EDWARD SPEEOW~S, sole owner of the pre~ises described in the
above matter, by his attorney, LEFFERTS P. EDSON, makes the following
points in co~uection with his application for an amendment to
the Southold Town Building Zone 0rdin~uceo
The purpose of the application is to qualify the land~br a
use per~itting the operation of a restaurant on the subject premises
by your applicant, using the existing strUcture for the conduct of
the business, the balance of the the 2 acre parcel to be used for
pa~king areas ~nd for landscaping.
Historically, this property was used as a boarding house by
the applicant's mother as far hack as the 1920's, providing food
and lodging to people from the west end. Adwsrtising for this
purpose was had in coope=ation with the Long Island Railroad in
furtherance of its prospective business.
The rapid increase inpopulation and in "second home" residences
in Southold Tow~ has created a need for public conveniences necessary
to satisfy the gro~-~h. The pressures of growth force changes in
zoning districts to meet the demands. Niddle Road between South~d
and Greenport is responding to this need as evidenced by the non-
residential uses now existing abng its route. Growth prom_pta changes.

and use on Middle Road and should not,
therefo~e~ be g~anted. This would be contradictory argument. If
traffic a~d the noise generated by it on Niddle Road are now problems,
then for these same reasons, the residential characteristics of the
~ea a~e presently diminished. The retention of this property as a
residential area wmuld ~ot increase traffic problems but would also
not c~e traffic ills that now exist. The solution for the traffic
p~oblem does not lie in placing a~ undue burden on the individual
owr~sr of a parcel of land.
It cannot be said that the granting of this application would
constitute illegal spot zoning. It is not spo$~ zoning if an
amendment to the Zoning Ordinance bears a reasonable relation to
public welfare and is thus consistent with the general purpose of
the Ordinance.

~E2~FERTS P. EDSON: In comm~ing to a decision of thio
matter, each member of the Board should take note of the points
made'in this memo before the final decision is made. The Middle
Road, between Southold ~ud Greenport has at least 30 uses other than
Residential existing along it. It is inevitably going to be a
business area. Becuase of the fact that there is a good deal of
traffic a~d noise ~ud congestion on it makes for more reason to
grant this application. This laud is not suitable for residential
purposes. As the ~nd exists now~ the p~tion of N~. Speeches land,
is not suitable fo~ residential use. It has to be suitable and
useful for something and with the Village Disposal unit across
the street ~ud other uses, it is not reasonable to assume that the
owner ca~es to use this for residential p~poses. We re~luest
your consideratio~d careful reading of the petition.
SUPERVISOR MARTOCCHIA: Is there anyone else that wishes to

FRED GOP~)0N: I think the North Fork area is very fortunate
in having a number of flue restaurant. I would like to mention
that every one is familia~ with the possibility of this change
for a restaurant in this area. We are very fortunate in having
~ery fine restaurants in this area. They are a tremendous
d~awing fo~ the North Fork and I am sttre that another restaurs+-
in this area certainly would add to this fact and not hinder it.

MRS. TRAUTMAN: Most plannLug experts are opposed to spot
zoning. The development plan discour~ag~es~business development
along this road, and discourages spot ~=w~ zoning. I request the
Board delay decision on this application until you can make a
decision of the development plan now before the Board.

I appear here on behalf of the applicant. Am to therthe recommendation
of the Suffolk County Plying Board, they do not wa~t business on
Route 27 nor on Route 2~. It seems the same individual w~ote this
recommendation that wrote the reeommendatien for the previous
application, if the~e is to be no business area on Rt. 27 and

informed 'as to whe~W'~..::wi!l allow business. This particular
application is a~ applicationfor a chsnge of zone on small parcel
of land which is situated on the easterly side of Aldrich Lane,
coming out of a large tract o~rned by the applicab~,n The Board
has a s~rvey prepared in connection with this application. Viewing
of ssme will show that across the at~eet there is a business zone.
This particmlar zone runs, from the 8~mensions on the zoning map,

approximately 1000 feet along Aldrich Lane a~d 750 feet along ~
Road. The change this application proposes on the easterly side
ef Aldric~Lane is an area of approximately 250 feet on
Aldrich Lane, 205 feet on N~ Road, and a rear line of 242 feet,
other line 206 feet. This would create a unique busifzese asea at
the intersection of Aldrich Lane and N~oad. I find it ~ifficult
to sew what real objection thez-e should be to changing this area.
I find no reason to object to the change in conju%tion with what
already exists. I don't believe this is spot zoning. It is not
in conflict with the zoning Ordinance, not withstanding the recom-
mendation of the Suffolk County Planning Board and the Southold
To~_ Pls~ulng Board. We request the granting of this change as
requested.

they plan to put on that corner?

structure.

RICHARD CRON,ESQ.: It won't offend the school.

MRS. TRAUTMAN: ~r. Cron's proposal does not go along with
the development plan map. Part II, pg 2 of this pla~ states that
business development should be in the central pa~t of the towns
and business development along rt. 25 should be discouraged. It
is inevitable that this will all be buslnems u~less we stop spot
MR. RICHARD HOMNEL: Mr. Supervisor ~ud Members of the Town
Board. The intersection of Aldrich L~ue and Main Road is about
a residential as you can get. Across the street is a house
~hat has been reconstructed for residentisl use. It was formerly
Laurel School House. That is not very business like. To the
immediate north of that building you have Laurel Cam_etery and we have
wish us~ Leland F~u~ug of the Cemetery Asso~ation. To continue
on dog, the street, there are some more old buildings. They are
not being used. You have two more residence, then Laurel Schoo~
Any commercial establishment would be detrimental to the school.
M~. Hommel (Con't) We feel that it would be bad principle to
give blank change of zone. It cuuld be a bank, or it could be
something else. This property was taken over by a syndicate.
They are not there to keep it residential, Tou know what happens
when you start with a ~mall business area. There is no need for
business in this residential a~ea. We do not wish to see this
property changed to businems use.

May I ask a question. De not the ~urrounding tax payers get a
notice of a proposed cha~ge of zone.

Dear IV~r. Richmond:
Pursuant to the requirements of Sections Z39-1 and m of the General /V~unicipal
Law, the Suffolk County Plar~ing Commission has reviewed the above captioned
zoning action and, after due study and deliberation, disapproved this change of
zone because of the following:
It is not consistent with the Town l%~aster Plan which designates this
area for Agricultural-Residential use and states that retail develop-
rnent should be absolutely prohibited along County Road 27.
It is not consistent with the pattern of zoning in the area and there-
fore must be considered as "spot zoningu,
3. It would set a precedent for further downzonings along the County
road which would be detrimental to the safety and traffic carrying
capacity of said facility.

Gentlemen;
This is to advise you that the following action was taken
by the Southold Town Planning Board at a regular meeting held
on December 8~ 1969:
In the matter of the original petition of Edward Speeches,
North Road, Greenport, New York, relative to a change of zone
from "A" Residential and Agricultural District to "B-2" Business
District on certain property located on north side of Middle
Road (CR27)= Greenport, New York~
It was RESOLVED that the Southold Town Planning Board does
not recommend to the Southold Town Board the change of zone
from 'A" Residential and Agricultural District to "B-2" Business
District on the above described property.
This change of zone is contrary to the Planning Board's
policy. It does not coincide with the comprehensive plan of
the area: It is against the County's recommendation of limiting
business on CR27o The change of zone from "A" to "M" on property
located across the street, made by the Town Board= was not
recommended by the Planning Board.

Edward Speeches, the applicant herein, for more than twenty years
was.a member of a partnership of three which owned and operated Sound
View Restaurant, located a~proxL~ately a mile westerly of the subject
location. Due to the ag~ of one of the partners the partnership termi-
nated in 'the fall of 1965 at which time the real'property and the
business was ~sold to Jack Levin, owner and operator of the adjoining
large motel complex. In cQnnection with ~ha% s~le Edward Speeches agreed
not to engage in the restaurant business for the ensuing eighteen months.
During the years of operation of the above business Edward Speeches
c3ained an extensive reputation for.providing good.food ~nd maintaining a
very.o~derly and properly conducted establishment. The local.people as
well as the thousands of sun~uer'visitors greatly appreciated the services
rendered.
The past sub, er.season demonstrated that the To~n of Southold now
needs an ~dditional good restaurant facility. The better restaurants

Mr. Speech~s intends to use the present renovated structure for the
dining room and will construct a kitchen, storeroom and lavatories on the
north side.of the existing structure. Access will be directly from Middle
Road and parking space will be ample for any foreseeable number of patrons
as sho%rn by the areas available for that purpose on the attached survey.

showing uses or_her than residential now existing on Middle Road between
Youngs Avenue in Southold and Main Street in Greenport.
