Gentlemen:
This is to advise you that the following resolution was
passed by the Southold Town Planning Board at their meeting
held on March 7, 1972:
In the matter of the original petition of Halsey A. Staples,
Greenport, New York, relative to change of zone fro~ "A"
Residential and Agricultural District to "B-l" General
Business District on certain property situated at S/W corner
of Wilmarth Avenue & Main Street, Map of Washington Heights
Lots 3, 4, & 5, Greenport, New York, it was
RESOLVED that the Southold Town Planning Board recommend
favorably to the Southold Town Board the change of zone from
"A" Residential and Agricultural District to "B-l" General
Business District on the above described property.
This property has been used as business for many years prior
to the Zoning Ordinance. In recommending this proposed change
of zone, the Planning Board feels that they are recognizing
an existing use.

1972 we reviewed the above captioned zoning action and disapprove

stone cutters, if Z don:t get this change tonight, I have lost
nothing except if anything happens to me or the property. I am
just trying to protect ~self to ~e able to put bread on the
table for the next thirty or forty years.

not granting the application, gs far as we know he can continue
to operate his business until doomsday. He doesn't need a
Business zone. it could be opened up to a great many other
things. The people in that area would prefer to keep it zoned
Residential.

there and I would not object to an amendment.

1. Our ~;Iashing%on Heights area is deslguated
for residential aevelopment by the Town
~J~ster Plan.
2. "Spot Zoning" would be very bad for the
residen%ial character clout area.
3. I feel t~is would downgrade our area and
could estaolish a baals £or X'uture similar
downgradi~gs.
I am no5 opposed to 2~. Staples continuing his
present business and under his present zoning he is per-
mitted to do so ~oreve~. Therefore, a chaege in zoning
is totally u~necessary and I request %~at his application
be denied, and ~ne Gecision or t~e Su~I~o£k Oouu~y Dept.

ness District, this is to inform you that I am opposed to the grant-
i~ of such application. I approve of the action of the Suffolk Co.
Dept. of Planning which has disapproved the applieatlon on the
grounds that it is contrary.to the Tow~ Master Plan for the Washing-
ton Heights area which has been designated for residential develop-
me~t Washington Heights is a commUnity of well~ken~omes, and tv
give a B-1 zoning in the area would downgrade it and would be "spot
zoning", which is to be avoided. Also, the narrow two lane road on
both ~ln St. and Wllmarth Ave. would not support business traffic in
that area and would create d~ngerous traffic situations detrimental
to the safety of everyone.
Under a B-! General ~siness District zone Mr. Staples would
be permitted to c,nduct several kinds of business, such as places of
amUsement, fishing stations, new and used car lots, public garages,
gasollue service stations, etc., or could sell his property for such
uses, all of which would be harmful to the residential character of
our Washington Heights area.
I want to make it clear, however, that I ~have no objection
to~.~ Staples conti'~uing his presenMbusin~ssi of tette~ing and selling
cemetery monuments. His application states "This change is desired to
formalize an existing use". As is apparent to everyone, no formaliza-
tion is needed to continue his pre~e~t business and, therefore, his
application should be disapproved as it has been by t~e Suffolk

Dear Mr, Richmond:
Pursuant to the requirements of Sections 1323 to 1332 of the Suffolk County
Charter~ the Su_ffolk County Planning Commission on April 5~ 1972 reviewed
the above captioned zoning action and after due study and deliberation, dig-
approved this change of zone because of the following:
1. It is contrary to the Town Master Plan which designate s [his
area for residential development;
It is inconsistent with the residential character of the surrounding
area;
3° It is inconsistent with the pattern of zoning in the locale and there-
fore must be considered as 'tspot zoningrt;
It would tend to establish a precedent for further downz6nings in
the locale and along the state roadway detrimental to the safety
and traffic carrying capacity of said facility.

Being 198.52 feet on Wilmarth Avenue; 115. 73 feet on Main Street;
211.48 feet on the South and 115 feet on the West.
2. I do hereby petition the Town Board of the Tmvn of Southold to change, modify and
amend the Building Zone Ordinance of the Town of Soutkold, Suffolk County, NewX'orx,'
including the Building Zone Maps heretofore made a part thereof, as follows:
To change subject premises from A Agricultural Residential to B General
Business District.
Such request is made for the following reasons: These premises h~ve be_e_rl used
continuously f~om 1928 as retail cemeter3r monuments, sales and lettering,
first by Stuart Staples until January, 1988 and since then by applicant who
succeeded the said Stuart Staples and is m 5w a non-conforming use.
This change is desired to formalize an existing use. The location is extremely
suitable for sale of monuments and the sale of monuments is an essential
busineSS-.
