The use of the premises to be for a boat station and marina. 3. Such request is made for the following reasons: For the past several years I have constantly tried to sell the herein described premises for residential purposes, having listed same with several real estate brokers. During that period of time I have had no interested buyers who wanted it for residential purposes, but others have expressed an interest in buying it for business purposes. Due to my recent unsuccessful farming operations I must sell this property as I am in need of funds. I now have an opportunity to sell this property for business use to Mr. George Schmidt of 17 Carman Road, Huntington Station, N.Y. who has paid a deposit on the property with the proviso that for business use, as hereinbefore (L.S).Stamley. STARK: Mr. Supervisor, members of the Town Board, I am appearing as attorney on behalf of property owners who both own property and reside in the immediate vicinity of the parcel in question. The large,parcel involved is the property of Mrs. the premises can be re-zoned mentioned. Alberta Jackson, which comprises a large parcel of approximately 17 acres immediately to the east of the subject parcel, separated only by the Versal Holding Corporation. I also appear for a number of residents of Youngs Point, further to the east of this property, who own property and have substantial homes in the William Wertenberg development, which I am sure you are familiar with. On behalf of these people I am authorized today to appear for them and interpose their objections to the Town Board granting this change of zone. In the first place I tend to sympathize with his position, but I would assert as to whether this is a proper ground for the Town Board to consider such a radical change. If you are familiar, the category for "B" Business is a rather unlimited category. There is allowed a large quantity of business enterprises and all of the types of enterprises could be executed on there either by himself or a buyer if it were a "B" Business District. If it is the purpose of either Mr. Sledzieski or his contract buyer to use the property for marina purposes, then you realize he may apply for a marina in the "A"Residential and Agricultural District by special exception. However, this applicant and his contract vendee have come sub- stantially beyond that and are asking for a general rezoning for unlimited business use as set forth in the Ordinance. My clients are largely disturbed because of that. I do not believe they would object if it were graded and used for a nice marina, but they are applying for a general reclassification to "B" Business. The owner or contract vendee are not limited if granted this. If Mr. Sledzieski or Mr. Schmidt wished to sell the land six months from now the buyer could go in there and put up any of the type businesses allowed in the "B" Business District. The Town Board should take the township into consideration and determine whether it is necessary in the public interest to classify this property for such a broad business use, except the statement of the buyer for what it is going to be used for. If this property is parcelled out from "A" Residential and Agricultural to "B" Business District the parcel would be entirely surrounded like a little island by a residential area. Unless such a radical change of zone is justified by the Town of Southold and in accordance with the comprehensive plan for the development of property it might certainly detract from the area, since there is a substantial investment in the area. Mrs. Jackson's property is improved by her homsstead and there is a possibility of her dividing up some of her property into many residential plots. It might be detrimental to her property particularly, and it mi,jht not fit into the general character of the neighborhood. A formal boat marina could be accomplished by a special exception and would not be objectionable. The people that reside at ¥oungs Point which is east of the property down the Creek, have improved their property by $20,000 and $30,000 homes and this could possibly be detrimental to their property values in their area. The people are concerned if this property is classified for "B" Business use and certain types of boats are allowed in ther~ such as commercial fishing boats there might be a health problem. At the present time there is a problem of free flow of water because of the dead-end of that branch of the Creek and a facility of this type at the end of the Creek would add to it. That in general is the objection of my clients. I realize the Planning Board has endorsed this. At this time some of the people present might like to add their remarks to mine. MR. STANLEY WICK, Mattituck, New York: I am here to represent Mr. k. G. Brown, President of the Westphalia Civic Association, who have homes on the southwest side of that branch of the Creek. They are in opposition to the Town granting this change. We do not wish business in that particular area, and if this were limited generally only to a marina I do not believe there would be any opposition to it. MRS. ALBERTA JACKSON, Mattituck, New York: I think Mr. Stark has spoken for all of us. MR. STANTON JENNINGS, Mattituck, New York: I subscribe to what Mr. Stark stated. MRS. JACKSON: Mr. Sledzieski said he could not sell that land. I understood from someone else that the Town wanted to buy this land and cut off the turn. I do not know if there is any truth in that. COUNCILMAN ALBERTSON: As far as I know there isn~ruth in that. MR. ARTHUR BECKER, Mattituck, New York: At the Chamber of Commerce we have discussed that and there is a definite danger there. The oil trucks travel up and down there. The Road Commissioner was representative at our meeting and that was discussed . 10 MR. BECKER: I think the water sufficient water, but be unsafe. MR. STARK: SUPERINTENDENT OF HIGHWAYS PRICE: The parcel of land which we were interested in is not this parcel. What he wanted to do was go up on Breakwater road in back of his house and into the bottom of the hill. Take the road away from Mrs. Ashleys property. That is the opposite side of the road. MRS. JACKSON: That land there is at the end of the creek and the water stops there stagnant, and the dredge only came down part of the way to the Versal Estates and the water gets in there and is really stagnant. And to have boats come in there, with throwing garbage overboard and oil in the water would make it impossible for us to bathe in there and we all%se our beaches. I am one of the property owners on Youngs Point. front property should be improved where there is if there is a marina put down there it would I would like to point out that if this petition is granted and Mr. Sledzieski's property is classified as "B" Bus- iness, if Versal Holding corporation, which holds a considerable frontage piece across the road and on the water front to the east, if they, at a later date, were to make the same application the Board might be in a position where they would not be able to deny them. Opening up the door here as classifying this area as "B" Business would give Versal quite an argument, and the same for Mrs. Jackson, if this petition is granted. This will shift the character of the neighborhood where there are no business enterprises in 11 operation to just the opposite and a definite the radical change to "B" Business they are not limited, applied for a marina then they would be limited. Such requestis made forthe following reasons: For the past several years ~ have constantly tried to sell the herein described premisea for residential purposes, having listed same with several real estate brokers. During that period of time I have had no interested buyers who wanted it for residential purposes, but others have expressed an interest in buying it for business purposes. Due to my recent unsuccessful farming operations I must sell this property as I am in need of funds. I now have an opportunity to sell this property for business use to Hr.
