Appl. No. 5467 -THOMAS DeWOLF a j r. Property Location: 415 Sterling Place, Greenport; Parcel 34-3-50. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. • PROPERTY FACTS/DESCRIPTION: The applicant's 4,728 sq. ft. parcel has 58.8 feet along Sterling Place, Greenport. The property is improved with a single-family, 1-1/2 story frame dwelling and one- : story detached frame accessory building, as shown on the September 12, 2001 survey prepared by John C. Ehlers, L.S. BASIS OF APPLICATION: Building Department's December 1, 2003, Notice of Disapproval, amended December 3, 2003, citing Section 100-244B in its denial of a building permit application concerning an addition which is proposed to be located with a setback of 17 feet from the front property line. The house has an existing setback of 7.4 feet at its closest point, and the addition is proposed behind this portion of the house. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on January 22, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct a partial 2nd floor 19'8" by 12' addition at the southwest corner, behind the front portion of the house. The set back is proposed 17+- feet from the front property line, as shown on the site plan prepared 11/26/03 by Frank W. Uellendahl, RA., integrating the survey prepared by John C. Ehlers, L.S. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the relief requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant wishes to construct 135+- sq. ft. of floor area to his existing 1-1/2 story home. The applicant's home is on a substandard lot with nonconforming setbacks, and simply wishes to fill in the remaining first story area with a second- ,fl Page 2—February 12, 2004 Appl. No. 5467—T. DeW olf 34-3-50 at Greenport floor as a minimum. The addition is proposed behind a portion of the existing, front side of the dwelling which will be greater than the 7.4 ft. front yard setback, proposing a 17 ft. setback. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The lot is substandard in size and the setbacks of the dwelling are nonconforming, having been built many years ago. The addition is farther from the street than the existing house. 3. The variance granted herein is not substantial and is the minimum necessary for the Board to approve. 4. The difficulty was self-created because the home has existed for many years with the existing nonconforming setbacks. 5. No evidence has been submitted to suggest that a variance in this community of smaller, substandard size lots, will have an adverse impact on the physical or environmental conditions in the neighborhood. The area consists of dwellings containing similar setbacks. 6. Grant of the relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition and alterations, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Chairwoman Oliva, seconded by Member Orlando, and duly carried, to GRANT the variance as applied for, as shown on the site plan prepared 11/26/03 by Frank W. Uellendahl, R.A., integrating the survey prepared by John C. Ehlers, L.S. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. (see elevation) It will not interrupt sight lines or views or create any other form of visual detriment to the character of the neighborhood, which alternates between leafy portions due to large maple trees, and small open spaces, such as the yards directly to the north and south. This lot is the only lot actually facing onto the block of Sterling Place between Champlin Place and Bridge Street; the adjoining properties face onto one or the other of those cross-streets . To the north: the proposed addition will be only partially visible from the property on the SE corner of Champlin Place and Sterling Place (221 Champlin) and not at all from other properties to the north. To the south, the addition will be visible from the adjoining property at 306 Bridge Street (eJW corner Bridge &Sterling) and from the upper story of the house directly west thereof, whose back yard abuts mine. The view from the SW corner Bridge & Sterling is minimal due to trees . It will also be visible from 330 Bridge, SE corner Bridge & Sterling. Both .SE Bridge & Champlin are in the incorporated Village of Greenport. The property at the NE corner of Bridge & Sterling is not occupied and its view of this property is screened year round by a stand of yew trees . The subject of this "visibility” does not alter much for the viewer: the highest point is its connection to the existing roof tree. Seen two-dimensionally, there is hardly any noticeable change. As mentioned above, the area is completely screened during the periods of the year when there are leaves on the large maple, and there is another large maple near it on the property to the south. During the non-leafy period, the view of the addition is still obscured somewhat by the trees . E 4 627 15 5. • 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than the area variance, because: The current bedroom is inadequate in size and is immediately adjacent to the living room. Applicant wishes to convert the attic into a bedroom and the current bedroom into an office. The current stairs to the attic, enclosed along the north wall of the living room, are narrow at only 27" of width, and there is insufficient headroom at the top of the staircase due to the slant of the roof. To increase said headroom, the north wall and roof would have to be opened up to install dormers, which would be much more expensive than the current design. Also, the stairs would have to be widened, which would encroach into the living room. The design moves the stairs to the proposed office, currently the bedroom, where there would also be adequate room for desk and shelving. It is appropriate to have a bathroom on the same level used for sleeping. Design also calls for construction of a full bath in an addition over the current bedroom (parallel at the top to the proposed staircase) _ The current bathroom is an unsatisfactory arrangement directly off the dining area of the kitchen. Design calls for retention of toilet and sink fixtures for guest "powder room, " sealed off from the kitchen and accessible only through vestibu_e/mudroom off the kitchen. 3. The amount of relief requested is not `- stantial because: The proposed changes to the property have no deleterious effect on the property, and will only bring the standard of living of the occupant up to a more acceptable level; and have no discernable effect on the neighborhood. 4. The variance will l _}OT have an adverse affect or impact on the physical or environmental conditions in the neighborhood or district because: The proposed changes consist of an upward extention of a pre-existing building, and would not affect lot coverage or any other interruption to a discernable ecosystem. No overuse of materials or resources would be caused. 5. See application. 6. Additional information This application is made in deference to what seems to be called a "setback issue. " It should be noted that most of the buildings in the neighborhood, many with no greater distance from the marker than this property has, have fully functional second stories . 'ire second story on this dwelling had never been converted to include a bathroom, although there is evidence that it was used in the past (although not during the tenure of the previous owner) , presumably as sleeping quarters. The proposed addition is not a large or otherwise imposing one. As can be seen in the photographs and diagrams, and understood from the answers in the application, there would ::o harm to neighborhood, community or environment by the execution of this proposed addition to the property.
