FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March 18, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: PROPERTY FACTS/DESCRIPTION: The applicant's property consists of 12,500 sq. ft. (or .287 of an acre) and is shown as Lot 41 on the filed Map of Orient by the Sea, Section One, and the Suffolk County Tax Maps as Parcel 15-7-11. The adjacent property which has been deemed merged by the Building Department with the applicant's property is improved with a dwelling and is referred to as CTM 15-7-10, shown as Lot #40 on the filed Map of Orient By the Sea. BASIS OF APPLICATION: Building Department's February 23, 2004 Notice of Disapproval, citing Code Section 100-26 in its denial of a building permit application, in which it determined that CTM 11 has been merged with CTM 10 due to common ownership during a period of time after July 1, 1983. RELIEF REQUESTED: Applicant requests a Lot Waiver to unmerge CTM 11 as shown on the Stanley J. Isaksen, L.S. survey dated 2/28/02, amended April 30, 2002, from CTM 10 (shown on the R. VanTuyl survey dated 8/25/60). CODE PROVISION: Section 100-26 of the Zoning Code reads, as follows: A. If a lot has merged, the Zoning Board of Appeals may waive the merger and recognize original lot lines upon public hearing and upon finding that: (1) The waiver will not result in a significant increase in the density of the neighborhood. (2) The waiver would recognize a lot that is consistent with the size of lots in that neighborhood. (3) The waiver will avoid economic hardship. (4) The natural details and character of the contours and slopes of the lot will not be significantly changed or altered in any manner, and there will not be a substantial filling of land affecting nearby environmental or flood areas. _J Page 2—April 8,2004 ZBA#5101 —G. Diakoumakos CTM 15-7-11 REASONS FOR BOARD ACTION: In considering all of the above and applying the criteria under Section 100-26 of the Zoning Code, and on the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. The waiver of merger will not result in a significant increase in the density of the neighborhood because only one additional house will be built. 2. The waiver of merger will recognize a lot that is consistent with the size of lots in the neighborhood. The neighborhood and district is well-developed with single-family residences, and consists of many older lots that do not conform to the R-40 (40,000) minimum for this zoning district. 3. The waiver will avoid economic hardship because the lots are currently held in separate ownership and the vacant lot was purchased with reliance on the 1997 Notice of Non-Merger issued by the Southold Town Building Inspector. 4. No evidence was presented to suggest that its natural details, character, contours or slope would be significantly altered in any manner. Nor was any evidence presented to suggest that the lot would require substantial filling affecting environmental or flood areas. 5. The waiver would recognize the original lot lines for Lot 41 as set forth in the filed Map of Orient By the Sea, filed 11/21/1957. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Member Goehringer, and duly carried, to GRANT the Waiver of Merger, as applied for. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Kren and Marion E. Kren, his wife. Ownership of each of the lots was changed in September 1989, apparently, in a effort to avoid merger. By letter dated November 1996 (copy enclosed), Gary Flanner Olsen, Esq. requested a determination of merger from the Southold Building Department. The Building Department issued "Notice of Disapproval" dated January 15, 1997 signed by Sr. Building Inspector Thomas J. Fisher with respect to the subject parcel (lot#41; SCTM # 1000-15-7-11 ("Lot #11")) and the unproved parcel to the north (lot #40; SCTM # 1000-15-7-10 ("Lot #10")); which notice states, in pertinent part, "UNDER SECTION 100-25 C (4) LOTS IN QUESTION HAVE NOT MERGED AS THEY HAVE BEEN HELD IN SINGLE AND SEPARATE OWNERSHIP FROM JANUARY 1, 1997 TO DATE" (the "1997 Notice of Non-Merger"). Pursuant to §100-25, the non-conforming house Lot #10 merged with the adjacent (i.e., sharing a common course of 50 feet or more) conforming vacant Lot #1 because: 1. the lots have an area of less than 40,000 square feet; or 2. there is no ZBA lot size variance; or 3. the Lots #10 and #11 were held in common ownership between July 19, 1962 and September 30, 1989 (see attached); or 4. the Lots #10 and #11 are not on the maps described in former §100-12; or 5. each lot is not currently developed (only Lot #10 is improved). APPLICANT'S REASONS Lots #10 and #11 are similar in size to most of the other lots in Orient By The Sea, Section#1. Accordingly, a waiver would nor result in a significant increase in the density of the neighborhood and would recognize a lot that is consistent with the size of lots in the neighborhood. It is not envisioned that there will be any significant change or alteration of the natural details and character of the contours and slopes of the lot. There would be no substantial filling of land affecting nearby environmental or flood areas. Both lots are currently and have been in separate ownership since the end of September 1989. Lot #11 and Lot #10 to the north subsequently were sold to third-parties in arms-length transactions in reliance on the 1997 Notice on Non-Merger. Separate tax bills are issued for each of the parcels; and the taxes are paid by the owners.
