Unsafe Building 114-12-5
WHEREAS, the Notice advised that the property must be made safe, and if the owner failed to
comply, that a hearing would be held before the Southold Town Board on April 15, 2025; and
WHEREAS, the property owner failed to make the property safe in compliance with Chapter 100
of the Southold Town Code; and
WHEREAS, a public hearing pursuant to Chapter 100 of the Southold Town Code was held on
April 15, 2025, at 9:00 a.m., at Southold Town Hall, 53095 Main Road, Southold,NY 11971.
The property owner was not present. The record includes the written comment and findings of
the Deputy Chief Building Inspector, who recommended that the structure be boarded up to
prevent access to the interior of the home and the basement for public safety purposes; NOW
THEREFORE BE IT
RESOLVED, The Town Board of the Town of Southold hereby adopts the recommendation of
the Deputy Chief Building Inspector and declares the structure located at 580 New Suffolk
Avenue, Mattituck, SCTM #1000-114-12-5 to be an unsafe building in accordance with Chapter
100 of the Southold Town Code.
BE IT FURTHER RESOLVED, The Town Board of the Town of Southold will arrange for the
structure to be boarded up to prevent entry to the subject premises. Any costs and expenses
incurred will be assessed against the property located at 580 New Suffolk Avenue, Mattituck,
SCTM#1000-114-12-5 pursuant to Chapter 100 of the Southold Town Code.

Unsafe Building 114-I2-17.1
WHEREAS, the Deputy Chief Building Inspector of the Town of Southold inspected the
property located at 1120 New Suffolk Avenue, Mattituck, SCTM #1000-114-12-17.1 and
prepared a written report of his findings in the form of a Notice dated March 7, 2025; and
WHEREAS, the Deputy Chief Building Inspector determined the structure to be unsafe and
dangerous due to inadequate maintenance, neglect, dilapidation, and abandonment; and
WHEREAS, said Notice was sent via personal delivery to the interested party, Robert Brenner,
and said notice was posted at the subject location pursuant to Town Code Section 100; and
WHEREAS, the Notice advised that the property must be made safe, and if the owner failed to
comply, that a hearing would be held before the Southold Town Board on April 15, 2025; and
WHEREAS, the property owner failed to make the property safe in compliance with Chapter 100
of the Southold Town Code; and
WHEREAS,public hearings pursuant to Chapter 100 of the Southold Town Code were held on
April 15, 2025, at 9:00 a.m., April 29, 2025, at 9:00 a.m., and finally on May 13, 2025, at 9:00
a.m. at Southold Town Hall, 53095 Main Road, Southold, NY 11971. The property owner was
present at each of the public hearings, and testimony was heard from the Deputy Chief Building
Inspector and the Chief Building Inspector, after which the Town Board determined that the
subject structure is unsafe pursuant to Chapter 100.
NOW, THEREFORE BE IT
RESOLVED, The Town Board of the Town of Southold hereby adopts the recommendation of
the Deputy Chief Building Inspector and Chief Building Inspector and declares the structure
located at 1120 New Suffolk Avenue, Mattituck, SCTM #1000-114-12-17.1 to be an unsafe
building in accordance with Chapter 100 of the Southold Town Code.
BE IT FURTHER RESOLVED, the Town Board of the Town of Southold, its employees, agents
and/or outside contractors, shall cause the structure to be boarded up in a water tight condition,
shall have the site secured by fencing and shall cause overgrown vegetation on the parcel to be
trimmed. Any and all costs and expenses incurred in these activities will be assessed against the
property located at 1120 New Suffolk Avenue, Mattituck, SCTM#1000-114-12-17.1 pursuant to
Chapter 100 of the Southold Town Code.
BE IT FURTHER RESOLVED, that the Town Board reserves the right to remove the structure
from the premises after 90 days following the adoption of this resolution unless construction to
replace or develop the structure has commenced in accordance with a duly issued building permit
or the parcel owner has obtained an extension of this time requirement from the Town Board
based upon a pending application for a building permit. Any and all costs and expenses incurred
in the removal of the structure will be assessed against the property located at 1120 New Suffolk

WHEREAS, the Ferry District requires additional Deckhands (FIFD);
Therefore it is RESOLVED to appoint, with effect April 17, 2025, Mathew Goulart-Peishot as a
part-time Deckhand (FIFD) at a rate of$17.00 per hour.
It is further RESOLVED to temporarily appoint with effect May 12, 2025 Mr. Goulart-Peishot
from part-time to full-time summer seasonal status. On September 15, 2025, Mr. Goulart-
Peishot will terminate his summer seasonal position (FIFD) and return to part-time status.

WHEREAS, there has been presented to the Town Board of the Town of Southold, Suffolk
County,New York, on the 18th day of March, 2025, a Local Law entitled"A Local Law in
relation to an Amendment to Chapter 280, Zoning,Accessory Apartments" and
WHEREAS that the Town Board of the Town of Southold held a public hearing on the aforesaid
Local Law at which time all interested persons were given an opportunity to be heard, now
therefor be it
RESOLVED that the Town Board of the Town of Southold hereby ENACTS the proposed Local
Law entitled, "A Local Law in relation to an Amendment to Chapter 280, Zoning,
Accessory Apartments" which reads as follows:
LOCAL LAW NO. 2025
A Local Law entitled, "A Local Law in relation to an Amendment to Chapter 280, Zoning,
Accessory Apartments"
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose
The Purpose of the amendment is to update the Southold Town Code with regard to Accessory
Apartments.
H. Amendment
The Southold Town Code is hereby amended by removing the struck through words and adding
the underlined words as follows:
§ 280-13(B)(13)(e)
The entirety of the living floor area of the accessory apartment must be on one floor of the

accessory structure. If established on the first floor, access to any storage area above shall be by
pull-down ladder staircase only.
§280-13(B)(13)(i)
Occupancy of resident structures on the premises shall be subject to the issuance of anbi-annual
rental permit in accordance with § 280-13D and the following requirements:
[1] One of the dwelling units shall be for the sole, exclusive occupancy of the owner or
family member as defined in § 280-4. The other dwelling unit shall be leased for
year-round occupancy evidenced by a written lease for a term of an no less than one
year and no more than two years to:
[a] A family member; or
[b] A resident who is currently on the Southold Town Affordable Housing Registry
and eligible for placement.
[2] Rents charged to a resident on the Affordable Housing Registry shall not exceed the rent
established by the Town Board annually pursuant to § 280-30F of this Code.
[3] No accessory apartment shall be occupied by more than the number of persons permitted
to occupy the dwelling unit under Section 404 of the Property Maintenance Code of the
New York State Uniform Fire Prevention and Building Code.
[4] An accessory apartment shall only be occupied or otherwise utilized in accordance with
the certificate of occupancy issued for the dwelling unit.
[5] Upon approval of the special exception and prior to the issuance of a rental permit,
the applicant shall file covenants and restrictions with the Suffolk County Clerk's
office in a form approved by the Town Attorney. The covenants and restrictions
shall include terms and conditions deemed necessary by the Zoning Board of
Appeals to ensure that: 1) the accessory apartment shall only be rented to a family
member or resident who qualifies to be on the Southold Town Affordable Housing
Registry, and 2) the special exception approval and resulting rental permit are
nontransferable and any future owner must reapply for the permit.
III. Severability
If any clause, sentence,paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. Effective Date
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.
