No. 5445 — EVERETT and MELISSA CLARK CORWIN Setif 3. in LI ; Property Location: 706 Brown Street, Greenport; Parcel 1000-48-3-22. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 5629.58 sq. ft. parcel has 50 ft. frontage along the north side of Brown Street in Greenport. The property is improved with an one-story frame house of approximately 735 sq. ft. in size, and detached accessory garage in the northwest corner of the property, all as shown on the March 5, 2003 survey prepared by Joseph A. Ingegno, L.S. BASIS OF APPLICATION: Building Department's September 5, 2003 Notice of Disapproval, citing Section 100-244B, in its denial of a building permit to construct a porch addition to the existing dwelling with a setback less than 35 feet from the front lot line, less than 10 feet on a single side yard and less than 25 feet for both side yards, and lot coverage in excess of the code limitation of 20 percent of the lot size. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on December 18, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicants wish to construct an 8 ft. by 30.2 ft. front porch addition, with a proposed '26.6 ft. front yard setback at its closest point to the southerly front property, 4.8 feet from the easterly side line, and at least 20 feet on the westerly side line as shown on the,survey prepared March 5, 2003 by Joseph A. Ingegno, amended September 19, 2003. Applicants are proposing a lot coverage total of+-23%. • REASONS FOR BOARD ACTION: On the basis of testimony presented, material submitted and personal inspections, the'Board makes the following findings: 1. Grant of the alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant has proposed to 1 IO��i -� Page 2—January 8,2004 Appl. No.5445—Melissa Corklin 48.-3-22 at Greenport construct a 8' x 30'2" roofed, open porch, open on three sides, on the front of their newly renovated home. At the hearing, the Board asked the applicants to explain their needs based on a 8 ft. size, and discussed an alternative for a smaller size, for a lesser variance. For the record the Board in June 2003 also granted variances to expand the dwelling with a second story, maintaining the same setbacks as the existing footprint. 2. The grant of alternative relief for a smaller +- 182 sq. ft. front porch, 6' x 30.2' instead of 8' x 30.2', will not adversely change the character of the surrounding neighborhood. A reduction in the size of the porch will increase the setback from the front, facing the street. The neighborhood is a developed residential area with other nonconforming parcels and buildings of similar size. 3. The benefit sought by the applicants cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicants wish to place a porch to enhance the appearance and design, and for family use. 4. The relief sought is substantial. The reduction of the setback from the house to the front lot line facing the street is proposed to be only 26.6 feet. By reducing the size of the porch, the setback is increased to 28.6 feet and the lot coverage percentage is reduced by 59+- square feet from applicant's original request of 23%, allowing a 6 ft. x 30.2 ft. porch addition. 4. The difficulty has been self-created. Although this lot and the neighborhood consists of small, substandard sized lots, improved, previous variances were granted, and any new construction will required further variances. The lot and dwelling sizes are nonconforming, and the porch was planned in a location that does not meet the code requirements. 5. No evidence has been submitted to suggest that a porch addition will have an adverse impact on physical or environmental conditions in the neighborhood. The lot is located in a residentially developed neighborhood with numerous nonconforming buildings, without any outstanding wetland or related environmental issues or concerns. 6. Grant of a variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a roofed, open front porch addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Orlando, seconded by Member Goehringer, and duly carried, to Page 3—January 8,2004 a "" Appl. No. 5445—Melissa Corwin 48:3-22 at Greenport DENY the variance as applied for, and to GRANT alternative relief for a 6' by 30.2' front porch addition, subject to the following CONDITIONS: 1. that the porch not be enclosed; 2. that the porch may be roofed; 3. that the front yard setback not be reduced to less than 28.6 feet. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. It didn' t mention that within 18 the prior variance - - you know, the house is quite tall, it' s quite large and probably one 19 of the reasons why you want the porch to do that , but you know, there' s a degree of 20 pushing the limit , and I think we' re at that degree . And I 'm just mentioning that to you I 21 mean in reference to how much you can build on a 50 foot lot, and I ' ll pass at this point 22 until I hear from my fellow colleagues regarding this _ 23 CHAIRWOMAN OLIVA: Mr_ Orlando . BOARD MEMBER ORLANDO: I 'm in 24 somewhat agreement with Mr. Goehringer. I ' m not totally opposed to a front porch you have 25 an eight foot, six foot would be acceptable for me . At the time that we granted the variance, I 4 clearly recall this application that we had discussed the fact that this was -- it was a 5 large house, you wanted to go up to create more room, but we were also concerned that 6 this would not be a further expansion_ So I really am having a lot of problems with this 7 because there are three variances and that we' re requesting, lot coverage, you want to go 8 from 20 percent to 23 percent; you want tc continue to the reduced side yards , which is 9 right on top of your neighbor' s property, and you want to come forward to the road. You' re 10 at 34-7 now, and now you want to knock that down having a front yard setback of 26 feet . 11 So quite frankly, I ' m not in favor of this • application. 12 MR _ CORWIN: How am I reducing the side yards? 13 BOARD MEMBER TORTORA: You' re /s-, continuing t0 extend along that end, which is 14 what we granted you a variance for the principal house last year, but you' re 4 feet, 15 4 . 5 feet from your neighbor' s property line now. You want to continue that 4 . 8 inches 16 from the property line now for the porch_ So that' s just exacerbating the problem. You 17 want to increase your lot coverage this time over the limit . I really kind of agree with 18 Mr. Goehringer. There' s a limit, I think we've reached it _ That ' s my comment . 19 CHAIRWOP'LAN OLIVA: Mr. Horning? BOARD MEMBER HORNING: No other 20 comments _ BOARD MEMBER GGEHRINGER: I want 21 to reflect on one thing_ Possibly you could construct a porch just over the front door and 22 not extend it out to both sides of the house; that would be within variance purview and not 23 as significant as the issue that we' re discussing at this point . 24 MR_ CORWIN: Okay, so if I - - would I have to reapply again and go through 25 the whole procedure if I changed the plans? CHAIRWOMAN OLIVA: You could just December 18 , 2003 25 1 1.... �. 2 give us amended plans _ The lots there are very small, and there is just no room between 3 your house and another house . And we certainly wouldn' t want to see that all of a 4 sudden you' re going to apply for a deck in the rear. It' s really tight down there . 5 MS . KOWALSKI : I believe the Board wanted an amended site plan to show. 6 CHAIRWOMAN OLIVA: Yes , an amended site plan to show. 7 MR. CORWIN: I understand you say it' s tight, but there' s fences up and I have a 8 driveway on one side . I don' t understand where it' s making any -- 9 CHAIRWOMAN OLIVA: But we have a policy that we only want 20 percent of lot 10 coverage for any structures on the property. You are just about 20 percent, if you put the 11 porch on the way it is now it would be 23 percent, and we do not look favorably upon 12 this at all . BOARD MEMBER ORLANDO : If he made 13 it 20 foot wide, six foot deep, you have to give the gentleman a number to work with. 14 Jerry, 20? BOARD MEMBER GOEHRINGER: I think 15 you have window and you don' t want to extend it to the window on both sides of the front 16 door. So, I would architecturally try to develop something that would look very 17 appealing, but not a porch across the whole front . We basically just did one and voted on 18 it . It was the first application, the name was DeFeis . It was Cedar Beach_ It was a one 19 story- They converted it to a high ranch, which is now a two story. It was a very 20 tastefully done front porch. Exactly the same situation that you have in reference to the • 21 front property line and so on and so forth. CHAIRWOMAN OLIVA: I think some 22 of the members of the Board really want to deliberate on this a little bit more, but give 23 us your amended plan. MR. CORWIN: Okay, and I 24 appreciate if you' re going to deliberate and stuff, just the phrase overdoing it to me, I 25 mean, overdoing what? I ' m trying just -- I 'm trying to make what I got lucky enough to buy December 18 , 2003 26 1 v 2 better. PROPERTY FACTS/DESCRIPTION: The applicant's 5629.58 sq. ft. parcel has 50 ft. frontage along the north side of Brown Street in Greenport. The property is improved with a one-story frame house of approximately 735 sq. ft. in size, and detached accessory garage in the northwest corner of the property, all as shown on the March 5, 2003 survey prepared by Joseph A. Ingegno,L.S. BASIS OF APPLICATION: Building Department's November 26, 2002 Notice of Disapproval, citing Sections 100-242A and 100-244, in its denial of a building permit to construct a second-floor addition and alteration to the dwelling with a setback on a single side yard at less than 10 feet and less than 25 feet for both side yards. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 15,2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct a second-story addition to her existing home,maintaining the existing easterly side yard at 4.6 feet at its closest point. The westerly side yard is existing with variables at 10 feet at its closest point and 15 feet to the west side of the foundation(exclusive of existing stoop or shed). REASONS FOR BOARD ACTION: On the basis of testimony presented, material submitted and personal inspections,the Board makes the following findings: 1. Grant of the relief requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant has proposed to expand this one-story residence by adding a second story,with the same dimensions as the existing footprint. The overall height of the building will be increased by eight feet, raising it from 16 feet to approximately 24 feet in height. The applicant cannot create the living space necessary for the family's needs without the construction allowed in this variance. 3. The relief granted is not substantial. The expansion of the building will be over the existing first floor footprint, and the total building height after completion of the new construction will not exceed the height limitation allowed by the zoning code. The lot coverage will remain(presently about 14%). 4. The difficulty has not been self-created. The lot and dwelling sizes are nonconforming, and the applicant has chosen to increase its size in height rather than expanding at the sides or rear. 5. No evidence has been submitted to suggest that the proposed additions will have an adverse impact on physical or environmental conditions in the neighborhood. The lot is located in a residentially developed neighborhood with numerous nonconforming buildings,without any outstanding environmental issues or concerns. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a second-story addition,while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
