Wilsberg, relative to a change of zone from "A" Residential and Agricultural zone to "M-l" Multiple Residence zone on certain property situated at Orient, New York; "IT WAS RESOLVED that the $outhold Town Planning Board recommend to the Southold Town Board denial of the change of zone from "A" Residential and Agricultural District to "M-i" Multiple Residence Zone on the above described property." It is the opinion of the Planning Board that this proposed change of zone be denied because (1) the proposed density of 135 units is too high for this location; (2) the fresh water supply is precarious; (3) The Master Plan does not call for any condominiums in Orient. Such request is made for the following reasons: The subject premises as presently zoned for single family residential dwellings would require the division of the land into 40~000 square foot parcels~ utilizing approximately 45.75 acres of the described parcel. Under such a plan of development there would be approximately 2.25 acres of open space. Through a change of zone to "M-i" Multiple Residence, and by application of a clustering concept, it is proposed that con- dominium units be constructed utilizing approximately 6.19 acres of total land for building purposes. Through this concept, approximately 35.22 acres of the land would be devoted to open space, with absolutely no residential construction within a minimum distance of 200 feet of any shore line. The balance of acreage would be employed for sewage treatment, roadways and parking facilities. The uniqueness of the land and its geograph- ical location ideally lends itself to the condominium concept of development. It is proposed to eventually construct 135 condominium units, maximum of two bedrooms per units to be utilized~it is anticipated, as limited and seasonal second dwellings. The benefits to follow from the utilization ofthe land under the condominium concept are significant. Firstly, the major portion of ~edescribed land will be devoted to open space; the shore line area will remain as open space not subject to construction of residential dwellings; increased tax benefits to the municipality; seasonal use of the condominium units which will not impair or require extension of existing services; imposition of covenants and restrictions limiting the ages of children so as not to impose undue hardship upon existing area school facilities; and finally, the development of a unique parcel of land in a proper and imaginative manner.
