preserving. the character of the neighborhood and the health, s,afety,. and welfare of the community. dESO 1JLIJQl'gw,OF Tl-IF;mmBOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Acampora, seconded by Member Lehnert, and duly carried,to GRANT the variances as applied, for two front yard setbacks in order to construct additions and alterations to a portion of an existing fire house; or in the alternative, if deemed necessary because of disrepair and/or deteriorated condition, GRANT THE RELIEF AS AMENDED to demolish the existing 1,280 sq. ft. portion of the firehouse, and construct in place and in kind a two story 2,560 sq, ft, proposed portion of. the fire honse with basement maintaining the non-coriforming front yard setbacks as applied for herein and as shown on the Site Development Plan, Shect 1 of 2, prepared by Richard Ff. County of Suffolk, State of New York. FINDINGS OF FACT 1. The building that ia the subject ofthis petition is being used as Fine Station. 2. At this time the Petitioner wishes to construct a second story addition of approximately 1,472 square feet for use as an apartment for the caretaker. Because the apartment will be used for |eao than 10 persons, this would be classified as on R'3 occupancy. 3 Section 1101.1 of the 2O30Existing Building Code of New York State(E8CNYS)stipulates that . An addition to a building or structure shall comply with the Uniform Code as adopted for new construction ,---I ww���� spTa� Department J-- r_ _ ^ p, nnmwn' ; of State Petition No 2021-0322 Page 2 without requiring the existing building or structure to comply with any requirements of those codes or these provisions, except as required by this chapter. Where an addition impacts the existing building or structure, that portion shall comply with this code. 4. Section 903.2.8 of the 2020 Building Code of New York State(BCNYS)stipulates that,.. An automatic sprinkler system installed in accordance with Section 903.3 shall be provided throughout all buildings with a Group R fire area. To be compliant with this requirement for new construction, the sprinkler system would have to be installed throughout the entire building. 5. The Petitioner has stated that, at this time, installing an automatic sprinkler system throughout the building would be both physically and financially infeasible. 6. The Petitioner has proposed that the new living quarters will be separated from the rest of the building with 2-hour fire rated barrier wall and floor assemblies as per Section 707 of the 2020 BCNYS. 7. It is proposed that the new second story apartment and exits therefrom, will have an automatic sprinkler system installed as per NFPA 13R as permitted by Section 903.3.1.2 of the 2020 BCNYS. 8. It is proposed that, the new stairway will meet all applicable provisions found in the 2020 BCNYS. 9. It is proposed that the new stairway will have a continuous 2-hour fire rating within the enclosers to the exterior. 10. The local code enforcement official has been consulted in this matter and does not object to the granting of a variance under the provisions of 19 NYCRR 1205.6. CONCLUSION OF LAW The proposed variance will not substantially adversely affect the Code's provisions for health, safety and security. Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would entail practical difficulties, economic hardship, or would otherwise be unwarranted because such would be unnecessary in light of alternatives which, without a loss in the level of safety, achieve the intended purpose of the code, DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from the 2020 Building Code of New York State, Section 903.2.8, to allow an automatic sprinkler system to be installed in accordance Petition No 2021-0322 Page 3 with Section 903.3 in only the R-3 occupancy portion of the building, be and is hereby PROPOSED TO BE GRANTED with the following conditions: 1. That the new second story apartment will be separated from the rest of the building with 2-hour fire rated barrier wall and floor assemblies as per Section 707 of the 2020 BCNYS. 2.
