Smith & Sons Inc was received tc. day.
This should be a "B" zone not a "B-2" zone if it is to cover
the present operation - carpenter s~!op~ contractors yars and realestate
sales office. This use was approved by the Board of Appeals as an equal
classi£ication to the "non-confor}~ing" service station and garage that
Mras operated there before the Smith's bought it.
This a~ lication will have to be refferred to tk~e Plarm~ing Board
for an investigation an~ re~ort if it is anproved by the Town Attorney.

1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSMIPbecouse this has been a busines~ ?~roperty for many years,
lcng before zoning. We bought thJ_s for business use and expect to
use same for many years to come. We were granted permission to use
this property for business as a non cQnform~ing'us.e, partl~y d. ue to
the fact that our business would ~pgrade from the previcus use of
this property. However if circumstances or conditions should change
ir, the future and w~ would wish or have to sell, we would be sub-
ject to the decision of the a,c, peals board at that time. The make up
of the board at that t.i. me might decide against allowing a non
conforming use and we would be at their mercy. Also in case of
serious fire of over fifty per cent damage, we would loose our rights.

2. The hardship created, is UNIQUE and is not shared by all properties alike in the immediate.

be very costly and therefore not practical.
3. The Variance would Observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because this has always been business property.
and any business that wo~ld_ be allowed in the B 2 district now or
in the future v~ould be an improvement over what this was for many
years, that is a gss station and garage. We already have a business
area shout 600 feet west, then within 300 feet is a church. The
properties in bet-ween contain residences and no doubt would remain
so for years to ccme. Also any use of properties in this proposed
B 2 area would not seriously affect any existing residences.
