Properly Location: S/s Madeline Avenue and E/s Crescent Avenue, Fishers Island; CTM 6-8-1. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicants' 21,686 sq. ft. lot has 100 ft. frontage along the east side of Crescent Avenue and 232 ft. frontage along the south side of Madeline Avenue. The lot is improved with an existing single-family, one-story dwelling situated with a nonconforming setback of 21.5 feet from the front lot line along Madeline Avenue and a conforming setback of 97+-feet from the front line along Crescent Avenue. BASIS OF APPLICATION: Building Department's February 24, 2004 Notice of Disapproval, citing Code Sections 100-242A and 100-244 in its denial of a building permit application concerning proposed additions to dwelling which will be less than 40 feet from the front lot line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 22, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicants wish to construct a 37'1" extension of 760+- sq. ft. at the east side of the existing dwelling, maintaining the existing line of the house with a front setback of 21.9' and 22.5' (northwest and northeast corners respectively) at the closest points to the front lot line along Madeline Avenue. (The deck modification proposed behind the new extension is not the subject to the front yard variance reduction or any other code provision as submitted.) REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the relief requested would not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The new addition will be for the applicants' residential purposes, which is permitted in the area. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicants' lot has two front yards as defined by the Section 100-232 of the Southold Town Code. Strict adherence to this part of our code would require the applicant to move a driveway and septic system to build the addition within the limits of the code. 3. The variance granted herein is not substantial. The setback of the existing house from Madeline Avenue is 21.5 feet and the addition would be no closer than 21.9 feet. Lot coverage and other code provisions would not be affected, and a part of the addition will replace an existing deck, lessening any lot coverage. 4. The variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because the dwelling will continue to be one-story in a neighborhood consisting mainly of one-story dwellings. Part of the addition will replace a deck. 5. The difficulty has not been self-created. 6. No evidence has been submitted to suggest that a variance in this community of single-story residences will have an adverse impact on the physical or environmental conditions in the neighborhood. 7. Grant of this relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Ham, Ill RE: Application of Christopher Edwards and Trudi Edwards (SCTM # 1000-6-8-1) This Memorandum is being submitted in support of the application of Christopher Edwards and Trudi Edwards (Application No. 5509)for a variance relating to premises owned by them at the southeast corner of Crescent Avenue and Madeline Avenue, Fishers Island, New York (SCTM # 1000-6-8-1). VARIANCE REQUESTED The applicants are requesting a variance to the Southold Town Zoning Code (the "Zoning Code") to permit the construction of an addition and modified deck onto a single-family residence at their approximately .50-acre parcel as shown on the Site Plan for Christopher Edwards and Trudi Ann Edwards prepared by CME Engineering, Land Surveying & Architecture, PLLC, dated February 4, 2004. Under the proposed plan, the Edwards are requesting a variance to permit 1 the proposed addition to be located at a minimum distance of 21.9 feet from the front lot line on Madeline Avenue. This variance relates to the requirements under Section 100- 244.B of the Zoning Code pursuant to which a lot with an area of 20,000-39,999 square feet is required to have a minimum front yard setback of 40 feet. Since the use of the single-family dwelling with a deck is a permitted use in this R-40 Zone District and the relief sought relates to the dimensional and physical requirements of the Zoning Code, the requested variance is an area variance. Town Law §267.1. Therefore, the standards of Town Law §267-b(3)(b) apply. The factors to be considered by a zoning board of appeals in making a determination regarding an area variance under Town Law§267-b(3)(b)are as follows:(1) the benefit to the applicant as weighed against the detriment to the health, safety and welfare of the neighborhood; (2) whether an undesirable change will be produced in the character of the neighborhood or to nearby properties; (3)whether the benefit sought can be achieved in another manner; (4) whether the variance is substantial; (5) whether the variance will have an adverse effect on physical or environmental characteristics; and (6) whether the alleged difficulty was self-created. An examination of the circumstances present in the instant matter in light of the foregoing factors follows. 1. Relative Benefit and Detriment. The applicants, who are year-round residents of Fishers Island, intend to build an addition and a modified deck (which conforms to the Zoning Code)at the dwelling on their .50-acre parcel in a residential zone. The purpose of the addition is to provide more living space for their family. There should be no detriment to the health, safety or welfare of the 2 neighborhood by the granting of the requested variance. The use for residential purposes is a permitted use. There will be no increase in density, noise or traffic. Although the addition will be about 750 square feet and the modified deck will be about 380 square feet, those structures will partially replace an existing deck. The lot coverage would be increased by only about 760 square feet on this approximately 21,686 square-foot parcel, resulting in an increase in the relevant percentage from about 9.2% to 12.7% in a Zone District where 20% is permitted. Under these circumstances, the benefit of additional living space for the applicants clearly outweighs any conceivable detriment to the public. 2. Character of the Neighborhood. The addition to the single-family dwelling and modification of the deck in the proposed locations will not result in an undesirable change in the neighborhood or to nearby properties. The existing residence has a setback of 21.5 feet to 21.9 feet and the new addition will be no closer to the front lot line than the greatest current setback of 21.9 feet; therefore, in one sense, the degree of nonconformity is not even being increased. The Meyer house opposite the subject premises is located closer to Madeline Avenue that the Edwards house now is and the addition would be. Also, houses in the immediate vicinity of the Edwards property are single-story, an attribute that would be preserved by the granting of the variance. The impact is not as significant as it otherwise might be since the addition encroaches on a setback from a street, not on one from a property line with a private owner. Rear and side yard setbacks, as well as the front yard setback to Crescent Avenue, meet the minimum standards. 3 There is even a precedent for a non-conforming setback from Madeline Avenue on this property. By a variance granted in 1959, a predecessor to your Board permitted the construction of a detached garage in the vicinity of the proposed addition at a minimum setback of ten feet. In granting that variance, the Board noted that the next property easterly with a dwelling had a garage closer that ten feet and that the general setback on the street was not deep. (The garage was apparently never built.) A copy of the determination is attached hereto as Exhibit A. 3. Alternatives. The purpose of the proposed addition is to provide additional living space for the Edwards family. At first glance, there appear to be three alternatives to the current proposal for construction on the northeasterly side of the dwelling: (i)construction of a second story to the existing dwelling; (ii) construction on the westerly(Crescent Avenue)side of the dwelling;and (Hi)construction on the southeasterly side of the dwelling. However, while all of the alternatives are theoretically possible, in light of existing circumstances, not one of them is satisfactory. The construction of a second story would not be in keeping with the character of the neighborhood which is comprised largely of single-story residences. Moreover, in light of the Walz decision, creation of additional living space by this means would probably still require a variance unless the second story were built only over the southerly portion of the house, in which case it would have a much greater (and more negative) impact on the residences owned by the Fishers Island Electric Company and Paul and Leslie Tombari. The applicants have also been advised that construction of a second storywould not be structurally feasible given the condition of the existing foundation. 4 Construction of the addition on the Crescent Avenue side of the house would be problematic for several reasons. The existing septic system, a recently installed replacement for an outdated system, would have to be relocated at great expense. Moreover, due to the presence of a patio, entryway, kitchen and bedrooms on that side, design and construction costs would be much greater than those anticipated under the current proposal. Furthermore, a variance to the setback from Madeline Avenue might still be necessary unless the addition were attached at the southerly portion of the house, in which case the impact on the two residences adjoining on the south would be exacerbated. Construction of the addition on the southeasterly side of the dwelling would appear to work on the drawing board, if only because the applicants could elect to treat the southerly yard as a"side"yard and therefore maintain a setback of 15 feet(as opposed to 50 feet for a rear yard). However, that yard is for all intents and purposes a rear yard and locating the addition would have an adverse impact on the Electric Company and Tombari residences. It would also require the removal of the shed and two trees. Your Board should also take into account the fact that the Edwards' architect compared that location with the one proposed and determined the proposed location to be superior from an ecological point of view. He estimates that the addition as now proposed would receive twice as much sunlight as it would were it located on the southeasterly side, thereby making the structure much more energy efficient. Based upon the foregoing,the applicants have selected the optimal location of all the conceivable alternatives. The alternative proposed is the one that most effectively addresses the economic needs of the owners and the impact on the 5 n neighborhood. 4. Substantial Nature of Variance. If entirely new construction were proposed at a minimum setback of 21.9 feet, the variance from 40 feet to 21.9 feet might be considered substantial. Even in that case, however, it would not be out of character in the neighborhood since the Meyer property across Madeline Avenue is even closer to the street line. In any event, the degree of the variance in this case is trivial because there already exists at the site a house and a deck with a front yard setback ranging from 21.5 to 21.9 feet and the applicants are not proposing to build any closer to the street. Except at the point where the addition will join the existing house, the addition will have a greater setback from Madeline Avenue than the existing house. Also, as previously noted, the proposed modified deck and addition together account for only about an additional 3.5% of lot coverage on this approximately 21,686 square foot lot, hardly an imposing increase. Finally, the variance to 21 .9 feet cannot be considered substantial in light of the previous variance granted in 1959 allowing a detached garage with a ten foot setback. Since that 1959 variance did not contain any condition requiring construction within a specified time frame and a variance applies to property and not to a particular owner, the applicants would now be entitled to build a structure ten feet closer to the street line than their proposed addition would be. 5. Impact on Physical and Environmental Conditions. The impact on physical and environmental conditions at the site will be slight. Only a small portion of this .50-acre parcel will be disturbed. There will be no new grading and no removal of fill from the site. 6 6. Self-Created Hardship. Self-created hardship is not an issue in this case. The applicants are seeking proper permits prior to construction and are not attempting to legitimize any illegally built structures.
